States</header><text display-inline="yes-display-inline">The terms <term>alien</term>, <term>national</term>, and <term>national of the United States</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="HFC26C0EB976D447683B291316E1F92AE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate congressional committees and leadership</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees and leadership</term> means—</text><subparagraph id="H87142F42780A432A8977F680F4D2D7EC" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, the Select Committee on Intelligence, and the majority leader and the minority leader of the Senate; and</text></subparagraph><subparagraph id="HAC3BBDA8238B42C6B73C233C3E4BD215" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Homeland Security, the Committee on the Judiciary, the Permanent Select Committee on Intelligence, and the Speaker and the minority leader of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H8E4FD923973544D28C13149B39785C75" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Basic Law</header><text display-inline="yes-display-inline">The term <term>Basic Law</term> means the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China.</text></paragraph><paragraph id="H82AC26D8052C466A998C0D5DA8BFAC74" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">China</header><text display-inline="yes-display-inline">The term <term>China</term> means the People's Republic of China.</text></paragraph><paragraph id="H5F9393B93C2944D6B3C4BC876FDEE472" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Entity</header><text display-inline="yes-display-inline">The term <term>entity</term> means a partnership, joint venture, association, corporation, organization, network, group, or subgroup, or any other form of business collaboration.</text></paragraph><paragraph id="HA8B4D3D00A8A44EDAC2FF5ACC473C1BC" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Financial institution</header><text display-inline="yes-display-inline">The term <term>financial institution</term> means a financial institution specified in section 5312(a)(2) of title 31, United States Code.</text></paragraph><paragraph id="H03E17DC6E667472AAEDAB48CC902CE43" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Hong Kong</header><text display-inline="yes-display-inline">The term <term>Hong Kong</term> means the Hong Kong Special Administrative Region of the People's Republic of China.</text></paragraph><paragraph id="HDD4E3F6E8BAD40A19C68ECAFDA7AB06A" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Joint Declaration</header><text display-inline="yes-display-inline">The term <term>Joint Declaration</term> means the Joint Declaration of the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the People's Republic of China on the Question of Hong Kong, done at Beijing on December 19, 1984.</text></paragraph><paragraph id="H299959A20BCE4C9EBBE3E8A7224DD777" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Knowingly</header><text display-inline="yes-display-inline">The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge of the conduct, the circumstance, or the result. </text></paragraph><paragraph id="H7BD149031CE14F6F86BABA60F26DAFC4" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="HAB54CAB737A048429F24D8C4C6763192" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">United States person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means—</text><subparagraph id="H326F5CA8AB7F49B395D5D8AD8A522894" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">any citizen or national of the United States;</text></subparagraph><subparagraph id="HE3B1DD8B5F704C73930435AE0A960E8F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any alien lawfully admitted for permanent residence in the United States;</text></subparagraph><subparagraph id="H675548E949F44E439AFBAC5FF196406D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any entity organized under the laws of the United States or any jurisdiction within the United States (including a foreign branch of such an entity); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCA8370E817B44E989CB1EA34B4FBE216"><enum>(D)</enum><text display-inline="yes-display-inline">any person located in the United States.</text></subparagraph></paragraph></section><section id="H20659CAAE2B74709ABDF96F7EB46C591" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="HD6EC9D0BB6BF440FB91ABE593DD4340E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Joint Declaration and the Basic Law clarify certain obligations and promises that the Government of China has made with respect to the future of Hong Kong.</text></paragraph><paragraph id="HE589F2C6C3D34367AF6E1450B6A98FE0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The obligations of the Government of China under the Joint Declaration were codified in a legally-binding treaty, signed by the Government of the United Kingdom of Great Britain and Northern Ireland and registered with the United Nations.</text></paragraph><paragraph id="H1822420AE6CE4A7BA67CCC4B02F92135" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The obligations of the Government of China under the Basic Law originate from the Joint Declaration, were passed into the domestic law of China by the National People’s Congress, and are widely considered by citizens of Hong Kong as part of the de facto legal constitution of Hong Kong.</text></paragraph><paragraph id="HE57F90F90D0A427C9285AD71B0900DCB" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Foremost among the obligations of the Government of China to Hong Kong is the promise that, pursuant to Paragraph 3b of the Joint Declaration, <quote>the Hong Kong Special Administrative Region will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government</quote>.</text></paragraph><paragraph id="HB073E41283314BDF8E6E0292A7B4D603" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">The obligation specified in Paragraph 3b of the Joint Declaration is referenced, reinforced, and extrapolated on in several portions of the Basic Law, including Articles 2, 12, 13, 14, and 22.</text></paragraph><paragraph id="H8A670580E7AA494DBD74D5E3EC674A05" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">Article 22 of the Basic Law establishes that <quote>No department of the Central People’s Government and no province, autonomous region, or municipality directly under the Central Government may interfere in the affairs which the Hong Kong Special Administrative Region administers on its own in accordance with this Law.</quote>.</text></paragraph><paragraph id="HB23EF43A772B4445B5D3C495F9911F3E" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">The Joint Declaration and the Basic Law make clear that additional obligations shall be undertaken by China to ensure the <quote>high degree of autonomy</quote> of Hong Kong.</text></paragraph><paragraph id="H25024FDD8BA144A3BA01329046E79E9E" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">Paragraph 3c of the Joint Declaration states, as reinforced by Articles 2, 16, 17, 18, 19, and 22 of the Basic Law, that Hong Kong <quote>will be vested with executive, legislative and independent judicial power, including that of final adjudication</quote>.</text></paragraph><paragraph id="HDD83B70781F74D5ABE825E34D8599F5E" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">On multiple occasions, the Government of China has undertaken actions that have contravened the letter or intent of the obligation described in paragraph (8) of this section, including the following:</text><subparagraph id="H26F20F8112264965AB8468AB74ADF95F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">In 1999, the Standing Committee of the National People's Congress overruled a decision by the Hong Kong Court of Final Appeal on the right of abode.