R. 7663</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200716">July 16, 2020</action-date><action-desc><sponsor name-id="T000460">Mr. Thompson of California</sponsor> (for himself, <cosponsor name-id="M001163">Ms. Matsui</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="S001183">Mr. Schweikert</cosponsor>, and <cosponsor name-id="W000800">Mr. Welch</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XI of the Social Security Act to authorize the Secretary of Health and Human Services to waive or modify application of Medicare requirements with respect to telehealth services during any emergency period, and for other purposes.</official-title></form><legis-body id="H918D4C0059A54BFAB36B9ECBE508760A" style="OLC"><section id="H74B8B2C86AA04DA1A2A72D5190839A29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Access to Post-COVID–19 Telehealth Act of 2020</short-title></quote>.</text></section><section id="H013C3A09F3594BC2A455A46A6A982B74"><enum>2.</enum><header>Authorization for the Secretary of Health and Human Services to waive or modify application of Medicare requirements with respect to telehealth services</header><subsection id="H2BED4CE3DA5A4CE29A4A19E187006293"><enum>(a)</enum><header>Secretarial authority to temporarily waive or modify Medicare requirements with respect to telehealth services furnished during any emergency period</header><text display-inline="yes-display-inline">Section 1135 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HE51A377AD88E415E96AC1B5253FC595B" display-inline="no-display-inline"><subsection id="HEDD4D9D03E60458EA774B326C1B438F3"><enum>(h)</enum><header>Waiver or modification of certain requirements with respect to telehealth services</header><paragraph id="HEBFC8C3B869042DC887B7883CA1CF236"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section, during the period described paragraph (2), the Secretary may waive or modify any requirement with respect to a telehealth service payable under section 1834(m)(1) for such period.</text></paragraph><paragraph id="H7E1C1DAC95204220A328DE1D03C2CC19"><enum>(2)</enum><header>Period described</header><text>For purposes of paragraph (1), the period described in this paragraph is the period—</text><subparagraph id="H5477D289D72245F4936C961E90EC04EE"><enum>(A)</enum><text>beginning on the first day of—</text><clause id="HB32B4EF8109C4547A61A65188B3F9347"><enum>(i)</enum><text display-inline="yes-display-inline">an emergency or disaster declared by the President pursuant to the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act; or</text></clause><clause id="H3E537E91AD824ED399732A7B5F91EFB0"><enum>(ii)</enum><text>a public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act; and</text></clause></subparagraph><subparagraph id="H7974AFC271804222BF8DA963B193E17A"><enum>(B)</enum><text>ending on the day that is 90 days after the last day of an emergency, disaster, or public health emergency described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEFE1A86AB4D240E8BAE630A0D7780728"><enum>(b)</enum><header>Report</header><paragraph id="H45ED3B0D6E3C44F79FCE883BED713CC7"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the last day of the period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>), the Secretary of Health and Human Services, acting through the Administrator of the Centers for Medicare &amp; Medicaid Services, shall submit to Congress a report, with respect to telehealth services (as defined in subparagraph (F) of such section 1834(m)(4) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>) to which a waiver or modification is applied pursuant to section 1135 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5</external-xref>), on—</text><subparagraph id="HD50155308C6548629937D1D73A17BFB4"><enum>(A)</enum><text display-inline="yes-display-inline">the number of eligible telehealth individuals (as defined in subparagraph (A) of section 1834(m)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>) during the period described in paragraph (2) and how frequently such individuals received telehealth services during such period (including the number of eligible telehealth individuals identified by racial and ethnic populations);</text></subparagraph><subparagraph id="H4DDFB7E68C2346F8AF659C886A50DE3C"><enum>(B)</enum><text display-inline="yes-display-inline">the number of physicians or practitioners that furnished a telehealth service during the period described in paragraph (2) and how frequently physicians or practitioners furnished such a service during such period;</text></subparagraph><subparagraph id="H0A3C94D72D5E49A4B903CF6097CFC469"><enum>(C)</enum><text display-inline="yes-display-inline">the amount payable under title XVIII of such Act for telehealth services furnished during the period described in paragraph (2);</text></subparagraph><subparagraph id="H5878AAC16207441094FEA3CD154DEBC6"><enum>(D)</enum><text display-inline="yes-display-inline">an assessment of benefits to eligible telehealth individuals who received telehealth services during the period described in paragraph (2); and</text></subparagraph><subparagraph id="H00C3206EDB734B8C884D82A23DE7F4F5"><enum>(E)</enum><text display-inline="yes-display-inline">the most common barriers to eligible telehealth individuals receiving and physicians or practitioners furnishing telehealth services during the period described in paragraph (2).</text></subparagraph></paragraph><paragraph id="HE72A95C1E6F34D8A969B3A28D1CF497A"><enum>(2)</enum><header>Period described</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the period described in this paragraph is the period—</text><subparagraph id="H01128F8323B44482838D6D9E83F03C28"><enum>(A)</enum><text>beginning on the first day of the emergency period described in section 1135(g)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>; and</text></subparagraph><subparagraph id="H34B4783DEC1646608C52EE071D0D58B7"><enum>(B)</enum><text display-inline="yes-display-inline">ending on the day that is 90 days after the last day such emergency period.