 <section id="HC451F8357DF246F28CA355C2D0A5885F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation Funding Fairness Act</short-title></quote>.</text> </section><section id="H12FA13B2B0C94773A456B3CEA921FFF0"><enum>2.</enum><header>Treatment of certain loans in consideration for fixed guideway capital investment grants</header> <subsection id="HB88858FC982E4EBDB7469C974B447DF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 603(b)(8) of title 23, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3BAAC7AAD7194BF78B79CDBFBBE647D1" style="USC">
					<paragraph id="H82D2F649B91F4754AB35826916485087"><enum>(8)</enum><header>Non-Federal share</header>
 <subparagraph id="H07DDDBAA25D1480ABDA591B90F25237A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State or other eligible sponsor may elect to have proceeds of a covered loan treated as any non-Federal share of project costs required under this title or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, if the loan is repayable from non-Federal funds.</text>
 </subparagraph><subparagraph id="HC060EE536EA144D6B586D0341E52599E"><enum>(B)</enum><header>Covered loan</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>covered loan</quote> means—</text> <clause id="HAB3ABB92559641CA9C84512CF8D1E86D"><enum>(i)</enum><text>a secured loan under the TIFIA program; and</text>
 </clause><clause id="H7857E0F7FCBE4CFE954FC787EF766D03"><enum>(ii)</enum><text display-inline="yes-display-inline">a loan issued pursuant to the railroad rehabilitation and improvement financing program authorized under sections 501 through 503 of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821–823</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H108F6E992DC2422EA9E3D61052BCAB99"><enum>(b)</enum><header>Special rule for fixed guideway capital investment grants</header><text>Section 5309(f) of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HA3D6162A7E2B4326B499B37C9C73ECF4" style="appropriations"> <paragraph id="HCFA383A8D74C45EEBD1102566F584265"><enum>(3)</enum><header>Special rule for proceeds of a covered loan</header> <subparagraph id="H8FEB247497FD4564BCCEC94F24962E20"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In making the determination and assessment pursuant to paragraphs (1) and (2), the Secretary—</text>
 <clause id="H2F4A464805B2453397D8EF1DCD6A9685"><enum>(i)</enum><text>shall treat proceeds of a covered loan that a State has elected to treat as a non-Federal share of project costs pursuant to section 603(b)(8) of title 23, United States Code, as a local financial commitment; and</text>
 </clause><clause id="H4439368990944086B057BD5C9D95465E"><enum>(ii)</enum><text>may not treat any such proceeds as non-local sources of capital and operating financing.</text> </clause></subparagraph><subparagraph id="HC80DD918E01C484681ED2DAC95FACF54"><enum>(B)</enum><header>Covered loan</header><text>In this subsection, the term <quote>covered loan</quote> means—</text>
 <clause id="HF175E7CA044C485BB8C9C0A37157721D"><enum>(i)</enum><text>a secured loan under the TIFIA program (as such term is defined in section 601 of title 23, United States Code); and</text>
 </clause><clause id="H3097D18266884886B193690B80D198CA"><enum>(ii)</enum><text>a loan issued pursuant to the railroad rehabilitation and improvement financing program authorized under sections 501 through 503 of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821–823</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
