			 other purposes.</official-title></form>
	<legis-body id="H73020D4F192B4250BB7B001221D1EAE1" style="OLC">
 <section id="H1B454AD7380C4B3D8EE893953BDCC3A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Bad Robocalls Act</short-title></quote>.</text> </section><section id="HB1D84F0D796E4986BC3D9C0B624596A4"><enum>2.</enum><header>Prohibitions on making robocalls</header> <subsection id="H72680324C4F2452A91B066371DC719E3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended—</text>
 <paragraph id="HDAA2FFFDA75945ECBC59BA7BC4F56017"><enum>(1)</enum><text>in subsection (a), by amending paragraph (1) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HF3EDD1C60B9546B7B8931F75775E7F9E" style="OLC"> <paragraph id="H84073301B97549FF8051A4292913FDBB"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>robocall</quote> means a call made (including a text message sent)—</text>
 <subparagraph id="H2F4107F27F6F4BF8A4B9245A16076E8D"><enum>(A)</enum><text>using equipment that makes a series of calls to stored telephone numbers, including numbers stored on a list, or to telephone numbers produced using a random or sequential number generator, except for a call made using only equipment that the caller demonstrates requires substantial additional human intervention to dial or place a call after a human initiates the series of calls; or</text>
 </subparagraph><subparagraph id="H981AD8C758CD47E7ACD8D5F3EA526C0A"><enum>(B)</enum><text>using an artificial or prerecorded voice.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="HE6F16C68BD304C83B402171391ECC39C"><enum>(2)</enum><text>in subsection (b)—</text>
 <subparagraph id="H8E8EB998930C4E0FB9D366F8231FF67F"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H0AF7D3B035614855AE3FB6C1A6EAFA63"><enum>(i)</enum><text>in subparagraph (A)—</text>
 <subclause id="H464ACD6CB4574EEC9F0F15BCFD519D06"><enum>(I)</enum><text>by striking <quote>any call</quote> and inserting <quote>any robocall</quote>; and</text> </subclause><subclause id="H31FB528D177543AA9FB2FB992F7C0F73"><enum>(II)</enum><text>by striking <quote>using any automatic telephone dialing system or an artificial or prerecorded voice</quote>;</text>
 </subclause></clause><clause id="HD79DA4E1D516455E930EAE0EAA389004"><enum>(ii)</enum><text>in subparagraph (B)—</text> <subclause id="H745854669DFB4F48B707CBF40F5B2E79"><enum>(I)</enum><text>by striking <quote>telephone call</quote> and inserting <quote>robocall</quote>; and</text>
 </subclause><subclause id="H6AF5885A79104A21BBABD40CF3B22A0D"><enum>(II)</enum><text>by striking <quote>using an artificial or prerecorded voice to deliver a message</quote>; and</text> </subclause></clause><clause id="H02A31D9DFC6B4849A380C917295DB4E7"><enum>(iii)</enum><text>in subparagraph (D), by striking <quote>use an automatic telephone dialing system</quote> and inserting <quote>make robocalls</quote>; and</text>
 </clause></subparagraph><subparagraph id="H45D74AC19BF943C1B0DE9953AAAD37EA"><enum>(B)</enum><text>in paragraph (2)(A), by striking <quote>calls made using an artificial or prerecorded voice</quote> and inserting <quote>robocalls</quote>;</text> </subparagraph></paragraph><paragraph commented="no" id="H1BAF079D130C4B7ABBB8533D3E530CD3"><enum>(3)</enum><text>in subsection (d)—</text>
 <subparagraph commented="no" id="HA15D9B2EA7D54ACFA48A6F237DBA6B10"><enum>(A)</enum><text>in paragraph (1)(A)—</text> <clause commented="no" id="H7C2789EC66784F91B1BD4D8D14D825F5"><enum>(i)</enum><text>by striking <quote>telephone call using any automatic telephone dialing system</quote> and inserting <quote>robocall described in subsection (a)(1)(A) using any equipment</quote>; and</text>
 </clause><clause commented="no" id="H1699129BD04B4622AE01E52CAD2A596B"><enum>(ii)</enum><text>by striking <quote>or automatic telephone dialing system</quote> and inserting <quote>or to make any robocall described in subsection (a)(1)(A)</quote>; and</text> </clause></subparagraph><subparagraph commented="no" id="HD1D1E5C404F2491395379FB1E1D34A63"><enum>(B)</enum><text>in paragraph (3)—</text>
 <clause commented="no" id="H37E8CBCBC40C4AF08746691E73716C98"><enum>(i)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="paragraph" style="OLC">robocall</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">voice</header-in-text></quote>;</text> </clause><clause commented="no" id="HA908EDE7ECE645B8AF6F793DA5B1379D"><enum>(ii)</enum><text>in the first sentence, by striking <quote>artificial or prerecorded voice message via telephone</quote> and inserting <quote>robocall described in subsection (a)(1)(B)</quote>; and</text>
