<official-title display="yes">To limit the price of insulin drugs accessible for participants, beneficiaries, and enrollees enrolled in group or individual health insurance coverage and group health plans and for uninsured individuals who have diabetes, and for other purposes.</official-title>

<section id="H8D1ACDA1BF3F491B8029B9E894932EB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Matt’s Act</short-title></quote>.</text></section> <section id="H6E15AD44E7A64FFDA09B3652AC345119"><enum>2.</enum><header>Insulin net price protection</header> <subsection id="HF2622C3E1D2A4B85AC2A67CD00BCEEF3"><enum>(a)</enum><header>Publishing of net price by manufacturers</header> <paragraph id="HBD91BB35F97E4E85807ABD3CE460F742"><enum>(1)</enum><header>In general</header><text>A manufacturer of an insulin drug shall, on a quarterly basis, publish on the internet website of such manufacturer the average net price of each such insulin drug for the preceding calendar quarter.</text></paragraph>
<paragraph id="H5F02788CAA874634AB9AFD6F121F2480"><enum>(2)</enum><header>Enforcement</header><text>In the case that a manufacturer of an insulin drug fails to comply with paragraph (1), a Federal agency or program may not make payment for such insulin drug of such until such manufacturer complies with such paragraph.</text></paragraph></subsection> <subsection id="H7D28343F0F4F40B0A4994A13E38899E2"><enum>(b)</enum><header>Net price for insulin drugs for certain individuals</header> <paragraph id="HA68CA24CA5B84684A19283D528E853F7"><enum>(1)</enum><header>Application to PHSA plans</header><text>Subpart 1 of part A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg</external-xref> et seq.) is amended by adding at the end the following new section:</text>

<section id="H07932E0F681540E1A349D5224DB565E1"><enum>2730.</enum><header>Net price for insulin drugs</header>
<subsection id="HD3131A0094A34265853A2D82DAB50FB2"><enum>(a)</enum><header>Availability of net price</header><text display-inline="yes-display-inline">With respect to plan years beginning on and after January 1, 2021, a health insurance issuer offering group or individual health insurance coverage shall provide a participant, beneficiary, or enrollee who has diabetes access to an insulin drug at—</text> <paragraph id="H6D0C3B69B5834B6587F8778AE0D91DA0"><enum>(1)</enum><text>the lesser of—</text>
<subparagraph id="H247C2054F61C4D15AA0759A33139DCC3"><enum>(A)</enum><text display-inline="yes-display-inline">the 10 percent of the average net price for such drug published pursuant to section 2(a) of Matt’s Act, plus the average charges for distribution and dispensing described in subsection (c) for such drug;</text></subparagraph> <subparagraph id="H24F925EF6A434A42A853AB238CC875DF"><enum>(B)</enum><text display-inline="yes-display-inline">the coinsurance amount for an insulin drug under the health insurance coverage under which such an individual is a participant, beneficiary, or enrollee would otherwise be responsible notwithstanding this section; or</text></subparagraph>
<subparagraph id="H743EEAC471F64E29BF4CC62EBCA4B86A"><enum>(C)</enum><text>$20; or</text></subparagraph></paragraph> <paragraph id="HC9F8810E2E4045638806E222742EEA55"><enum>(2)</enum><text display-inline="yes-display-inline">$0, in the case such a participant, beneficiary, or enrollee is enrolled in a high deductible health plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/223">section 223(c)(2)</external-xref> of the Internal Revenue Code of 1986).</text></paragraph></subsection>
<subsection id="H1912D919FD36437C9E4EB27432CC8601"><enum>(b)</enum><header>Waiver of deductible</header><text display-inline="yes-display-inline">In applying subsection (a), such a participant, beneficiary, or enrollee shall have access to an insulin drug without regard to a deductible.</text></subsection> <subsection id="H21282F4BB8314A43AA1690AF9B1BB8CB"><enum>(c)</enum><header>Charges for distributing and dispensing</header> <paragraph id="H9A725C0435F54322985F823338710514"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), charges for distribution and dispensing described in this subsection—</text>
