<official-title display="yes">To revise section 48 of title 18, United States Code, and for other purposes.</official-title>

<section id="HE226276673D548DE9152C99714F6CF57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Animal Cruelty and Torture Act</short-title></quote> or the <quote><short-title>PACT Act</short-title></quote>.</text> </section> <section id="H2D6D4438C78E484F82DC94B80F342B33"><enum>2.</enum><header>Revision of section 48</header> <subsection id="HF09D47DE68944FBFA38A19AA91882915"><enum>(a)</enum><header>In general</header><text>Section 48 of title 18, United States Code, is amended to read as follows:</text>

<section id="HE855BC26061547799DA34F52EE81800B"><enum>48.</enum><header>Animal crushing</header> 
<subsection id="HAE490C6E9FF74486BE4FDDB14E437181"><enum>(a)</enum><header>Offenses</header> 
<paragraph id="H3D36E216823E4098852AD85B2CB3F896"><enum>(1)</enum><header>Crushing</header><text>It shall be unlawful for any person to purposely engage in animal crushing in or affecting interstate or foreign commerce or within the special maritime and territorial jurisdiction of the United States.</text> </paragraph> <paragraph id="H880DB785DE3F4DAF927BDE7A87D7E7E9"><enum>(2)</enum><header>Creation of animal crush videos</header><text>It shall be unlawful for any person to knowingly create an animal crush video, if—</text> 
<subparagraph id="H04D8B40CCC514BBDA9948C93D017E09C"><enum>(A)</enum><text>the person intends or has reason to know that the animal crush video will be distributed in, or using a means or facility of, interstate or foreign commerce; or</text> </subparagraph> <subparagraph id="H745B5D1D024349E5AD68E1D94048425B"><enum>(B)</enum><text>the animal crush video is distributed in, or using a means or facility of, interstate or foreign commerce.</text> </subparagraph></paragraph> 
<paragraph id="H5CD99C209C8649B0A7C4DE9374985355"><enum>(3)</enum><header>Distribution of animal crush videos</header><text>It shall be unlawful for any person to knowingly sell, market, advertise, exchange, or distribute an animal crush video in, or using a means or facility of, interstate or foreign commerce.</text> </paragraph></subsection> <subsection id="H4E6B24DFA3B149EA8DEC1B1AD85E2B94"><enum>(b)</enum><header>Extraterritorial application</header><text>This section applies to the knowing sale, marketing, advertising, exchange, distribution, or creation of an animal crush video outside of the United States, if—</text> 
<paragraph id="H9AFCBFCCCA0346268C73E6639BF8DF76"><enum>(1)</enum><text>the person engaging in such conduct intends or has reason to know that the animal crush video will be transported into the United States or its territories or possessions; or</text> </paragraph> <paragraph id="HF09ED81D63144A4D95F1D4131927F458"><enum>(2)</enum><text>the animal crush video is transported into the United States or its territories or possessions.</text> </paragraph></subsection> 
<subsection id="H7BC7E3757A794A8DA83DFEF4FF864AE6"><enum>(c)</enum><header>Penalties</header><text>Whoever violates this section shall be fined under this title, imprisoned for not more than 7 years, or both.</text> </subsection> <subsection id="H798403E8F2E84107941D605499476C46"><enum>(d)</enum><header>Exceptions</header> <paragraph id="H9CC38C667D094613B440666B76F4A914"><enum>(1)</enum><header>In general</header><text>This section does not apply with regard to any conduct, or a visual depiction of that conduct, that is—</text> 
<subparagraph id="H4C615ED705EE4E3CBFD5458DC6E11C81"><enum>(A)</enum><text>a customary and normal veterinary, agricultural husbandry, or other animal management practice;</text> </subparagraph> <subparagraph id="H7390023A624042808D8443E3A87F06F0"><enum>(B)</enum><text>the slaughter of animals for food;</text> </subparagraph> 
<subparagraph id="HEFBE415AC97C464CB895930902D182AB"><enum>(C)</enum><text>hunting, trapping, fishing, a sporting activity not otherwise prohibited by Federal law, predator control, or pest control;</text> </subparagraph> <subparagraph id="HA29948C9F2C947A2BC094599430A4DDD"><enum>(D)</enum><text>medical or scientific research;</text> </subparagraph> 
