which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to expand the scope of practitioners eligible for payment for telehealth services under the Medicare program, and for other purposes.</official-title></form><legis-body id="H0CA9FB93DBC84CC99789AE7E3E34620E" style="OLC"><section id="H5F2A5CDE037D4AA88F5C56AE774DB5FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanded Telehealth Access Act</short-title></quote>. </text></section><section id="H126260AD6D21466E88434D17C74F63D8"><enum>2.</enum><header>Expanding the scope of practitioners eligible for payment for telehealth services under Medicare</header><subsection id="HC2DA00BE92D24BE5A5D122C89B238660"><enum>(a)</enum><header>Telehealth provider parity</header><text display-inline="yes-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H0C94ED45CCBB4B3BBCA45E52E5F1B8FC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="HAF941F111E59495B82E87FF03BFDDEA7"><enum>(A)</enum><text>by striking <quote>or a practitioner (described in section 1842(b)(18)(C))</quote> and inserting <quote>or a professional described in paragraph (4)(E))</quote>; and</text></subparagraph><subparagraph id="H3980DCAE19AC49D9A623FFD0918B7D4D"><enum>(B)</enum><text>by striking <quote>individual physician or practitioner</quote> and inserting <quote>individual physician or professional</quote>;</text></subparagraph></paragraph><paragraph id="H42CA305DFE524260A93FFE8BB1EDC0D5"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H5F0CC8D016394DB998E4ED2296AB8D26" commented="no"><enum>(A)</enum><text>by striking <quote>practitioner</quote> each place it appears and inserting <quote>professional</quote> each such place; </text></subparagraph><subparagraph id="HC307CE3A6FBC4F9CA5F26B9335C2F4EC"><enum>(B)</enum><text>by inserting before <quote>located at a distant site</quote> the following <quote>(or, in the case of an occupational therapy assistant described in paragraph (4)(E)(ii)(II) or a physical therapist assistant described in paragraph (4)(E)(ii)(II), shall pay with respect to such assistant)</quote>; and</text></subparagraph><subparagraph id="HF2B5F54CFABE4AA48A659AEB3DF1E2FD"><enum>(C)</enum><text>by inserting <quote>(or, in the case of an occupational therapy assistant described in paragraph (4)(E)(ii)(II) or a physical therapist assistant described in paragraph (4)(E)(ii)(II), the amount that would have been paid under this title with respect to such assistant)</quote> after <quote>would have been paid under this title</quote>;</text></subparagraph></paragraph><paragraph id="H9718980AD9BF4AB39994EE9F5DA5A7F6"><enum>(3)</enum><text>in paragraph (3)(A), by striking <quote>or practitioner</quote> and inserting <quote>or professional</quote>; and</text></paragraph><paragraph id="H319D893222194FD389B0D2B8D4126A65"><enum>(4)</enum><text>in paragraph (4)—</text><subparagraph id="H59359F9BB8CE47C5B2680DD3287C2E5B"><enum>(A)</enum><text>in each of subparagraphs (A) and (C), by striking <quote>or practitioner</quote> and inserting <quote>or professional</quote>; and </text></subparagraph><subparagraph id="H46EBFF092922491B92CA69A4AF41B130"><enum>(B)</enum><text>by amending subparagraph (E) to read as follows:</text><quoted-block style="OLC" id="H85FF85041B1441C8A7E6570E00DD1782" display-inline="no-display-inline"><subparagraph id="H8F71B59E4DE243FC851FCD9EC5777918"><enum>(E)</enum><header>Professional described</header><text display-inline="yes-display-inline">A professional described in this subparagraph is—</text><clause id="H8A62BC1C88ED4EB59574CDFEC770DD0C"><enum>(i)</enum><text>a practitioner described in section 1842(b)(18)(C); or</text></clause><clause id="HFEA2B7B34ED24FE0982C5B4FE671E8CE"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to services furnished on or after the date of enactment of the Expanded Telehealth Access Act, a licensed—</text><subclause id="H9339C72DD3FC4C39AE3323CFA9FAB129"><enum>(I)</enum><text>audiologist;</text></subclause><subclause id="HFEF1EBADF44149948988FF08554FCC93"><enum>(II)</enum><text>occupational therapist and occupational therapy assistant under the supervision of an occupational therapist;</text></subclause><subclause id="HF8E8C82B765F494385246E2A23AD7CA7"><enum>(III)</enum><text>physical therapist and physical therapist assistant under the supervision of a physical therapist;</text></subclause><subclause id="H7E0A9EAE2D364DBFA7AB2088A10695DD"><enum>(IV)</enum><text>speech language pathologist; </text></subclause><subclause id="H9BA47067E91B4A84B14A7778760790D0"><enum>(V)</enum><text>facility described in paragraph (8) or (9) of section 1833(a) that furnishes telehealth therapy services; and</text></subclause><subclause id="H6437E443411446519D96E7D47F9DE6D8"><enum>(VI)</enum><text>any additional health care provider, as specified by the Secretary, who participates under this title and furnishes a service that is included as a telehealth service under this subsection.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HEB661F4D70444F46951697617827412E"><enum>(b)</enum><header>Additional covered telehealth services</header><text>Section 1834(m)(4)(F)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)(i)</external-xref>) is amended by adding at the end the following new sentence: <quote>Such term shall include, audiology services (as defined in section 1861(ll)(3)) and outpatient therapy services (including such services furnished by a therapy assistant (as defined by the Secretary)), including physical therapy of the type described in section 1861(p), occupational therapy of the type that are described in section 1861(g), and speech-language pathology services of the type described in section 1861(ll)(2).</quote>.</text></subsection></section></legis-body></bill>
