<official-title display="yes">To require the Assistant Secretary of Commerce for Communications and Information, in consultation with the Secretary of Education, to promulgate regulations to provide support to institutions of higher education for the provision of certain equipment and services to students of those institutions, and for other purposes.</official-title>

<section id="id6CF42F9C223C4AD2B120468CCB23D273" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Con­nec­tiv­ity for Higher Education Students in Need Act</short-title></quote>.</text></section> <section id="idC6CDFB6201414CDBB8F48A5C848EAB5C"><enum>2.</enum><header>Funds to support</header> <subsection id="id93FFD2F4692348DD9862E520C546BE27"><enum>(a)</enum><header>Regulations Required</header> <paragraph id="idba89753dd4e749869fff892f23216ae3"><enum>(1)</enum><header>In general</header><text>Not later than 14 days after the date of enactment of this Act, the Assistant Secretary, in consultation with the Secretary of Education, shall promulgate regulations for the provision, from amounts made available from the Emergency Higher Education Connectivity Fund established under subsection (d)(1), of support to an institution of higher education for the purposes of providing eligible services and eligible equipment to students of that institution.</text></paragraph>
<paragraph id="idf435806acad64563978ed6127a735ea0"><enum>(2)</enum><header>Content</header><text>The regulations promulgated under paragraph (1) shall—</text> <subparagraph id="idEA0853B8665C45B3980A9B6FEB9C6C77"><enum>(A)</enum><text>prioritize support for—</text>
<clause id="id0A26A978EB6843978DBB5356E177D79C"><enum>(i)</enum><text>an institution of higher education that is eligible to receive a grant under part A or B of title III or title V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1057">20 U.S.C. 1057</external-xref> et seq., 1060 et seq., 1101 et seq.), including—</text> <subclause id="id0931993AD2C34027BA044817EB4BE370"><enum>(I)</enum><text>a historically Black college or university;</text></subclause>
<subclause id="id807718E69B5B4B7DB7E7C403565A1FD1"><enum>(II)</enum><text>a Hispanic-serving institution;</text></subclause> <subclause id="idDBFE2896FBC64B3C8235A1A668BD8C81"><enum>(III)</enum><text>a Tribal College or University; and</text></subclause>
<subclause id="id9FE06B7283784F129A19ADCD2DFF6F03"><enum>(IV)</enum><text>a minority-serving institution; and</text></subclause></clause> <clause id="id4F8D896798864418A512C9E603B3A173"><enum>(ii)</enum><text>a rural-serving institution;</text></clause></subparagraph>
<subparagraph id="id7A95FF3531D24F75A1F4031C51B05989"><enum>(B)</enum><text>provide a mechanism to require an institution of higher education to prioritize the provision of an eligible service or eligible equipment to a student who—</text> <clause id="idCF06C7AE60AB4677A90F9EDEBCAF5A62"><enum>(i)</enum><text>is eligible to receive a Federal Pell Grant;</text></clause>
<clause id="id3A2D344F6A00415D9800A258CBBB4E55"><enum>(ii)</enum><text>is a recipient of any other need-based financial aid from the Federal Government, a State, or that institution of higher education;</text></clause> <clause id="id179D2088DAF44F8CA785F07C27424BDF"><enum>(iii)</enum><text>is eligible for a Lifeline qualifying assistance program;</text></clause>
<clause id="idBD56995300594F14B9B638339A57E0D7"><enum>(iv)</enum><text>is a low-income individual, as that term is defined in section 312(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(g)</external-xref>);</text></clause> <clause id="idFC29E20ACA794332A631C62CB0310C62"><enum>(v)</enum><text> is a first generation college student, as that term is defined in section 646.7 of title 34, Code of Federal Regulations (or any successor regulation);</text></clause>
<clause id="id9D509BB73AB545E6AF78905088477299"><enum>(vi)</enum><text>has been approved to receive Federal or State unemployment insurance benefits since March 1, 2020; or</text></clause> <clause id="id291D8123535649EEB8D05C1634B3D0CD"><enum>(vii)</enum><text>the institution of higher education believes lacks necessary connectivity for participating in distance learning or academic and student support services;</text></clause></subparagraph>
<subparagraph id="id1E044CDCBFC548369B61B23BD4E743A4"><enum>(C)</enum><text>establish a schedule of reasonable per-student funding amounts for eligible services and eligible equipment supported under those regulations;</text></subparagraph> <subparagraph id="idAFBD18CCDC7B4AB9BC7ED8BA2217FDBD"><enum>(D)</enum><text>provide that—</text>
