R. 6719</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200505">May 5, 2020</action-date><action-desc><sponsor name-id="K000389">Mr. Khanna</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HBA00">Financial Services</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Federal Government to provide critical health care resources in response to the COVID–19 pandemic.</official-title></form><legis-body id="HF0835AB1D25745FCB064E0841EACC31F" style="OLC"><section id="HF8E395E9169C4F3C914E4F7A745D929B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Medical Supplies Procurement Act</short-title></quote>. </text></section><section id="HD0F5579F53F14D639A31EBB598AD0823"><enum>2.</enum><header>Federal provision of critical health care resources</header><subsection id="HA1CD28BE5D684FDA95A895376D212B15"><enum>(a)</enum><header>Requirement To provide critical health care resources</header><paragraph id="HCF8B9FD7F619408E92A9615C3046E067"><enum>(1)</enum><header>In general</header><text>The President, acting through the Administrator of the Federal Emergency Management Agency, and in consultation with the Secretary of Health and Human Services and the head of any other relevant Federal agency, shall fulfill, to the greatest extent possible and with due urgency, according to need, all requests from States for critical health care resources that are required to support medical providers, treat patients, or promote the general well-being in response to, or to recover from, the outbreak of COVID–19.</text></paragraph><paragraph id="H36698E4CECCC43FA98642C6A29DF9D04"><enum>(2)</enum><header>Use of authorities</header><text>To carry out paragraph (1), the President shall make use of any and all available authorities at the disposal of the Federal Government to procure, manufacture, and support the manufacturing of critical health care resources, including emergency authorities such as the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4511">50 U.S.C. 4511</external-xref> et seq.), the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.), and the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.).</text></paragraph><paragraph id="H87C5EF90164146F3A2976CCDCD05F481"><enum>(3)</enum><header>Determination of emergency end date</header><text>The Secretary of Health and Human Services and the Administrator of the Federal Emergency Management Agency shall jointly—</text><subparagraph id="H4F6A051B095D4E898D8BA1CD13EA9B78"><enum>(A)</enum><text>determine the date on which all requests from States for critical health care resources related to the outbreak of COVID–19 are fulfilled or otherwise resolved, which shall not be earlier than the day after the date on which no new cases of COVID–19 are reported in the United States for a period of not less than 14 consecutive days; and</text></subparagraph><subparagraph id="H1C9447868D6C49629A1278ED53146091"><enum>(B)</enum><text>promptly submit to Congress and the Secretary of the Treasury a certification indicating the date determined under subparagraph (A). </text></subparagraph></paragraph></subsection><subsection id="H89688C42FD9941709DD687B1F1BC44F4"><enum>(b)</enum><header>Reports to Congress</header><text>Not later than 7 days after the date of enactment of this Act, and every 7 days thereafter until the COVID–19 emergency end date, the Secretary of Health and Human Services and the Administrator of the Federal Emergency Management Agency shall jointly submit to Congress a report on the implementation of and activities authorized by this section, including information on—</text><paragraph id="HEB34D1841E4A478F8537955D617ABA4D"><enum>(1)</enum><text>the use of funds; </text></paragraph><paragraph id="H59D184BEC97446ECB6562315DC4743A8"><enum>(2)</enum><text>the number of requests received from States for critical health care resources, including the contents of the requests and the dates on which the requests are received and fulfilled;</text></paragraph><paragraph id="H5A1741EB2E4744A485B6A72078CA1A35"><enum>(3)</enum><text>if any State request received has not been fulfilled or has been partially fulfilled, the reasons why the request was not fully fulfilled; </text></paragraph><paragraph id="HA5093639FEA845858CCFA9FC0695D439"><enum>(4)</enum><text>the distribution of critical health care resources by State, geographic area, and need; </text></paragraph><paragraph id="HD5B85F55862B4890AA801F760DD0B3F4"><enum>(5)</enum><text>the criteria or methodology used to guide the prioritization of State requests and the distribution of critical health care resources; and</text></paragraph><paragraph id="HA174020928BC4CAEBFF5C65891187A5E"><enum>(6)</enum><text>the sources of the critical health care resources provided to States, including the prices paid by the Federal Government for such critical health care resources and to which suppliers such amounts were paid.</text></paragraph></subsection><subsection id="HCF98E65223E34CD5ADB015A99C70B056"><enum>(c)</enum><header>Funding; limitations</header><paragraph id="H4811B6FD656D4AD69C680EABED83E362"><enum>(1)</enum><header>Funding</header><text>There is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2020, to remain available until the COVID–19 emergency end date, $75,000,000,000 to the Federal Emergency Management Agency to carry out this section.