</text></subparagraph><subparagraph id="HC4DE8F963D854B3880F57459177CDF33" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">On multiple occasions, the Government of Hong Kong, at the advice of the Government of China, is suspected to have not allowed persons entry into Hong Kong allegedly because of their support for democracy and human rights in Hong Kong and China.</text></subparagraph><subparagraph id="H5991F389D3FA4E3983F94D8316FAD8D4" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">The Liaison Office of China in Hong Kong has, despite restrictions on interference in the affairs of Hong Kong as detailed in Article 22 of the Basic Law—</text><clause id="H8596782652A641CFA163AD2443C3D03F" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">openly expressed support for candidates in Hong Kong for Chief Executive and Legislative Council;</text></clause><clause id="H1E09307CD53C405398BA80405113BDC3" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">expressed views on various policies for the Government of Hong Kong and other internal matters relating to Hong Kong; and</text></clause><clause id="H0E05946865ED4904A35063DA0C2A608E" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">on April 17, 2020, asserted that both the Liaison Office of China in Hong Kong and the Hong Kong and Macau Affairs Office of the State Council <quote>have the right to exercise supervision … on affairs regarding Hong Kong and the mainland, in order to ensure correct implementation of the Basic Law</quote>.</text></clause></subparagraph><subparagraph id="HC5C16B5B74194F449BF4C87A1F5BAECA" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">The National People’s Congress has passed laws requiring Hong Kong to pass laws banning disrespectful treatment of the national flag and national anthem of China.</text></subparagraph><subparagraph id="H62EE865AAF954691A31D4A0349DF1A0D" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">The State Council of China released a white paper on June 10, 2014, that stressed the <quote>comprehensive jurisdiction</quote> of the Government of China over Hong Kong and indicated that Hong Kong must be governed by <quote>patriots</quote>.</text></subparagraph><subparagraph id="H242AB4FD74844FDA82A323F1A3322728" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">The Government of China has directed operatives to kidnap and bring to the mainland, or is otherwise responsible for the kidnapping of, residents of Hong Kong, including businessman Xiao Jianhua and bookseller Gui Minhai.</text></subparagraph><subparagraph id="H9FD4F589E50443858A637CA6A57F83F4" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">The Government of Hong Kong, acting with the support of the Government of China, introduced an extradition bill that would have permitted the Government of China to request and enforce extradition requests for any individual present in Hong Kong, regardless of the legality of the request or the degree to which it compromised the judicial independence of Hong Kong.</text></subparagraph><subparagraph id="HE0622897384F4214A44AAD6A088CBE24" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">The spokesman for the Standing Committee of the National People's Congress said, <quote>Whether Hong Kong’s laws are consistent with the Basic Law can only be judged and decided by the National People’s Congress Standing Committee. No other authority has the right to make judgments and decisions.</quote>.</text></subparagraph></paragraph><paragraph id="H707471047BD94B61B555075E5B2A3B6E" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">Paragraph 3e of the Joint Declaration states, as reinforced by Article 5 of the Basic Law, that the <quote>current social and economic systems in Hong Kong will remain unchanged, as so will the life-style.</quote>.</text></paragraph><paragraph id="HB6DE6B1613F242A3BE4B9845D0E5142A" commented="no" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">On multiple occasions, the Government of China has undertaken actions that have contravened the letter or intent of the obligation described in paragraph (10) of this section, including the following:</text><subparagraph id="HBDE3B68F7F3941DB963600267D88FF5E" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">In 2002, the Government of China pressured the Government of Hong Kong to introduce <quote>patriotic</quote> curriculum in primary and secondary schools.</text></subparagraph><subparagraph id="H2B05AC2FAB874D21903D687FD8736544" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The governments of China and Hong Kong proposed the prohibition of discussion of Hong Kong independence and self-determination in primary and secondary schools, which infringes on freedom of speech.</text></subparagraph><subparagraph id="HE9EE0B9248E544D48350BF04E3984FB0" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">The Government of Hong Kong mandated that Mandarin, and not the native language of Cantonese, be the language of instruction in Hong Kong schools.</text></subparagraph><subparagraph id="H256920F2A8324615991ABB8E3EB5E55A" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">The governments of China and Hong Kong agreed to a daily quota of mainland immigrants to Hong Kong, which is widely believed by citizens of Hong Kong to be part of an effort to <quote>mainlandize</quote> Hong Kong.</text></subparagraph></paragraph><paragraph id="HF702B78512454E36B0BC128AE3403BF4" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text display-inline="yes-display-inline">Paragraph 3e of the Joint Declaration states, as reinforced by Articles 4, 26, 27, 28, 29, 30, 31, 32 33, 34, and 39 of the Basic Law, that the <quote>rights and freedoms, including those of person, of speech, of the press, of assembly, of association, of travel, of movement, of correspondence, of strike, of choice of occupation, of academic research and of religious belief will be ensured by law</quote> in Hong Kong.</text></paragraph><paragraph id="HDDC33E35695349BFAEAEE8686DADC8D9" commented="no" display-inline="no-display-inline"><enum>(13)</enum><text display-inline="yes-display-inline">On multiple occasions, the Government of China has undertaken actions that have contravened the letter or intent of the obligation described in paragraph (12) of this section, including the following:</text><subparagraph id="HA8BB4427834A449FA45FCF91C849DFD3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">On February 26, 2003, the Government of Hong Kong introduced a national security bill that would have placed restrictions on freedom of speech and other protected rights.</text></subparagraph><subparagraph id="HD9410368BA4B4791841BA5A36FC873BC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The Liaison Office of China in Hong Kong has pressured businesses in Hong Kong not to advertise in newspapers and magazines critical of the governments of China and Hong Kong.</text></subparagraph><subparagraph id="HA25F23D1F4624AE18207212C81CC5DDB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">The Hong Kong Police Force selectively blocked demonstrations and protests expressing opposition to the governments of China and Hong Kong or the policies of those governments.</text></subparagraph><subparagraph id="HF10C9489BB094C8E89FE64D2E60CABDB" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">The Government of Hong Kong refused to renew work visa for a foreign journalist, allegedly for hosting a speaker from the banned Hong Kong National Party.</text></subparagraph><subparagraph id="HBE1A2CE09FEF4FDA9D1A976C257D6C5A" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">The Justice Department of Hong Kong selectively prosecuted cases against leaders of the Umbrella Movement, while failing to prosecute police officers accused of using excessive force during the protests in 2014.