			 purposes, and definitions</header>
 <section id="id5031694B32E04814B963745899FA90CA"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id75cb2810279448e88bb6876966d46427"><enum>(1)</enum><text>the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.)—</text>
 <subparagraph id="id61eaf28809ac4c1eb4473cecf3b5d2ef"><enum>(A)</enum><text>made the Federal Government responsible for providing for the permanent disposal of nuclear waste;</text>
 </subparagraph><subparagraph id="idf2f1bfd7b04e449e8665581249f1cec4"><enum>(B)</enum><text>vested the responsibility for siting, constructing, and operating a permanent geologic repository for the disposal of nuclear waste in the Secretary of Energy; and</text>
 </subparagraph><subparagraph id="id3593c41ae13b492cb2aa7360da5bd003"><enum>(C)</enum><text>required the Secretary to enter into binding contracts with the generators and owners of nuclear waste pursuant to which the Secretary is obligated to have begun disposing of the nuclear waste in a repository not later than January 31, 1998;</text>
 </subparagraph></paragraph><paragraph id="id27bd21b6772b4b9bbd63cf82fa0e51e6"><enum>(2)</enum><text>in 1987, Congress designated the Yucca Mountain site as the site for the repository and precluded consideration of other sites;</text>
 </paragraph><paragraph id="id9decae3fc31249dfbe3c097d2ee27543"><enum>(3)</enum><text>in 2002, the Secretary found the Yucca Mountain site to be suitable for the development of the repository, the President recommended the site to Congress, and Congress enacted a joint resolution approving the Yucca Mountain site for the repository;</text>
 </paragraph><paragraph id="id2b0348f021494d7bac2bda1d9c19927d"><enum>(4)</enum><text>in 2008, the Secretary applied to the Nuclear Regulatory Commission for a license to construct a repository at the Yucca Mountain site;</text>
 </paragraph><paragraph id="idb797a9dd212e4461905e7706f39833ca"><enum>(5)</enum><text>in 2009, the Secretary found the Yucca Mountain site to be unworkable and abandoned efforts to construct a repository;</text>
 </paragraph><paragraph id="id3142a17ff53c467192100cc2f7c2a677"><enum>(6)</enum><text>in 2010, the Secretary, at the request of the President, established the Blue Ribbon Commission on America’s Nuclear Future to conduct a comprehensive review of the nuclear waste management policies of the United States and recommend a new strategy for managing the nuclear waste of the United States; and</text>
 </paragraph><paragraph id="id2f4fe35fb5914127b389bdd83c53fa6e"><enum>(7)</enum><text>the Blue Ribbon Commission has recommended that Congress establish a new nuclear waste management organization and adopt a new consensual approach to siting nuclear waste management facilities.</text>
 </paragraph></section><section id="id1e03def38dcd453ebf671a12b2b06880"><enum>102.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> <paragraph id="idcb21a876a76948e6aba5db97f148e129"><enum>(1)</enum><text>to establish a new nuclear waste management organization;</text>
 </paragraph><paragraph id="id82d5a82b5540431a97e8479667619a4b"><enum>(2)</enum><text>to transfer to the new organization the functions of the Secretary relating to the siting, licensing, construction, and operation of nuclear waste management facilities;</text>
 </paragraph><paragraph id="id3c4a29727fac47cfbd00c5d5ab233eda"><enum>(3)</enum><text>to establish a new consensual process for the siting of nuclear waste management facilities;</text>
 </paragraph><paragraph id="id4c7e8e692f2544719dfaabf1a6d1c4f8"><enum>(4)</enum><text>to provide for centralized storage of nuclear waste pending completion of a repository; and</text>
 </paragraph><paragraph id="ida9ab3a5df51c445a9aa5d343880d9684"><enum>(5)</enum><text>to ensure that—</text>
 <subparagraph id="id4699990f3edb48bd897cc4faace0c9de"><enum>(A)</enum><text>the generators and owners of nuclear waste pay the full cost of the program; and</text>
 </subparagraph><subparagraph id="idf2eef0f973494e40b9e5ea21e968f998"><enum>(B)</enum><text>funds collected for the program are used for that purpose.</text>
 </subparagraph></paragraph></section><section id="idf1c3ae47f3f044378090c5254f8f251d"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="ida344b6bfcc444642be9bbcb677cd407b"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Nuclear Waste Administration established by section 201.</text>
 </paragraph><paragraph id="id0b845d96aa194dd88275a1bceefd0479"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Administration.</text>
				</paragraph><paragraph id="id0be1bfe676e7443c8a967b2efcf62866"><enum>(3)</enum><header>Affected Indian
 tribe</header><text>The term <term>affected Indian Tribe</term> means any Indian Tribe—</text>
 <subparagraph id="id377e68fc18d24c5a87ac0927b8464454"><enum>(A)</enum><text>within the reservation boundaries of which a repository or storage facility is proposed to be located; or</text>
 </subparagraph><subparagraph id="id3ef4a3f7ca7f4832bdccd92413bff39a"><enum>(B)</enum><text>that has federally defined possessory or usage rights to other land outside of the reservation boundaries that—</text>
 <clause id="idc9306e357de446d592e833e96b014454"><enum>(i)</enum><text>arise out of a congressionally ratified treaty; and</text>
 </clause><clause id="id6aa21e11ffa748068a1b8f7a7fa02797"><enum>(ii)</enum><text>the Secretary of the Interior finds, on petition of an appropriate governmental official of the Indian Tribe, may be substantially and adversely affected by the repository or storage facility.</text>
						</clause></subparagraph></paragraph><paragraph id="id76f846f454ed48fc88c78dcb1f55b827"><enum>(4)</enum><header>Affected unit
			 of general local government</header>
					<subparagraph id="idBEAD44A7EDD2458C80675430307354D8"><enum>(A)</enum><header>In
 general</header><text>The term <term>affected unit of general local government</term> means the unit of general local government that has jurisdiction over the site of a repository or storage facility.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id957a3cdb60ca407da94678179539012a"><enum>(B)</enum><header>Inclusion</header><text>The term <term>affected unit of general local government</term> may include, at the discretion of the Administrator, units of general local government that are contiguous with the unit that has jurisdiction over the site of a repository or storage facility.</text>
					</subparagraph></paragraph><paragraph id="idd8a310365d5b430996798aba0e1aee6d"><enum>(5)</enum><header>Civilian
 nuclear power reactor</header><text>The term <term>civilian nuclear power reactor</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
 </paragraph><paragraph id="id5bee43b1e17943c292d36ce1bd4bc9b6"><enum>(6)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text>
				</paragraph><paragraph id="id55ad81c10d8c4c72bf6289541063c33c"><enum>(7)</enum><header>Compliance
 agreement</header><text>The term <term>compliance agreement</term> means a legally enforceable agreement between the Secretary and a Federal or State agency requiring the removal of defense waste from a Department of Energy facility.</text>
				</paragraph><paragraph id="id023fa17ecf524d7c97f3fc12d541ebbf"><enum>(8)</enum><header>Contract
 holder</header><text>The term <term>contract holder</term> means any person who—</text>
 <subparagraph id="idbf18c64949424bbbbcc0dd695ed3c0f5"><enum>(A)</enum><text>generates or holds title to nuclear waste generated at a civilian nuclear power reactor; and</text>
 </subparagraph><subparagraph id="id7a88d5952b83404daddf0026d1d26a55"><enum>(B)</enum><text>has entered into a contract for the disposal of nuclear waste under section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) or this Act.</text>
					</subparagraph></paragraph><paragraph id="id111ca7b469f945419bd6280300f046fc"><enum>(9)</enum><header>Defense
 waste</header><text>The term <term>defense waste</term> means nuclear waste generated by an atomic energy defense activity (as defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>)).</text>
 </paragraph><paragraph id="idd0c5c55922bf4f16a74934ef084635db"><enum>(10)</enum><header>Disposal</header><text>The term <term>disposal</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
				</paragraph><paragraph id="id5ab4b4b95e754fa082eab677f6ea8b52"><enum>(11)</enum><header>Emergency
			 delivery</header>
					<subparagraph id="id9c82ed79521f4b92a5b7ca976caec509"><enum>(A)</enum><header>In
 general</header><text>The term <term>emergency delivery</term> means nuclear waste accepted by the Administrator for storage prior to the date provided in the contractual delivery commitment schedule pursuant to article V.D. of the standard contract for disposal of nuclear waste codified in section 961.11 of title 10, Code of Federal Regulations.</text>
 </subparagraph><subparagraph id="id0766058b4d5d49e9b11e490d28b1866e"><enum>(B)</enum><header>Inclusion</header><text>The term <term>emergency delivery</term> may include, at the discretion of the Administrator, defense waste that is required to be removed from a Department of Energy facility—</text>
 <clause id="id743c5a92b8a242438f85f318805f1f40"><enum>(i)</enum><text>pursuant to a compliance agreement; or</text>
 </clause><clause id="idf1ef586bd20242d5b330ee7c5c497c76"><enum>(ii)</enum><text>to eliminate an imminent and serious threat to the health and safety of the public or the common defense and security.</text>
						</clause></subparagraph></paragraph><paragraph id="idd4331d2178c6422bbc4822fd0b1ce61d"><enum>(12)</enum><header>High-level
 radioactive waste</header><text>The term <term>high-level radioactive waste</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
				</paragraph><paragraph id="id5535fb4351c047e78968e0112b3293ac"><enum>(13)</enum><header>Indian
 tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <quote>Indian tribe</quote> in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
				</paragraph><paragraph id="ida973e0c732df4899b5f6c8fcfb8842a7"><enum>(14)</enum><header>Mission
 plan</header><text>The term <term>mission plan</term> means the comprehensive report required under section 504.</text>
				</paragraph><paragraph id="idb0e36467ca1f4c2e97fa23195afbd766"><enum>(15)</enum><header>Nonpriority
 waste</header><text>The term <term>nonpriority waste</term> means nuclear waste that does not qualify as priority waste.</text>
				</paragraph><paragraph id="id5f412133192f43078e34b65255218075"><enum>(16)</enum><header>Nuclear
 waste</header><text>The term <term>nuclear waste</term> means—</text> <subparagraph id="id93bc298428634b08a03f5c6e6bb37def"><enum>(A)</enum><text>spent nuclear fuel; and</text>
 </subparagraph><subparagraph id="id6d0d2151a1a34517b9c83e1d87388a0c"><enum>(B)</enum><text>high-level radioactive waste.</text>
					</subparagraph></paragraph><paragraph id="ida1c48c90b3e5497b8e714d7392d95ccd"><enum>(17)</enum><header>Nuclear waste
 activities</header><text>The term <term>nuclear waste activities</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text>
				</paragraph><paragraph id="ida2199bc9f3bc432b86f3796be1382ff1"><enum>(18)</enum><header>Nuclear waste
 facility</header><text>The term <term>nuclear waste facility</term> means—</text>
 <subparagraph id="id1e11e40490744139b57093c617f8d063"><enum>(A)</enum><text>a repository; and</text>
 </subparagraph><subparagraph id="idb7a661c1ada7442f91a375613feceb3c"><enum>(B)</enum><text>a storage facility.</text>
					</subparagraph></paragraph><paragraph id="id5d758f71e90b4a13b7019fa1ea8279c0"><enum>(19)</enum><header>Nuclear Waste
 Fund</header><text>The term <term>Nuclear Waste Fund</term> means the separate fund in the Treasury established by section 302(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(c)</external-xref>).</text>
				</paragraph><paragraph id="idc0f3adf0b1654806ac3c22018ea63a26"><enum>(20)</enum><header>Oversight
 Board</header><text>The term <term>Oversight Board</term> means the Nuclear Waste Oversight Board established by section 205.</text>
				</paragraph><paragraph id="idac18dae6c3984830bade3dd397899922"><enum>(21)</enum><header>Pilot
 facility</header><text>The term <term>pilot facility</term> means the storage facility for priority waste authorized by section 303(1).</text>
				</paragraph><paragraph id="id5b0ef2b4d23f4ee6a9f563ff4361cf2d"><enum>(22)</enum><header>Priority
 waste</header><text>The term <term>priority waste</term> means—</text> <subparagraph id="idcd969454781e49aa9831547f83076e55"><enum>(A)</enum><text>any emergency delivery; and</text>
 </subparagraph><subparagraph id="idb83dad089ed74774a47a913030cb1ea6"><enum>(B)</enum><text>spent nuclear fuel removed from a civilian nuclear power reactor that has been permanently shut down.</text>
					</subparagraph></paragraph><paragraph id="id5f271636d0df467da3d58bc43baa408a"><enum>(23)</enum><header>Public
 liability</header><text>The term <term>public liability</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text>
 </paragraph><paragraph id="id1a1de0c574cb4ca0bea7725252560275"><enum>(24)</enum><header>Repository</header><text>The term <term>repository</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
 </paragraph><paragraph id="id716a13b926b84e04a8dbf890d3442ef6"><enum>(25)</enum><header>Reservation</header><text>The term <term>reservation</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
 </paragraph><paragraph id="idfb1866c20c7349a89a9bffc7e6939a78"><enum>(26)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph><paragraph id="idb1b3dfcd1589463387297ff82b833d30"><enum>(27)</enum><header>Site
			 characterization</header>
					<subparagraph id="id4652565f45eb433f9eeee3b848f9ab72"><enum>(A)</enum><header>In
 general</header><text>The term <term>site characterization</term> means the site-specific activities that the Administrator determines necessary to support an application to the Commission for a license to construct a repository or storage facility under section 305(c).</text>
					</subparagraph><subparagraph id="id71f1674fe3d94e31aaa369867c069c96"><enum>(B)</enum><header>Repository site
 characterization</header><text>In the case of a site for a repository, the term <term>site characterization</term> may include borings, surface excavations, excavations of exploratory shafts, limited subsurface lateral excavations and borings, and in situ testing needed to evaluate the suitability of a candidate site for the location of a repository.</text>

 characterization</header><text>In the case of a site for an above-ground storage facility, the term <term>site characterization</term> does not include subsurface borings and excavations that the Administrator determines are uniquely associated with underground disposal and unnecessary to evaluate the suitability of a candidate site for the location of an above-ground storage facility.</text>

