R. 7075</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200601">June 1, 2020</action-date><action-desc><sponsor name-id="G000587">Ms. Garcia of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the President from deploying any strategic weapon, such as a nuclear bomb, for purposes of altering weather patterns or addressing climate change, and for other purposes.</official-title></form><legis-body id="H466A2DE2F8624AAA9E2ACD00D56690DF" style="OLC"><section id="H14590E8C79424255BA17E00F617F632B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate Change and Hurricane Correlation and Strategy Act</short-title></quote>. </text></section><section id="H1E6023ED6D434D8A893B376EF30A594D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H6E7572D8FBE6457E997AB7B910978CF6"><enum>(1)</enum><text>According to reports dated August 24, 2019, President Trump suggested the use of nuclear weapons to disrupt hurricane paths. Specifically, the President stated, <quote>I got it. I got it. Why don’t we nuke them? They start forming off the coast of Africa, as they’re moving across the Atlantic, we drop a bomb inside the eye of the hurricane and it disrupts it. Why can’t we do that?</quote>.</text></paragraph><paragraph id="HF1885A8E53C24521A13709798B4B43EC"><enum>(2)</enum><text display-inline="yes-display-inline">The National Oceanic and Atmospheric Administration (NOAA), the United States Government agency that monitors and researches weather patterns and changes, stated <quote>During each hurricane season, there always appear suggestions that one should simply use nuclear weapons to try and destroy the storms. Apart from the fact that this might not even alter the storm, this approach neglects the problem that the released radioactive fallout would fairly quickly move with the tradewinds to affect land areas and cause devastating environmental problems. Needless to say, this is not a good idea.</quote>.</text></paragraph><paragraph id="H678A02074912414480652230906FD035"><enum>(3)</enum><text display-inline="yes-display-inline">Nuclear weapons are the most powerful weapons known to mankind. A nuclear blast radius carries exponentially damaging radioactive fallout, as demonstrated by atmospheric tests conducted by the United States in the 1950s and 1960s in the Pacific and Nevada Test Range.</text></paragraph><paragraph id="H8F4C104817994F509B1B73C161431F27"><enum>(4)</enum><text display-inline="yes-display-inline">According to the Director of National Intelligence and Chairman of the Joint Chiefs of Staff, climate change remains a critical national security threat.</text></paragraph><paragraph id="HC8D61AF011CD43D6B2B9ECD219EFA29A"><enum>(5)</enum><text display-inline="yes-display-inline">Researchers found that if little is done to constrain greenhouse gas emissions, and the world warms by 3 ºC to 4 ºC this century, then hurricane rainfall could increase by a third, while wind speeds would be boosted by as much as 25 knots.</text></paragraph><paragraph id="HAAB19BB23A914522B9258E4C1071C233"><enum>(6)</enum><text display-inline="yes-display-inline">Stronger hurricanes are intensifying more rapidly than they were 30 years ago due to climate change, according to recent research.</text></paragraph><paragraph id="H653C203859BC4F63B6462B886F948298"><enum>(7)</enum><text display-inline="yes-display-inline">Increasing numbers of hurricanes are a function of climate change and must be addressed through serious and long-term solutions that include scientific research and technological innovation.</text></paragraph><paragraph id="H586D2FBFE862413995CF5EA0C8C2256C"><enum>(8)</enum><text display-inline="yes-display-inline">There is cause for concern to public health, safety, and national security by the dangerous misuse of nuclear bombs to alter serious weather patterns. </text></paragraph></section><section id="H0B2557F71D05474897FF1C4A8A713C31"><enum>3.</enum><header>Prohibition</header><text display-inline="no-display-inline">The Federal Government (including the President and any Federal official, department, and agency) shall not deploy a strategic weapon, such as a nuclear bomb, for purposes of altering weather patterns or addressing climate change.