 </clause><clause commented="no" id="HC0D0821D079446EF9C98861BA39296AE"><enum>(iii)</enum><text>in subparagraph (A), by striking <quote>all artificial or prerecorded telephone messages</quote> and inserting <quote>the artificial or prerecorded voice message contained in any robocall described in such subsection</quote>; and</text> </clause></subparagraph></paragraph><paragraph id="HBB310E3BDAE94E29918045790622F254"><enum>(4)</enum><text>in subsection (f)(1)—</text>
 <subparagraph id="HA0D7A03B30724F2784FCA576F9ED993A"><enum>(A)</enum><text>by striking subparagraphs (B) and (C) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HAE68502539F54377A455AE412600CCE3" style="OLC"> <subparagraph id="H9EC2EF00AEE940E5AE0E6323B8A78780"><enum>(B)</enum><text display-inline="yes-display-inline">the making of robocalls; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H40A96D03B4B047E0AB6AF30F5F3ADEC2"><enum>(B)</enum><text>by redesignating subparagraph (D) as subparagraph (C).</text> </subparagraph></paragraph></subsection><subsection id="H9F60724898094804B99A92279953BD0C"><enum>(b)</enum><header>Manner of revoking prior express consent</header><text>Section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>) is amended—</text>
 <paragraph id="H82CEA153CC814C4295098F743B07B692"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (7); and</text> </paragraph><paragraph id="HD07394866D8F42C582386AB04A1F7E00"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE144EE832439405A870CDB695E932E30" style="OLC">
 <paragraph id="H03337F1C527A4AEB9D59007F10576E3F"><enum>(3)</enum><header>Manner of revoking prior express consent</header><text display-inline="yes-display-inline">For purposes of this subsection, prior express consent may be revoked at any time and in any reasonable manner, regardless of the context in which consent was provided.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H3AC072E6168741F39696091E59D5A38A"><enum>(c)</enum><header>Deadline for regulations</header><text>Not later than 1 year after the date of the enactment of this Act, the Federal Communications Commission shall prescribe such regulations, or amend such existing regulations, as necessary to implement the amendments made by this section. Such regulations shall include such clarifications regarding descriptions of equipment and services as will, in the judgment of the Commission, effectuate the consumer protection purposes of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), prevent circumvention or evasion of such section, and facilitate compliance with such section.</text>
 </subsection><subsection id="HCEC85B81E5834C5C901F32B5B595C624"><enum>(d)</enum><header>Report to Congress on text messages</header><text>Not later than 60 days after the date of the enactment of this Act, after notice and an opportunity for public comment, the Federal Communications Commission shall submit to Congress a report on how best to limit the number of unwanted text messages received by consumers. Such report shall contain recommendations by the Commission, including recommendations for potential legislation.</text>
			</subsection></section><section id="HC79005C24B0B4917A24CB5C1FADBB5BE"><enum>3.</enum><header>Consumer protections for exemptions</header>
 <subsection id="H361FC66AD8C341389224079C426A844C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)(2)</external-xref>) is amended—</text> <paragraph id="H6D1B0D0A7BE5406E9B11042849EAB3C6"><enum>(1)</enum><text>in subparagraph (G)(ii), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="H6C87A815508A420589013D68260164B2"><enum>(2)</enum><text>in subparagraph (H), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="HDAE497E8DE4C460C93C7710C47601014"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H51EAAD06E62C42DD8CFB6BE3E753F300" style="OLC">
 <subparagraph id="H954023B7EA9747C49C6BB5AE93EC4C9F"><enum>(I)</enum><text display-inline="yes-display-inline">shall ensure that any exemption under subparagraph (B) or (C) contains requirements for calls made in reliance on the exemption with respect to—</text>
