			 extraction and recovery of rare earth elements and minerals from coal and
			 coal byproducts, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rare Earth Element Advanced Coal Technologies Act</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSEG00" id="idF0F4FB25601749ECB68BF00BAA5C247E" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph id="id72af9d00aea54e938c700416166f0cd6"><enum>(1)</enum><text>the United States is largely dependent on foreign imports for the domestic supply of rare earth elements and critical minerals in the United States;</text>
 </paragraph><paragraph id="id5f229079c9404cb9aef8a48b42e34545"><enum>(2)</enum><text>as of the date of enactment of this Act, the United States does not have domestic production capability for, or a guaranteed supply chain of, rare earth elements and critical minerals;</text>
 </paragraph><paragraph id="id22434613aada48cda3db8089908883fe"><enum>(3)</enum><text>access to certain rare earth elements and minerals is critical for the national security of the United States;</text>
 </paragraph><paragraph id="idF5443AB44AD34F318C5D7E42835818A4"><enum>(4)</enum><text>China maintains a near monopoly of the global supply chain of rare earth elements and critical minerals;</text>
 </paragraph><paragraph id="id3db82ad4170d426ba17064bce81c2384"><enum>(5)</enum><text>the successful development of commercially viable refining methods of rare earth elements from coal byproducts could lead to new economic development opportunities in parts of the United States most affected by the downturn of the coal industry;</text>
 </paragraph><paragraph id="idc8dcf9c6d96d4442a97fdaf81bc486f3"><enum>(6)</enum><text>rare earth elements—</text> <subparagraph id="id399E1A8CBA6047A898A90B1931D01815"><enum>(A)</enum><text>comprise elements on the periodic table, including—</text>
 <clause id="idF0C38AC60B2A47DEB625BA0FBD21AF86"><enum>(i)</enum><text>the lanthanides, which are lanthanum (La), cerium (Ce), praseodymium (Pr), neodymium (Nd), samarium (Sm), europium (Eu), gadolinium (Gd), terbium (Tb), dysprosium (Dy), holmium (Ho), erbium (Er), thulium (Tm), ytterbium (Yb), and lutetium (Lu); and</text>
 </clause><clause id="idFAA768F22A9B4B088A87185BD7E87893"><enum>(ii)</enum><text>transition elements, which are scandium (Sc) and yttrium (Y); and</text> </clause></subparagraph><subparagraph id="idb6560eb8d10b46fba0c90fea40ed2818"><enum>(B)</enum><text>can be divided into—</text>
 <clause id="id00AF39380D21494E803AA965560629B3"><enum>(i)</enum><text>light rare earth elements, which are lanthanum (La), cerium (Ce), praseodymium (Pr), neodymium (Nd), promethium (Pm), and samarium (Sm); and</text>
 </clause><clause id="idFF6650BBDA784C9088E88642FD1311EC"><enum>(ii)</enum><text>heavy rare earth elements, which are scandium (Sc), yttrium (Y), gadolinium (Gd), terbium (Tb), dysprosium (Dy), holmium (Ho), erbium (Er), thulium (Tm), ytterbium (Yb), and lutetium (Lu); and</text>
 </clause></subparagraph></paragraph><paragraph id="id254ec59d1657419db96e8129ff9692b6"><enum>(7)</enum><text>it is in the interest of the Federal Government—</text> <subparagraph id="id4D23AEC02FC842E088056B2FDA17EB76"><enum>(A)</enum><text>to guide responsible domestic production methods of rare earth elements and minerals to ensure industry and consumers in the United States have access to a reliable domestic supply of valuable rare earth elements and minerals; and</text>
 </subparagraph><subparagraph id="idE9173BE600904DE280F0C0E095A05E45"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idD9C37432BA0A49F7822DD4F978E5F08D"><enum>(i)</enum><text>to identify the areas of highest potential interruption in the global supply chain of rare earth elements and minerals; and</text>
 </clause><clause changed="deleted" committee-id="SSEG00" id="id0A01209382FD4E27BA2688311D54953B" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>to strengthen the position of the United States in that supply chain by mitigating potential interruptions through the development of advanced separation technologies for coal and coal byproducts.</text>
					</clause></subparagraph></paragraph></section><section changed="deleted" committee-id="SSEG00" id="idE4FE465C6E3D4F4EAC8B636ACCEE5F9F" reported-display-style="strikethrough"><enum>3.</enum><header>Program for extraction and recovery of rare earth elements and minerals from coal and coal
			 byproducts</header>
 <subsection id="id113AD23AB5384853B22F5A54E702A9C2"><enum>(a)</enum><header>In general</header><text>The Secretary of Energy, acting through the Assistant Secretary for Fossil Energy (referred to in this Act as the <quote>Secretary</quote>), shall carry out a program under which the Secretary shall develop advanced separation technologies for the extraction and recovery of rare earth elements and minerals from coal and coal byproducts.</text>
 </subsection><subsection id="idB092E4DCCAF34030B8969AC438AD2D76"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program described in subsection (a) $23,000,000 for each of fiscal years 2020 through 2027.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="id3E2F30D9ADA9485FBDEC62BB64EC9BFF" reported-display-style="strikethrough"><enum>4.</enum><header>Assessment and report</header>
 <subsection id="id66E1ACA04E2F42CCB2074CC88C57DB9A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Defense and the Secretary of the Interior, shall carry out, and submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives—</text>
