R. 8381</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200924">September 24, 2020</action-date><action-desc><sponsor name-id="G000587">Ms. Garcia of Texas</sponsor> (for herself, <cosponsor name-id="W000826">Ms. Wild</cosponsor>, and <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit employers from asking the age or date of birth of an individual before the completion and submission of an application for employment by such individual.</official-title></form><legis-body id="H24E2736B67EF46D78197C263D6B718A4" style="OLC"><section id="H03C9D175366B472BBD41CF502C41ECEC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Older Job Applicants Act</short-title></quote> or the <quote><short-title>POJA Act</short-title></quote>.</text></section><section id="H7C665A4E3F4740BB982C8E47FAB39CE5"><enum>2.</enum><header>Prohibition against asking the age or date of birth before the completion and submission of the application for employment</header><text display-inline="no-display-inline">Section 4(a) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623(a)</external-xref>) is amended—</text><paragraph id="HA65AC87D1BF84D929807DF6E1C7E37A8"><enum>(1)</enum><text>in paragraph (2) by striking the <quote>or</quote> at the end, </text></paragraph><paragraph id="H055BA5A133F341B9B176A6F2C275DA09"><enum>(2)</enum><text>in paragraph (3) by striking the period at the end and inserting <quote>; or</quote>, and</text></paragraph><paragraph id="HCBBF31ED1C0643CAA8B1F7262C3AAE7B" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE8CFC9D0864D48CFAEA369DFB9C5C85E"><paragraph id="H141BF3EEA36D4EB287719F60BE5DAE08" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">to ask the age or date of birth of an individual before the completion and submission of an application for employment by such individual.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="HA49C134BB1B14C0AAA351D3F1CCA8F24" section-type="subsequent-section"><enum>3.</enum><header>Prohibition against limiting, segregating, or classifying applicants for employment</header><text display-inline="no-display-inline">Section 4(a)(2) of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623(a)(2)</external-xref>) is amended—</text><paragraph id="HA059E089434C4A019C13980B513BB69F" commented="no"><enum>(1)</enum><text>by inserting <quote>or applicants for employment</quote> after <quote>employees</quote>, and</text></paragraph><paragraph id="H7C9886594999463D852CDE528494831B"><enum>(2)</enum><text>by inserting <quote>or as an applicant for employment</quote> after <quote>employee</quote>.</text></paragraph></section><section id="H6B5F647CC4C2432A8D8B13176FF43A84"><enum>4.</enum><header>Damages for requesting the age or date of birth at the time of application</header><text display-inline="no-display-inline">Section 7 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626</external-xref>) is amended—</text><paragraph id="H6298B00170534443A6B21A726E9D8D53"><enum>(1)</enum><text>in subsection (b) by inserting <quote>, except where a remedy is provided in subsection (g)</quote> after <quote>of this section</quote>, and</text></paragraph><paragraph id="H0FC125AAAB154DD99F520AC56F9AF2C4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBB7BDC040808442689AFE4B1FB72E6A8"><subsection id="H5CC2857F7CDF44008F9AF1F5C48AA291"><enum>(g)</enum><text display-inline="yes-display-inline">The amount owing to an applicant for employment for a violation of paragraph (2) or (4) of section 4(a) shall be $5,000 in lieu of any other amounts owing under this Act for such violation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF4F0A629D85F43989042D390445D4595"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect 1 year after the date of the enactment of this Act.</text></section></legis-body></bill>