</text></subparagraph><subparagraph id="HA656419ACF404A288D6714AEDF3AC83B" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">On April 18, 2020, the Hong Kong Police Force arrested 14 high-profile democracy activists and campaigners for their role in organizing a protest march that took place on August 18, 2019, in which almost 2,000,000 people rallied against a proposed extradition bill. </text></subparagraph></paragraph><paragraph id="H3200515AA1394440B6A8F8EFB0062593" commented="no" display-inline="no-display-inline"><enum>(14)</enum><text display-inline="yes-display-inline">Articles 45 and 68 of the Basic Law assert that the selection of Chief Executive and all members of the Legislative Council of Hong Kong should be by <quote>universal suffrage.</quote>.</text></paragraph><paragraph id="H9719ABBD93AF4FC58549D7E808535670" commented="no" display-inline="no-display-inline"><enum>(15)</enum><text display-inline="yes-display-inline">On multiple occasions, the Government of China has undertaken actions that have contravened the letter or intent of the obligation described in paragraph (14) of this section, including the following:</text><subparagraph id="H251E106A5ED1408A9E9CEA8C36B498E2" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">In 2004, the National People’s Congress created new, antidemocratic procedures restricting the adoption of universal suffrage for the election of the Chief Executive of Hong Kong.</text></subparagraph><subparagraph id="HA86DE59A591E4ABA83AC99D1E1A5B812" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The decision by the National People’s Congress on December 29, 2007, which ruled out universal suffrage in 2012 elections and set restrictions on when and if universal suffrage will be implemented.</text></subparagraph><subparagraph id="H4C6BFA83F3B446DCAF2582E8E972D3A6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">The decision by the National People’s Congress on August 31, 2014, which placed limits on the nomination process for the Chief Executive of Hong Kong as a condition for adoption of universal suffrage.</text></subparagraph><subparagraph id="HA2DDCCBCA4F5421E82F02C45D23033E5" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">On November 7, 2016, the National People’s Congress interpreted Article 104 of the Basic Law in such a way to disqualify 6 elected members of the Legislative Council.</text></subparagraph><subparagraph id="H0E85386C99444C8EBCBC7466B5D7C878" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">In 2018, the Government of Hong Kong banned the Hong Kong National Party and blocked the candidacy of pro-democracy candidates.</text></subparagraph></paragraph><paragraph id="H1C9B8C2955174545B636126A760A0340" commented="no" display-inline="no-display-inline"><enum>(16)</enum><text display-inline="yes-display-inline">The ways in which the Government of China, at times with the support of a subservient Government of Hong Kong, has acted in contravention of its obligations under the Joint Declaration and the Basic Law, as set forth in this section, are deeply concerning to the people of Hong Kong, the United States, and members of the international community who support the autonomy of Hong Kong.</text></paragraph></section><section id="H797E149A075141C8A6F8D757F1D43A07" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Sense of Congress regarding Hong Kong</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" id="H476FA8C9F60F4FC789422101C4CF7ABB" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the United States continues to uphold the principles and policy established in the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5701">22 U.S.C. 5701</external-xref> et seq.) and the Hong Kong Human Rights and Democracy Act of 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/116/76">Public Law 116–76</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/5701">22 U.S.C. 5701</external-xref> note), which remain consistent with China’s obligations under the Joint Declaration and certain promulgated objectives under the Basic Law, including that— </text><subparagraph commented="no" id="H1C4A9090A3AF498D8277A20546B3D9FC" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">as set forth in section 101(1) of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5711">22 U.S.C. 5711(1)</external-xref>), <quote>The United States should play an active role, before, on, and after July 1, 1997, in maintaining Hong Kong's confidence and prosperity, Hong Kong's role as an international financial center, and the mutually beneficial ties between the people of the United States and the people of Hong Kong.</quote>; and</text></subparagraph><subparagraph commented="no" id="H2F20D126758741CFB15C9F112CEC8739" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">as set forth in section 2(5) of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5701">22 U.S.C. 5701(5)</external-xref>), <quote>Support for democratization is a fundamental principle of United States foreign policy. As such, it naturally applies to United States policy toward Hong Kong. This will remain equally true after June 30, 1997.</quote>;</text></subparagraph></paragraph><paragraph commented="no" id="HF348998738B24627A06892F40A49CF10" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">although the United States recognizes that, under the Joint Declaration, the Government of China <quote>resumed the exercise of sovereignty over Hong Kong with effect on 1 July 1997</quote>, the United States supports the autonomy of Hong Kong in furtherance of the United States-Hong Kong Policy Act of 1992 and the Hong Kong Human Rights and Democracy Act of 2019 and advances the desire of the people of Hong Kong to continue the <quote>one country, two systems</quote> regime, in addition to other obligations promulgated by China under the Joint Declaration and the Basic Law;</text></paragraph><paragraph commented="no" id="H0946A4079DF146DDB00BA2FF8D7E8D98" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in order to support the benefits and protections that Hong Kong has been afforded by the Government of China under the Joint Declaration and the Basic Law, the United States should establish a clear and unambiguous set of penalties with respect to foreign persons determined by the Secretary of State, in consultation with the Secretary of the Treasury, to be involved in the contravention of the obligations of China under the Joint Declaration and the Basic Law and the financial institutions transacting with those foreign persons;</text></paragraph><paragraph commented="no" id="H4925DD5CAC1A4ECF8E816281D62A267F" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the Secretary of State should provide an unclassified assessment of the reason for imposition of certain economic penalties on entities, so as to permit a clear path for the removal of economic penalties if the sanctioned behavior is reversed and verified by the Secretary of State;</text></paragraph><paragraph commented="no" id="HAAF5ABD2289546228C2F871847238954" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">relevant Federal agencies should establish a multilateral sanctions regime with respect to foreign persons involved in the contravention of the obligations of China under the Joint Declaration and the Basic Law; and</text></paragraph><paragraph id="H1FD255053E57415883BEDEB34478E0FD" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">in addition to the penalties on foreign persons, and financial institutions transacting with those foreign persons, for the contravention of the obligations of China under the Joint Declaration and the Basic Law, the United States should take steps, in a time of crisis, to assist permanent residents of Hong Kong who are persecuted or fear persecution as a result of the contravention by China of its obligations under the Joint Declaration and the Basic Law to become eligible to obtain lawful entry into the United States. </text></paragraph></section><section id="H9B22402D845B4F67BE53C52AF2D5ED77" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Identification of foreign persons involved in the erosion of the obligations of China under the Joint Declaration or the Basic Law and foreign financial institutions that conduct significant transactions with those persons</header><subsection id="HB7A18969B7B846ACA16D93A7BBDEE9B8" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, if the Secretary of State, in consultation with the Secretary of the Treasury, determines that a foreign person is materially contributing to, has materially contributed to, or attempts to materially contribute to the failure of the Government of China to meet its obligations under the Joint Declaration or the Basic Law, the Secretary of State shall submit to the appropriate congressional committees and leadership a report that includes—</text><paragraph id="H741AF948491E48519074F807DCD64244" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">an identification of the foreign person; and</text></paragraph><paragraph id="HC5D3865C2B8943EEB83761A7B4E5FB1E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a clear explanation for why the foreign person was identified and a description of the activity that resulted in the identification.