 <clause id="HDED4CCBE6FAB4F9FBA541EFEAF4E24EC"><enum>(i)</enum><text>the classes or categories of parties that may make such calls;</text> </clause><clause id="HF3AF7FDAC00444018B0EEC421FF18E4E"><enum>(ii)</enum><text>the classes or categories of parties that may be called;</text>
 </clause><clause id="HA7638C38F26D45C498B278EBB04CB6F7"><enum>(iii)</enum><text>the purposes for which such calls may be made;</text> </clause><clause id="HE656ED58AE8D469EB12B12615B47B194"><enum>(iv)</enum><text>the number of such calls that a calling party may make to a particular called party; and</text>
 </clause><clause id="HDED1E7B3BB7F43F6B6F94068DE20C555"><enum>(v)</enum><text>the obligation of the calling party—</text> <subclause id="H51974E57BC7E46D3BEC51BFC29252B39"><enum>(I)</enum><text>to provide the called party with a conspicuous consumer choice mechanism that permits the called party, at any time, to indicate that the called party wishes to stop receiving such calls from the calling party; and</text>
 </subclause><subclause id="H6FCD6F95A8604028B3B4C353DEE9C159"><enum>(II)</enum><text>to stop making such calls to the called party if the called party so indicates.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H574BDBF17DB74EDBAB241F571E9844EE"><enum>(b)</enum><header>Deadline for regulations</header><text>In the case of any exemption issued under subparagraph (B) or (C) of section 227(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)(2)</external-xref>) before the date of the enactment of this Act, the Federal Communications Commission, shall, not later than 1 year after such date of enactment, prescribe such regulations, or amend such existing regulations, as necessary to ensure that such exemption meets the requirements of subparagraph (I) of such section, as added by subsection (a).</text>
			</subsection></section><section id="H84F97C9F3B034216B4620711AF1FF037"><enum>4.</enum><header>Reassigned number database; safe harbor</header>
 <subsection id="H49827A7827F945758805BA86AC848A83"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>), as amended by section 2(b), is further amended by inserting after paragraph (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC301FB2E878A4203AD2EFB7BE89CFF92" style="OLC">
					<paragraph id="H8F2CD5D409FD4F4BAD3C4C62CCCCE26D"><enum>(4)</enum><header>Reassigned number database; safe harbor</header>
 <subparagraph id="H982E4FB75AE24A688821AAC8C824F313"><enum>(A)</enum><header>Database required</header><text display-inline="yes-display-inline">The Commission shall establish a nationwide database of telephone numbers that have been reassigned in order to provide persons making calls subject to this subsection with the comprehensive and timely information that such persons need to avoid making calls without the prior express consent of the called party because of the reassignment of the number called to a different party. The Commission shall ensure that information in the database required by this subparagraph is up-to-date.</text>
 </subparagraph><subparagraph id="H2E1E390575DB45029889B3A624F2A57A"><enum>(B)</enum><header>Provider participation required</header><text>The Commission shall require each covered provider to report to the database required by subparagraph (A) the reassignment of any telephone number to or from a subscriber of such provider.</text>
 </subparagraph><subparagraph commented="no" id="H9EA8A9F390A94BC5ABFC59A4615D99E3"><enum>(C)</enum><header>Safe harbor</header><text>Beginning on the date of the establishment of the database required by subparagraph (A), in the case of a person who makes a call subject to this subsection to a telephone number that has been reassigned from a subscriber who had given prior express consent to be called by such person, such person shall not be found in violation of this subsection on the basis of not having the prior express consent of the called party to make such call, if such person shows that—</text>
 <clause commented="no" id="H08C95927D2F5415E9C811AC518934826"><enum>(i)</enum><text>such person had the prior express consent of such subscriber and such consent had not been revoked as of the time of such call;</text>
