		<official-title display="yes">To impose criminal sanctions on certain persons involved in international doping fraud
			 conspiracies, to provide restitution for victims of such conspiracies, and
			 to require sharing of information with the United States Anti-Doping
			 Agency to assist its fight against doping, and for other purposes.</official-title>

 <section id="HB174E353C29A469FA7B320C5C5FF9F3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rodchenkov Anti-Doping Act of 2019</short-title></quote>.</text> </section><section id="H19D4161992D64A8AA2794F668CABABA1"><enum>2.</enum><header>Definitions</header> <paragraph id="H65043FEEACC2439491093AD862894DBD"><enum>(1)</enum><header>Anti-doping organization</header><text>The term <term>anti-doping organization</term> has the meaning given the term in Article 2 of the Convention.</text>
 </paragraph><paragraph id="HB865D9D326594A0783C4FA1E0E76731A"><enum>(2)</enum><header>Athlete</header><text>The term <term>athlete</term> has the meaning given the term in Article 2 of the Convention.</text> </paragraph><paragraph id="H4F98D4572BC94BD98F66269A75239406"><enum>(3)</enum><header>Code</header><text>The term <term>Code</term> means the World Anti-Doping Code most recently adopted by WADA on March 5, 2003.</text>
 </paragraph><paragraph id="HCD60245A55A842A88D643C44AB837706"><enum>(4)</enum><header>Convention</header><text>The term <term>Convention</term> means the United Nations Educational, Scientific, and Cultural Organization International Convention Against Doping in Sport done at Paris October 19, 2005, and ratified by the United States in 2008.</text>
 </paragraph><paragraph id="H71ED7B7F19474B8DA61D4BBA037BF34F"><enum>(5)</enum><header>Major international sport competition</header><text>The term <quote>Major International Sport Competition</quote>—</text> <subparagraph id="HDC582F9399EC45EBB0ABB0B6257737AE"><enum>(A)</enum><text>means a competition—</text>
 <clause id="HE43B0E455E76449BA3FAE34D67315D6E"><enum>(i)</enum><text>in which one or more United States athletes and three or more athletes from other countries participate;</text>
 </clause><clause id="HA0CFB1FD3FD04E8E8C0C33F03981D45E"><enum>(ii)</enum><text>that is governed by the anti-doping rules and principles of the Code; and</text> </clause><clause id="H9E159EAAE08A47DDAB30D1212B03F0CE"><enum>(iii)</enum><text display-inline="yes-display-inline">in which—</text>
 <subclause display-inline="no-display-inline" id="H985081EF711F4370B21800751D6A7037"><enum>(I)</enum><text>the competition organizer or sanctioning body receives sponsorship or other financial support from an organization doing business in the United States; or</text>
 </subclause><subclause id="H8818132C324B47D0BA86FA5320358897"><enum>(II)</enum><text>the competition organizer or sanctioning body receives compensation for the right to broadcast the competition in the United States; and</text>
 </subclause></clause></subparagraph><subparagraph id="H9495626DFF544F5AA4A60FF611FE85AC"><enum>(B)</enum><text>includes a competition that is a single event or a competition that consists of a series of events held at different times which, when combined, qualify an athlete or team for an award or other recognition.</text>
 </subparagraph></paragraph><paragraph id="H3F4B4DF782294395B17E4D132C503D09"><enum>(6)</enum><header>Person</header><text>The term <term>person</term> means any individual, partnership, corporation, association, or other entity.</text> </paragraph><paragraph id="H27DE60A604D74402AD279928ED2EAB1F"><enum>(7)</enum><header>Prohibited method</header><text>The term <term>prohibited method</term> has the meaning given the term in Article 2 of the Convention.</text>
 </paragraph><paragraph id="HC0394FB62C1C4B9EAA6B7D29E7C83954"><enum>(8)</enum><header>Prohibited substance</header><text>The term <term>prohibited substance</term> has the meaning given the term in Article 2 of the Convention.</text> </paragraph><paragraph id="HC0767942978D47FD9EC4A03688183851"><enum>(9)</enum><header>Scheme in commerce</header><text>The term <term>scheme in commerce</term> means any scheme effectuated in whole or in part through the use in interstate or foreign commerce of any facility for transportation or communication.</text>
 </paragraph><paragraph id="H93A6CDBE2C724AF2B1F719B34363BBF3"><enum>(10)</enum><header>USADA</header><text>The term <term>USADA</term> means the United States Anti-Doping Agency.</text> </paragraph><paragraph id="HF171F367252E4371A4F09046A3B68C15"><enum>(11)</enum><header>WADA</header><text>The term <term>WADA</term> means the World Anti-Doping Agency.</text>
			</paragraph></section><section id="H24D4CE1173974C1D9EC1C72414C8FA94"><enum>3.</enum><header>Major international doping fraud conspiracies</header>
 <subsection id="H2D599CEE86C644009B325D4AB68B3E98"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for any person, other than an athlete, to knowingly carry into effect, attempt to carry into effect, or conspire with any other person to carry into effect a scheme in commerce to influence by use of a prohibited substance or prohibited method any major international sports competition.</text>