 fuel</header><text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
 </paragraph><paragraph id="id3546b9005f584adca604105148ba440d"><enum>(29)</enum><header>Storage</header><text>The term <term>storage</term> means the temporary retention of nuclear waste pending the disposal of the nuclear waste in a repository.</text>
				</paragraph><paragraph id="id4e402e81565b43f59dff6c4df2f4e5c0"><enum>(30)</enum><header>Storage
 facility</header><text>The term <term>storage facility</term> means a facility for the consolidated storage of nuclear waste from multiple contract holders or the Secretary pending the disposal of the spent nuclear fuel in a repository.</text>
				</paragraph><paragraph id="id0e9674633f3e42df9457567a6ce461f4"><enum>(31)</enum><header>Unit of
 general local government</header><text>The term <term>unit of general local government</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
				</paragraph><paragraph id="id4d48457865c841349a68b5818ade08f4"><enum>(32)</enum><header>Working
 Capital Fund</header><text>The term <term>Working Capital Fund</term> means the Nuclear Waste Administration Working Capital Fund established by section 401.</text>
				</paragraph></section></title><title id="ida664b70035474e918c870bde19003292"><enum>II</enum><header>Nuclear Waste
			 Administration</header>
			<section id="idbda272ce90cf488f8135310fc5cb74be"><enum>201.</enum><header>Establishment</header>
 <subsection id="idb7041037573140cab1f569a32ec47b70"><enum>(a)</enum><header>Establishment</header><text>There is established an independent agency in the executive branch to be known as the <term>Nuclear Waste Administration</term>.</text>
 </subsection><subsection id="id1dd6e4ccd511412ab84174c34431903d"><enum>(b)</enum><header>Purpose</header><text>The purposes of the Administration are—</text>
 <paragraph id="id81a4e97c00204af8a1d1fa68ee40bc91"><enum>(1)</enum><text>to discharge the responsibility of the Federal Government to provide for the permanent disposal of nuclear waste;</text>
 </paragraph><paragraph id="id90f6df8f1f5640fbbd7e2beaf75f19f8"><enum>(2)</enum><text>to protect the public health and safety and the environment in discharging the responsibility under paragraph (1); and</text>
 </paragraph><paragraph id="id43761c13adf34c6da9b5a6034e66c365"><enum>(3)</enum><text>to ensure that the costs of activities under paragraph (1) are borne by the persons responsible for generating the nuclear waste.</text>
					</paragraph></subsection></section><section id="id89054cb36feb4caea8991b4920ceb696"><enum>202.</enum><header>Principal
			 officers</header>
				<subsection id="id580af8d766f842439ed26aa0c55fb3f0"><enum>(a)</enum><header>Administrator</header>
 <paragraph id="id2a9c39c8c930479eb850d41a331d69c4"><enum>(1)</enum><header>Appointment</header><text>There shall be at the head of the Administration a Nuclear Waste Administrator, who shall be appointed by the President, by and with the advice and consent of the Senate, from among persons who are, by reason of education, experience, and attainments, exceptionally well qualified to perform the duties of the Administrator.</text>
 </paragraph><paragraph id="id5E4DB0B46CE943928566D683BF53C1E8"><enum>(2)</enum><header>Term</header><text>The term of service of the Administrator shall be 6 years.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5758DCFE03114AA488E30E0F5B7104CE"><enum>(3)</enum><header>Reappointment</header><text>An Administrator may serve more than 1 term.</text>
					</paragraph><paragraph id="idc07a55a38aa14c81acc3e1dd17afbc51"><enum>(4)</enum><header>Functions and
 powers</header><text>The functions and powers of the Administration shall be vested in and exercised by the Administrator.</text>
					</paragraph><paragraph id="ida7d16b732a1a479dbc19eb82efd79734"><enum>(5)</enum><header>Supervision and
 direction</header><text>The Administration shall be administrated under the supervision and direction of the Administrator, who shall be responsible for the efficient and coordinated management of the Administration.</text>
 </paragraph><paragraph id="ide0fda6187f46454d8c9068c4f0e7cea8"><enum>(6)</enum><header>Delegation</header><text>The Administrator may, from time to time and to the extent permitted by law, delegate such functions of the Administrator as the Administrator determines to be appropriate.</text>
 </paragraph><paragraph id="id16a68687902949d5a930d850b4ab3fc7"><enum>(7)</enum><header>Compensation</header><text>The President shall fix the total annual compensation of the Administrator in an amount that—</text>
 <subparagraph id="id5d002362961a490f9eaabd8c7c9d1595"><enum>(A)</enum><text>is sufficient to recruit and retain a person of demonstrated ability and achievement in managing large corporate or governmental organizations; and</text>
 </subparagraph><subparagraph id="id4f162b06ad224d0b84b48a0b63794b2b"><enum>(B)</enum><text>does not exceed the total annual compensation paid to the Chief Executive Officer of the Tennessee Valley Authority.</text>
						</subparagraph></paragraph></subsection><subsection id="ideeabd16a53464bde8f25b7730e8d17e8"><enum>(b)</enum><header>Deputy
			 administrator</header>
 <paragraph id="id88d6a1294def4ccbaaf2ff184f79d21b"><enum>(1)</enum><header>Appointment</header><text>There shall be in the Administration a Deputy Administrator, who shall be appointed by the President, by and with the advice and consent of the Senate, from among persons who are, by reason of education, experience, and attainments, exceptionally well qualified to perform the duties of the Deputy Administrator.</text>
 </paragraph><paragraph id="id45BAB47479F747968B65DE2FC73C3936"><enum>(2)</enum><header>Term</header><text>The term of service of the Deputy Administrator shall be 6 years.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DDD88D6A10946AAAE071BEDE81CB502"><enum>(3)</enum><header>Reappointment</header><text>A Deputy Administrator may serve more than 1 term.</text>
 </paragraph><paragraph id="id6d376efdb6cf462398e3bacf6ae1a388"><enum>(4)</enum><header>Duties</header><text>The Deputy Administrator shall—</text>
 <subparagraph id="id3be6f157fe934f0193fff543a5e3261c"><enum>(A)</enum><text>perform such functions as the Administrator shall from time to time assign or delegate; and</text>
 </subparagraph><subparagraph id="idd17a4db7248f4623b8b5feb935d47df9"><enum>(B)</enum><text>act as the Administrator during the absence or disability of the Administrator or in the event of a vacancy in the office of the Administrator.</text>
 </subparagraph></paragraph><paragraph id="id75546670e45f47b99bc55e8d65fc70f9"><enum>(5)</enum><header>Compensation</header><text>The President shall fix the total annual compensation of the Deputy Administrator in an amount that—</text>
 <subparagraph id="id4fdb6d7fd8674eba8827faa51c0d7648"><enum>(A)</enum><text>is sufficient to recruit and retain a person of demonstrated ability and achievement in managing large corporate or governmental organizations; and</text>
 </subparagraph><subparagraph id="id5c594bc9256241d997960aeec8d1dd21"><enum>(B)</enum><text>does not exceed the total annual compensation paid to the Administrator.</text>
						</subparagraph></paragraph></subsection></section><section id="id82a67942260e4fb8976b802855fdb0d6"><enum>203.</enum><header>Other
			 officers</header>
 <subsection id="idc48bfad63fa842579954238317b1c583"><enum>(a)</enum><header>Establishment</header><text>There shall be in the Administration—</text>
 <paragraph id="id73535e8a3222413b8ebf3460d60827d9"><enum>(1)</enum><text>a General Counsel;</text>
 </paragraph><paragraph id="id22441c9f411a442d8d35f0cfc1575673"><enum>(2)</enum><text>a Chief Financial Officer, who shall be appointed from among individuals who possess demonstrated ability in general management of, and knowledge of and extensive practical experience in, financial management practices in large governmental or business entities; and</text>
 </paragraph><paragraph id="id23f191d7bbd34e92a59a22663dc8458e"><enum>(3)</enum><text>not more than 3 Assistant Administrators, who shall perform such functions as the Administrator shall specify from time to time.</text>
 </paragraph></subsection><subsection id="id63d04e9f3847463fbd966e54be89d955"><enum>(b)</enum><header>Appointment</header><text>Officers appointed under this section shall—</text>
 <paragraph id="id7638fdc1812f4caea694c318043b3e47"><enum>(1)</enum><text>be appointed by the Administrator;</text>
 </paragraph><paragraph id="ide5192375c7a9452bb2a7136f116fa5d9"><enum>(2)</enum><text>be considered career appointees; and</text>
 </paragraph><paragraph id="id4f37e86d7ec6498fbc18cc5cfd114713"><enum>(3)</enum><text>be subject to section 161 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2201">42 U.S.C. 2201(d)</external-xref>).</text>
					</paragraph></subsection><subsection id="ida8b15d8717d445b68f3de8727312b3eb"><enum>(c)</enum><header>Order of
 succession</header><text>The Administrator may designate the order in which the officers appointed pursuant to this section shall act for, and perform the functions of, the Administrator during the absence or disability of the Administrator and the Deputy Administrator or in the event of vacancies in the offices of the Administrator and the Deputy Administrator.</text>
				</subsection></section><section id="id4b58278c90d04ad5b4f4d7191499b394"><enum>204.</enum><header>Inspector
 General</header><text display-inline="no-display-inline">There shall be in the Administration an Inspector General, who shall be appointed by the President, by and with the advice and consent of the Senate, in accordance with <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /3">section 3</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.).</text>
			</section><section id="id9493c64b9ade4e19bfbe5ec83484c7cf"><enum>205.</enum><header>Nuclear Waste
			 Oversight Board</header>
 <subsection id="ide34cdd37ed95454293acb0b524ce336f"><enum>(a)</enum><header>Establishment</header><text>There is established an independent establishment in the executive branch, to be known as the <term>Nuclear Waste Oversight Board</term>—</text>
 <paragraph id="id426f899a65864891a2afbb176c5c0c8b"><enum>(1)</enum><text>to oversee—</text>
 <subparagraph id="idd08bf0137ffd45e0bd2e2d1b3eabf257"><enum>(A)</enum><text>the receipt, disbursement, and use of funds in the Working Capital Fund and the Nuclear Waste Fund;</text>
 </subparagraph><subparagraph id="ide7a8f3072daf4f69b56416fd3f67da14"><enum>(B)</enum><text>the adequacy of the fees collected under section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) to ensure the full recovery of the costs incurred by the Federal Government in carrying out activities under this Act and the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="id4214ac8b0ac54f09a905e3cae36f8124"><enum>(C)</enum><text>the performance of the Administrator in—</text>
 <clause id="id0fd094df760b44e4b6878bb59e0c7486"><enum>(i)</enum><text>fulfilling contracts with contract holders; and</text>
 </clause><clause id="id4e49dda35f434d9aaf2f90f64cbe6258"><enum>(ii)</enum><text>complying with the mission plan; and</text>
 </clause></subparagraph></paragraph><paragraph id="ide6e5780f186e47dba4e8201feceed067"><enum>(2)</enum><text>to review the annual management reports and financial statements submitted by the Administrator under section 505.</text>
 </paragraph></subsection><subsection id="idd48446a6606147f88f6f5ae6c23931bf"><enum>(b)</enum><header>Members</header><text>The Oversight Board shall be composed of 5 members appointed by the President, by and with the advice and consent of the Senate, from among prominent United States citizens of integrity and reputation who, based on the training, experience, and attainments of the individuals, are exceptionally well qualified to evaluate and oversee the administration of this Act.</text>
				</subsection><subsection id="id69031acb9f7f4052bfb935a5d4f7eafc"><enum>(c)</enum><header>Political
 affiliation</header><text>Not more than 3 members of the Oversight Board may be members of the same political party.</text>
				</subsection><subsection id="idd4eec58937d942428d0847ab08f4cb38"><enum>(d)</enum><header>Terms</header>
					<paragraph id="id48dac2359ca34587abb60c4b14e1ad02"><enum>(1)</enum><header>In
 general</header><text>Except as provided in paragraphs (2) and (3), each member shall serve a term of 5 years.</text>
					</paragraph><paragraph id="idba9e51e406a4493291c08d8573ea924e"><enum>(2)</enum><header>Initial
			 terms</header>
						<subparagraph id="id9bf49b7b643644679dbc60329693be3d"><enum>(A)</enum><header>Starting
 date</header><text>The term of the first 5 members appointed to the Oversight Board shall be treated as having started on the first July 1 after the date of enactment of this Act.</text>
						</subparagraph><subparagraph id="idc8f71b7d49b34ea79f1bb246da5b182a"><enum>(B)</enum><header>Staggered
 term</header><text>Of the 5 members first appointed to the Board under subparagraph (A)—</text>
 <clause id="idef9ea4af3e8944fd953f932517aec07f"><enum>(i)</enum><text>1 shall be appointed for a term of 1 year;</text>
 </clause><clause id="ida06d5e68b047446a809069f24f873472"><enum>(ii)</enum><text>1 shall be appointed for a term of 2 years;</text>
 </clause><clause id="id91b9ff41e78a4f06b2426609a04525ad"><enum>(iii)</enum><text>1 shall be appointed for a term of 3 years;</text>
 </clause><clause id="id4c819c929a664f87995cf108017915ec"><enum>(iv)</enum><text>1 shall be appointed for a term of 4 years; and</text>
 </clause><clause id="id6592038c68404f9cbde596b00157e374"><enum>(v)</enum><text>1 shall be appointed for a term of 5 years.</text>
							</clause></subparagraph></paragraph><paragraph id="idbe290c9a69a144be98d9910539dc7108"><enum>(3)</enum><header>Extension of
			 term</header>
						<subparagraph id="id1f88d31a54494676a208a4170c342fd9"><enum>(A)</enum><header>In
 general</header><text>Subject to subparagraph (B), a member of the Oversight Board may continue to serve after the expiration of the term of the member until a successor is appointed, has been confirmed, and has taken the oath of office.</text>
 </subparagraph><subparagraph id="ida7b32b07a2e64b769aa7bed1d4f02987"><enum>(B)</enum><header>Limitation</header><text>No member of the Oversight Board may serve beyond the end of the session of the Congress in which the term of the member expires.</text>
 </subparagraph></paragraph><paragraph id="idb7a400efe2b449c28c4601e0b64fbdd5"><enum>(4)</enum><header>Vacancies</header><text>A member of the Oversight Board appointed to fill a vacancy occurring before the expiration of the term for which the predecessor of the member was appointed shall be appointed only for the remainder of the term of the predecessor.</text>