<subparagraph id="H531B91D054334C10B144313C0E1D8979"><enum>(A)</enum><text>are charges associated with the transactions, with respect to an insulin drug, between wholesalers, distributors, retailers, and pharmacies; and</text></subparagraph> <subparagraph id="H9A23F0FAE3FC4BA9B260FAB789AAA1DC"><enum>(B)</enum><text>may not exceed 10 percent of the average net price of such an insulin drug.</text></subparagraph></paragraph>
<paragraph id="H7EE2DE854D0744A697E8684A15FEEA58"><enum>(2)</enum><header>Reporting requirement for plans</header><text display-inline="yes-display-inline">In the case that a health insurance issuer offering group or individual health insurance coverage charges a participant, beneficiary, or enrollee for average charges for distribution and dispensing pursuant to subsection (a)(1), the health insurance issuer shall submit to the Inspector General of the Department of Health and Human Services information with respect to such charges and the amount of the charges.</text></paragraph> <paragraph id="H2817A1822C8046469FEDE133586EB906"><enum>(3)</enum><header>Report to Congress by Inspector General</header><text>Beginning January 1, 2022, and annually thereafter, the Inspector General shall review the charges described in paragraph (2) and submit to Congress a report on such on review.</text></paragraph></subsection>
<subsection id="H8275D84F89F045CF98BEA4B5EB61592C"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H2CF4BF8A2C0048FAB078A8F67AD2389E"><enum>(1)</enum><header>Insulin</header> <subparagraph id="HDCB297FDAC6B40879077DF56E8FD61B5"><enum>(A)</enum><header>In general</header><text>The term <quote>insulin</quote> means a prescription drug containing insulin that is approved by the Food and Drug Administration to improve glycemic control in patients with diabetes mellitus (and may include any medical supplies included with such drug or associated with the injection of such drug).</text></subparagraph>
<subparagraph id="HDB308A3323A04F098C0D4F94FDE36916"><enum>(B)</enum><header>Exclusion</header><text>Such term does not include any medical supplies that provides for the monitoring of insulin levels.</text></subparagraph></paragraph> <paragraph id="HDE60EC1E02C540D2A3D71B4EC3B78158"><enum>(2)</enum><header>List price</header><text display-inline="yes-display-inline">The term <quote>list price</quote> has the meaning given the term wholesale acquisition cost in section 1847A(c)(6)(B) of the Social Security Act.</text></paragraph>
<paragraph id="HA646C1E78A35451EAE4EE8C50A650DBF" commented="no"><enum>(3)</enum><header>Net price</header><text display-inline="yes-display-inline">The term <quote>net price</quote> means, with respect to prescription drug coverage under group or individual health insurance coverage offered by a health insurance issuer, the list price of the drug net all rebates, discounts, concessions, and other adjustments applied to the cost paid by the health insurance issuer, or by any other entity that provides pharmacy benefit management services under a contract with any such health insurance issuer, regardless of whether such adjustments are prospective or retrospective.</text></paragraph> <paragraph id="H1342231A8CA8479C92C1451C5E468AA3"><enum>(4)</enum><header>Prescription drug</header><text display-inline="yes-display-inline">The term <quote>prescription drug</quote> mean a drug, as defined in section 201(g) of the Federal Food, Drug, and Cosmetic Act, that is subject to section 503(b)(1) of such Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H5DD9D33B9A49449DBF41AE3A6D92F54A"><enum>(2)</enum><header>Application to ERISA plans</header><text>Subpart A of part 7 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185</external-xref> et seq.) is amended by adding at the end the following new section (and amending the table of contents accordingly):</text> <quoted-block style="OLC" id="H138A47B48FB445888D46024096B82931" display-inline="no-display-inline"> <section id="H3AD00EFAE8D64987927E6311DA94005A"><enum>704.</enum><header>Net price for insulin drugs</header> <subsection id="H14637D4ADDD34B4E80403633C2E165BB"><enum>(a)</enum><header>Availability of net price</header><text display-inline="yes-display-inline">With respect to plan years beginning on and after January 1, 2021, a group health plan shall provide a participant, beneficiary, or enrollee who has diabetes access to an insulin drug at—</text>