 </clause><clause commented="no" id="H42A55820ABA1459A948AABE4899B0956"><enum>(ii)</enum><text>such person queried such database before making such call, the query did not show such number as being reassigned from such subscriber, and such person made such call within a reasonable period of time (as defined by the Commission) after such query;</text>
 </clause><clause commented="no" id="H75BD9697383B495B95AC520FF7043C7B"><enum>(iii)</enum><text>the failure of such query to show such number as being reassigned from such subscriber resulted from an inaccuracy on the part of—</text>
 <subclause commented="no" id="HB95A740572CE4AB1A5E6D05B9A478911"><enum>(I)</enum><text>the Commission or other entity administering such database; or</text> </subclause><subclause commented="no" id="HBC108FE2B977405DBE6FBB24FD111927"><enum>(II)</enum><text>a covered provider in reassigning such number or in making a report to such database about the reassignment of such number;</text>
 </subclause></clause><clause commented="no" id="H56A7253CB6AF4019B64FD515EE71400E"><enum>(iv)</enum><text>such person did not otherwise know or have any reason to know that such number had been reassigned from such subscriber;</text>
 </clause><clause commented="no" id="HED08C696014841F6BC4387A5387DD5D9"><enum>(v)</enum><text>such call would have complied with the requirements of this subsection but for the lack of the prior express consent of the called party; and</text>
 </clause><clause commented="no" id="H116655D85DE64F1F93207DCEEEEE788B"><enum>(vi)</enum><text display-inline="yes-display-inline">such person—</text> <subclause commented="no" id="H4766159E06834EF6BB0D432790BC4D89"><enum>(I)</enum><text>took affirmative steps to correct the internal records of such person with respect to such number; and</text>
 </subclause><subclause commented="no" id="HF76BFD15B0ED43D8B6C7B7E7F4AE3901"><enum>(II)</enum><text>reported to such database any inaccuracy that such person discovered with respect to such number in such database.</text>
 </subclause></clause></subparagraph><subparagraph id="HCE9E21FF75D44305B66BE8EBCD5CF09C"><enum>(D)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed to preclude the Commission from contracting with a private entity to provide the database required by subparagraph (A).</text>
 </subparagraph><subparagraph id="H316737639D824AF49C387937AE5E9B86"><enum>(E)</enum><header>Covered provider defined</header><text>In this paragraph, the term <quote>covered provider</quote> means a provider of voice service or text messaging service (as such terms are defined in subsection (e)(8)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H19472317CB294739863B772E89713A2D"><enum>(b)</enum><header>Clarification of definition of called party</header>
 <paragraph id="H7414D00062B44EB49A32E928FA147DD3"><enum>(1)</enum><header>In general</header><text>Section 227(a) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(a)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9AEC1DA808FA4A729D41D5123862CB7E" style="OLC">
 <paragraph id="H1FBEC79A57744C32A31D687C5E727A2B"><enum>(6)</enum><text display-inline="yes-display-inline">The term <quote>called party</quote> means, with respect to a call, the current subscriber of the telephone number to which the call is made, determined at the time when the call is made.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H70535BAE2CBB4F4AAD313D96F2FB58EE"><enum>(2)</enum><header>Conforming amendments</header><text>Section 227(d)(3)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(d)(3)(B)</external-xref>) is amended—</text> <subparagraph id="H56F3AEE00F9742029B252A803AD46D96"><enum>(A)</enum><text>by striking <quote>called party’s line</quote> each place it appears and inserting <quote>telephone line called</quote>; and</text>
 </subparagraph><subparagraph id="H7C627DDCB52044EEA71D80D7BC9852E8"><enum>(B)</enum><text>by striking <quote>called party has hung up</quote> and inserting <quote>answering party has hung up</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HD3653B55B15A4975903B01F57E00D870"><enum>(c)</enum><header>Deadline for regulations and establishment of database</header><text>Not later than 1 year after the date of the enactment of this Act, the Federal Communications Commission shall—</text>
 <paragraph id="HD56CD86F11F24362A14AE9BEFC18144E"><enum>(1)</enum><text display-inline="yes-display-inline">prescribe regulations to implement the amendments made by this section; and</text> </paragraph><paragraph id="H623D647D427549BBBA8DC8EA06055472"><enum>(2)</enum><text>establish the database required by such amendments.</text>