 </paragraph><paragraph id="idd1db60da018149c0ad6c0cce02e8ebff"><enum>(5)</enum><header>Reappointment</header><text>A member of the Oversight Board may be reappointed for an additional term by the President, by and with the advice and consent of the Senate.</text>
 </paragraph></subsection><subsection id="idb06677344bb54d1ca8eddcb893a1fdcd"><enum>(e)</enum><header>Removal</header><text>The President may remove any member of the Oversight Board for inefficiency, neglect of duty, or malfeasance in office.</text>
 </subsection><subsection id="id98b1a3bc7116457999ca492961b66fd1"><enum>(f)</enum><header>Chair</header><text>The President shall designate 1 member of the Oversight Board as Chair of the Oversight Board.</text>
				</subsection><subsection id="idded081eb340a4a0dac5a7188a0d1086d"><enum>(g)</enum><header>Acting
 chair</header><text>The Chair designated under subsection (f) may from time to time designate any other member of the Oversight Board to act in the place and stead of the Chair during the absence.</text>
 </subsection><subsection id="id29726c34ebfd4f2b9ef90f5c8b6eb306"><enum>(h)</enum><header>Quorum</header><text>Three members of the Oversight Board shall constitute a quorum for the purpose of doing business.</text>
				</subsection><subsection id="id5799ebd17f644bdfaa22fa9988b5d044"><enum>(i)</enum><header>Equal
 responsibility and authority</header><text>Each member of the Oversight Board, including the Chair, shall have—</text>
 <paragraph id="ideb791bcb6a36437ea300c33a5a23c2f0"><enum>(1)</enum><text>equal responsibility and authority in all decisions and actions of the Oversight Board;</text>
 </paragraph><paragraph id="id0791d3cdb0684c91b19b078993547638"><enum>(2)</enum><text>full access to all information relating to the performance of the duties and responsibilities of the member; and</text>
 </paragraph><paragraph id="id2d6474b471cf40ab8edf550cac79ef8e"><enum>(3)</enum><text>1 vote.</text> </paragraph></subsection><subsection id="id955c19544f954cc08e5a2ea9a6a9310d"><enum>(j)</enum><header>Conflict of interest</header><text>No member of the Oversight Board shall—</text>
 <paragraph id="ide6ae2ff3b4284be2bfab3946cda1b90c"><enum>(1)</enum><text>be employed by the Administration or the Department of Energy; or</text>
 </paragraph><paragraph id="ida9c604fb90fd496c954e4c45a28b12e1"><enum>(2)</enum><text>have a financial interest in (including an employment relationship with) any contract holder or contractor of the Administration.</text>
					</paragraph></subsection><subsection id="id9b32266f71df4d748c869c459169ff5b"><enum>(k)</enum><header>Compensation</header>
					<paragraph id="idcf9db652473e4627b66bb53329999376"><enum>(1)</enum><header>In
 general</header><text>Each member of the Oversight Board shall be paid at the rate of pay payable for level III of the Executive Schedule in subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, for each day (including travel time) the member is engaged in the work of the Oversight Board.</text>
					</paragraph><paragraph id="id64e0269b1f4547bd8b027bdfe4693a67"><enum>(2)</enum><header>Travel
 expenses</header><text>Each member of the Oversight Board may receive travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code.</text>
 </paragraph></subsection><subsection id="idc72d200e3b644e51b98d74cb0749ef95"><enum>(l)</enum><header>Meetings</header><text>The Oversight Board shall meet at least once every 90 days.</text>
 </subsection><subsection id="idddff58ffe1dc4136b45a2f62ec85514c"><enum>(m)</enum><header>Functions</header><text>The Oversight Board shall—</text>
 <paragraph id="idee74b365c3584d909ee4c06d79f05ce5"><enum>(1)</enum><text>review, on an ongoing basis—</text>
 <subparagraph id="idc6bb1fc8430f4da281d8f3d7dc04b77d"><enum>(A)</enum><text>the progress made by the Administrator in siting, constructing, and operating nuclear waste facilities under this Act;</text>
 </subparagraph><subparagraph id="id6f1c5d06b4df4d0dbd2c69a12609b850"><enum>(B)</enum><text>the use of funds made available to the Administrator under this Act;</text>
 </subparagraph><subparagraph id="id95a8bbe2192b4e17a9ca09a24e20edd8"><enum>(C)</enum><text>whether the fees collected from contract holders are sufficient to ensure full cost recovery or require adjustment; and</text>
 </subparagraph><subparagraph id="id0477094f0be14b4494e8c227cf3bc0ef"><enum>(D)</enum><text>the liability of the United States to contract holders;</text>
 </subparagraph></paragraph><paragraph id="id7fcb202f45834224bdda210f76410c64"><enum>(2)</enum><text>identify any problems that may impede the implementation of this Act; and</text>
 </paragraph><paragraph id="idb3c8e09cff3544efaacd861f0bf5c3cf"><enum>(3)</enum><text>recommend to the Administrator, the President, or Congress, as appropriate, any actions that may be needed to ensure the implementation of this Act.</text>
 </paragraph></subsection><subsection id="idaf0a6ab7e96345528ddc245aefaacef3"><enum>(n)</enum><header>Reports</header><text>The Oversight Board shall report the findings, conclusions, and recommendations of the Oversight Board to the Administrator, the President, and Congress not less than once per year.</text>
				</subsection><subsection id="id07f3e1b6dbac44848456aa76fc7368c7"><enum>(o)</enum><header>Response by the
 administrator</header><text>Not later than 45 days after the date on which the Oversight Board submits a report to the Administrator under subsection (n), the Administrator shall transmit to the Oversight Board, in writing—</text>
 <paragraph id="id99ed8d985d2b42bba418271f70d3401b"><enum>(1)</enum><text>a statement of whether the Administrator accepts or rejects, in whole or in part, the recommendations submitted by the Oversight Board;</text>
 </paragraph><paragraph id="idfde8a7ea5f97479ab23848f16e002479"><enum>(2)</enum><text>a description of the actions taken in response to the recommendations (or an explanation of the reasons for not acting on the recommendations); and</text>
 </paragraph><paragraph id="id397f7faa06d24fa99e5bb9fdf778ade6"><enum>(3)</enum><text>the views of the Administrator on the recommendations.</text>
					</paragraph></subsection><subsection id="idf1682f48349441b1964a6add086956ed"><enum>(p)</enum><header>Public
 availability</header><text>The Administrator shall make all reports under subsection (n) and all responses from the Administrator under subsection (o) available to the public.</text>
				</subsection><subsection id="id3c9a4d1665e243e4928b5d66ca77381c"><enum>(q)</enum><header>Executive
 Secretary</header><text>The Oversight Board shall appoint and fix the compensation of an Executive Secretary, who shall—</text>
 <paragraph id="id57625f2339b84a558a69f0a7da1cfba7"><enum>(1)</enum><text>assemble and maintain the reports, records, and other papers of the Oversight Board; and</text>
 </paragraph><paragraph id="idfbbb9891182e41e2953862cc94458cf7"><enum>(2)</enum><text>perform such functions as the Oversight Board shall from time to time assign or delegate to the Executive Secretary.</text>
					</paragraph></subsection><subsection id="idcab5862cb97c4acd86f96adeffa08ca8"><enum>(r)</enum><header>Additional
			 staff</header>
 <paragraph id="ide433723916dd45df8d83919af1acd341"><enum>(1)</enum><header>Appointment</header><text>The Oversight Board may appoint and fix the compensation of such additional clerical and professional staff as may be necessary to discharge the responsibilities of the Oversight Board.</text>
 </paragraph><paragraph id="idafa5e1b883b9411eb1bcffd493481ecd"><enum>(2)</enum><header>Limitation</header><text>The Oversight Board may appoint not more than 10 clerical or professional staff members under this subsection.</text>
					</paragraph><paragraph id="id061d5653817641baac31de7529cf6eae"><enum>(3)</enum><header>Supervision and
 direction</header><text>The clerical and professional staff of the Oversight Board shall be under the supervision and direction of the Executive Secretary.</text>
					</paragraph></subsection><subsection id="idca0aac0b6adc4534b2f119e7284be949"><enum>(s)</enum><header>Staff
			 compensation</header>
					<paragraph id="idd911ee43ab584b49b9cd9f43fbfb2ee3"><enum>(1)</enum><header>Clerical
 staff</header><text>Clerical staff shall be appointed subject to the provisions of title 5, United States Code, governing appointments in the competitive service, and shall be paid in accordance with the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule rates.</text>
					</paragraph><paragraph id="id5d2aa55affca4a3586dd67230930fc5f"><enum>(2)</enum><header>Professional
 staff</header><text>Professional staff members may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of that title relating to classification and General Schedule pay rates, except that no individual so appointed may receive pay in excess of the maximum rate of pay under the General Schedule.</text>
					</paragraph></subsection><subsection id="idc9aa5efdba5344e58ccc1acbedcb1d12"><enum>(t)</enum><header>Access to
			 information</header>
					<paragraph id="id780f339315d5497ebed965cc935556e0"><enum>(1)</enum><header>Duty to
 inform</header><text>The Administrator shall keep the Oversight Board fully and currently informed on all of the activities of the Administration.</text>
					</paragraph><paragraph id="id067ab266272441b480e804a3a084fe30"><enum>(2)</enum><header>Production of
 documents</header><text>The Administrator shall provide the Oversight Board with any records, files, papers, data, or information requested by the Oversight Board.</text>
					</paragraph></subsection><subsection id="id85f8b3d2c64e4b3e9dace1eee8a8fad2"><enum>(u)</enum><header>Support
 services</header><text>To the extent permitted by law and requested by the Oversight Board, the Administrator of General Services shall provide the Oversight Board with necessary administrative services, facilities, and support on a reimbursable basis.</text>
				</subsection><subsection id="idbeadae18ec4e479c871277677b6e653f"><enum>(v)</enum><header>Health, safety,
 and environmental regulation</header><text>Nothing in this section gives the Oversight Board jurisdiction to regulate the activities of the Administration to protect the health and safety of the public or the environment.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idec34a9fe329b4257b7cfb3d305936f6a"><enum>(w)</enum><header>Authorization
 of appropriations</header><text>There are authorized to be appropriated to the Oversight Board from amounts in the Nuclear Waste Fund such sums as are necessary to carry out this section.</text>
				</subsection></section><section id="id1cb60e8f25ce45aa9f6a0033f361a944"><enum>206.</enum><header>Conforming
			 amendments</header>
 <subsection id="id4c9fc86f25824c45a57f9fa4568ec562"><enum>(a)</enum><text>Section 901(b)(2) of title 31, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2ba83e99d4094cd59f7368c76a6f7bc0" style="OLC">
 <subparagraph id="id05be030b0d644924af4dc2b3098c1cbd"><enum>(H)</enum><text>The Nuclear Waste Administration.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id252f7c3daf35421bbadb3d0b949c6a81"><enum>(b)</enum><text>Section 12 of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
 <paragraph id="id4e749d0e5e3c4012b0cc06cc44b08196"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>the Administrator of the Nuclear Waste Administration;</quote> after <quote>Export-Import Bank;</quote>; and</text>
 </paragraph><paragraph id="id3e22bb024f05486e96558dc2ae906f60"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>the Nuclear Waste Administration,</quote> after <quote>Export-Import Bank,</quote>.</text>
					</paragraph></subsection></section></title><title id="id899bcd5220c7433ebc436432e2c7cb93"><enum>III</enum><header>Functions</header>
			<section id="ida83f8508fe734f14aad48a2519a69819"><enum>301.</enum><header>Transfer of
 functions</header><text display-inline="no-display-inline">There are transferred to and vested in the Administrator all functions vested in the Secretary by the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.) relating to—</text>
 <paragraph id="id47e239de813f49c7baa9c955b4960387"><enum>(1)</enum><text>the construction and operation of a repository;</text>
 </paragraph><paragraph id="idf408516a429a46408a792fb76ea39d19"><enum>(2)</enum><text>entering into and performing contracts for the disposal of nuclear waste under section 302 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222</external-xref>);</text>
 </paragraph><paragraph id="id3917449ac2004edeb5e86d407313c659"><enum>(3)</enum><text>the collection, adjustment, deposition, and use of fees to offset expenditures for the management of nuclear waste; and</text>
 </paragraph><paragraph id="id5acf3e7bdb1649f8b18b274329ebd636"><enum>(4)</enum><text>the issuance of obligations under section 302(e)(5) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(e)(5)</external-xref>).</text>
				</paragraph></section><section id="id1d0715aac1a24f8cad1b235b9a8aec57"><enum>302.</enum><header>Transfer of
 contracts</header><text display-inline="no-display-inline">Each contract for the disposal of nuclear waste entered into by the Secretary before the date of enactment of this Act shall continue in effect according to the terms of the contract with the Administrator substituted for the Secretary.</text>
			</section><section id="ida83a34aff10e4d11b04d9e7aacf6b57e"><enum>303.</enum><header>Nuclear waste
 facilities</header><text display-inline="no-display-inline">The Administrator shall site, construct, and operate—</text>
 <paragraph id="id867e0768ec64450b9279b86e02c6fcac"><enum>(1)</enum><text>a pilot facility for the storage of priority waste;</text>
 </paragraph><paragraph id="id6756db0361e04dfbbed4facc23d96820"><enum>(2)</enum><text>1 or more additional storage facilities for the storage of nonpriority nuclear waste; and</text>
 </paragraph><paragraph id="idebb21e55e2c44babbce4f76f5c0fee3c"><enum>(3)</enum><text>1 or more repositories for the permanent disposal of nuclear waste.</text>
				</paragraph></section><section id="idad01a05b62eb4b86a8845edf65f17b17"><enum>304.</enum><header>Siting nuclear
 waste facilities</header><text display-inline="no-display-inline">In siting nuclear waste facilities under this Act or performing any function transferred under section 301(1), the Administrator shall employ a process that—</text>
 <paragraph id="idce6262b64bb24d0f8f0a16163a6b4fc8"><enum>(1)</enum><text>allows affected communities to decide whether, and on what terms, the affected communities will host a nuclear waste facility;</text>