 <paragraph id="id23381FC4C7C24793A70C9A178F03481A"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment—</text> <subparagraph id="id189fd86ce6da45f2990846588dd1475d"><enum>(A)</enum><text>identifying and ranking the rare earth elements that—</text>
 <clause id="id507E95C50C5F430D87C7386E1A71DD70"><enum>(i)</enum><text>are most important to consumers in the United States;</text> </clause><clause id="id99B12824E37C467B9C23AC5DD3B11A06"><enum>(ii)</enum><text>are most jeopardized in the global supply chain; and</text>
 </clause><clause id="idC5247144AD844929A66FB2E14A836934"><enum>(iii)</enum><text>will have the greatest impact to consumers in the United States in the event of a disruption in the global supply chain;</text>
 </clause></subparagraph><subparagraph id="id1E203C5F77DA407D8A4D89D031748329"><enum>(B)</enum><text display-inline="yes-display-inline">evaluating the development of advanced separation technologies for the extraction and recovery of rare earth elements and minerals from coal and coal byproducts (referred to in this subsection as the <quote>technologies</quote>);</text>
 </subparagraph><subparagraph id="id771730f74c8a4cdfa534ac0fc15e761a"><enum>(C)</enum><text>identifying and evaluating the results of the development of the technologies, including the results with respect to the extraction and recovery of each rare earth element;</text>
 </subparagraph><subparagraph id="idCB49D7380B0F48B79ACC13ABEDCC2D5E"><enum>(D)</enum><text>determining what the technologies are capable of producing;</text> </subparagraph><subparagraph id="id8551DE89FC5D43A7A7648E053B0D47BF"><enum>(E)</enum><text>evaluating the performance of the technologies, including what the technologies—</text>
 <clause id="id5345BC7AF8E340A49BC138C0FB26EB39"><enum>(i)</enum><text>succeed and fail at accomplishing; and</text> </clause><clause id="idFE79FB3498EC4655BC38B4AE8B3DC174"><enum>(ii)</enum><text>can and cannot do cost-effectively; and</text>
 </clause></subparagraph><subparagraph id="id8932247428f04a30bf0aee786ced30b9"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="idC4F99CA6A400405799F73480EA537CE9"><enum>(i)</enum><text>evaluating the market impact on each rare earth mineral of the penetration of commercially viable technologies; and</text>
 </clause><clause changed="deleted" committee-id="SSEG00" id="idD9EC3EE0A85745568A7704FBF81531C6" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>how the penetration of commercially viable coal-based technology will impact the global supply chain; and</text>
 </clause></subparagraph></paragraph><paragraph id="id1E41AC92960E44C7AA9D25C1DCD47E39"><enum>(2)</enum><text display-inline="yes-display-inline">a report analyzing—</text>
 <subparagraph id="id58E3EB212D3F4292837E30C5D3B22531"><enum>(A)</enum><text display-inline="yes-display-inline">the additional resources required for the development of commercial-ready deployment of technologies that are second generation and transformational; and</text>
 </subparagraph><subparagraph id="id8158C5AD3C9F4B01B4B85C48A41EA860"><enum>(B)</enum><text display-inline="yes-display-inline">the market impact of processes to treat and recover rare earth elements and minerals from acid mine drainage from coal mines.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1D2BD81A6FC849F88D05EF33ADE7C78A"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">In carrying out the assessment and report under subsection (a), the Secretary shall focus on the rare earth elements determined by the Secretary to be most critical to the national security of the United States.</text></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
 <section changed="added" committee-id="SSEG00" id="id51b59975-3c36-47f7-948c-ee746b51dc47" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rare Earth Element Advanced Coal Technologies Act</short-title></quote>.</text> </section><section changed="added" committee-id="SSEG00" id="idcfa7afd6-7e0c-4618-b66f-94669825d16d" reported-display-style="italic"><enum>2.</enum><header>Program for extraction and recovery of rare earth elements and minerals from coal and coal byproducts</header> <subsection id="id49988c38-edc9-4979-b507-133b3fbb745f"><enum>(a)</enum><header>In general</header><text>The Secretary of Energy, acting through the Assistant Secretary for Fossil Energy (referred to in this Act as the <quote>Secretary</quote>), shall carry out a program under which the Secretary shall develop advanced separation technologies for the extraction and recovery of rare earth elements and minerals from coal and coal byproducts.</text>
 </subsection><subsection id="idecf92971-e13f-423e-80b4-a55821dc7f8d"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program described in subsection (a) $23,000,000 for each of fiscal years 2020 through 2027.</text>
 </subsection></section><section changed="added" committee-id="SSEG00" id="id94a0ff94-48e6-4a88-a8f1-575a219f680e" reported-display-style="italic"><enum>3.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report evaluating the development of advanced separation technologies for the extraction and recovery of rare earth elements and minerals from coal and coal byproducts, including acid mine drainage from coal mines.</text></section></legis-body><endorsement><action-date>August 16, 2019</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