 </subsection><subsection id="H6E6D5A9594194E908E2D781C8B22780A"><enum>(b)</enum><header>Extraterritorial jurisdiction</header><text>There is extraterritorial Federal jurisdiction over an offense under this section.</text> </subsection></section><section id="H6A74EAFF4ABB4CC8BA16DA50B84A85C0"><enum>4.</enum><header>Criminal penalties and statute of limitations</header> <subsection id="HEA3515D0EC5D4210BD6882CD3CF35F7B"><enum>(a)</enum><header>In general</header> <paragraph id="H333ECA729FDE4DCBAE767352468B83E4"><enum>(1)</enum><header>Criminal penalty</header><text>Whoever violates section 3 shall be sentenced to a term of imprisonment for not more than 10 years, fined $250,000 if the person is an individual or $1,000,000 if the defendant is other than an individual, or both.</text>
 </paragraph><paragraph id="H05DDFA173D594E49B2564CE18AE04454"><enum>(2)</enum><header>Forfeiture</header><text display-inline="yes-display-inline">Any property real or personal, tangible or intangible, may be seized and criminally forfeited to the United States if that property—</text>
 <subparagraph id="HCC2A3BDB509A4F21AFDE026C961FA42C"><enum>(A)</enum><text>is used or intended to be used, in any manner, to commit or facilitate a violation of section 3; or</text> </subparagraph><subparagraph id="H5A4EB09010824D01B2D0E30C8F995017"><enum>(B)</enum><text display-inline="yes-display-inline">constitutes or is traceable to the proceeds taken, obtained, or retained in connection with or as a result of a violation of section 3.</text>
					</subparagraph></paragraph></subsection><subsection id="H3631AD9364F848F0894460AED81BEBB6"><enum>(b)</enum><header>Limitation on prosecution</header>
 <paragraph id="H3FD0309106D64DC8BE4C3A0FECB285E2"><enum>(1)</enum><header>In general</header><text>No person shall be prosecuted, tried, or punished for violation of section 3 unless the indictment is returned or the information is filed within 10 years after the date on which the offense was completed.</text>
 </paragraph><paragraph id="H82E21E8E8B4B4284A5E889E681B0DE82"><enum>(2)</enum><header>Tolling</header><text>Upon application in the United States, filed before a return of an indictment, indicating that evidence of an offense under this chapter is in a foreign country, the district court before which a grand jury is impaneled to investigate the offense shall suspend the running of this statute of limitation for the offense if the court finds by a preponderance of the evidence that an official request has been made for such evidence and that it reasonably appears, or reasonably appeared at the time the request was made, that such evidence is, or was, in such foreign country.</text>
 </paragraph></subsection></section><section id="HDC263B3E85B14C71B642E0BE59737FB8"><enum>5.</enum><header>Restitution</header><text display-inline="no-display-inline">Section 3663A of title 18, United States Code, is amended in subsection (c)—</text> <paragraph id="H6E3CBAB34ED04D40AD5739A365626930"><enum>(1)</enum><text>in paragraph (1)(A)—</text>
 <subparagraph id="HF4BCCE86C17145199BBE39D3E3741B63"><enum>(A)</enum><text>by redesignating clauses (iii) and (iv) as clauses (iv) and (v), respectively; and</text> </subparagraph><subparagraph id="H65B77F21A96C407B91F9D6D5DB1B6D4F"><enum>(B)</enum><text>by inserting after clause (ii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H89F37D85FEEC4207868E91538121419C" style="OLC">
 <clause id="H0582F25F182241088913D0E248330BD3"><enum>(iii)</enum><text>an offense described in section 3 of the <short-title>Rodchenkov Anti-Doping Act of 2019</short-title>;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HA2539432FD9148F79B5480531F3E9E1F"><enum>(2)</enum><text>in paragraph (3), in the matter preceding subparagraph (A), by inserting <quote>or (iii)</quote> after <quote>paragraph (1)(A)(ii)</quote>.</text>
 </paragraph></section><section id="H6508C4EDB1A64483BF81ABAFFA2FA46F"><enum>6.</enum><header>Coordination and sharing of information with USADA</header><text display-inline="no-display-inline">Except as otherwise prohibited by law and except in cases in which the integrity of a criminal investigation would be affected, in furtherance of the obligation of the United States under Article 7 of the Convention, the Department of Justice, the Department of Homeland Security, and the Food and Drug Administration shall coordinate with USADA with regard to any investigation related to a potential violation of section 3 of this Act, to include sharing with USADA all information in the possession of the Department of Justice, the Department of Homeland Security, or the Food and Drug Administration which may be relevant to any such potential violation.</text>
 </section><section id="H170B4972B6004035B0F2AF2103A6A413"><enum>7.</enum><header>Determination of Budgetary Effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, and the amendments made by this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text>
