which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide automatic forgiveness for paycheck protection program loans under $150,000, and for other purposes.</official-title></form><legis-body id="H2EFF5C56FE6F4E06B71CA167C0C02BF3" style="OLC"><section id="H4E7053F77DE14E79A2735718BD30EA11" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paycheck Protection Small Business Forgiveness Act</short-title></quote>.</text></section><section id="HC0693B2C2EA44662B9F4E706964AACE2"><enum>2.</enum><header>Loan forgiveness for PPP loans under $150,000</header><text display-inline="no-display-inline">Section 1106 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) is amended—</text><paragraph id="H20BD3C12894D484ABB8E26ABBA73B46D"><enum>(1)</enum><text>in subsection (e), in the matter preceding paragraph (1), by striking <quote>An eligible</quote> and inserting <quote>Except as provided in subsection (m), an eligible</quote>;</text></paragraph><paragraph id="H6FE6EF49BAEC4F99AC5A494AB751E65C"><enum>(2)</enum><text>in subsection (f), by inserting <quote>or the information required under subsection (m), as applicable</quote> after <quote>subsection (e)</quote>; </text></paragraph><paragraph id="HE4711B7EE4A44517964F5D08B157D3F9"><enum>(3)</enum><text>by striking subsection (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB808959FFEC149388A6A22EE4F23D2F4"><subsection id="H26607A2ED0F84F4CAB4CAE267ACBA1DB"><enum>(h)</enum><header>Hold harmless</header><paragraph id="H647BE6A0856349F88B3566FE08AB036F"><enum>(1)</enum><header>In general</header><text>A lender may rely on all certifications and documentation submitted by an applicant or eligible recipient pursuant to any requirement in statute regarding covered loans, or rules or guidance promulgated to carry out any action relating to covered loans, from an applicant or eligible recipient attesting that the applicant or eligible recipient has accurately verified all documentation provided to the lender.</text></paragraph><paragraph id="H602EE97719DD4B0CA3A1F5A3A2446F48"><enum>(2)</enum><header>No enforcement action</header><text>With respect to a lender that relies on the certifications and documentation described in paragraph (1)—</text><subparagraph id="HA60FBC87D41B47728D6317545FB63B8C"><enum>(A)</enum><text>no enforcement or other action may be taken against the lender relating to loan origination, forgiveness, or guarantee based on such reliance, including claims under—</text><clause id="HFBD692EE808B4225A0F0CDB362148534"><enum>(i)</enum><text>the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> et seq.);</text></clause><clause id="H3E124CBA69654A0D906A7871DB6CC83F"><enum>(ii)</enum><text>sections 3729 through 3733 of title 31, United States Code (commonly known as the <quote>False Claims Act</quote>);</text></clause><clause id="H157FF60C14584B80ADB9C97A8F931F3C"><enum>(iii)</enum><text>the Financial Institutions Reform, Recovery, and Enforcement Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/73">Public Law 101–73</external-xref>);</text></clause><clause id="H43968D172E4045D2846C1AF75039B0FD"><enum>(iv)</enum><text>section 21 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829b">12 U.S.C. 1829b</external-xref>), chapter 2 of title I of <external-xref legal-doc="public-law" parsable-cite="pl/91/508">Public Law 91–508</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/12/1951">12 U.S.C. 1951</external-xref> et seq.), and subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code (collectively known as the <quote>Bank Secrecy Act</quote>); or</text></clause><clause id="H60C84491BA664445AE14E7AB0BBF801C"><enum>(v)</enum><text>any other Federal, State, or other criminal or civil law or regulation; and</text></clause></subparagraph><subparagraph id="HE400BF8B256D431FB2A9884865146AEE"><enum>(B)</enum><text>the lender shall not be subject to any penalties relating to loan origination, forgiveness, or guarantee based on such reliance.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H098EAECC13AB4671BBAB9B2785D802C3"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HC7C9A748C1454BC6B8052A4B9066E6C6"><subsection id="H7497B5E024C547998276610278564578"><enum>(m)</enum><header>Forgiveness for covered loans under $150,000</header><paragraph id="H0C015947280444FF9E7FE45533ECCDAB"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (e), with respect to a covered loan made to an eligible recipient that is not more than $150,000, the covered loan amount shall be forgiven under this section if the eligible recipient submits to the lender a one-page online or paper form, to be established by the Administrator, that attests that the eligible recipient complied with the requirements under section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>). Covered individuals (defined under section 4019 of this Act) are not eligible for forgiveness under this subsection. </text></paragraph><paragraph id="HB1DEEBD50A4A409C942F61A902D6882C"><enum>(2)</enum><header>Hold harmless</header><text>With respect to a lender that relies on an attestation submitted by an eligible recipient under paragraph (1), no enforcement action may be taken against the lender for any falsehoods contained in the attestation.</text></paragraph><paragraph id="H5F28E1CFB3604FB5AEBF033FCB8FA2DB"><enum>(3)</enum><header>Demographic information</header><text>The online or paper form established by the Administrator under paragraph (1) shall include a means by which an eligible recipient may, at the discretion of the eligible recipient, submit demographic information of the owner of the eligible recipient, including the sex, race, ethnicity, and veteran status of the owner.</text></paragraph><paragraph id="HF1F6FDC243424CF3930ACEF7D2A0A1DE"><enum>(4)</enum><header>Expenditure information</header><text display-inline="yes-display-inline">The form established by the Administrator under paragraph (1) shall include a process by which an eligible recipient may elect to submit information about the use of the covered loan, including indication of whether the eligible recipient—</text><subparagraph id="HEB253C430437428E8CE8B13D08A2537B"><enum>(A)</enum><text display-inline="yes-display-inline">used 60 percent or more of the covered loan amount for payroll costs as defined in section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>);</text></subparagraph><subparagraph id="HA32323AE7D6647608C0ABA069D6E860B"><enum>(B)</enum><text display-inline="yes-display-inline">used less than 60 percent of the covered loan amount for payroll costs but is able to document an inability to hire or rehire employees as described under subsection (d)(7)(A); or</text></subparagraph><subparagraph id="H83617981939D431893B19D55639FB416"><enum>(C)</enum><text display-inline="yes-display-inline">used less than 60 percent of the covered loan amount for payroll costs but is able to document an inability to return to the same level of business activity as described under subsection (d)(7)(B).</text></subparagraph></paragraph></subsection><subsection id="HA2CE63E144FE4DA8B98E58CEB3AF9CA7"><enum>(n)</enum><header>Enforcement action against borrowers</header><text>An eligible recipient of a covered loan may only be subject to an enforcement action or penalty relating to loan origination, forgiveness, or guarantee of the covered loan if the eligible recipient commits fraud or expends covered loan proceeds on expenses that are not allowable under section 7(a)(36)(F) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(F)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