<paragraph id="HDA67430F643F4D0E92641F3E06BDC006"><enum>(1)</enum><text>the lesser of—</text> <subparagraph id="H6120FB8E503D46FAA8BC16E5EA062C78"><enum>(A)</enum><text display-inline="yes-display-inline">the 10 percent of the average net price for such drug published pursuant to section 2(a) of Matt’s Act, plus the average charges for distribution and dispensing described in subsection (c) for such drug;</text></subparagraph>
<subparagraph id="H552F0141E7C24CE988645857EFC80D24"><enum>(B)</enum><text display-inline="yes-display-inline">the coinsurance amount for an insulin drug under the group health plan which such an individual is a participant, beneficiary, or enrollee would otherwise be responsible notwithstanding this section; or</text></subparagraph> <subparagraph id="HC7C508C745164F0D8708650EC7F20B76"><enum>(C)</enum><text>$20; or</text></subparagraph></paragraph>
<paragraph id="HC7ADFE8B3A7446F8BE37111208D71E3C"><enum>(2)</enum><text display-inline="yes-display-inline">$0, in the case such a participant, beneficiary, or enrollee is enrolled in a high deductible health plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/223">section 223(c)(2)</external-xref> of the Internal Revenue Code of 1986).</text></paragraph></subsection> <subsection id="H7855F1C9E39A4891B4CDEE3FF1434EBC"><enum>(b)</enum><header>Waiver of deductible</header><text display-inline="yes-display-inline">In applying subsection (a), such a participant, beneficiary, or enrollee shall have access to an insulin drug without regard to a deductible.</text></subsection>
<subsection id="H053CB342E65048AF90D466BF1EC98415"><enum>(c)</enum><header>Charges for distributing and dispensing</header>
<paragraph id="H337810B4D56D49B4B3915F9A574F1050"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), charges for distribution and dispensing described in this subsection—</text> <subparagraph id="H20955B4BDA684B12A0FFFBFCFC04C062"><enum>(A)</enum><text>are charges associated with the transactions, with respect to an insulin drug, between wholesalers, distributors, retailers, and pharmacies; and</text></subparagraph>
<subparagraph id="HCDDA1A8CDF2A46EB8EA1ABE95A90BF32"><enum>(B)</enum><text>may not exceed 10 percent of the average net price of such an insulin drug.</text></subparagraph></paragraph> <paragraph id="H310DC890BD2C4755847F9F5EA405EC81"><enum>(2)</enum><header>Reporting requirement for plans</header><text display-inline="yes-display-inline">In the case that a group health plan charges a participant, beneficiary, or enrollee for average charges for distribution and dispensing pursuant to subsection (a)(1), the group health plan shall submit to the Inspector General of the Department of Health and Human Services information with respect to such charges and the amount of the charges.</text></paragraph>
<paragraph id="H5157DA3698CF4C659A681A1DE9B6545A"><enum>(3)</enum><header>Report to Congress by Inspector General</header><text>Beginning January 1, 2022, and annually thereafter, the Inspector General shall review the charges described in paragraph (2) and submit to Congress a report on such on review.</text></paragraph></subsection> <subsection id="H93C6B10FB7A64ABAB8C7A1CB4181E7E2"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>