 </paragraph><paragraph id="id5a3c7bf2849a41c7b2bf3000b35c9c52"><enum>(2)</enum><text>is open to the public and allows interested persons to be heard in a meaningful way;</text>
 </paragraph><paragraph id="ideac252617e994cae97fec78526ca5dbe"><enum>(3)</enum><text>is flexible and allows decisions to be reviewed and modified in response to new information or new technical, social, or political developments; and</text>
 </paragraph><paragraph id="idf2786ab6fdbb46cea9159d462d3ffbce"><enum>(4)</enum><text>is based on sound science and meets public health, safety, and environmental standards.</text>
				</paragraph></section><section id="id18A0EE3C2ADE42B6A43124C6696C0116"><enum>305.</enum><header>Storage
			 facilities</header>
				<subsection id="ID14e25d7f31ce4c95b0ae5742e43ef78e"><enum>(a)</enum><header>Establishment
 of storage facility program</header><text>The Administrator shall establish a storage program to license, construct, and operate through 1 or more non-Federal sector partners, 1 or more government or non-federally owned storage facilities to provide interim storage, as needed, for spent nuclear fuel and high-level radioactive waste.</text>
				</subsection><subsection id="ID3d208afb0a80423c8b6c53c5b4b7f2ba"><enum>(b)</enum><header>Pilot program
			 for the storage of priority waste</header>
					<paragraph id="id3FA2EF8779EE4420982B62D6D25CD987"><enum>(1)</enum><header>Request for
			 proposals</header>
						<subparagraph id="id78CC7649BD98453398D1AC3D238AE467"><enum>(A)</enum><header>In
 general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall issue a request for proposals for cooperative agreements for a pilot program for the storage of priority waste—</text>
 <clause id="ID5d944cce998641e2bfd914bae46f2698"><enum>(i)</enum><text>to obtain any license from the Nuclear Regulatory Commission and any other Federal or State entity that is necessary for the construction of 1 or more storage facilities;</text>
 </clause><clause id="IDdf59fc3ffd744a8fb48af154fd1f6769"><enum>(ii)</enum><text>to demonstrate the safe transportation of spent nuclear fuel and high-level radioactive waste, as applicable; and</text>
 </clause><clause id="IDd5178a2d37564979b9432303d33a07b6"><enum>(iii)</enum><text>to demonstrate the safe storage of spent nuclear and high-level radioactive waste, as applicable, at the 1 or more storage facilities, pending the construction and operation of deep geologic disposal capacity for the permanent disposal of the spent nuclear fuel or high-level radioactive waste.</text>
							</clause></subparagraph><subparagraph id="idbc16812072494647899debc6709f9e4d"><enum>(B)</enum><header>Guidelines</header>
							<clause id="id863F3484174B4A6BA99134A15C097F91"><enum>(i)</enum><header>In
 general</header><text>The request for proposals under subparagraph (A) shall include general guidelines for the consideration of storage facilities consistent with each requirement of section 112(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10132">42 U.S.C. 10132(a)</external-xref>), that the Administrator determines to be applicable to above-ground storage.</text>
 </clause><clause id="id25cf5d514ef6498c80f744dc9bd703a1"><enum>(ii)</enum><header>Revisions</header><text>The Administrator may revise the general guidelines from time to time, consistent with this section.</text>
							</clause></subparagraph></paragraph><paragraph id="ID3a5d5b3de73045dda96acc518d7ddcda"><enum>(2)</enum><header>Reviews of
			 Proposals</header>
						<subparagraph id="idfc123ff7ea8d4d1d893c8137ab751481"><enum>(A)</enum><header>In
 general</header><text>The Administrator shall review each proposal submitted under paragraph (1) to evaluate—</text>
 <clause id="idc5b889f1e4e84a60afd3e6603a26dc28"><enum>(i)</enum><text>the extent to which the applicable States, affected units of general local government, and affected Indian Tribes support the proposal;</text>
 </clause><clause id="id50c7f3bf5f5f4e96a42f1b21b7793298"><enum>(ii)</enum><text>the likelihood that the proposed site is suitable for site characterization under the guidelines under paragraph (1)(B);</text>
 </clause><clause id="ide796fdf98e764f46a562158933a0fcac"><enum>(iii)</enum><text>a reasonable comparative evaluation of the proposed site and other proposed sites;</text>
 </clause><clause id="id50a245c08335400c87081c520e281048"><enum>(iv)</enum><text>the extent to which nuclear wastes are, or are planned to be, stored or disposed of within the State;</text>
 </clause><clause id="ida38c2533005e45cc9a4cef67c111e305"><enum>(v)</enum><text>the extent to which each proposal would—</text>
 <subclause id="id18985d1cacdd44de8e1efdf5541de800"><enum>(I)</enum><text>enhance the reliability and flexibility of the system for the disposal of nuclear waste, including co-location with a proposed permanent geological repository; and</text>
 </subclause><subclause id="ide4fec38955034735bb7a7f770bffe487"><enum>(II)</enum><text>minimize the impacts of transportation and handling of nuclear waste;</text>
 </subclause></clause><clause id="id266f93d601cb4d77926cbf845211126b"><enum>(vi)</enum><text>potential conflicts with—</text>
 <subclause id="idc029a496febe4449a27317ed8b92dcc6"><enum>(I)</enum><text>a compliance agreement requiring removal of nuclear waste from a site; or</text>
 </subclause><subclause id="id4a45f6761e1c44afb5e5818a6355a825"><enum>(II)</enum><text>a statutory prohibition on the storage or disposal of nuclear waste at a site; and</text>
 </subclause></clause><clause id="idf2b21be6e0334fa896e108b0f5d6ef9b"><enum>(vii)</enum><text>any other criteria, including criteria relating to technical or safety specifications, that the Administrator determines to be appropriate.</text>
							</clause></subparagraph><subparagraph id="id5914930BE5274AF7B257CE9C40C1A1C0"><enum>(B)</enum><header>Preference for
 co-located repository and storage facility</header><text>In reviewing proposals submitted under paragraph (1), the Administrator shall give preference to sites proposed to be co-located with—</text>
 <clause id="idC23068A31D8B4800BFFAFB693A8DB497"><enum>(i)</enum><text>additional storage facilities for nonpriority waste; or</text>
 </clause><clause id="id66879E7FCBBB44BB8DE86612D6B7BBC5"><enum>(ii)</enum><text>a repository.</text>
							</clause></subparagraph></paragraph><paragraph id="id934bb9f44c7647f7a253962fd28c1b2d"><enum>(3)</enum><header>Site
			 characterization</header>
						<subparagraph id="id79be0305e2d943bbab9896f4807d87d5"><enum>(A)</enum><header>Determination
 of suitability</header><text>After conducting a review under paragraph (2) and any additional site investigation that the Administrator determines to be appropriate, the Administrator shall determine whether the site is suitable for site characterization.</text>
						</subparagraph><subparagraph id="ID3ac8af692072409ca85ef8f90be2f63b"><enum>(B)</enum><header>Selection of
 site for characterization</header><text>From the sites determined to be suitable for site characterization under subparagraph (A), the Administrator shall select at least 1 site for site characterization, giving priority to sites that have been proposed to be co-located with a permanent geological repository, after—</text>
 <clause id="ID21c79063c94844849cac80bdb7ead5e2"><enum>(i)</enum><text>holding public hearings in the vicinity of each site and at least 1 other location within the State in which the site is located; and</text>
 </clause><clause id="idef6a5a9e11a8411996bc6e43be79cbd9"><enum>(ii)</enum><text>notifying Congress.</text>
							</clause></subparagraph><subparagraph id="idca6c67af809f4ddead800ecea115e237"><enum>(C)</enum><header>Cooperative
 agreement</header><text>On selection of a site for characterization under subparagraph (B), the Administrator may enter into a cooperative agreement, subject to section 401(e), with the State, affected units of general local government, and affected Indian Tribes, as applicable, that includes—</text>
 <clause id="idafc8b51bbd8e42188b0c00ae6da1d100"><enum>(i)</enum><text>terms of financial and technical assistance to enable each applicable unit of government to monitor, review, evaluate, comment on, obtain information on, make recommendations on, and mitigate any impacts from, site characterization activities; and</text>
 </clause><clause id="id94ed92b1941d4486875012adba3f7f43"><enum>(ii)</enum><text>any other term that the Administrator determines to be appropriate.</text>
							</clause></subparagraph></paragraph><paragraph id="ID9242ff65e8844fca89e676ca9450da40"><enum>(4)</enum><header>Site
			 selection</header>
						<subparagraph id="idD3D70C36AAC94003B67706AA5DCE2BF7"><enum>(A)</enum><header>In
 general</header><text>Subject to subparagraphs (B) and (C), on completion of site characterization activities, the Administrator shall—</text>
 <clause id="id56754B94695D422DAA33511E62BCCDA2"><enum>(i)</enum><text>make a final determination for each site of whether the site is suitable for development as a storage facility; and</text>
 </clause><clause id="id8EA2760216A845DBB96AB7BE44B10A18"><enum>(ii)</enum><text>select 1 or more suitable sites for storage facilities.</text>
							</clause></subparagraph><subparagraph id="ID9a1a07a78e5640ee96d18d50c67220e1"><enum>(B)</enum><header>Consent-Based
 Approval</header><text>Before selecting a site for developing a storage facility, the Administrator shall enter into a consent agreement, subject to section 401(e), to host the facility with—</text>
 <clause id="IDb924baed733441e89f18dcc3c275a129"><enum>(i)</enum><text>the Governor or other authorized official of the State in which the site is proposed to be located;</text>
 </clause><clause id="ID7d59b22794fc4951a564e742a1eb8858"><enum>(ii)</enum><text>each affected unit of general local government; and</text>
 </clause><clause id="IDaa7b27637eb14eaba30a001134840247"><enum>(iii)</enum><text>any affected Indian Tribe.</text>
							</clause></subparagraph><subparagraph id="id32871971929848bea177daa6b8133fd0"><enum>(C)</enum><header>Binding
 effect</header><text>The consent agreement—</text> <clause id="idcf2f37fe9dac42648a0bb2a7ab898167"><enum>(i)</enum><text>shall be binding on the parties, subject to section 401(e); and</text>
 </clause><clause id="ide1e176f2fa9e4afda6782560bd78837c"><enum>(ii)</enum><text>shall not be amended or revoked except by mutual agreement of the parties.</text>
							</clause></subparagraph></paragraph><paragraph id="id165d60b06fa44de8a9e0848b5f80b91b"><enum>(5)</enum><header>Submission of
 program plan</header><text>Not less than 30 days before selecting a site for development of a storage facility under paragraph (4), the Administrator shall submit to Congress a program plan that includes—</text>
 <subparagraph id="ID486731dc44d54e81a2f250cbe8daff00"><enum>(A)</enum><text>a list of the 1 or more sites the Administrator proposes to select for a storage facility;</text>
 </subparagraph><subparagraph id="IDd99e95d2d6e7424e8867aaf2ac26e392"><enum>(B)</enum><text>an estimate of the cost of licensing, constructing, and operating each storage facility, including the transportation costs, on an annual basis, over the expected lifetime of the storage facility;</text>
 </subparagraph><subparagraph id="ID82ec6b8890ef4233b85f6ac4aaa8c6c1"><enum>(C)</enum><text>a schedule for—</text>
 <clause id="ID9712a5f238a04b3a8ec19267449099ed"><enum>(i)</enum><text>obtaining from the Nuclear Regulatory Commission any license necessary to construct and operate the storage facility;</text>
 </clause><clause id="ID8a5f21553c3242e086fb6488d3bd01a3"><enum>(ii)</enum><text>constructing the storage facility;</text>
 </clause><clause id="IDc2832528cdfb4bca8b624f55d5279b59"><enum>(iii)</enum><text>transporting spent fuel to the storage facility; and</text>
 </clause><clause id="IDe131bdc1d1eb4c158be1e37a94730476"><enum>(iv)</enum><text>removing the spent fuel from, and decommissioning of, the storage facility;</text>
 </clause></subparagraph><subparagraph id="IDa846a12c20724dd1a52da17e765710a8"><enum>(D)</enum><text>an estimate of the cost of any financial assistance, compensation, or incentives proposed to be paid to the host State, Indian Tribe, or unit of local government;</text>
 </subparagraph><subparagraph id="id3315783b86264d59bc1aebb8192d777d"><enum>(E)</enum><text>an estimate of any future reductions in the damages expected to be paid by the United States for the delay of the Department of Energy in accepting spent fuel expected to result from the storage facilities developed under this section; and</text>
 </subparagraph><subparagraph id="IDee4ac023e9224a5d94504644a967e747"><enum>(F)</enum><text>recommendations for any additional legislation needed to authorize and implement the program.</text>
						</subparagraph></paragraph><paragraph id="IDfe53d7d466fc465dba9ac309b8a6e57d"><enum>(6)</enum><header>Submission of
 license application</header><text>On selection of a site under paragraph (4), the applicant (in the case of a non-Federal facility) or the Administrator (in the case of a federally owned facility) shall submit to the Commission an application for a construction authorization for the storage facility.</text>
					</paragraph></subsection><subsection id="id8110a15124e7435e947961e058f8ce19"><enum>(c)</enum><header>Additional
			 storage facilities for nonpriority waste</header>
					<paragraph id="ida7cdce5cac034ff9b4363ad826a54065"><enum>(1)</enum><header>In
 general</header><text>The Administrator shall seek to ensure that efforts to site, construct, and operate a storage facility for nonpriority waste are accompanied by parallel efforts to site, construct, and operate 1 or more repositories.</text>
					</paragraph><paragraph id="idf7b01969c72c4e82b10401edccd54446"><enum>(2)</enum><header>Storage
 facilities for nonpriority waste</header><text>Except as provided in paragraphs (3) and (4), the Administrator may issue requests for proposals and select sites for site characterization for 1 or more additional storage facilities for nonpriority waste as the Administrator determines to be necessary—</text>
 <subparagraph id="id3dc4d048d6a9454fa51f1381c5947c54"><enum>(A)</enum><text>subject to the terms and conditions of this section; and</text>
 </subparagraph><subparagraph id="idd194f95d023347aaad4a827aaa4bf826"><enum>(B)</enum><text>in accordance with the mission plan developed under section 504.</text>
						</subparagraph></paragraph><paragraph id="id6db2edffb4834bfe8ffa4cab67321507"><enum>(3)</enum><header>First 10