</text></paragraph></subsection><subsection id="H8ECB295DF4A84D99B16F7CD152EB9787" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Identifying foreign financial institutions</header><text display-inline="yes-display-inline">Not earlier than 30 days and not later than 60 days after the Secretary of State submits to the appropriate congressional committees and leadership the report under subsection (a), the Secretary of the Treasury, in consultation with the Secretary of State, shall submit to the appropriate congressional committees and leadership a report that identifies any foreign financial institution that knowingly conducts a significant transaction with a foreign person identified in the report under subsection (a).</text></subsection><subsection id="HBB6D40222F3049B492AD68A9FEF417AF" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Exclusion of certain information</header><paragraph id="HD2DA73E92D92433AAE958CE79EEA0B3B" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Intelligence</header><text display-inline="yes-display-inline">The Secretary of State shall not disclose the identity of a person in a report submitted under subsection (a) or (b), or an update under subsection (e), if the Director of National Intelligence determines that such disclosure could compromise an intelligence operation, activity, source, or method of the United States.</text></paragraph><paragraph id="H054F0B2DF69743F1814FF40AA7A8BF2F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Law enforcement</header><text display-inline="yes-display-inline">The Secretary of State shall not disclose the identity of a person in a report submitted under subsection (a) or (b), or an update under subsection (e), if the Attorney General, in coordination, as appropriate, with the Director of the Federal Bureau of Investigation, the head of any other appropriate Federal law enforcement agency, and the Secretary of the Treasury, determines that such disclosure could reasonably be expected—</text><subparagraph id="H43DC634FE924486882D24086EABFE17A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to compromise the identity of a confidential source, including a State, local, or foreign agency or authority or any private institution that furnished information on a confidential basis;</text></subparagraph><subparagraph id="H3CE00478C8574D17B97031518DB04AB6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to jeopardize the integrity or success of an ongoing criminal investigation or prosecution;</text></subparagraph><subparagraph id="H1E62905B2AA44521BDBE71B4996EEDBE" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to endanger the life or physical safety of any person; or</text></subparagraph><subparagraph id="HB059E90AAF584659ACE8C78B1212FF38" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to cause substantial harm to physical property.</text></subparagraph></paragraph><paragraph id="H15DD65A7E73449F588DB7E25AF7FE5EC" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Notification required</header><text display-inline="yes-display-inline">If the Director of National Intelligence makes a determination under paragraph (1) or the Attorney General makes a determination under paragraph (2), the Director or the Attorney General, as the case may be, shall notify the appropriate congressional committees and leadership of the determination and the reasons for the determination.</text></paragraph></subsection><subsection id="H0B5357045F924CE2BC1A1EDB6BA2BF17" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Exclusion or removal of foreign persons and foreign financial institutions</header><paragraph id="HC333A3E4624342AFAC8D09873464EF18" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Foreign persons</header><text display-inline="yes-display-inline">The President may exclude a foreign person from the report under subsection (a), or an update under subsection (e), or remove a foreign person from the report or update prior to the imposition of sanctions under section 6(a) if the material contribution (as described in subsection (g)) that merited inclusion in that report or update—</text><subparagraph id="HF113C05E88F04FAE9806220A2A47E332" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">does not have a significant and lasting negative effect that contravenes the obligations of China under the Joint Declaration and the Basic Law;</text></subparagraph><subparagraph id="H1B8A1FB08E5B453082EBC0D01702C15E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is not likely to be repeated in the future; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB4F7BC0191A4C79B330007E4473C065"><enum>(C)</enum><text display-inline="yes-display-inline">has been reversed or otherwise mitigated through positive countermeasures taken by that foreign person.</text></subparagraph></paragraph><paragraph id="H29D673B80DCC4D88B73989BF1913AF86" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Foreign financial institutions</header><text display-inline="yes-display-inline">The President may exclude a foreign financial institution from the report under subsection (b), or an update under subsection (e), or remove a foreign financial institution from the report or update prior to the imposition of sanctions under section 7(a) if the significant transaction or significant transactions of the foreign financial institution that merited inclusion in that report or update—</text><subparagraph id="HBFD80226428345E998CAA2357EBB9C54" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">does not have a significant and lasting negative effect that contravenes the obligations of China under the Joint Declaration and the Basic Law;</text></subparagraph><subparagraph id="H46AB92AE324743D7BD7B7F6AB334BDAC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is not likely to be repeated in the future; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7ABA8303C3314D9F8BE66CA40DEDE1AD"><enum>(C)</enum><text display-inline="yes-display-inline">has been reversed or otherwise mitigated through positive countermeasures taken by that foreign financial institution.</text></subparagraph></paragraph><paragraph id="H63ABE5C59FB148F2A997FDC87C814070" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Notification required</header><text display-inline="yes-display-inline">If the President makes a determination under paragraph (1) or (2) to exclude or remove a foreign person or foreign financial institution from a report under subsection (a) or (b), as the case may be, the President shall notify the appropriate congressional committees and leadership of the determination and the reasons for the determination. </text></paragraph></subsection><subsection id="H7095C58485944D8DA0C21FD62811103F" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Update of reports</header><paragraph id="HCFD27421B8FD4C9FBE708FF45B1E1C87" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each report submitted under subsections (a) and (b) shall be updated in an ongoing manner and, to the extent practicable, updated reports shall be resubmitted with the annual report under section 301 of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5731">22 U.S.C. 5731</external-xref>).