which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act and the CARES Act to modify certain provisions related to the forgiveness of loans under the paycheck protection program, to allow recipients of loan forgiveness under the paycheck protection program to defer payroll taxes, and for other purposes.</official-title></form><legis-body id="HA1850B565A76457891E200B3FD5A74C5" style="OLC"><section id="HC19AD244812F4BE7B39484293B0E9AD8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paycheck Protection Program Flexibility Act of 2020</short-title></quote>.</text></section><section id="H2388743B69654D95B5B30ECBC4BBED13" section-type="subsequent-section"><enum>2.</enum><header>Maturity for loans with remaining balance after application of forgiveness</header><text display-inline="no-display-inline">Section 7(a)(36)(K)(ii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) is amended by inserting <quote>minimum maturity of 5 years and a</quote> before <quote>maximum maturity</quote>.</text></section><section id="H3F024C6221E84E03868C62823C6A57D7"><enum>3.</enum><header>Amendments to paycheck protection program loan forgiveness</header><subsection id="H0F15514575CB4CA5983F0ABD99340B08"><enum>(a)</enum><header>Extension of covered period</header><text>Section 7(a)(36)(A)(iii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(A)(iii)</external-xref>) is amended by striking <quote>June 30, 2020</quote> and inserting <quote>December 31, 2020</quote>.</text></subsection><subsection id="HA109ADC722EA47FF9E900298D4CBFB9A"><enum>(b)</enum><header>Forgiveness</header><text display-inline="yes-display-inline">Section 1106 of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) is amended—</text><paragraph id="H5FBE5602D4E847658B3E650C3047EE56" commented="no"><enum>(1)</enum><text>in subsection (a), by striking paragraph (3) and inserting the following: </text><quoted-block style="OLC" id="H621A74266BB04B9BA173B7682C97E1AA" display-inline="no-display-inline"><paragraph id="HED32EEAD03F6485F8EA13A297A930D36" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>covered period</term> means, subject to subsection (l), the period beginning on the date of the origination of a covered loan and ending the earlier of—</text><subparagraph id="H019E73CA7E1A4D659D16DC86799CAEE2" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 24 weeks after such date of origination; or</text></subparagraph><subparagraph id="HD8B78C627DA64E06ACCB4819882E5AC3"><enum>(B)</enum><text>December 31, 2020;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H1069AFFBC76B41148CE61ECBCDF50FA5"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="HE782A67277F4458A8BF676B7D0A88EB5"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5)(B), by striking <quote>June 30, 2020</quote> each place it appears and inserting <quote>December 31, 2020</quote>; and</text></subparagraph><subparagraph id="HAE998FC963604AA8B6BC5FC5A98C734E"><enum>(B)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" id="H0E23869A9DFB48D2BD9C3FEA894E17C4" display-inline="no-display-inline"><paragraph id="HD010947FAA0047D0B1B8DD048D1E3768"><enum>(7)</enum><header>Exemption based on employee availability</header><text display-inline="yes-display-inline">During the period beginning on February 15, 2020, and ending on December 31, 2020, the amount of loan forgiveness under this section shall be determined without regard to a reduction in the number of full-time equivalent employees if an eligible recipient—</text><subparagraph id="H47ADBE45C8AE4DACB440A0CB641E1ADD"><enum>(A)</enum><text>is unable to rehire an individual who was an employee of the eligible recipient on or before February 15, 2020;</text></subparagraph><subparagraph id="H98B914C475234E8D84D056CE0ADB0B92"><enum>(B)</enum><text>is able to demonstrate an inability to hire similarly qualified employees on or before December 31, 2020; or</text></subparagraph><subparagraph id="H2141AA88F3C543BAACBA2580025DC615"><enum>(C)</enum><text>is able to demonstrate an inability to return to the same level of business activity as such business was operating at prior to February 15, 2020.</text></subparagraph></paragraph><paragraph id="H4A721EF915F440FE98C6ACB40DBA5EF7"><enum>(8)</enum><header>No limitations</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator may not limit the non-payroll portion of a forgivable covered loan amount.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H0BB4AF6A20DD40BD81D627EBEEF703AB"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H7B466E0EABA74B0AA3634C6F77A7DD80" display-inline="no-display-inline"><subsection id="H616924BB250D4433A01A5C6C0ECCABF6"><enum>(l)</enum><header>Application to certain eligible recipients</header><text display-inline="yes-display-inline">An eligible recipient that received a covered loan before the date of enactment of this subsection may elect for the covered period applicable to such covered loan to end on the date that is 8 weeks after the date of the origination of such covered loan.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HADDA9DED74E7444B8FF779EFDAF3B512"><enum>4.</enum><header>Delay of payment of employer payroll taxes</header><text display-inline="no-display-inline">Section 2302(a) of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) is amended by striking paragraph (3).</text></section><section id="H5C49425CA0AC41739C8A7A6149CDAB56"><enum>5.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall be effective as if included in the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) and shall apply to any loan made pursuant to section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) or section 1109 of the CARES Act. </text></section></legis-body></bill>