 years</header><text>During the 10-year period following the date of enactment of this Act, the Administrator may not issue an additional request for proposals or select a site for site characterization for an additional storage facility for nonpriority waste unless the Administrator has obligated funds for activities under section 306.</text>
					</paragraph><paragraph id="idfff3f0cfc7974f7ab13ef765b29057e2"><enum>(4)</enum><header>After first 10
 years</header><text>After the date that is 10 years after the date of enactment of this Act, the Administrator may not issue an additional request for proposals or select a site for site characterization for an additional storage facility for nonpriority waste until the Administrator has selected a site for evaluation under section 306(b)(2).</text>
					</paragraph><paragraph id="id6320433bb73c48e3905c8a632c4c5a2a"><enum>(5)</enum><header>Storage of
 priority waste</header><text>Nothing in this section precludes the Administrator from storing priority waste at a storage facility for nonpriority waste.</text>
					</paragraph></subsection></section><section id="idba41849edabb4ddba3faff8b5df138d2"><enum>306.</enum><header>Repositories</header>
				<subsection id="idb02d24229d2145b58c10dcc5b0958803"><enum>(a)</enum><header>Siting
			 guidelines</header>
 <paragraph id="id16b3c011931d4852b929b3dbb6fc97e4"><enum>(1)</enum><header>Issuance</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall issue general guidelines for the consideration of candidate sites for repositories, which shall—</text>
 <subparagraph id="id8a54ffc88a654279b50c45e673ff5b85"><enum>(A)</enum><text>comply with the requirements of section 112(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10132">42 U.S.C. 10132(a)</external-xref>); and</text>
 </subparagraph><subparagraph id="idc86320e61ec747818b7a4e21fe901df7"><enum>(B)</enum><text>require the Administrator to take into account the extent to which a repository would—</text>
 <clause id="id5603de38a6c2435bb5bf386cc3f326d8"><enum>(i)</enum><text>enhance the reliability and flexibility of the system for the disposal of nuclear waste; and</text>
 </clause><clause id="id4affbefe8d064e4dad4e1ade49a43570"><enum>(ii)</enum><text>minimize the impacts of transportation and handling of nuclear waste.</text>
 </clause></subparagraph></paragraph><paragraph id="id7c9942b4ee33421bb89b898bdfaac2a3"><enum>(2)</enum><header>Revisions</header><text>The Administrator may revise the guidelines in a manner consistent with this subsection and section 112(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10132">42 U.S.C. 10132(a)</external-xref>).</text>
					</paragraph></subsection><subsection id="id8824d7543b794bebafceeed4fcff6310"><enum>(b)</enum><header>Identification
			 of candidate sites</header>
					<paragraph id="idaa91abe723494c2f95d9e53bc9a6d41e"><enum>(1)</enum><header>Review of
 potential sites</header><text>As soon as practicable after the date of the issuance of the guidelines under subsection (a), the Administrator shall evaluate potential sites for a repository to determine whether the sites are suitable for site characterization.</text>
					</paragraph><paragraph id="id40e1075de0374ccb82927609e7a11303"><enum>(2)</enum><header>Sites eligible
 for review</header><text>The Administrator shall select sites for evaluation under paragraph (1) from among sites recommended by—</text>
 <subparagraph id="iddb347d04175d4c2da9db62bab2db87c0"><enum>(A)</enum><text>the Governor or duly authorized official of the State in which the site is located;</text>
 </subparagraph><subparagraph id="idfca195af685442cfab61a3824569d62c"><enum>(B)</enum><text>the governing body of the affected unit of general local government;</text>
 </subparagraph><subparagraph id="id2bd7d1aaa74040169906ee63fcb30563"><enum>(C)</enum><text>the governing body of an Indian Tribe within the reservation boundaries of which the site is located; or</text>
 </subparagraph><subparagraph id="id87a69cd794c34696a03dacf82493f95d"><enum>(D)</enum><text>the Administrator, after consultation with, and with the consent of—</text>
 <clause id="idaa31abca0b4b4692a95052b8b47dffaa"><enum>(i)</enum><text>the Governor of the State in which the site is located;</text>
 </clause><clause id="id9019e1ac31304b9cbf3258c547a06ee0"><enum>(ii)</enum><text>the governing body of the affected unit of general local government; and</text>
 </clause><clause id="id682de87157f548cdb215fdc274631d54"><enum>(iii)</enum><text>the governing body of the Indian Tribe, if the site is located within the reservation of an Indian Tribe.</text>
							</clause></subparagraph></paragraph><paragraph id="ide50aca08958a44ea9efa001e8eb858b6"><enum>(3)</enum><header>Site
 investigations</header><text>In evaluating a site under this subsection prior to any determination of the suitability of the site for site characterization, the Administrator—</text>
 <subparagraph id="id9a6977d71f594d9fb6e35263921f78ad"><enum>(A)</enum><text>shall use available geophysical, geological, geochemical, hydrological, and other information; and</text>
 </subparagraph><subparagraph id="id76b146942b774ccba6d4bdbfd3888617"><enum>(B)</enum><text>shall not perform any preliminary borings or excavations at the site unless necessary to determine the suitability of the site and authorized by the landowner.</text>
						</subparagraph></paragraph><paragraph id="id57a1db4125f6474e88feb62abb60a934"><enum>(4)</enum><header>Determination
 of suitability</header><text>The Administrator shall determine whether a site is suitable for site characterization based on an environmental assessment of the site, which shall include—</text>
 <subparagraph id="id4f0716a1833d406fb02b68623028b4df"><enum>(A)</enum><text>an evaluation by the Administrator of whether the site is suitable for development as a repository under the guidelines established under subsection (a), including a safety case that provides the basis for confidence in the safety of the proposed nuclear waste facility at the proposed site;</text>
 </subparagraph><subparagraph id="idb54db815d476457f99a359468c180ff9"><enum>(B)</enum><text>an evaluation by the Administrator of the effects of site characterization activities on public health and safety and the environment;</text>
 </subparagraph><subparagraph id="id918335aa4ec0480abf77495b4c475d89"><enum>(C)</enum><text>a reasonable comparative evaluation of the proposed site and other proposed sites;</text>
 </subparagraph><subparagraph id="iddc53dda99deb4bb9ae565fb895406610"><enum>(D)</enum><text>a description of the decision process by which the site was recommended;</text>
 </subparagraph><subparagraph id="id95f2e0b3c5d64e33abcfe4f24dac6344"><enum>(E)</enum><text>an assessment of the regional and local impacts of locating a repository at the site, including the extent to which nuclear wastes are, or are planned to be, stored or disposed of within the State; and</text>
 </subparagraph><subparagraph id="id12e96d6b61874ff2b302ccfa4cf40589"><enum>(F)</enum><text>potential conflicts with—</text>
 <clause id="idbb9350213870473bb8709dcb5717bbd6"><enum>(i)</enum><text>a compliance agreement requiring removal of nuclear waste from a site; or</text>
 </clause><clause id="ida42e092185e74bd49e11fcd72216350d"><enum>(ii)</enum><text>a statutory prohibition on the storage or disposal of nuclear waste at a site.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="idae7a2037e5e84e83beb8612d7e652fd9"><enum>(c)</enum><header>Site
			 characterization</header>
					<paragraph id="id7ee80e54edd4466fb0ae92d433d34a17"><enum>(1)</enum><header>Selection of
 sites</header><text>From among the sites determined to be suitable for site characterization under subsection (b), the Administrator shall select at least 1 site for site characterization as a repository.</text>
					</paragraph><paragraph id="id9b1a4f774cdf48b68fe4a9d23442595c"><enum>(2)</enum><header>Preference for
 co-located repository and storage facility</header><text>In selecting sites for site characterization as a repository, the Administrator shall give preference and priority to sites determined to be suitable for co-location of a storage facility and a repository.</text>
					</paragraph><paragraph id="id4a61867ef4744960bd76dcfd7924a72e"><enum>(3)</enum><header>Public
 hearings</header><text>Before selecting a site for site characterization, the Administrator shall hold public hearings in the vicinity of the site and at least 1 other location within the State in which the site is located—</text>
 <subparagraph id="id17d52d5f4e5c4bb783997448feaffc9b"><enum>(A)</enum><text>to inform the public of the proposed site characterization; and</text>
 </subparagraph><subparagraph id="id590a45b063624bcc98906772446ec484"><enum>(B)</enum><text>to solicit public comments and recommendations with respect to the site characterization plan of the Administrator.</text>
						</subparagraph></paragraph><paragraph id="id0a1ff632fccc4fd2b232ee8a9290352a"><enum>(4)</enum><header>Consultation
			 and cooperation agreement</header>
 <subparagraph id="id26aa87ce2c4b43c29cd69f2a93b230ea"><enum>(A)</enum><header>Requirement</header><text>Before selecting a site for site characterization, the Administrator shall enter into a consultation and cooperation agreement, subject to section 401(e), with—</text>
 <clause id="idc5bdd690e3c3476097d2dbd52af9e56a"><enum>(i)</enum><text>the Governor of the State in which the site is located;</text>
 </clause><clause id="id7f5f537b872f4f4eaab53ed350df5aa8"><enum>(ii)</enum><text>the governing body of the affected unit of general local government; and</text>
 </clause><clause id="id4295ac059074441093db0d9b172ce487"><enum>(iii)</enum><text>the governing body of any affected Indian Tribe.</text>
 </clause></subparagraph><subparagraph id="id588131d25ccf4b1889d46d2f2c73deec"><enum>(B)</enum><header>Contents</header><text>The consultation and cooperation agreement shall provide—</text>
 <clause id="id9b84d040d5004cd2b3217b1019e47552"><enum>(i)</enum><text>compensation to the State, any affected units of local government, and any affected Indian Tribes for any potential economic, social, public health and safety, and environmental impacts associated with site characterization; and</text>
 </clause><clause id="id0049572cfffb44bfb39a04034ae972cc"><enum>(ii)</enum><text>financial and technical assistance to enable the State, affected units of local government, and affected Indian Tribes to monitor, review, evaluate, comment on, obtain information on, and make recommendations on site characterization activities.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id8701ed16a14843f3a3ae7e47eef91edc"><enum>(d)</enum><header>Final site
			 suitability determination</header>
					<paragraph id="id06319d61a0b0425587f0faebbf411293"><enum>(1)</enum><header>Determination
 required</header><text>On completion of site characterization activities, the Administrator shall make a final determination of whether the site is suitable for development as a repository.</text>
					</paragraph><paragraph id="idf3985afeb57346c887773ba475694c2b"><enum>(2)</enum><header>Basis of
 determination</header><text>In making a determination under paragraph (1), the Administrator shall determine if—</text>
 <subparagraph id="ida75e5c08d83343a5853b48e2af113f04"><enum>(A)</enum><text>the site is scientifically and technically suitable for development as a repository, taking into account—</text>
 <clause id="id1d4ae8474272455ba82292a86891994e"><enum>(i)</enum><text>whether the site meets the siting guidelines of the Administrator; and</text>
 </clause><clause id="id447159a3b8ec4d1f923a83cc0fc0eccc"><enum>(ii)</enum><text>whether there is reasonable assurance that a repository at the site will meet—</text>
 <subclause id="ida1794ac0dff040b4a443a0a35f05c948"><enum>(I)</enum><text>the radiation protection standards of the Administrator of the Environmental Protection Agency; and</text>
 </subclause><subclause id="idcdc5cf3c9c5b4f1f9a6437b4155cf9fb"><enum>(II)</enum><text>the licensing standards of the Commission; and</text>
 </subclause></clause></subparagraph><subparagraph id="idd7144e0bce0246e9beff3d4e1b9461fc"><enum>(B)</enum><text>development of a repository or storage facility at the site is in the national interest.</text>
						</subparagraph></paragraph><paragraph id="ida498619cb6aa491baaf2341de2e768c1"><enum>(3)</enum><header>Public
 hearings</header><text>Before making a final determination under paragraph (1), the Administrator shall hold public hearings in the vicinity of the site and at least 1 other location within the State in which the site is located to solicit public comments and recommendations on the proposed determination.</text>
					</paragraph></subsection><subsection id="ide31ed2957b06456297f94967f5d0ae14"><enum>(e)</enum><header>Consent
			 agreements</header>
 <paragraph id="id6de3689f9306485690ae9455b2f7a248"><enum>(1)</enum><header>Requirement</header><text>On making a final determination of site suitability under subsection (d), but before submitting a license application to the Commission under subsection (f), the Administrator shall enter into a consent agreement, subject to section 401(e), with—</text>
 <subparagraph id="idd8246e359b674903a95543d588ce4674"><enum>(A)</enum><text>the Governor or other authorized official of the State in which the site is located;</text>
 </subparagraph><subparagraph id="id855a581ac9664cb3a5d51f7a4333522a"><enum>(B)</enum><text>the governing body of the affected unit of general local government; and</text>
 </subparagraph><subparagraph id="idd2820831591f43a88e313de3c908e7f9"><enum>(C)</enum><text>if the site is located on a reservation, the governing body of the affected Indian Tribe.</text>
 </subparagraph></paragraph><paragraph id="idf508ae7d5b864e0fa78df3f9a60c7349"><enum>(2)</enum><header>Contents</header><text>The consent agreement shall—</text>
 <subparagraph id="id44d24de565fd4baaa0333f5bc68ec01d"><enum>(A)</enum><text>contain the terms and conditions on which each State, local government, and Indian Tribe, as applicable, consents to host the repository; and</text>
 </subparagraph><subparagraph id="idec20e4ca08fc4794a6ef529f28a4b7bb"><enum>(B)</enum><text>express the consent of each State, local government, and Indian Tribe to host the repository.</text>
						</subparagraph></paragraph><paragraph id="idce8a3860d9b24333976364f467c39f05"><enum>(3)</enum><header>Terms and
 conditions</header><text>The terms and conditions under paragraph (2)(A)—</text>
 <subparagraph id="idc84aeaf9ea824a65ae79578511be264b"><enum>(A)</enum><text>shall promote the economic and social well-being of the people living in the vicinity of the repository; and</text>
 </subparagraph><subparagraph id="idc9f3ac08e0534ce09a624eddec9b955b"><enum>(B)</enum><text>may include—</text>