<clause id="id151B159A89984DBE80983141CBECF940"><enum>(i)</enum><text>an institution of higher education that purchases eligible equipment using support received under those regulations may, after the termination of those regulations under subsection (b), use that eligible equipment for purposes that the institution considers appropriate, subject to any restrictions provided in those regulations (or any successor regulations that are promulgated on or before the termination date described in paragraph (1) of that subsection);</text></clause> <clause id="id46C2FBA6A6014E049BFC04B8AFE71B0B"><enum>(ii)</enum><text>no person that receives support under those regulations may sell or otherwise transfer eligible support or eligible equipment in exchange for anything (including a service) of value, except that such person may exchange that eligible equipment for upgraded equipment of the same type; and</text></clause>
<clause id="id5CCB97737F4A4A5F908A6DF5B280D0C6"><enum>(iii)</enum><text>an institution of higher education may use support received under those regulations to provide eligible services and eligible equipment in conjunction with other Federal funding if the total amount of Federal funding received by the institution is not greater than the cost of so providing the eligible services and eligible equipment; and</text></clause></subparagraph> <subparagraph id="id6007A78C159F440689007665CAC2B074"><enum>(E)</enum><text>establish reasonable requirements—</text>
<clause id="id3FA0BF0BAB4B48CA86D7AC36DF85570F"><enum>(i)</enum><text>for an institution of higher education to apply for support under those regulations;</text></clause> <clause id="id99DBF19E8FFA4F979BC1B3BEB73C75F4"><enum>(ii)</enum><text>for an institution of higher education to procure eligible services and eligible equipment with support obtained under those regulations;</text></clause>
<clause id="id8B57829D6A0840D1AC7D9560A871398E"><enum>(iii)</enum><text>with respect to reporting, recordkeeping, retention of documents, compliance, and audits for an institution of higher education that receives support under those regulations;</text></clause> <clause id="id3BBFE6B7877C4B7EBD113B74EAA7B382"><enum>(iv)</enum><text>for payment and distribution of support to institutions of higher education under those regulations; and</text></clause>
<clause id="idB68104B268A842ABACC2AAF072A4F424"><enum>(v)</enum><text>with respect to any other processes that the Assistant Secretary, in consultation with the Secretary of Education, determines to be appropriate.</text></clause></subparagraph></paragraph></subsection> <subsection id="idE189204DA2A9482FA24EF35136CCDBF4"><enum>(b)</enum><header>Termination of regulations</header> <paragraph id="idA12AA85821824C62A5424F26310225E3"><enum>(1)</enum><header> In general</header><text>Subject to paragraph (2), the regulations promulgated under subsection (a) shall terminate on the date that is 60 days after the date on which the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) with respect to COVID–19, or any renewal of that declaration, terminates.</text></paragraph>
<paragraph id="id914097C09D93450996CA76153C486B8D"><enum>(2)</enum><header>Continuity of funding</header><text>If, during the period in which the regulations promulgated under subsection (a) are in effect, the Assistant Secretary makes a commitment to provide support to an institution of higher education under those regulations, the Assistant Secretary may make a payment with respect to that commitment on any date that is on or before September 30, 2021.</text></paragraph></subsection> <subsection id="idEF253C19EF2643E59465A211D9A46133"><enum>(c)</enum><header>Exemptions</header> <paragraph id="id306AEA935A914541A0B31469D4AC0C58"><enum>(1)</enum><header>Notice and comment rulemaking requirements</header><text>Subsections (b), (c), and (d) of section 553 of title 5, United States Code, shall not apply with respect to a regulation promulgated under subsection (a) of this section or a rulemaking to promulgate such a regulation.</text></paragraph>
<paragraph id="id2ACF0A199A9645828646C8D7FF59F8AF"><enum>(2)</enum><header>Paperwork Reduction Act requirements</header><text>A collection of information conducted or sponsored under the regulations promulgated under subsection (a) shall not constitute a collection of information for the purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection> <subsection id="idE34B808AF8F14273A583BD3C774C8EE5"><enum>(d)</enum><header>Emergency Higher Education Con­nec­tiv­ity Fund</header> <paragraph id="idb22c737f96b84654ac333c01c4569c95"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Emergency Higher Education Con­nec­tiv­ity Fund</quote>.</text></paragraph>