</text></paragraph><paragraph id="HB2D45843B78644688133A10C6369635C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to terminate the requirement to update the reports under subsections (a) and (b) upon the termination of the requirement to submit the annual report under section 301 of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5731">22 U.S.C. 5731</external-xref>).</text></paragraph></subsection><subsection id="H3037F31A754C48BBBE6D0A0275FBAC39" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Form of reports</header><paragraph id="HB8F39B5751E94DBA94ABD1BF7A1022AE" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each report under subsection (a) or (b) (including updates under subsection (e)) shall be submitted in unclassified form and made available to the public.</text></paragraph><paragraph id="H1E9C3D5BFC6B45C18D8538847885EAEB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Classified annex</header><text display-inline="yes-display-inline">The explanations and descriptions included in the report under subsection (a)(2) (including updates under subsection (e)) may be expanded on in a classified annex. </text></paragraph></subsection><subsection id="H81AAF266C1344CF3895409E4C6C24190" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Material contributions related to obligations of China described</header><text display-inline="yes-display-inline">For purposes of this section, a foreign person materially contributes to the failure of the Government of China to meet its obligations under the Joint Declaration or the Basic Law if the person—</text><paragraph id="H696132054FA24473A6086DBEA078A247" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">took action that resulted in the inability of the people of Hong Kong—</text><subparagraph id="HDEBB2832697B4B8EA1C055058EAB2193" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to enjoy freedom of assembly, speech, press, or independent rule of law; or</text></subparagraph><subparagraph id="H70F47ED2313F4A40BB30FA670D8FF47F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to participate in democratic outcomes; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2CD06F1048714E6DBAAC43F178CEF927"><enum>(2)</enum><text display-inline="yes-display-inline">otherwise took action that reduces the high degree of autonomy of Hong Kong.</text></paragraph></subsection></section><section id="HAC1D54E47AF5436FA8957CE9BDCA344C" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Sanctions with respect to foreign persons that contravene the obligations of China under the Joint Declaration or the Basic Law</header><subsection id="HF2A99FDDF92E4488A1431F80B83FE6FD" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Imposition of sanctions</header><paragraph id="HCEFD931F40C14D4E9456B156B47B9CEF" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On and after the date on which a foreign person is included in the report under section 5(a) or an update to that report under section 5(e), the President may impose sanctions described in subsection (b) with respect to that foreign person.</text></paragraph><paragraph id="H5CF23F0B62F6455EBD5B185CEB8EAC53" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Mandatory sanctions</header><text display-inline="yes-display-inline">Not later than one year after the date on which a foreign person is included in the report under section 5(a) or an update to that report under section 5(e), the President shall impose sanctions described in subsection (b) with respect to that foreign person. </text></paragraph></subsection><subsection id="H9294A2AA027C499392F81CD7FBDF1FAF" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection with respect to a foreign person are the following:</text><paragraph id="H9405043245764CB7B47706818E985B57" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Property transactions</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any person from—</text><subparagraph id="H5D1D9A21869141CFB3E24611977EDF79" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">acquiring, holding, withholding, using, transferring, withdrawing, transporting, or exporting any property that is subject to the jurisdiction of the United States and with respect to which the foreign person has any interest;</text></subparagraph><subparagraph id="HBBB5D41B687840BBADDB2B1DEC0DAD41" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">dealing in or exercising any right, power, or privilege with respect to such property; or</text></subparagraph><subparagraph id="HEE654A0ED80649DC9897F7A80C422BC3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">conducting any transaction involving such property.</text></subparagraph></paragraph><paragraph id="H96DFA8C79495421DAD6123BA3F67A74A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusion from the United States and revocation of visa or other documentation</header><text display-inline="yes-display-inline">In the case of a foreign person who is an individual, the President may direct the Secretary of State to deny a visa to, and the Secretary of Homeland Security to exclude from the United States, the foreign person, subject to regulatory exceptions to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text></paragraph></subsection></section><section id="H79D65B54DFDC45BE9CD14EFB5ABEF6C3" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Sanctions with respect to foreign financial institutions that conduct significant transactions with foreign persons that contravene the obligations of China under the Joint Declaration or the Basic Law</header><subsection id="H821CFD06C146478E94121C3761EBBDC5" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Imposition of sanctions</header><paragraph id="HCC43D029F7A44895A72EDA3B344A8915" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Initial sanctions</header><text display-inline="yes-display-inline">Not later than one year after the date on which a foreign financial institution is included in the report under section 5(b) or an update to that report under section 5(e), the President shall impose not fewer than 5 of the sanctions described in subsection (b) with respect to that foreign financial institution.</text></paragraph><paragraph id="HE2E6E3AD6EE644A287142EECFFF97A3A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Expanded sanctions</header><text display-inline="yes-display-inline">Not later than two years after the date on which a foreign financial institution is included in the report under section 5(b) or an update to that report under section 5(e), the President shall impose each of the sanctions described in subsection (b). </text></paragraph></subsection><subsection commented="no" id="HB987833D0F0643018E45DFD86BF58361" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection with respect to a foreign financial institution are the following:</text><paragraph commented="no" id="HAC51773A5FD6402CAE7DAF86E7D0CFD2" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Loans from United States financial institutions</header><text display-inline="yes-display-inline">The United States Government may prohibit any United States financial institution from making loans or providing credits to the foreign financial institution.</text></paragraph><paragraph commented="no" id="H383B962C402742E684E6B2A74E269A19" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition on designation as primary dealer</header><text display-inline="yes-display-inline">Neither the Board of Governors of the Federal Reserve System nor the Federal Reserve Bank of New York may designate, or permit the continuation of any prior designation of, the foreign financial institution as a primary dealer in United States Government debt instruments.