 <clause id="idba0e42ca445b45c9b10e9b428a9905cf"><enum>(i)</enum><text>financial compensation and incentives;</text>
 </clause><clause id="idf95e066fc65845d48e33310aa56ad9f4"><enum>(ii)</enum><text>economic development assistance;</text>
 </clause><clause id="id19296ecbc61d45069d517713c7e4276b"><enum>(iii)</enum><text>operational limitations or requirements; and</text>
 </clause><clause id="idcad0966b047d465b93c62be513a938c6"><enum>(iv)</enum><text>regulatory oversight authority.</text>
							</clause></subparagraph></paragraph><paragraph id="id3662d81bbd6f420abdd6782a4ba3c546"><enum>(4)</enum><header>Binding
 effect</header><text>The consent agreement—</text> <subparagraph id="id8ae48b6fd18849558e0f325ca017c86b"><enum>(A)</enum><text>shall be binding on the parties, subject to section 401(e); and</text>
 </subparagraph><subparagraph id="id249e722fb942454d8f2783da79d29aeb"><enum>(B)</enum><text>shall not be amended or revoked except by mutual agreement of the parties.</text>
						</subparagraph></paragraph></subsection><subsection id="id86da01361fa046d7a27e7f493f950244"><enum>(f)</enum><header>Submission of
 license application</header><text>On determining that a site is suitable under subsection (d) and ratification of a consent agreement under subsection (e), the Administrator shall submit to the Commission an application for a construction authorization for the repository.</text>
				</subsection></section><section id="id4580f86b261641748d1a6b8c760ec333"><enum>307.</enum><header>Licensing
 nuclear waste facilities</header><text display-inline="no-display-inline">The construction and operation of a storage facility or repository under this Act shall be subject to—</text>
 <paragraph id="id2cb6431423ac4ee795b9209c57785e62"><enum>(1)</enum><text>all applicable standards for the protection of the general environment from offsite releases of radioactive material;</text>
 </paragraph><paragraph id="id3b45545c01034f93b84d696eced8da40"><enum>(2)</enum><text>the licensing and regulatory jurisdiction of the Commission, including all applicable criteria and requirements issued by the Commission under section 121(b) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10141">42 U.S.C. 10141(b)</external-xref>); and</text>
 </paragraph><paragraph id="idf3d86773d9c640c9ad7a4a75c71c8e7f"><enum>(3)</enum><text>the terms and conditions of each consent agreement entered into under section 305(b)(4) or section 306(e).</text>
				</paragraph></section><section id="id602c6b194ea849d8b9b0b493ede431ea"><enum>308.</enum><header>Defense
			 waste</header>
				<subsection id="id02376138eecb47febfba6ba04b9fbd4a"><enum>(a)</enum><header>Disposal and
 storage by Administration</header><text>The Secretary—</text> <paragraph id="idb1b090f4601540cb86ea9ca41058c3e2"><enum>(1)</enum><text>shall arrange for the Administrator to dispose of defense wastes in a repository developed under this Act; and</text>
 </paragraph><paragraph id="id59df4a7dc2a44e8ea9cc66caeb06aa5d"><enum>(2)</enum><text>may arrange for the Administrator to store defense wastes in storage facilities developed under this Act pending disposal in a repository.</text>
					</paragraph></subsection><subsection id="id7183eadd97a04269a8fa1e08d4da4df4"><enum>(b)</enum><header>Memorandum of
 agreement</header><text>The arrangements shall be covered by a memorandum of agreement between the Secretary and the Administrator.</text>
 </subsection><subsection id="idfbe3d5b7370c4f4c8e219d1d8918691a"><enum>(c)</enum><header>Costs</header><text>The portion of the cost of developing, constructing, and operating the repository or storage facilities under this Act that is attributable to defense wastes shall be allocated to the Federal Government and paid by the Federal Government into the Working Capital Fund.</text>
 </subsection><subsection id="iddb7960bedeb841ca96189cc20d65a0fb"><enum>(d)</enum><header>Prohibition</header><text>No defense waste may be stored or disposed of by the Administrator in any storage facility or repository constructed under this Act until funds are appropriated to the Working Capital Fund in an amount equal to the fees that would be paid by contract holders under section 302 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222</external-xref>) if such nuclear waste were generated by a contract holder.</text>
				</subsection><subsection id="ida237892a8e644a01ba85f7146726c230"><enum>(e)</enum><header>Commingling
			 determination</header>
 <paragraph id="idb4b6c7ad46d049be8024b917663cc36f"><enum>(1)</enum><header>Reevaluation</header><text>Notwithstanding section 8 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10107">42 U.S.C. 10107</external-xref>), the Secretary may reevaluate the decision to commingle defense wastes with nuclear waste from civilian nuclear power reactors.</text>
 </paragraph><paragraph id="id231527f237374488a4165fa5a5c9d436"><enum>(2)</enum><header>Notification</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall notify the President and the appropriate committees of Congress of whether the Secretary intends to reevaluate the decision under paragraph (1) and the reasons for that decision.</text>
					</paragraph><paragraph id="idc29dbf8bf4c749d7b8387c823e14335f"><enum>(3)</enum><header>Separate
 nuclear waste facilities</header><text>If the Secretary finds, after conducting the reevaluation under paragraph (1), that the development of separate nuclear waste facilities for the storage or disposal of defenses wastes is necessary or appropriate for the efficient management of defenses wastes, the Administrator may, with the concurrence of the President, site, construct, and operate 1 or more separate nuclear waste facilities for the storage or disposal of defenses wastes.</text>
					</paragraph></subsection></section><section id="idea24964f06a34330a73ed5dd2960a177"><enum>309.</enum><header>Transportation</header>
				<subsection id="idc5c9e2bb602e4e9ab73491d6ca19116d"><enum>(a)</enum><header>In
 general</header><text>The Administrator shall be responsible for transporting nuclear waste—</text>
 <paragraph id="idd12f4de36f674ce99eca841e13340fd3"><enum>(1)</enum><text>from the site of a contract holder to a storage facility or repository;</text>
 </paragraph><paragraph id="id923e7ef6132948d8adf6cb6ba77342a9"><enum>(2)</enum><text>from a storage facility to a repository; and</text>
 </paragraph><paragraph id="idb560a46250be458584bc3046b7f84224"><enum>(3)</enum><text>in the case of defense waste, from a Department of Energy site to a repository.</text>
					</paragraph></subsection><subsection id="id4ba2c2dc273b47cb92e46b81195d316d"><enum>(b)</enum><header>Certified
 packages</header><text>No nuclear waste may be transported under this Act except in packages—</text>
 <paragraph id="idf8575a31dc374bf7aa090341977de49f"><enum>(1)</enum><text>the design of which has been certified by the Commission; and</text>
 </paragraph><paragraph id="id993d2f46196c4ea4a55c5767d361193c"><enum>(2)</enum><text>that have been determined by the Commission to satisfy the quality assurance requirements of the Commission.</text>
 </paragraph></subsection><subsection id="id4a789b8e661a425384e5cc410ce9c8d4"><enum>(c)</enum><header>Notification</header><text>Prior to any transportation of nuclear waste under this Act, the Administrator shall provide advance notification to States and Indian Tribes through whose jurisdiction the Administrator plans to transport the nuclear waste.</text>
				</subsection><subsection id="id4979dec05bcd4b8cb602f5474804622f"><enum>(d)</enum><header>Transportation
			 assistance</header>
					<paragraph id="id69d8dc3147d94693902ebfe215d699d3"><enum>(1)</enum><header>Public
 education</header><text>The Administrator shall conduct a program to provide information to the public about the transportation of nuclear waste.</text>
 </paragraph><paragraph id="id4d6fd061be5947dda7675fe80e60322b"><enum>(2)</enum><header>Training</header><text>The Administrator shall provide financial and technical assistance to States and Indian Tribes through whose jurisdiction the Administrator plans to transport nuclear waste to train public safety officials and other emergency responders on—</text>
 <subparagraph id="iddec8b64d5ccb42438220511b400b55f2"><enum>(A)</enum><text>procedures required for the safe, routine transportation of nuclear waste; and</text>
 </subparagraph><subparagraph id="id275b3458ab2043499f6bc2be89cc67b4"><enum>(B)</enum><text>procedures for dealing with emergency response situations involving nuclear waste, including instruction of—</text>
 <clause id="id4417049c49184b7783b6057f8a57d793"><enum>(i)</enum><text>government and Tribal officials and public safety officers in command and control procedures;</text>
 </clause><clause id="idcf2f58e329b64563a8cc6c2cd10aa983"><enum>(ii)</enum><text>emergency response personnel; and</text>
 </clause><clause id="idfbdfcb54ea9247a0a61fdc9de4537a7c"><enum>(iii)</enum><text>radiological protection and emergency medical personnel.</text>
 </clause></subparagraph></paragraph><paragraph id="idafe0b028359c44a8955b66519b06129f"><enum>(3)</enum><header>Equipment</header><text>The Administrator shall provide monetary grants and contributions in-kind to assist States and Indian Tribes through whose jurisdiction the Administrator plans to transport nuclear waste for the purpose of acquiring equipment for responding to a transportation incident involving nuclear waste.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide932e58f1ff740d58ac75fe925a2df4c"><enum>(4)</enum><header>Transportation
 safety programs</header><text>The Administrator shall provide in-kind, financial, technical, and other appropriate assistance to States and Indian Tribes through whose jurisdiction the Administrator plans to transport nuclear waste for transportation safety programs related to shipments of nuclear waste.</text>
					</paragraph></subsection></section></title><title id="idaa0978c6a85d4dbe85011d53d51ab14d"><enum>IV</enum><header>Funding and
			 legal proceedings</header>
			<section id="id755343e44e7b45a3a9f4d868ea79e920"><enum>401.</enum><header> Working
			 Capital Fund</header>
 <subsection id="id3f4267a921b74ffcb898c99ff6c283c1"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate fund, to be known as the <term>Nuclear Waste Administration Working Capital Fund</term>, which shall be separate from the Nuclear Waste Fund.</text>
 </subsection><subsection id="id3ab2e8a9bca14812b1f13be102e84cd9"><enum>(b)</enum><header>Contents</header><text>The Working Capital Fund shall consist of—</text>
 <paragraph id="id42bcf9ff527244edba7b6b63929b6149"><enum>(1)</enum><text>all fees paid by contract holders pursuant to section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) on or after the date of enactment of this Act, which shall be paid into the Working Capital Fund—</text>
 <subparagraph id="id7f1d2515c9724ed5b1406125d9d2120b"><enum>(A)</enum><text>notwithstanding section 302(c)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(c)(1)</external-xref>); and</text>
 </subparagraph><subparagraph id="id150008bc2b284046b3ebcf8f2fd68d18"><enum>(B)</enum><text>immediately on the payment of the fees;</text>
 </subparagraph></paragraph><paragraph id="iddab3520156c74baca8b02cd7549475c6"><enum>(2)</enum><text>any appropriations made by Congress to pay the share of the cost of the program established under this Act attributable to defense wastes; and</text>
 </paragraph><paragraph id="id114a2f456c544c17a771c20b5eaca047"><enum>(3)</enum><text>interest paid on the unexpended balance of the Working Capital Fund.</text>
 </paragraph></subsection><subsection id="id5084efa99ef1477eae991bcb2a3e2f93"><enum>(c)</enum><header>Availability</header><text>All funds deposited in the Working Capital Fund—</text>
 <paragraph id="id0f9fe51064fe4c41a52269280c0360f4"><enum>(1)</enum><text>shall be immediately available to the Administrator to carry out the functions of the Administrator, except to the extent limited in annual authorization or appropriation Acts;</text>
 </paragraph><paragraph id="id3326d8f1a2a640a18c9f50e89787a415"><enum>(2)</enum><text>shall remain available until expended; and</text>
 </paragraph><paragraph id="id5423ae5e71cb490b98e022023a264999"><enum>(3)</enum><text>shall not be subject to apportionment under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/15">chapter 15</external-xref> of title 31, United States Code.</text>
					</paragraph></subsection><subsection id="idf20e8bda12a04df2bdc81e2f63fe71c9"><enum>(d)</enum><header>Use of
 Fund</header><text>Except to the extent limited in annual authorization or appropriation Acts, the Administrator may make expenditures from the Working Capital Fund only for purposes of carrying out functions authorized by this Act.</text>
				</subsection><subsection id="id0fb64190f8404dc680cf167426d44e07"><enum>(e)</enum><header>Contract
 authority</header><text>Any contract or agreement that authorizes an expenditure or obligation exceeding an amount available in the Working Capital Fund for the expenditure or obligation (including any cooperative agreement, consultation, and cooperation agreement, or consent agreement under section 305 or 306) shall be subject to appropriation.</text>
				</subsection><subsection id="id12067b38fb214585b8d78a8daea0e396"><enum>(f)</enum><header>Performance-Based
 funding</header><text>No fees paid by contract holders pursuant to section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) shall be paid into the Working Capital Fund after December 31, 2029, unless the Administrator is operating a nuclear waste facility by that date.</text>
				</subsection></section><section id="id8594b594903d4ab4ad0a2798b01f021e"><enum>402.</enum><header> Nuclear Waste
			 Fund</header>
				<subsection id="idbd41bdd7dda44c9a8333595527a8201e"><enum>(a)</enum><header>Elimination of
 legislative veto</header><text>Section 302(a)(4) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)(4)</external-xref>) is amended—</text>
 <paragraph id="idDC2570996F564B76A73184823D0A191F"><enum>(1)</enum><text>in the third sentence, by striking <quote>insure</quote> and inserting <quote>ensure</quote>; and</text> </paragraph><paragraph id="id97AEC75267E448B1921C2967899B6710"><enum>(2)</enum><text>in the last sentence by striking <quote>transmittal unless</quote> and all that follows through the end of the sentence and inserting <quote>transmittal.</quote>.</text>
					</paragraph></subsection><subsection id="id5f5a192f7e4f48cfbf8c43f76871f54d"><enum>(b)</enum><header>Administration
 of the waste fund</header><text>Section 302(e) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(e)</external-xref>) is amended—</text>