 </paragraph></subsection><subsection id="H4118C5306179472B8FF1E437F5B614D4"><enum>(d)</enum><header>Transitional rule regarding definition of covered provider</header><text>Subparagraph (E) of paragraph (4) of subsection (b) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as added by subsection (a) of this section, shall apply before the effective date of the amendment made to subsection (e)(8) of such section 227 by subparagraph (C) of section 503(a)(2) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) as if such amendment was already in effect.</text>
			</subsection></section><section id="H28969A8CD72B46B1848847C83F365800"><enum>5.</enum><header>Enforcement</header>
			<subsection id="H16926B612DA94A16BA4159548A0CC062"><enum>(a)</enum><header>No citation required To seek forfeiture penalty</header>
 <paragraph id="H8B7B44B10D1E402F93DF75F95BFA3FEC"><enum>(1)</enum><header>For robocall violations</header><text display-inline="yes-display-inline">Section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>), as amended by sections 2(b) and 4(a), is further amended by inserting after paragraph (4) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3B5FF4DD997D45AEA780A6792030E5BB" style="OLC">
 <paragraph id="H4234A056C46E4B6B8EE45ECD7C0D8860"><enum>(5)</enum><header>No citation required to seek forfeiture penalty</header><text display-inline="yes-display-inline">Paragraph (5) of section 503(b) shall not apply in the case of a violation of this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph><paragraph id="H72DCFAB726FC4D6E8297DF8A6C8B26DC"><enum>(2)</enum><header>For caller identification information violations</header><text display-inline="yes-display-inline">Section 227(e)(5)(A)(iii) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(5)(A)(iii)</external-xref>) is amended by adding at the end the following: <quote>Paragraph (5) of section 503(b) shall not apply in the case of a violation of this subsection.</quote>.</text>
				</paragraph></subsection><subsection id="HFEE8FDF629DC4194B3B5989368E7A382"><enum>(b)</enum><header>4-Year statute of limitations</header>
 <paragraph id="HFD578B6013BE47A8BA1572E451B3728E"><enum>(1)</enum><header>For robocall violations</header><text display-inline="yes-display-inline">Section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>), as amended by sections 2(b) and 4(a) and subsection (a)(1) of this section, is further amended by inserting after paragraph (5) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H65E427AA0E794E0AA497DC34A233524B" style="OLC">
 <paragraph id="HA63A6E588C704581AC29A47E67127772"><enum>(6)</enum><header>4-year statute of limitations</header><text display-inline="yes-display-inline">Notwithstanding paragraph (6) of section 503(b), no forfeiture penalty for violation of this subsection shall be determined or imposed against any person if the violation charged occurred more than 4 years prior to the date of issuance of the notice required by paragraph (3) of such section or the notice of apparent liability required by paragraph (4) of such section (as the case may be).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HE286A4807A7A4D3D93691973E162B52F"><enum>(2)</enum><header>For caller identification information violations</header><text display-inline="yes-display-inline">Section 227(e)(5)(A)(iv) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(5)(A)(iv)</external-xref>) is amended—</text> <subparagraph id="H73D85E57191046958F5DC27E725830BB"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="clause" style="OLC">2-year</header-in-text></quote> and inserting <quote><header-in-text level="clause" style="OLC">4-year</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="H1C7CEB38268D46BD9D9604C00015A20C"><enum>(B)</enum><text>by striking <quote>2 years</quote> and inserting <quote>4 years</quote>.</text> </subparagraph></paragraph></subsection></section><section id="H063BDBA8CCF04FF499037EC02A27AB91"><enum>6.</enum><header>Annual report to Congress</header><text display-inline="no-display-inline">Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H560A6CCEEFBF4BAEA815EAF183DE4232" style="OLC">