<subparagraph id="H9A039702362B42BD9A1916B77D2A99BE"><enum>(E)</enum><text>necessary to protect the life or property of a person; or</text> </subparagraph> <subparagraph id="H229FE640AD47446EB8F304F1DCDCBA8F"><enum>(F)</enum><text>performed as part of euthanizing an animal.</text> </subparagraph></paragraph> 
<paragraph id="HB7992848C75E4517AA5207EB0FF748D4"><enum>(2)</enum><header>Good-faith distribution</header><text>This section does not apply to the good-faith distribution of an animal crush video to—</text> <subparagraph id="H94CE3261E5DB471BADB7A8F6EA916608"><enum>(A)</enum><text>a law enforcement agency; or</text> </subparagraph> 
<subparagraph id="H343792D948C14CD3BB4E356F1831858F"><enum>(B)</enum><text>a third party for the sole purpose of analysis to determine if referral to a law enforcement agency is appropriate.</text> </subparagraph></paragraph> <paragraph id="HA7C66029DF814D7D800C6FCC5F97F153"><enum>(3)</enum><header>Unintentional conduct</header><text>This section does not apply to unintentional conduct that injures or kills an animal.</text> </paragraph> 
<paragraph id="H4BB4F5DE481B4484AD45C4EE472BDF6F"><enum>(4)</enum><header>Consistency with rfra</header><text>This section shall be enforced in a manner that is consistent with section 3 of the Religious Freedom Restoration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb-1">42 U.S.C. 2000bb–1</external-xref>).</text> </paragraph></subsection> <subsection id="H8F4F3A836BF34B86B10262D5DB00550C"><enum>(e)</enum><header>No preemption</header><text>Nothing in this section shall be construed to preempt the law of any State or local subdivision thereof to protect animals.</text> </subsection> 
<subsection id="HA0C6FECD513740198D9186DBB95025D4"><enum>(f)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H3099BAFF16ED47CBB1670428025B8B90"><enum>(1)</enum><text>the term <quote>animal crushing</quote> means actual conduct in which one or more living non-human mammals, birds, reptiles, or amphibians is purposely crushed, burned, drowned, suffocated, impaled, or otherwise subjected to serious bodily injury (as defined in section 1365 and including conduct that, if committed against a person and in the special maritime and territorial jurisdiction of the United States, would violate section 2241 or 2242);</text> </paragraph> 
<paragraph id="HBF33C6D9D1D741CC8E46F733F0B36E9E"><enum>(2)</enum><text>the term <quote>animal crush video</quote> means any photograph, motion-picture film, video or digital recording, or electronic image that—</text> <subparagraph id="H38EE09C6F51A470CAF1F9822EA47E3FC"><enum>(A)</enum><text>depicts animal crushing; and</text> </subparagraph> 
<subparagraph id="H59D892542A154216AAFCF38D3BAB15D3"><enum>(B)</enum><text>is obscene; and</text> </subparagraph></paragraph> <paragraph id="HBB47DD5BFA7A41619AF8ED56695E4B18"><enum>(3)</enum><text>the term <quote>euthanizing an animal</quote> means the humane destruction of an animal accomplished by a method that—</text> 
<subparagraph id="H21F0C9737ACE40ADB57916E02C0C009D"><enum>(A)</enum><text>produces rapid unconsciousness and subsequent death without evidence of pain or distress; or</text> </subparagraph> <subparagraph id="H3CEE4B8315004072AB097D80910DB231"><enum>(B)</enum><text>uses anesthesia produced by an agent that causes painless loss of consciousness and subsequent death.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H26C3B30DED074A659A398A3B0CFD428D"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/3">chapter 3</external-xref> of title 18, United States Code, is amended by striking the item relating to section 48 and inserting the following:</text> <quoted-block id="HE16F696ED40B41758589A7DD52584EE4" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">48. Animal crushing.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H9114BFE0BC1E4EB38EC7F6686E050086"><enum>3.</enum><header>Determination of Budgetary Effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, and the amendments made by this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text> </section>