 <paragraph id="idec957f8082ca4f54b828853e5a5d0ff5"><enum>(1)</enum><text>by striking <quote>Secretary</quote> each place it appears (except where it appears in the context of the <term>Secretary of the Treasury</term>) and inserting <quote>Administrator of the Nuclear Waste Administration</quote>; and</text>
 </paragraph><paragraph id="id1a03fd59cdb74973b86e9ec25c1359c7"><enum>(2)</enum><text>by striking <quote>the Waste Fund</quote> each place it appears and inserting <quote>the Waste Fund or the Working Capital Fund established by section 401 of the <short-title>Nuclear Waste Administration Act of 2019</short-title></quote>.</text>
					</paragraph></subsection></section><section id="id40076cdf9d9945bc9714573e69604288"><enum>403.</enum><header>Full cost
 recovery</header><text display-inline="no-display-inline">In determining whether insufficient or excess revenues are being collected to ensure full cost recovery under section 302(a)(4) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)(4)</external-xref>), the Administrator shall—</text>
 <paragraph id="ide476cd974ae841deb1b9a97a5f4f1243"><enum>(1)</enum><text>assume that sufficient funds will be appropriated to the Nuclear Waste Fund to cover the costs attributable to disposal of defense wastes; and</text>
 </paragraph><paragraph id="id66e0e3349d2a435394b6dbab56fa9af7"><enum>(2)</enum><text>take into account the additional costs resulting from the enactment of this Act.</text>
				</paragraph></section><section id="idcc15c859dd0348518a3d913ee40cb267"><enum>404.</enum><header>Judicial
			 review</header>
				<subsection id="id620ee41c2cf240beb8f67bb8d65a0291"><enum>(a)</enum><header>Jurisdiction</header>
					<paragraph id="idc3223660f0194492bef7dcdbfa49b78d"><enum>(1)</enum><header>Courts of
 appeals</header><text>Except for review in the Supreme Court, a court of appeals of the United States shall have original and exclusive jurisdiction over any civil action—</text>
 <subparagraph id="idb0e8f0ae22e945a9aca76c4197c9b69f"><enum>(A)</enum><text>for review of any final decision or action of the Administrator or the Commission under this Act;</text>
 </subparagraph><subparagraph id="id09647cee73b84d358dbec104d84b1ee1"><enum>(B)</enum><text>alleging the failure of the Administrator or the Commission to make any decision, or take any action, required under this Act;</text>
 </subparagraph><subparagraph id="idec779f3e286c472fb833709bc767ef4b"><enum>(C)</enum><text>challenging the constitutionality of any decision made, or action taken, under this Act; or</text>
 </subparagraph><subparagraph id="idea9efd5cdb9a4ceb8556408ba1306395"><enum>(D)</enum><text>for review of any environmental assessment or environmental impact statement prepared pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) with respect to any action under this Act, or alleging a failure to prepare any such assessment or statement with respect to any such action.</text>
 </subparagraph></paragraph><paragraph id="id0e72e3a45f294d25977efcf0a4d280e6"><enum>(2)</enum><header>Venue</header><text>The venue of any proceeding under this section shall be in—</text>
 <subparagraph id="id9665efa960cb4df8af1352623fb3010a"><enum>(A)</enum><text>the judicial circuit in which the petitioner involved resides or has the principal office of the petitioner; or</text>
 </subparagraph><subparagraph id="id1c37433160a54af1a120be6c54336fa8"><enum>(B)</enum><text>the United States Court of Appeals for the District of Columbia Circuit.</text>
						</subparagraph></paragraph></subsection><subsection id="id4427b0a6aa764028b3abd86ad0aa9ca7"><enum>(b)</enum><header>Deadline for
			 commencing action</header>
					<paragraph id="id0EAE0F90547543C5B036DA22123A35FE"><enum>(1)</enum><header>In
 general</header><text>Except as provided in paragraph (2), a civil action for judicial review described in subsection (a)(1) may be brought not later than the date that is 180 days after the date of the decision or action or failure to act involved.</text>
					</paragraph><paragraph id="id83E7F71793F44E64A32BC3C523A7E46A"><enum>(2)</enum><header>No knowledge of
 decision or action</header><text>If a party shows that the party did not know of the decision or action complained of (or of the failure to act) and that a reasonable person acting under the circumstances would not have known, the party may bring a civil action not later than 180 days after the date the party acquired actual or constructive knowledge of the decision, action, or failure to act.</text>
					</paragraph></subsection></section><section id="id1917ae91a9074801835b3a4fe2afaa50"><enum>405.</enum><header>Litigation
			 authority</header>
				<subsection id="idd20ece096fe2412cbe5b85d2d6e72931"><enum>(a)</enum><header>Supervision by
 attorney general</header><text>The litigation of the Administration shall be subject to the supervision of the Attorney General pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/31">chapter 31</external-xref> of title 28, United States Code.</text>
				</subsection><subsection id="id4bbd312622ae4f9f99c4b4caa46c7217"><enum>(b)</enum><header>Attorneys of
 Administration</header><text>The Attorney General may authorize any attorney of the Administration to conduct any civil litigation of the Administration in any Federal court, except the Supreme Court.</text>
				</subsection></section><section id="id0fdaef3048da43908ee3e3fc6ee7cf42"><enum>406.</enum><header>Liabilities</header>
				<subsection id="id5d287c0ef6694e079f92ff05c23f8221"><enum>(a)</enum><header>Pending legal
 proceedings</header><text>Any suit, cause of action, or judicial proceeding commenced by or against the Secretary relating to functions or contracts transferred to the Administrator by this Act shall—</text>
 <paragraph id="idfdf8aba7a357470b8dece52c0a671942"><enum>(1)</enum><text>not abate by reason of the enactment of this Act; and</text>
 </paragraph><paragraph id="id2902e35908884193b89d59aa80e1b0f5"><enum>(2)</enum><text>continue in effect with the Administrator substituted for the Secretary.</text>
					</paragraph></subsection><subsection id="id860acc568f2143a4aca063e87a432751"><enum>(b)</enum><header>Settlement of
			 pending litigation; contract modification</header>
 <paragraph id="id604F572CCF15464EAF68D279DD188739"><enum>(1)</enum><header>Settlement</header><text>The Attorney General, in consultation with the Administrator, shall settle all claims against the United States by a contract holder for the breach of a contract for the disposal of nuclear waste under section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) as a condition precedent of an agreement of the Administrator to take title to and store the nuclear waste of the contract holder at a storage facility.</text>
					</paragraph><paragraph id="id6498c13bcaf94b86910dc570a4af4f05"><enum>(2)</enum><header>Contract
 modification</header><text>The Administrator and contract holders shall modify contracts entered into under section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) in accordance with the settlement under paragraph (1).</text>
					</paragraph></subsection><subsection id="ide48024f5076249bca0f6567877aa3225"><enum>(c)</enum><header>Payment of
 judgments and settlements</header><text>Payment of judgments and settlements in cases arising from the failure of the Secretary to meet the deadline of January 31, 1998, to begin to dispose of nuclear waste under contracts entered into under section 302(a)(1) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)(1)</external-xref>) shall continue to be paid from the permanent judgment appropriation established pursuant to section 1304 of title 31, United States Code.</text>
				</subsection><subsection id="idf069f80035274053803aa2205ae81e93"><enum>(d)</enum><header>New
 contracts</header><text>Notwithstanding section 302(a)(5) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)(5)</external-xref>), the Administrator shall not enter into any contract after the date of enactment of this Act that obligates the Administrator to begin disposing of nuclear waste before the Commission has licensed the Administrator to operate a repository or storage facility.</text>
				</subsection><subsection id="id7b9192db0b8143bc84204d4104f0f92c"><enum>(e)</enum><header>Nuclear
			 indemnification</header>
					<paragraph id="id088c757aabb44606a32bca4a19c02d9b"><enum>(1)</enum><header>Indemnification
 agreements</header><text>For purposes of section 170 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref>) (commonly known as the <term>Price-Anderson Act</term>)—</text>
 <subparagraph id="id7944dfe651924933b8ed43edc984184c"><enum>(A)</enum><text>any person that conducts nuclear waste activities under a contract with the Administrator that may involve the risk of public liability shall be treated as a contractor of the Secretary; and</text>
 </subparagraph><subparagraph id="id258f44afbe1c4ee4a533ee9fd3777186"><enum>(B)</enum><text>the Secretary shall enter into an agreement of indemnification with any person described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="id7bc8a0ac737146be80395b2a5816d7ed"><enum>(2)</enum><header>Conforming
 amendment</header><text>Section 11 ff. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014(ff)</external-xref>) is amended by inserting <quote>or the Nuclear Waste Administration</quote> after <quote>Secretary of Energy</quote>.</text>
					</paragraph></subsection></section></title><title id="id077ca0873d984717b3b878732d2035cf"><enum>V</enum><header>Administrative
			 and savings provisions</header>
			<section id="idfc1573d841544121bdc6b3dd66238df7"><enum>501.</enum><header>Administrative
 powers of Administrator</header><text display-inline="no-display-inline">The Administrator shall have the power—</text>
 <paragraph id="idcc2d7a88e648472b98bd1a16913a18ed"><enum>(1)</enum><text>to perform the functions of the Secretary transferred to the Administrator pursuant to this Act;</text>
 </paragraph><paragraph id="id1d6f498ff7344861bb8cc19fb6c4f8ba"><enum>(2)</enum><text>to enter into contracts with any person who generates or holds title to nuclear waste generated in a civilian nuclear power reactor for the acceptance of title, subsequent transportation, storage, and disposal of the nuclear waste;</text>
 </paragraph><paragraph id="id471fb4c53d8f440badb24c215dce77fe"><enum>(3)</enum><text>to enter into and perform contracts, leases, and cooperative agreements with public agencies, private organizations, and persons necessary or appropriate to carry out the functions of the Administrator;</text>
 </paragraph><paragraph id="id1bf3651dfeb54bfa807d92b1f7e5cc40"><enum>(4)</enum><text>to acquire, in the name of the United States, real estate for the construction, operation, and decommissioning of nuclear waste facilities;</text>
 </paragraph><paragraph id="id10d6a197daf149af9673683461bc32ac"><enum>(5)</enum><text>to obtain from the Administrator of General Services the services the Administrator of General Services is authorized to provide agencies of the United States, on the same basis as those services are provided to other agencies of the United States;</text>
 </paragraph><paragraph id="id2385cf63c427411d82bebd280970befd"><enum>(6)</enum><text>to conduct nongeneric research, development, and demonstration activities necessary or appropriate to carrying out the functions of the Administrator; and</text>
 </paragraph><paragraph id="id2cd5dd9d959649c283aa4527b5810f51"><enum>(7)</enum><text>to make such rules and regulations, not inconsistent with this Act, as may be necessary to carry out the functions of the Administrator.</text>
				</paragraph></section><section id="idfab11c8dc3184c96a1c21ac8fd62fa17"><enum>502.</enum><header>Personnel</header>
				<subsection id="idaa22b56ed5e84743bd4cadccf4432c86"><enum>(a)</enum><header>Officers and
			 employees</header>
 <paragraph id="idaa12c1c4fd104ed8bb3667bc150fa5fe"><enum>(1)</enum><header>Appointment</header><text>In addition to the senior officers described in section 203, the Administrator may appoint and fix the compensation of such officers and employees as may be necessary to carry out the functions of the Administration.</text>
 </paragraph><paragraph id="id6b9755e897e84ed9a7b70f7115096bb1"><enum>(2)</enum><header>Compensation</header><text>Except as provided in paragraph (3), officers and employees appointed under this subsection shall be appointed in accordance with the civil service laws and the compensation of the officers and employees shall be fixed in accordance with title 5, United States Code.</text>
 </paragraph><paragraph id="id626c5a3c6a1b407881b92d4dc67f3143"><enum>(3)</enum><header>Exception</header><text>Notwithstanding paragraph (2), the Administrator may, to the extent the Administrator determines necessary to discharge the responsibilities of the Administrator—</text>
 <subparagraph id="id582a1cce1dcc4f5393977136d689c80e"><enum>(A)</enum><text>appoint exceptionally well qualified individuals to scientific, engineering, or other critical positions without regard to the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, governing appointments in the competitive service; and</text>
 </subparagraph><subparagraph id="id605054044823403a9b2a76844851a554"><enum>(B)</enum><text>fix the basic pay of any individual appointed under subparagraph (A) at a rate of not more than level I of the Executive Schedule without regard to the civil service laws, except that the total annual compensation of the individual shall be at a rate of not more than the highest total annual compensation payable under section 104 of title 3, United States Code.</text>
						</subparagraph></paragraph><paragraph id="id78c9fc2580214460b41c7593738b0b4c"><enum>(4)</enum><header>Merit
 principles</header><text>The Administrator shall ensure that the exercise of the authority granted under paragraph (3) is consistent with the merit principles of section 2301 of title 5, United States Code.</text>
					</paragraph></subsection><subsection id="idc50fb8f8c5254d69ad4e34297f1b83e3"><enum>(b)</enum><header>Experts and
 consultants</header><text>The Administrator may obtain the temporary or intermittent services of experts or consultants as authorized by section 3109 of title 5, United States Code.</text>
				</subsection><subsection id="idc161c0d316484eae9d466847a0bfbda6"><enum>(c)</enum><header>Advisory
			 committees</header>
 <paragraph id="id8f5675ef658e4a27897658f5b1e1b591"><enum>(1)</enum><header>Establishment</header><text>The Administrator may establish, in accordance with the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.), such advisory committees as the Administrator may consider appropriate to assist in the performance of the functions of the Administrator.</text>