				<subsection id="H699C42A1CA4540FE8FE38877D4AC6179"><enum>(i)</enum><header>Annual report to Congress on robocalls and transmission of misleading or inaccurate caller
			 identification information</header>
 <paragraph id="H0D3C3BB16E2641A4B52AEEB233AAB0AB"><enum>(1)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of the <short-title>Stopping Bad Robocalls Act</short-title>, and annually thereafter, the Commission, after consultation with the Federal Trade Commission, shall submit to Congress a report regarding enforcement by the Commission of subsections (b), (d), and (e) during the preceding calendar year.</text>
 </paragraph><paragraph id="H0886901BF82B44A598A014C18CCEFDB6"><enum>(2)</enum><header>Matters for inclusion</header><text>Each report required by paragraph (1) shall include the following:</text> <subparagraph id="HD960FF50F1A34920988998083BAAE9BE"><enum>(A)</enum><text>The number of complaints received by the Commission during each of the preceding five calendar years, for each of the following categories:</text>
 <clause id="HB3467BB8783B4C1F9B2F208B64A0A5CA"><enum>(i)</enum><text display-inline="yes-display-inline">Complaints alleging that a consumer received a robocall in violation of subsection (b).</text> </clause><clause commented="no" id="H5E9670BC49D84645912067DA78DB1CAF"><enum>(ii)</enum><text display-inline="yes-display-inline">Complaints alleging that a consumer received a robocall in violation of the standards prescribed under subsection (d).</text>
 </clause><clause id="H0249CD4ECCAC47AE905A8A58E5F4FCE0"><enum>(iii)</enum><text>Complaints alleging that a consumer received a call in connection with which misleading or inaccurate caller identification information was transmitted in violation of subsection (e).</text>
 </clause></subparagraph><subparagraph id="H54C13D415C8B4547AE2759D51B3D80B2"><enum>(B)</enum><text display-inline="yes-display-inline">The number of citations issued by the Commission pursuant to section 503(b) during the preceding calendar year to enforce subsection (d), and details of each such citation.</text>
 </subparagraph><subparagraph id="HA759E97BB4A54D499909DCE01620B23E"><enum>(C)</enum><text display-inline="yes-display-inline">The number of notices of apparent liability issued by the Commission pursuant to section 503(b) during the preceding calendar year to enforce subsections (b), (d), and (e), and details of each such notice including the proposed forfeiture amount.</text>
 </subparagraph><subparagraph id="H04FA69409EF944EE8756EBBF2F8FE668"><enum>(D)</enum><text display-inline="yes-display-inline">The number of final orders imposing forfeiture penalties issued pursuant to section 503(b) during the preceding calendar year to enforce such subsections, and details of each such order including the total forfeiture imposed.</text>
 </subparagraph><subparagraph id="H25BAA260BD6E4E20806379EC6AE488D0"><enum>(E)</enum><text>The amount of forfeiture penalties or criminal fines collected, during the preceding calendar year, by the Commission or the Attorney General for violations of such subsections, and details of each case in which such a forfeiture penalty or criminal fine was collected.</text>
 </subparagraph><subparagraph id="H705C4264BCB1476D98296102EC0A0B4F"><enum>(F)</enum><text>Proposals for reducing by half the number of calls made in violation of such subsections.</text> </subparagraph><subparagraph id="H9453A1F444734057BED2679B7E1772D1"><enum>(G)</enum><text display-inline="yes-display-inline">An analysis of the contribution by providers of interconnected VoIP service and non-interconnected VoIP service that discount high-volume, short-duration calls to the total number of robocalls, and recommendations on how to address such contribution in order to decrease the total number of robocalls.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8FADD426958948319DB8F0001FC29DAF"><enum>7.</enum><header>Regulations relating to caller identification information authentication standards</header>
 <subsection id="H2B473A1042DA462A9AA1ACCF2B5FF167"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission shall prescribe regulations in WC Docket No. 17–97.</text>
			</subsection><subsection id="H07CF17DD722B44EA87853E87C8A95E23"><enum>(b)</enum><header>Requirements for caller identification information authentication technology</header>