<paragraph id="id1831208AAF8641289357739B90C27FAB"><enum>(2)</enum><header>Appropriation</header><text>There is appropriated to the Emergency Higher Education Connectivity Fund, out of any money in the Treasury not otherwise appropriated, $1,000,000,000 for fiscal year 2020, to remain available through fiscal year 2021.</text></paragraph> <paragraph id="idEB940632C49A46A19DB0527722BF2AAA"><enum>(3)</enum><header>Use of funds</header><text>Amounts in the Emergency Higher Education Connectivity Fund shall be available to the Assistant Secretary to provide support under the regulations promulgated under subsection (a).</text></paragraph></subsection>
<subsection id="idBFC29D54B53840A3B28629268C5E8039"><enum>(e)</enum><header>Rule of Construction</header><text>Nothing in this section, any regulation promulgated under this section, or any policy established by an institution of higher education to implement this section or a regulation promulgated under this section may be construed to preclude any student from receiving support provided under this section or a regulation promulgated under this section.</text></subsection> <subsection id="id37DEED012C304440A043949EA1E483D3"><enum>(f)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="id0779DDEB45A444B89ABC73A91F3B355F"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph> <paragraph id="id68AFA24E64324D97B28431C3B4B4AB23"><enum>(2)</enum><header>Broadband internet access service</header><text>The term <term>broadband internet access service</term> has the meaning given the term in section 8.1(b) of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph>
<paragraph id="id5F70EB9325D74D5180D2FAB637E09E33"><enum>(3)</enum><header>Eligible equipment</header><text>The term <term>eligible equipment</term> means any of the following:</text> <subparagraph id="ide687b21eb0aa4aefbff4f8eb02bf9623"><enum>(A)</enum><text>A laptop computer, tablet computer, or similar device capable of connecting to broad­band internet access service.</text></subparagraph>
<subparagraph id="idC8386EB7AAE94EFDBCD14B438FAA3306"><enum>(B)</enum><text>A modem.</text></subparagraph> <subparagraph id="id8C3A0A2E167B49F780B2E307D6019436"><enum>(C)</enum><text>A router.</text></subparagraph>
<subparagraph id="id9BF21CF8A59D4F159DDEF1E4B2830E1F"><enum>(D)</enum><text>A device that combines a modem and a router.</text></subparagraph> <subparagraph id="idB2650AA80262424E92F0B291F6BCD521"><enum>(E)</enum><text>A Wi-Fi hotspot. </text></subparagraph></paragraph>
<paragraph id="id799a279a51254ec4b8ddc200afdb045d"><enum>(4)</enum><header>Eligible service</header><text>The term <term>eligible service</term> means—</text> <subparagraph id="id7F279568E5F34D3B9611CC1EE995D1ED"><enum>(A)</enum><text>broadband internet access service; and</text></subparagraph>
<subparagraph id="idE114F99FD0834429BF8EFAEC5F64AFF1"><enum>(B)</enum><text>video-conferencing systems and services used for distance learning.</text></subparagraph></paragraph> <paragraph id="id2440592CBE3846BDB5B66144B678433D"><enum>(5)</enum><header>Federal Pell Grant</header><text>The term <term>Federal Pell Grant</term> means a grant under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>).</text></paragraph>
<paragraph id="id6362736339F84923A885E01D27118171"><enum>(6)</enum><header>Hispanic-serving institution</header><text>The term <term>Hispanic-serving institution</term> has the meaning given the term in section 502 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a</external-xref>).</text></paragraph> <paragraph id="id7E608D0102B4476994B6BDE90862612C"><enum>(7)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph>
<paragraph id="idDE270A5AEFF64437864BBC4799766E44"><enum>(8)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means—</text> <subparagraph id="idE46253E50F124E308CF0AB3B8C3F0FFE"><enum>(A)</enum><text>an institution of higher education, as that term is defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>); or</text></subparagraph>
<subparagraph id="idEDC9693CE1CA4B3CA548AB48050A6369"><enum>(B)</enum><text>a postsecondary vocational institution, as that term is defined in section 102(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>).</text></subparagraph></paragraph> <paragraph id="idEA65C958CEAC4AC1989328DC19F45F12"><enum>(9)</enum><header>Lifeline qualifying assistance progam</header><text>The term <term>Lifeline qualifying assistance program</term> means a program described in section 54.400(j) of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph>