</text></paragraph><paragraph commented="no" id="H404674774C264364A2FACD2670FE604F" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibition on service as a repository of government funds</header><text display-inline="yes-display-inline">The foreign financial institution may not serve as agent of the United States Government or serve as repository for United States Government funds.</text></paragraph><paragraph commented="no" id="HDA5D84FF918F46A8A0267A054A6E2EE3" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Foreign exchange</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any transactions in foreign exchange that are subject to the jurisdiction of the United States and involve the foreign financial institution.</text></paragraph><paragraph commented="no" id="HE6EE2DA310F146658C4B75F0F092B0DD" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Banking transactions</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any transfers of credit or payments between financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve the foreign financial institution.</text></paragraph><paragraph commented="no" id="H3860CE3C263A479B840258C75BB01FB6" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Property transactions</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations as the President may prescribe, prohibit any person from—</text><subparagraph commented="no" id="H574EA4B164F948AB8327B02C8B7DD1B8" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">acquiring, holding, withholding, using, transferring, withdrawing, transporting, importing, or exporting any property that is subject to the jurisdiction of the United States and with respect to which the foreign financial institution has any interest;</text></subparagraph><subparagraph commented="no" id="H4DED4932D6B3406B920DC38ED4FD0023" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">dealing in or exercising any right, power, or privilege with respect to such property; or</text></subparagraph><subparagraph commented="no" id="H2F278C18DB1845BAA6186EC507DF5B27" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">conducting any transaction involving such property.</text></subparagraph></paragraph><paragraph id="H627A396C0F364F71ACB26B4D6292870A" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Restriction on exports, reexports, and transfers</header><text display-inline="yes-display-inline">The President, in consultation with the Secretary of Commerce, may restrict or prohibit exports, reexports, and transfers (in-country) of commodities, software, and technology subject to the jurisdiction of the United States directly or indirectly to the foreign financial institution.</text></paragraph><paragraph commented="no" id="H896B8D85ADC24C5E873074A048FC9D99" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Ban on investment in equity or debt</header><text display-inline="yes-display-inline">The President may, pursuant to such regulations or guidelines as the President may prescribe, prohibit any United States person from investing in or purchasing significant amounts of equity or debt instruments of the foreign financial institution.</text></paragraph><paragraph id="H99D610152E5C45F5AFBE447024C214F2" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Exclusion of corporate officers</header><text display-inline="yes-display-inline">The President may direct the Secretary of State, in consultation with the Secretary of the Treasury and the Secretary of Homeland Security, to exclude from the United States any alien that is determined to be a corporate officer or principal of, or a shareholder with a controlling interest in, the foreign financial institution, subject to regulatory exceptions to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text></paragraph><paragraph commented="no" id="H174CBCAB134D4AA6A72FE414A8ADE6D4" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Sanctions on principal executive officers</header><text display-inline="yes-display-inline">The President may impose on the principal executive officer or officers of the foreign financial institution, or on individuals performing similar functions and with similar authorities as such officer or officers, any of the sanctions described in paragraphs (1) through (8) that are applicable.</text></paragraph></subsection><subsection commented="no" id="H66648B9C37EC4F439582B8E118E86DD0" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Timing of sanctions</header><text display-inline="yes-display-inline">The President may impose sanctions required under subsection (a) with respect to a financial institution included in the report under section 5(b) or an update to that report under section 5(e) beginning on the day on which the financial institution is included in that report or update. </text></subsection></section><section commented="no" id="HF00E1A82D4CD452C86F047A8F715524E" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Waiver, termination, exceptions, and congressional review process</header><subsection id="H087AE92649764538A602699B34B03D8C" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">National security waiver</header><text display-inline="yes-display-inline">Unless a disapproval resolution is enacted under subsection (e), the President may waive the application of sanctions under section 6 or 7 with respect to a foreign person or foreign financial institution if the President—</text><paragraph id="HA3F5496395BE4B89B69D5ABA86009762" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">determines that the waiver is in the national security interest of the United States; and</text></paragraph><paragraph id="H8017A8FEFE7A426CB599657A2EC6584B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">submits to the appropriate congressional committees and leadership a report on the determination and the reasons for the determination.</text></paragraph></subsection><subsection id="H4F3AD28C24CA4C22AE4A4FD67CDA8664" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Termination of sanctions and removal from report</header><text display-inline="yes-display-inline">Unless a disapproval resolution is enacted under subsection (e), the President may terminate the application of sanctions under section 6 or 7 with respect to a foreign person or foreign financial institution and remove the foreign person from the report required under section 5(a) or the foreign financial institution from the report required under section 5(b), as the case may be, if the Secretary of State, in consultation with the Secretary of the Treasury, determines that the actions taken by the foreign person or foreign financial institution that led to the imposition of sanctions— </text><paragraph id="H61DA335B9F6F4ECA84495A17568E4D0D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">do not have a significant and lasting negative effect that contravenes the obligations of China under the Joint Declaration and the Basic Law;</text></paragraph><paragraph id="HF95F7EA82C134BB083B9EB1A274D6732" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">are not likely to be repeated in the future; and</text></paragraph><paragraph id="H638F160EFDE044BF890D7A3AA192E724" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">have been reversed or otherwise mitigated through positive countermeasures taken by that foreign person or foreign financial institution.