 <paragraph id="HDDF2E4E24E304C2DBF483CBA88CDD253"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The regulations required by subsection (a) shall require providers of voice service to implement, by a date specified by the Commission, caller identification information authentication technology that has the ability to—</text>
 <subparagraph id="H1AB14CDD32E74CAA82D4AA1CADA98D4E"><enum>(A)</enum><text>verify that any caller identification information transmitted in connection with a call (including a call originating outside the United States if the recipient is within the United States) is—</text>
 <clause id="H5DFE5BF1EA3F480881A460582D6C0C9E"><enum>(i)</enum><text>accurate; or</text> </clause><clause id="H444E859AD8DF46F5B83E68F4BED55C8B"><enum>(ii)</enum><text>exempted under the regulations promulgated under paragraph (3) of section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) from the prohibition under paragraph (1) of such section; and</text>
 </clause></subparagraph><subparagraph id="H8CC3F26884C940259E9D7E70E064308B"><enum>(B)</enum><text>prevent a subscriber from receiving a call unless—</text> <clause id="HE6F243E68BCF405A925959839E98FA34"><enum>(i)</enum><text>any caller identification information transmitted in connection with such call is verified as described in subparagraph (A); or</text>
 </clause><clause id="HD137178A5234473D8202E986C013AFED"><enum>(ii)</enum><text display-inline="yes-display-inline">no caller identification information is transmitted in connection with such call, whether because a person has blocked the capability of a caller identification service to transmit such information in accordance with paragraph (2) of section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>) or otherwise.</text>
 </clause></subparagraph></paragraph><paragraph id="H577FAF57A5C94BEEB9BD9A922C09B339"><enum>(2)</enum><header>Unblocking requests</header><text>Such regulations shall require a provider of voice service to—</text> <subparagraph id="H34035C51AD5C4706B0589B16F313198D"><enum>(A)</enum><text display-inline="yes-display-inline">accept a request from a subscriber of such service, a calling party, or another provider of voice service for the caller identification information authentication technology required under paragraph (1) to allow the completion of a call in connection with which caller identification information is transmitted but not verified as described in subparagraph (A) of such paragraph; and</text>
 </subparagraph><subparagraph id="HEF5A02E388D84BA6A93E5C0656CC8BD9"><enum>(B)</enum><text>if such request meets criteria prescribed by the Commission in such regulations, grant such request.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H8703927C0458416BA3F4AEBCFED1A17D"><enum>(3)</enum><header>No additional cost to subscribers</header><text>Such regulations shall prohibit providers of voice service from making any additional charge to subscribers for the caller identification information authentication technology required under paragraph (1).</text>
 </paragraph></subsection><subsection id="H1EE590FD11C046DC84673E6A56FF501E"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H0C6218BED65C4146A3F45AB0BE8E4D86"><enum>(1)</enum><header>Caller identification information</header><text>The term <quote>caller identification information</quote> has the meaning given such term in section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H100BAE09F77D49A486B2174AAEC8AE82"><enum>(2)</enum><header>Caller identification service</header><text>The term <quote>caller identification service</quote> has the meaning given such term in section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>).</text>
 </paragraph><paragraph id="HF7552C00C27F4443AF1F4B995680A7AE"><enum>(3)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text> </paragraph><paragraph id="H60FA465D315E4D18BF8E59D38C383E92"><enum>(4)</enum><header>Voice service</header><text display-inline="yes-display-inline">The term <quote>voice service</quote> has the meaning given such term in section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>). This paragraph shall apply before the effective date of the amendment made to such section by subparagraph (C) of section 503(a)(2) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) as if such amendment was already in effect.</text>