 </paragraph><paragraph id="id4404e80589cb49a699170f96a1f86a2f"><enum>(2)</enum><header>Compensation</header><text>A member of an advisory committee, other than a full-time employee of the Federal Government, may be allowed travel expenses, including per diem in lieu of subsistence, as authorized by section 5703 of title 5, United States Code, for individuals in the Government service without pay, while attending meetings of the advisory committee or otherwise serving away from the homes or regular place of business of the member at the request of the Administrator.</text>
					</paragraph></subsection></section><section id="id3812e9b468314c17a8f3157db2c8e235"><enum>503.</enum><header>Offices</header>
				<subsection id="id39062171e7644c728ef301537a04e6fa"><enum>(a)</enum><header>Principal
 office</header><text>The principal office of the Administration shall be in or near the District of Columbia.</text>
				</subsection><subsection id="idf90d070fc5ee4cd4bce67d5f7a1844bc"><enum>(b)</enum><header>Field
 offices</header><text>The Administrator may maintain such field offices as the Administrator considers necessary to carry out the functions of the Administrator.</text>
				</subsection></section><section id="id5b9d5ac034cb491383feec8406afc230"><enum>504.</enum><header>Mission
			 plan</header>
				<subsection id="id6bd6ad347af54033a926abc37768b78b"><enum>(a)</enum><header>In
 general</header><text>The Administrator shall prepare a mission plan, which shall—</text>
 <paragraph id="idf9f407bace4a45c9b7007dc34487d876"><enum>(1)</enum><text>provide an informational basis sufficient to permit informed decisions to be made in carrying out the functions of the Administrator; and</text>
 </paragraph><paragraph id="id050aca002a234dfc9188c43ea116ae88"><enum>(2)</enum><text>provide verifiable indicators for oversight of the performance of the Administrator.</text>
 </paragraph></subsection><subsection id="idf8da3bdef2e846df8ed70d478821055a"><enum>(b)</enum><header>Contents</header><text>The mission plan shall include—</text>
 <paragraph id="id500bd0f129ca46eba1ec4084d1294594"><enum>(1)</enum><text>a description of the actions the Administrator plans to take to carry out the functions of the Administrator under this Act;</text>
 </paragraph><paragraph id="id179547bd35244d6c8f1ee8ba82809fae"><enum>(2)</enum><text>schedules and milestones for carrying out the functions of the Administrator, which shall provide for the operation of—</text>
 <subparagraph id="idda2e060a51a345589be254bf31ce31aa"><enum>(A)</enum><text>a pilot facility not later than December 31, 2025;</text>
 </subparagraph><subparagraph id="id038994bfa71c4523a7405e6e1e4fd9b3"><enum>(B)</enum><text>a storage facility for nonpriority waste not later than December 31, 2029; and</text>
 </subparagraph><subparagraph id="id9351a62c23e3429fbb973931c0497a75"><enum>(C)</enum><text>a repository not later than December 31, 2052; and</text>
 </subparagraph></paragraph><paragraph id="id039315834363463cbefcf87cd6d156c0"><enum>(3)</enum><text>an estimate of the amounts that the Administration will need Congress to appropriate from the Nuclear Waste Fund (in addition to amounts expected to be available from the Working Capital Fund) to carry out the functions of the Nuclear Waste Fund, on an annual basis.</text>
					</paragraph></subsection><subsection id="id127e26c2c9dc443e82d3bb29851cd2f1"><enum>(c)</enum><header>Proposed
 mission plan</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit a proposed mission plan for comment to—</text>
 <paragraph id="id6630389247B041C99BB2AE470220C6A5"><enum>(1)</enum><text>Congress;</text> </paragraph><paragraph id="id2A02AD0AB1CD455E98B7339C1D36AC33"><enum>(2)</enum><text>the Oversight Board;</text>
 </paragraph><paragraph id="idA9FEB5D60568468A805C26103E179366"><enum>(3)</enum><text>the Commission;</text>
 </paragraph><paragraph id="idC55B82A289E44B12ADCFE0834DC57542"><enum>(4)</enum><text>the Nuclear Waste Technical Review Board established by section 502 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10262">42 U.S.C. 10262</external-xref>);</text>
 </paragraph><paragraph id="idF4572B97ED594CDE9A7CAAE1D626DFDA"><enum>(5)</enum><text>the States;</text>
 </paragraph><paragraph id="idDDF68C2748364F6C87215D287D7217C1"><enum>(6)</enum><text>affected Indian Tribes; and</text>
 </paragraph><paragraph id="id468FBA5A39744A5E95ED46FF03C22B30"><enum>(7)</enum><text>such other interested persons as the Administrator considers appropriate.</text>
					</paragraph></subsection><subsection id="idb912dcc497d643139e01ad45a28c0fff"><enum>(d)</enum><header>Public notice
 and comment</header><text>On submitting the proposed mission plan for comment under subsection (c), the Administrator shall—</text>
 <paragraph id="id40D3B1B870BB4E5598F0F0919E29AAA8"><enum>(1)</enum><text>publish a notice in the Federal Register of the availability of the proposed mission plan for public comment; and</text>
 </paragraph><paragraph id="idCB3CBE73C88A46D395D8A8C2BE4D7F1D"><enum>(2)</enum><text>provide interested persons an opportunity to comment on the proposed plan.</text>
					</paragraph></subsection><subsection id="id83f6208afdd24f15b06a8b812da8ea68"><enum>(e)</enum><header>Submission of
 final mission plan</header><text>After consideration of the comments received, the Administrator shall—</text>
 <paragraph id="idf753fb493fd3440aad4ee58bebc8f0b8"><enum>(1)</enum><text>revise the proposed mission plan to the extent that the Administrator considers appropriate; and</text>
 </paragraph><paragraph id="idf7304a62c777477aacc5d1eb4d607222"><enum>(2)</enum><text>submit the final mission plan, along with a general statement responding to any significant issues raised in the comments received on the proposed mission plan, to the appropriate committees of Congress, the President, and the Oversight Board.</text>
					</paragraph></subsection><subsection id="id20c779a374084703992a8c58dc49a6ab"><enum>(f)</enum><header>Revision of the
 mission plan</header><text>The Administrator shall—</text> <paragraph id="id733c337a2a4145ae9e86f93565eb4358"><enum>(1)</enum><text>revise the mission plan, as appropriate, to reflect major changes in the planned activities, schedules, milestones, and cost estimates reported in the mission plan; and</text>
 </paragraph><paragraph id="idb27f1b9b989d47e58c95788d108cb76e"><enum>(2)</enum><text>submit the revised mission plan to Congress, the President, and the Oversight Board prior to implementing the proposed changes.</text>
					</paragraph></subsection></section><section id="id7b8b9fe32a9344c5b8bdf4eefa33b765"><enum>505.</enum><header>Annual
			 reports</header>
				<subsection id="id4555ef1731a74b469c992f1fc92adfb2"><enum>(a)</enum><header>In
 general</header><text>The Administrator shall annually prepare and submit to Congress, the President, and the Oversight Board a comprehensive report on the activities and expenditures of the Administration.</text>
				</subsection><subsection id="id53efe46a89074fd4b839f45953193818"><enum>(b)</enum><header>Management
 report</header><text>The annual report submitted under subsection (a) shall include—</text>
 <paragraph id="ide9c19448415544e3aa0e824b1753bdfc"><enum>(1)</enum><text>the annual management report required under section 9106 of title 31, United States Code; and</text>
 </paragraph><paragraph id="id3e0d4907bd314a639191fc879257fcd7"><enum>(2)</enum><text>the report on any audit of the financial statements of the Administration conducted under section 9105 of title 31, United States Code.</text>
					</paragraph></subsection></section><section id="id4e5e1930586c4fd9a2f76a28d7481509"><enum>506.</enum><header>Savings
			 provisions; terminations</header>
				<subsection id="id86a983c1b5604effa86a6c76f9dddac4"><enum>(a)</enum><header>Commission
 proceedings</header><text>This Act shall not affect any proceeding or any application for any license or permit pending before the Commission on the date of enactment of this Act.</text>
				</subsection><subsection id="id011f1d0ffaa54adfa562fa62f3769759"><enum>(b)</enum><header>Authority of
 the secretary</header><text>This Act shall not transfer or affect the authority of the Secretary with respect to—</text>
 <paragraph id="ida0dd7a4156a94c7787232bc203df2271"><enum>(1)</enum><text>the maintenance, treatment, packaging, and storage of defense wastes at Department of Energy sites prior to delivery to, and acceptance by, the Administrator for disposal in a repository;</text>
 </paragraph><paragraph id="id65f9ea5d62ba4655ac06c370afea616f"><enum>(2)</enum><text>the conduct of generic research, development, and demonstration activities related to nuclear waste management, including proliferation-resistant advanced fuel recycling and transmutation technologies that minimize environmental and public health and safety impacts; and</text>
 </paragraph><paragraph id="id5b54c9cbe2c248be8f9ed134b29d0caa"><enum>(3)</enum><text>training and workforce development programs relating to nuclear waste management.</text>
 </paragraph></subsection><subsection id="id78d66b7429df48449f1271e0e9315afe"><enum>(c)</enum><header>Terminations</header><text>The authority for each function of the Secretary relating to the siting, construction, and operation of repositories or storage facilities not transferred to the Administrator under this Act shall terminate on the date of enactment of this Act, including the authority—</text>
 <paragraph id="idb9b4cca2074047b5b7d60a546ae48ac2"><enum>(1)</enum><text>to provide interim storage or monitored, retrievable storage under subtitles B and C of title I of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10151">42 U.S.C. 10151</external-xref> et seq.); and</text>
 </paragraph><paragraph id="id2f02d0f41e814438a0ec161c653a8511"><enum>(2)</enum><text>to site or construct a test and evaluation facility under title II of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10191">42 U.S.C. 10191</external-xref> et seq.).</text>
					</paragraph></subsection></section><section id="id4a471f6aa71842408b397b1ad187dd9b"><enum>507.</enum><header>Technical
			 assistance in the field of spent fuel storage and disposal</header>
				<subsection id="id3724937f588e44948505860a2ee74a0c"><enum>(a)</enum><header>Joint
 notice</header><text>Not later than 90 days after the date of enactment of this Act and annually for 5 succeeding years, the Secretary and the Commission shall update and publish in the Federal Register the joint notice required by section 223(b) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10203">42 U.S.C. 10203(b)</external-xref>).</text>
				</subsection><subsection id="id4775ae76d39d435884048bf208f77177"><enum>(b)</enum><header>Informing
 foreign governments</header><text>As soon as practicable after the date of the publication of the annual joint notice described in subsection (a), the Secretary of State shall inform the governments of nations and organizations operating nuclear power plants, solicit expressions of interest, and transmit any such expressions of interest to the Secretary and the Commission, as provided in section 223(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10203">42 U.S.C. 10203(c)</external-xref>).</text>
				</subsection><subsection id="id1882945d4d134330b5fa818bdeb785f4"><enum>(c)</enum><header>Budget
 requests</header><text>The President shall include in the budget request of the President for the Commission and the Department of Energy for each of fiscal years 2020 through 2025 such funding requests for a program of cooperation and technical assistance with nations in the fields of spent nuclear fuel storage and disposal as the President determines appropriate in light of expressions of interest in the cooperation and assistance.</text>
 </subsection><subsection id="iddfcb5527a7bb47b18af8158f0c8b4a2f"><enum>(d)</enum><header>Eligibility</header><text>Notwithstanding any limitation on cooperation and technical assistance to non-nuclear weapon states under section 223 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10203">42 U.S.C. 10203</external-xref>), the Secretary and the Commission may cooperate with and provide technical assistance to nuclear weapon states, if the Secretary and the Commission determine the cooperation and technical assistance is in the national interest.</text>
				</subsection></section><section id="id3c67e1feab134280964a16ac255e037d"><enum>508.</enum><header>Nuclear Waste
			 Technical Review Board</header>
 <subsection id="id380d1f70ca7548d28461ddde9501820b"><enum>(a)</enum><header>Eligibility</header><text>Section 502(b)(3)(C)(iii)(I) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10262">42 U.S.C. 10262(b)(3)(C)(iii)(I)</external-xref>) is amended by inserting <quote>or the Nuclear Waste Administration</quote> after <quote>the Department of Energy</quote>.</text>
 </subsection><subsection id="idc8877ad12c4345b58ebb72c86b217551"><enum>(b)</enum><header>Functions</header><text>Section 503 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10263">42 U.S.C. 10263</external-xref>) is amended by striking <quote>1987</quote> and inserting <quote>1987 and the Nuclear Waste Administrator</quote>.</text>
				</subsection><subsection id="id37fbaad7afb5457fbb384ff97694adff"><enum>(c)</enum><header>Production of
 documents</header><text>Section 504(b) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10264">42 U.S.C. 10264(b)</external-xref>) is amended by striking <quote>Secretary</quote> each place it appears and inserting <quote>Nuclear Waste Administrator</quote>.</text>
 </subsection><subsection id="id9ea6f46a85564c0ebfcb971e0dfa62ac"><enum>(d)</enum><header>Reports</header><text>Section 508 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10268">42 U.S.C. 10268</external-xref>) is amended in the first sentence by striking <quote>Congress and the Secretary</quote> and inserting <quote>Congress, the Nuclear Waste Administrator, and the Nuclear Waste Oversight Board</quote>.</text>
 </subsection><subsection id="id192e8e6bde8c473a815a3398735f0507"><enum>(e)</enum><header>Termination</header><text>Section 510 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10270">42 U.S.C. 10270</external-xref>) is amended by striking <quote>Secretary</quote> and inserting <quote>Nuclear Waste Administrator</quote>.</text>
				</subsection></section><section id="idf4df1cc68c2e4a1fbaf0d2d6cc396ab1"><enum>509.</enum><header>Repeal of
 volume limitation</header><text display-inline="no-display-inline">Section 114(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10134">42 U.S.C. 10134(d)</external-xref>) is amended by striking the second and third sentences.</text></section></title></legis-body></bill>