</text></paragraph></subsection><subsection id="H510F836792C44722964C948CA0494AB7" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Termination of Act</header><paragraph id="H52A7D973D6E24635A1FB72932A7FF5A7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Report</header><subparagraph id="H8397AAC5BED9442B89AD8F6400C8EAAA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than July 1, 2046, the President, in consultation with the Secretary of State, the Secretary of the Treasury, and the heads of such other Federal agencies as the President considers appropriate, shall submit to Congress a report evaluating the implementation of this Act and sanctions imposed pursuant to this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1066734333C248CBA17B233ACDF12825"><enum>(B)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The President shall include in the report submitted under subparagraph (A) an assessment of whether this Act and the sanctions imposed pursuant to this Act should be terminated.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC2833D92A19E4E7A94C02638701EFAF1"><enum>(2)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">This Act and the sanctions imposed pursuant to this Act shall remain in effect unless a termination resolution is enacted under subsection (e) after July 1, 2047.</text></paragraph></subsection><subsection id="HEB70D79B355747D9A09D26B913BCB60E" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Exception relating to importation of goods</header><paragraph id="HFEBFC406F5B14EDEA75A52D7CC25805C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authorities and requirements to impose sanctions under sections 6 and 7 shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph><paragraph id="H098AF49A9C7D47D289005D766ED9C3FE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Good defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></paragraph></subsection><subsection id="H15B7651172B44AD190289DC1395255F9" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Congressional review</header><paragraph id="H66FC3BD8B2C74AE299CE14EDF8109D1D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Resolutions</header><subparagraph id="H50BB59A5DA4246B3BB34B63EC32C2DD8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Disapproval resolution</header><text display-inline="yes-display-inline">In this section, the term <term>disapproval resolution</term> means only a joint resolution of either House of Congress—</text><clause id="H1EBC3AC29BFE4CFE85F744F246717C05" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the title of which is as follows: <quote>A joint resolution disapproving the waiver or termination of sanctions with respect to a foreign person that contravenes the obligations of China with respect to Hong Kong or a foreign financial institution that conducts a significant transaction with that person.</quote>; and</text></clause><clause id="H53756E119ED3469CB1FD97AA6D25F5C1" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the sole matter after the resolving clause of which is the following: <quote>Congress disapproves of the action under section 8 of the <short-title>Hong Kong Autonomy Act</short-title> relating to the application of sanctions imposed with respect to a foreign person that contravenes the obligations of China with respect to Hong Kong, or a foreign financial institution that conducts a significant transaction with that person, on _______ relating to ________.</quote>, with the first blank space being filled with the appropriate date and the second blank space being filled with a short description of the proposed action.</text></clause></subparagraph><subparagraph id="HD64523E055C7482C89DA108A612676C6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Termination resolution</header><text display-inline="yes-display-inline">In this section, the term <term>termination resolution</term> means only a joint resolution of either House of Congress—</text><clause id="H6B4F355F118E49D8ADC1A0423004C8B5" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the title of which is as follows: <quote>A joint resolution terminating sanctions with respect to foreign persons that contravene the obligations of China with respect to Hong Kong and foreign financial institutions that conduct significant transactions with those persons.</quote>; and</text></clause><clause id="H939A3979E786486583C8EF963FE65F09" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the sole matter after the resolving clause of which is the following: <quote>The <short-title>Hong Kong Autonomy Act</short-title> and any sanctions imposed pursuant to that Act shall terminate on ____.</quote>, with the blank space being filled with the termination date.</text></clause></subparagraph><subparagraph id="H0314D2E92305427BA9E0DD699AC7AC26" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Covered resolution</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered resolution</term> means a disapproval resolution or a termination resolution.</text></subparagraph></paragraph><paragraph id="H87714916790445DCA53B3177652E31DD" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Introduction</header><text display-inline="yes-display-inline">A covered resolution may be introduced—</text><subparagraph id="H462FB4C57DF849F2A0C6D6AF96F368C7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the House of Representatives, by the majority leader or the minority leader; and</text></subparagraph><subparagraph id="HD24387EBD9AC462A9D12931AE7B1CA9C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in the Senate, by the majority leader (or the majority leader's designee) or the minority leader (or the minority leader's designee).</text></subparagraph></paragraph><paragraph id="HBE1F86F5E860400B8AF504E3C93F4DDC" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Floor consideration in House of Representatives</header><text display-inline="yes-display-inline">If a committee of the House of Representatives to which a covered resolution has been referred has not reported the resolution within 10 legislative days after the date of referral, that committee shall be discharged from further consideration of the resolution.</text></paragraph><paragraph id="HF1F0372624A243C1ACD54F7CF7971ACA" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Consideration in the Senate</header><subparagraph id="H84810176DF674F40A377D4A6728766A5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Committee referral</header><clause id="H386DE82A73814B1C9518A820A12F6B37" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Disapproval resolution</header><text display-inline="yes-display-inline">A disapproval resolution introduced in the Senate shall be—</text><subclause id="H40CED804873F4D3A9447E6726ACF3110" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">referred to the Committee on Banking, Housing, and Urban Affairs if the resolution relates to an action that is not intended to significantly alter United States foreign policy with regard to China; and</text></subclause><subclause id="H36F4DA2BF1A54DB781C7F49AA129478B" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">referred to the Committee on Foreign Relations if the resolution relates to an action that is intended to significantly alter United States foreign policy with regard to China.</text></subclause></clause><clause id="HB3DC5CB4BBC1447784AB30B00224260F" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Termination resolution</header><text display-inline="yes-display-inline">A termination resolution introduced in the Senate shall be referred to the Committee on Banking, Housing, and Urban Affairs and the Committee on Foreign Relations.</text></clause></subparagraph><subparagraph id="H4C289DE797794A3E8F988A1A2AEEFA10" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Reporting and discharge</header><text display-inline="yes-display-inline">If a committee to which a covered resolution was referred has not reported the resolution within 10 legislative days after the date of referral of the resolution, that committee shall be discharged from further consideration of the resolution and the resolution shall be placed on the appropriate calendar.