<paragraph id="H8DB1C00F8B524698AB1234A438C77B43"><enum>(4)</enum><header>Prescription drug</header><text display-inline="yes-display-inline">The term <quote>prescription drug</quote> mean a drug, as defined in section 201(g) of the Federal Food, Drug, and Cosmetic Act, that is subject to section 503(b)(1) of such Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HC77C0DD3D4CB4E4DA41411AD50ADCF6B"><enum>(3)</enum><header>Uninsured individuals</header> <subparagraph id="H312AA51D259A4767A467F97AF5BE8B06"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on and after January 1, 2021, a pharmacy shall provide to any individual who has diabetes and is not enrolled in any health plan access to an insulin drug at the average net price for such drug published pursuant to subsection (a), plus the average charges for the distribution and dispensing described in subparagraph (C) for such drug.</text></subparagraph>
<subparagraph id="H750CB3D101DF45BA8256F40D0C7B582F"><enum>(B)</enum><header>Review of charges</header><text display-inline="yes-display-inline">Beginning January 1, 2022, and annually thereafter, the Inspector General of the Department of Health and Human Services shall review the amount of charges paid by an individual described in subparagraph (A) and submit to Congress a report on such review.</text></subparagraph> <subparagraph id="H5510884E55E548BAAEE30717498E591B"><enum>(C)</enum><header>Charges for distributing and dispensing</header><text>For purposes of subparagraph (A), charges for distribution and dispensing described in this subsection—</text>
<clause id="H01C3B76F7B6841F78F493076192B2B62"><enum>(i)</enum><text>are charges associated with the transactions, with respect to an insulin drug, between wholesalers, distributors, retailers, and pharmacies; and</text></clause> <clause id="HD34D90765FE64051AC67865C491A1AAF"><enum>(ii)</enum><text>may not exceed 10 percent of the average net price of such an insulin drug.</text></clause></subparagraph>
<subparagraph id="H664F0DB4455E41DCAB7565BCBC45BC47" display-inline="no-display-inline"><enum>(D)</enum><header>Definitions</header><text>In this section:</text> <clause id="H3C8B8CDB0FDD43E997C00FFE79827200"><enum>(i)</enum><header>Insulin</header> <subclause id="H5D411893829140B7B7279A302C93308A"><enum>(I)</enum><header>In general</header><text>The term <quote>insulin</quote> means a prescription drug containing insulin that is approved by the Food and Drug Administration to improve glycemic control in patients with diabetes mellitus (and may include any medical supplies included with such drug or associated with the injection of such drug).</text></subclause>
<subclause id="H192BB9DE982B4CEC993175FCD9BF88ED"><enum>(II)</enum><header>Exclusion</header><text>Such term does not include any medical supplies that provides for the monitoring of insulin levels.</text></subclause></clause> <clause id="HEF87945B42684820B699624B7EA7B9CA" display-inline="no-display-inline"><enum>(ii)</enum><header>List price</header><text display-inline="yes-display-inline">The term <quote>list price</quote> has the meaning given the term wholesale acquisition cost in section 1847A(c)(6)(B) of the Social Security Act (42 U.S.C. 1395w–3a(c)(6)(B)).</text></clause>
<clause id="H1689D0D23D5B4FCA9636B90364FB15E1" commented="no"><enum>(iii)</enum><header>Net price</header><text display-inline="yes-display-inline">The term <quote>net price</quote> means, with respect to prescription drug coverage under a group health plan, the list price of the drug net all rebates, discounts, concessions, and other adjustments applied to the cost paid by the group health plan, or by any other entity that provides pharmacy benefit management services under a contract with any such group health plan, regardless of whether such adjustments are prospective or retrospective.</text></clause> <clause id="HFC469BE2175E45F99E16E62C96FD02AD"><enum>(iv)</enum><header>Prescription drug</header><text display-inline="yes-display-inline">The term <quote>prescription drug</quote> mean a drug, as defined in section 201(g) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(g)</external-xref>), that is subject to section 503(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(b)(1)</external-xref>).</text></clause></subparagraph></paragraph></subsection></section>