</text></subparagraph></paragraph></subsection></section><section id="H2C36109EA89041EB95E9A17D8D232665" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Rural health clinics and federally qualified health centers</header><subsection id="H562F3805CB5140FCACDACFD3FEBA86D4"><enum>(a)</enum><header>Expansion of distant sites</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="HACB98AF039104D949075FFB0028F32C4"><enum>(1)</enum><text>in the first sentence of paragraph (1)—</text><subparagraph id="H02C3F7156DAF4FFD8E1D0A7C7C2452EB"><enum>(A)</enum><text>by striking <quote>or a practitioner (described in section 1842(b)(18)(C))</quote> and inserting <quote>, a practitioner (described in section 1842(b)(18)(C)), a federally qualified health center, or a rural health clinic</quote>; and</text></subparagraph><subparagraph id="H7A33AF9A527C45EB97248571AB4488A6"><enum>(B)</enum><text>by striking <quote>or practitioner</quote> and inserting <quote>, practitioner, federally qualified health center, or rural health clinic</quote>;</text></subparagraph></paragraph><paragraph id="H0B392DD09B554E2BA09D7193EA7DF5A9"><enum>(2)</enum><text>in paragraph (2)(A)—</text><subparagraph id="HEF1F52866D1E45C1991694F47FCDE47E"><enum>(A)</enum><text>by inserting <quote>or to a federally qualified health center or rural health clinic that serves as a distant site</quote> after <quote>a distant site</quote>; and</text></subparagraph><subparagraph id="H617473D1C28B4C85BB95F9DA975715AF"><enum>(B)</enum><text>by striking <quote>such physician or practitioner</quote> and inserting <quote>such physician, practitioner, federally qualified health center, or rural health clinic</quote>; and</text></subparagraph></paragraph><paragraph id="H24E57E01BDAE447A9F2BFEF26216158D"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="H544200F17FA14A7A9BBE69C19049D037"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>and includes a federally qualified health center or rural health clinic that furnishes a telehealth service to an eligible individual</quote> before the period at the end; and</text></subparagraph><subparagraph id="H6C96CBB114C84AAF81E41D2BA8AC4CFA"><enum>(B)</enum><text>in subparagraph (F), by adding at the end the following new clause:</text><quoted-block id="HB6B0C7F495E54FCF91F5257030A69705" style="OLC"><clause id="HB3F96809AD76427485F98FD73041A6E2"><enum>(iii)</enum><header>Inclusion of rural health clinic services and federally qualified health center services furnished using telehealth</header><text>For purposes of this subparagraph, the term <quote>telehealth services</quote> includes a rural health clinic service or federally qualified health center service that is furnished using telehealth to the extent that payment codes corresponding to services identified by the Secretary under clause (i) or (ii) are listed on the corresponding claim for such rural health clinic service or Federally qualified health center service.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H92B28EF737404178B19C126DAA217693"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2021.</text></subsection></section><section id="H8D32010EA4694FEBBFB1F5C668E09163"><enum>4.</enum><header>Elimination of restrictions relating to telehealth services</header><subsection id="H44B96CFF803D447CBB2CBA1A040E944F"><enum>(a)</enum><header>Elimination of geographic restrictions of originating sites</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(i)</external-xref>) is amended—</text><paragraph id="HA1CC028B4BF74A158678C04C1E5475A2"><enum>(1)</enum><text>by striking <quote>the service is furnished via a telecommunications system and only if such site is located—</quote> and inserting <quote>the service—</quote>;</text></paragraph><paragraph id="H9DC9FE0DF1354A00B66A6165CC818A98"><enum>(2)</enum><text>by redesignating subclauses (I) through (III) as items (aa) through (cc), respectively, and moving the margins two ems to the right; and</text></paragraph><paragraph id="H0ADDCA55EBF842B7BD6D00A828E0BA31"><enum>(3)</enum><text>by inserting before item (aa), as redesignated by paragraph (2), the following new subclauses:</text><quoted-block style="OLC" id="H42D0EF80590A4C47951D73DF4543F0CE" display-inline="no-display-inline"><subclause id="HAA34340961D9466689FD0F8F6CB1F813"><enum>(I)</enum><text display-inline="yes-display-inline">is furnished via a telecommunications system; and</text></subclause><subclause id="H1B3D64AEA2C44DB2A581B716E41E4A1E"><enum>(II)</enum><text display-inline="yes-display-inline">for the period beginning on the date of the enactment of this subclause and ending on December 31, 2020, only if such site is located—</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H960BEC7BA82247049D9ED144C0831714"><enum>(b)</enum><header>Elimination of restrictions in which telehealth services may be furnished in the home</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C)(ii)(X) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(i)(X)</external-xref> is amended to read as follows:.</text><quoted-block style="OLC" id="HF5A6AC04D84E4FAFA36B6BAC4E1C36E1" display-inline="no-display-inline"><subclause id="HBEA0E1E69FC846DCA3462B749AD565E2"><enum>(X)</enum><item commented="no" display-inline="yes-display-inline" id="H47A63C11E46D4992A54D58B7E6D0E1C3"><enum>(aa)</enum><text>For the period beginning on the date of the enactment of this subclause and ending on December 31, 2020, the home of an individual but only for purposes of section 1881(b)(3)(B) or telehealth services described in paragraph (7).</text></item><item id="H78162B9A8662450EBAEA34F7853A3A3B" indent="up1"><enum>(bb)</enum><text>For the period beginning on or after January 1, 2021, the home of an individual.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