<paragraph id="id325361215F9C4DE98F2A0CC243A520E9"><enum>(10)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means any of the following:</text> <subparagraph id="id5A52AB5AF9CE4130ABFF7D6EF0F476F0"><enum>(A)</enum><text>An Alaska Native-serving institution (as that term is defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>)).</text></subparagraph>
<subparagraph id="id79BD62CD5D31444C99C415A37C4CC14D"><enum>(B)</enum><text>A Native Hawaiian-serving institution (as that term is defined in section 317(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>)).</text></subparagraph> <subparagraph id="id1ABE895A7DDD4B5592ACF5ED7DA042BC"><enum>(C)</enum><text>A Predominantly Black institution (as that term is defined in section 371(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>)).</text></subparagraph>
<subparagraph id="id5BE45EE5DCC1459BB8BEA51B0C743149"><enum>(D)</enum><text>An Asian American and Native American Pacific Islander-serving institution (as that term is defined in section 320(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059g">20 U.S.C. 1059g(b)</external-xref>)).</text></subparagraph> <subparagraph id="id53316CA998174CFB91885C341734BBB4"><enum>(E)</enum><text>A Native American-serving, nontribal institution (as that term is defined in section 319(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059f">20 U.S.C. 1059f(b)</external-xref>)).</text></subparagraph>
<subparagraph id="id5216EB2246C94892B211CEF686B95FEE"><enum>(F)</enum><text>A consortium of any of the following:</text> <clause id="idD0104FCEB0EB4AC1A3DDF3DD2506EC05"><enum>(i)</enum><text>A historically Black college or university.</text></clause>
<clause id="idA4D29863A3A147E4885EA2030AA2E155"><enum>(ii)</enum><text>A Hispanic-serving institution.</text></clause> <clause id="id5C683C73EACD4351B8C2711C999C1C51"><enum>(iii)</enum><text>A Tribal College or University.</text></clause>
<clause id="id59A783B1919D4728A606AEBC1CDA59B3"><enum>(iv)</enum><text>An institution described in any of subparagraphs (A) through (E).</text></clause></subparagraph></paragraph> <paragraph id="idD4C97E7069794A2CB4A4E6E4B6185354"><enum>(11)</enum><header>Rural-serving institution</header><text>The term <term>rural-serving institution</term> has the meaning given the term <term>rural-serving institution of higher education</term> in section 861(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161q">20 U.S.C. 1161q(b)</external-xref>).</text></paragraph>
<paragraph id="id8546C9FFBA3E43F4A7B8232CA1A94217"><enum>(12)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text></paragraph> <paragraph id="id68A055744FC14A45BAAE18FA3377EBA0"><enum>(13)</enum><header>Student</header><text>The term <term>student</term>, when used with respect to an institution of higher education, means an individual who, during the period in which the individual receives support under the regulations promulgated under subsection (a), is—</text>
<subparagraph id="id497DE3014F99418899A19404F1C8AA93"><enum>(A)</enum><text>registered as a student with the institution;</text></subparagraph> <subparagraph id="idA237908B421740FB97BD2B5315AF1CE4"><enum>(B)</enum><text>enrolled in not less than 1 class of the institution; or</text></subparagraph>
<subparagraph id="idB61ACD5FE9314FE788102ABFF7652857"><enum>(C)</enum><text>otherwise considered a student by the institution.</text></subparagraph></paragraph> <paragraph id="idE25189FF943241D383788BBADF06AB27"><enum>(14)</enum><header>Tribal college or university</header><text>The term <term>Tribal College or University</term> has the meaning given the term in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></paragraph>
<paragraph id="id73EC4A0E0E584DE9AA381EEC08F17B1A"><enum>(15)</enum><header>Wi-Fi</header><text>The term <term>Wi-Fi</term> means a wireless networking protocol based on Institute of Electrical and Electronics Engineers standard 802.11 (or any successor standard).</text></paragraph> <paragraph id="id57E34D9C6D5D4AB9B0B7097D5CAC9CAB"><enum>(16)</enum><header>Wi-Fi hotspot</header><text>The term <term>Wi-Fi hotspot</term> means a device that is capable of—</text>
<subparagraph id="idCB1ACDA154894C9B9F762C3920A656E6"><enum>(A)</enum><text>receiving broadband internet access service; and</text></subparagraph> <subparagraph id="id19115EACD14D4727BB852B4969CCE587"><enum>(B)</enum><text>sharing broadband internet access service with another device through the use of Wi-Fi.</text></subparagraph></paragraph></subsection></section>