</text></paragraph><paragraph id="H6AC4D962F6734F8E8A8F003CE14EA934"><enum>(2)</enum><header>Limitation</header><text>No funds made available under this section shall be provided to—</text><subparagraph id="H229C0D59B8654A8EAABE76BFE1F28EF4"><enum>(A)</enum><text>any person who is a Federal elected official or serving in a Senior Executive Service position; or</text></subparagraph><subparagraph id="HDEB9EE9CB5834C2AA2D6C05C2BDF55CB"><enum>(B)</enum><text>any entity that is controlled in whole or in part by a Federal elected official or serving in a Senior Executive Service position. </text></subparagraph></paragraph><paragraph id="H97A63C9A82A540BF8501F6D00120871A"><enum>(3)</enum><header>Emergency designation</header><subparagraph id="H7BA0D08F420145A39832C9032CEA798A"><enum>(A)</enum><header>In general</header><text>The amounts provided under this section are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subparagraph><subparagraph id="HF074CE05744D4C6C972D58F588DF1667"><enum>(B)</enum><header>Designation in Senate</header><text>In the Senate, this section is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018. </text></subparagraph></paragraph></subsection><subsection id="H69029272D979466AA4FE2EEA1FE68F3D"><enum>(d)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H6794D35DC3E7488E9EB8F442D7EDC70C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>COVID–19 emergency end date</term> means the date on which all requests from States for critical health care resources related to the outbreak of COVID–19 are fulfilled or otherwise resolved, as certified by the Administrator of the Federal Emergency Management Agency and the Secretary of Health and Human Services under subsection (a)(3); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5A43A3916D7A4547950A9FC30B52D4C7"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>critical health care resources</term> includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="H13EDC52F409C49FC8741CD580F41F790"><enum>(A)</enum><text display-inline="yes-display-inline">personal protective equipment (such as surgical masks, N–95 respirator masks, surgical gowns, and face visors); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF64FCD0BDEF244B3ACA7F337738E03B3"><enum>(B)</enum><text display-inline="yes-display-inline">ventilators; </text></subparagraph><subparagraph id="HBD0E0650B8924F51B871535311B5DBC0"><enum>(C)</enum><text>testing reagents and compounds; </text></subparagraph><subparagraph id="H12F3BB14BB5C4DC59C5735F0385DE4CF"><enum>(D)</enum><text>approved vaccines, therapeutics, di­ag­nos­tics, pharmaceuticals, small molecule active pharmaceutical ingredients, and other necessary drugs; </text></subparagraph><subparagraph id="HF629112AA1334D7FB66FF8FF8D2252FF"><enum>(E)</enum><text>ancillary medical supplies, and other applicable supplies required for the administration of drugs, vaccines and other biological products, medical devices, and diagnostic tests; and</text></subparagraph><subparagraph id="H39BD2E4999134DAEAE8CA1CC1DD4C3BB"><enum>(F)</enum><text>other medical supplies or hospital infrastructure, as necessary; </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HFDB6452CD0F04429AEBAFB871ACE6B32"><enum>(3)</enum><text>the term <term>Senior Executive Service position</term> has the meaning given that term in section 3132(a) of title 5, United States Code; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HCCD474C92E44417CA5019D6F07FD0E00"><enum>(4)</enum><text>the term <term>State</term> means— </text><subparagraph id="H2845015C3A134D9FAFB7D5F54339E7D5"><enum>(A)</enum><text>each of the several States of the United States;</text></subparagraph><subparagraph id="H318CFBAA48C44DAB89A78C702323E9EA"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H783D0C20B840477DB42E64EF608FC9F5"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="H373A55C9AD1746199CEE149AB1BFE75E"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph id="H26ECD8D6ECEF4006A562B2BC519EE443"><enum>(E)</enum><text>American Samoa;</text></subparagraph><subparagraph id="H6DF5EF4F6ED0466CA1D806DD6C31CB08"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="HC90524FB3B2D4DC2826B731D6BA972F2"><enum>(G)</enum><text>the Federated States of Micronesia;</text></subparagraph><subparagraph id="H295728DCDEF74FABABA708699B4CAFDF"><enum>(H)</enum><text>the Republic of the Marshall Islands;</text></subparagraph><subparagraph id="H860234F309C94E7C88DE005416886077"><enum>(I)</enum><text>the Republic of Palau;</text></subparagraph><subparagraph id="HEC949086A4024E909F9D715F6958CAD9"><enum>(J)</enum><text>the United States Virgin Islands; and</text></subparagraph><subparagraph id="HC1272448E21347199866D93B568CEFF5" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text>an Indian tribe, as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>). </text></subparagraph></paragraph></subsection></section></legis-body></bill>