</text></section><section id="HD727F5E43BE341468EC550EE9C99EB3A"><enum>4.</enum><header>Scientific report and strategic plan to address climate change and hurricanes</header><subsection id="HC100A9CD2A444FB1A000142AB085E6FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and annually thereafter for 5 years, the President, in coordination with the Administrators of the Environmental Protection Agency and the National Oceanic and Atmospheric Administration, shall issue a report to Congress on ways to combat increasing hurricane activity due to warming oceans from climate change.</text></subsection><subsection id="H5641739DF43E4AFB8C5C6F0F5E18208C"><enum>(b)</enum><header>Contents</header><text>Each report submitted under subsection (a) shall—</text><paragraph id="H5EB95A66D6C34BB9B0C61D7629BABB50"><enum>(1)</enum><text display-inline="yes-display-inline">specify the number, names, and dates of the hurricanes over the past 30 years;</text></paragraph><paragraph id="HD90401E6E8F9480F84FB58859B7B67F5"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to such hurricanes, include scientific evidence and research regarding—</text><subparagraph id="HD502A156455241968420C6B4670A8EA8"><enum>(A)</enum><text>fatalities and injuries;</text></subparagraph><subparagraph id="H7D5256EE814F43879D0F3E0FB2D9D371"><enum>(B)</enum><text>local, State, and Federal costs per hurricane; and</text></subparagraph><subparagraph id="H9610DC2AEDB14D428553FBC0C067B7AB"><enum>(C)</enum><text>frequency of occurrence and changes in magnitude and intensity patterns;</text></subparagraph></paragraph><paragraph id="H4541BBBC65E249649A2AB84DE201718F"><enum>(3)</enum><text>additional analysis of observations and changes to human activity that cause climate change and weather intensity; and</text></paragraph><paragraph id="HCD2F43897B3144AE9D0FCDC11266FC73"><enum>(4)</enum><text>the strategic plan addendum required by subsection (d).</text></paragraph></subsection><subsection id="H3ABCF9291FBF4202887080F5E863D927"><enum>(c)</enum><header>Effect of nuclear weapons</header><text display-inline="yes-display-inline">The first report submitted under subsection (a) shall include a one-time scientific explanation and analysis on the use of nuclear bombs to alter severe weather, such as hurricanes, including—</text><paragraph id="H0FFC48668D3F462290B5DDF86A77A66E"><enum>(1)</enum><text display-inline="yes-display-inline">the radioactive fallout;</text></paragraph><paragraph id="HD07580D97A3345EC82E31351F310171C"><enum>(2)</enum><text display-inline="yes-display-inline">the potential public health and environmental risks; and</text></paragraph><paragraph id="H8B0D3E1EEA394C47AFA3E8D135BD83F9"><enum>(3)</enum><text display-inline="yes-display-inline">observations as to how such use would or would not address the systemic issues and challenges of hurricanes.</text></paragraph></subsection><subsection id="H408604597D6D4A25BF8E33B5C8F0B907" commented="no"><enum>(d)</enum><header>Strategic plan</header><text display-inline="yes-display-inline">Each report submitted under subsection (a) shall include a strategic plan addendum including—</text><paragraph id="H0259F949FE1F4BE2B7AFC16658B2899A"><enum>(1)</enum><text>10-, 20-, and 30-year goals for—</text><subparagraph id="HED66D375B1114CC4B930D107EF1A8FAB"><enum>(A)</enum><text>reducing greenhouse gas emissions, pollution, and harmful human activity; and</text></subparagraph><subparagraph id="H2DA3343A10464E09A0325C51799F085A"><enum>(B)</enum><text>addressing causes of climate change and weather intensity; and</text></subparagraph></paragraph><paragraph id="H68A2F146AA3F42F4B12E9CCD0865D9FA"><enum>(2)</enum><text>recommendations to the Congress on policy changes needed to combat hurricane and climate change activity.</text></paragraph></subsection><subsection id="H82E8AE43EADB48859021060C3A5C84D5"><enum>(e)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing the report required by subsection (a), the Administrators of the Environmental Protection Agency and National Oceanic and Atmospheric Administration shall consult with relevant public and private sector scientific experts.</text></subsection></section></legis-body></bill>