</text></subparagraph><subparagraph id="HABC9E15FA09D4088BECC2BD3E2C71933" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Proceeding to consideration</header><text display-inline="yes-display-inline">Notwithstanding Rule XXII of the Standing Rules of the Senate, it is in order at any time after the Committee on Banking, Housing, and Urban Affairs or the Committee on Foreign Relations, as the case may be, reports a covered resolution to the Senate or has been discharged from consideration of such a resolution (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the resolution, and all points of order against the resolution (and against consideration of the resolution) are waived. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order.</text></subparagraph><subparagraph id="H9B0DFB1A2FD1411DB1E564C98D74F029" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Rulings of the Chair on procedure</header><text display-inline="yes-display-inline">Appeals from the decisions of the Chair relating to the application of the rules of the Senate, as the case may be, to the procedure relating to a covered resolution shall be decided without debate.</text></subparagraph><subparagraph id="H19D7C7FA1B664AE38C88DDF3EB7622AE" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Consideration of veto messages</header><text display-inline="yes-display-inline">Debate in the Senate of any veto message with respect to a covered resolution, including all debatable motions and appeals in connection with the resolution, shall be limited to 10 hours, to be equally divided between, and controlled by, the majority leader and the minority leader or their designees.</text></subparagraph></paragraph><paragraph id="H8B53C079112B4DC491156D8560E4A96C" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Rules relating to Senate and House of Representatives</header><subparagraph id="H2755F03CD8594C36B4AF5AE1BF5FDDA7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Treatment of Senate resolution in House</header><text display-inline="yes-display-inline">In the House of Representatives, the following procedures shall apply to a covered resolution received from the Senate (unless the House has already passed a resolution relating to the same proposed action):</text><clause id="HD554825193514612878A0CFAA5B57DF2" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">The resolution shall be referred to the appropriate committees.</text></clause><clause id="H2FFCA6CA18A34DF48646172DAD176C2E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">If a committee to which a resolution has been referred has not reported the resolution within 10 legislative days after the date of referral, that committee shall be discharged from further consideration of the resolution.</text></clause><clause id="HFD9793F2E79E46FF9BA3B7A1524C3D71" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">Beginning on the third legislative day after each committee to which a resolution has been referred reports the resolution to the House or has been discharged from further consideration thereof, it shall be in order to move to proceed to consider the resolution in the House. All points of order against the motion are waived. Such a motion shall not be in order after the House has disposed of a motion to proceed on the resolution. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. The motion shall not be debatable. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></clause><clause id="HC235ACD824B4454AA033E5D7BD3D0FE2" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">The resolution shall be considered as read. All points of order against the resolution and against its consideration are waived. The previous question shall be considered as ordered on the resolution to final passage without intervening motion except 2 hours of debate equally divided and controlled by the offeror of the motion to proceed (or a designee) and an opponent. A motion to reconsider the vote on passage of the resolution shall not be in order.</text></clause></subparagraph><subparagraph id="H7E2389B4703249D09B0D3273CE0E734B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of House resolution in Senate</header><clause id="HA5DA1F7D920347DD8F715005EAC9BB2D" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Received before passage of Senate resolution</header><text display-inline="yes-display-inline">If, before the passage by the Senate of a covered resolution, the Senate receives an identical resolution from the House of Representatives, the following procedures shall apply:</text><subclause id="H22B8933405064DE4A392F1CA71FD895C" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">That resolution shall not be referred to a committee.</text></subclause><subclause id="H4403BCC4651F4EB8AE904429B17EBC91" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">With respect to that resolution—</text><item id="HF9C78E6BC9E2444DB09856BE679D42BC" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">the procedure in the Senate shall be the same as if no resolution had been received from the House of Representatives; but</text></item><item id="H75D66CBFBBCC460F8330E04B180D414F" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">the vote on passage shall be on the resolution from the House of Representatives.</text></item></subclause></clause><clause id="H1916E36A9ED64B5585D88D8F215BD8BC" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Received after passage of Senate resolution</header><text display-inline="yes-display-inline">If, following passage of a covered resolution in the Senate, the Senate receives an identical resolution from the House of Representatives, that resolution shall be placed on the appropriate Senate calendar.</text></clause><clause id="H71E6BC6AD23E4C5091F7C05CC82B0282" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">No Senate companion</header><text display-inline="yes-display-inline">If a covered resolution is received from the House of Representatives, and no companion resolution has been introduced in the Senate, the Senate procedures under this subsection shall apply to the resolution from the House of Representatives.</text></clause></subparagraph><subparagraph id="H33524264EA0D44B89151C166073D327A" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Application to revenue measures</header><text display-inline="yes-display-inline">The provisions of this paragraph shall not apply in the House of Representatives to a covered resolution that is a revenue measure.</text></subparagraph></paragraph><paragraph id="H76F33F2929F94EC0931AA2E7C906EAF3" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Rules of House of Representatives and Senate</header><text display-inline="yes-display-inline">This subsection is enacted by Congress—</text><subparagraph id="H64B627FA083D45118AA38EB7318BEE4B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text></subparagraph><subparagraph id="H239E1E73E14244DDB9EEFCE499F93E6B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></subparagraph></paragraph></subsection></section><section id="HD532553A9A154DCDBB1681475A21EABD" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Implementation; penalties</header><subsection id="H3AE176FE0E87492BA1C8F40B521E0F04" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to the extent necessary to carry out this Act.</text></subsection><subsection id="H59F6AAB10C984308835E631D096FFD6A" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">A person that violates, attempts to violate, conspires to violate, or causes a violation of section 6 or 7 or any regulation, license, or order issued to carry out that section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section. </text></subsection></section><section id="H20E85EF88FE54A7A8156137C11A29DAF" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed as an authorization of military force against China.</text></section></legis-body><attestation><attestation-group><attestation-date date="20200701" chamber="House">Passed the House of Representatives July 1, 2020.</attestation-date><attestor display="yes">Cheryl L.
