which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the issuance of emergency monthly payments to every American throughout the duration of the coronavirus crisis to be provided by the Department of the Treasury, in consultation with other Federal and State agencies.</official-title></form><legis-body id="H9FD99C1D0E83451789D309B78F237865" style="OLC"><section id="H5BDC26A55C4E4650A61C175688EEDFB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Money for the People Act</short-title></quote>.</text></section><section id="H4953DBC379274C09A1E992D0CFB80CF5"><enum>2.</enum><header>Emergency payments</header><subsection id="H1C1B9A150B0E4181A6DCF010F022E4EF"><enum>(a)</enum><header>General rule</header><paragraph id="HE41652B9B81A4877B9279B2ABFA9D99F"><enum>(1)</enum><header>Directive to make payments</header><text>The Secretary of the Treasury shall make a payment in each month of the payment period to each eligible individual.</text></paragraph><paragraph id="HF210E4C4A71146A8903B97F59845AA39"><enum>(2)</enum><header>Beginning date</header><text display-inline="yes-display-inline">Payments for the first of such months shall be distributed within 14 days after the date of the enactment of this Act.</text></paragraph><paragraph id="H2B03D0F62E7F4A43ABC87AE313ECF702"><enum>(3)</enum><header>Payment period</header><text>The term <term>payment period</term> means the 12-month period beginning with the first month in which the Secretary makes a payment under paragraph (1), unless as of the end of the sixth month of such period the employment-to-population ratio for people ages 16 and over is greater than 60 percent.</text></paragraph><paragraph id="H18AA16A922B34BD89870CCC0C5298CDF"><enum>(4)</enum><header>Form and manner of payments</header><text display-inline="yes-display-inline">Payments under paragraph (1) shall be made in such form and manner as the Secretary shall provide, except that the Secretary shall—</text><subparagraph id="H34269F13AAD44A5A9108AEAA8359FD40"><enum>(A)</enum><text display-inline="yes-display-inline">offer the option of receiving payments under this section by direct deposit, check, pre-paid debit card, or electronic transfer of payment through an electronic transfer application that can be used on mobile devices to receive payments; and</text></subparagraph><subparagraph id="HEA01A2FC2DBF44639DD1E29384CC2622"><enum>(B)</enum><text>ensure that payments under this section are made to those without fixed addresses.</text></subparagraph></paragraph></subsection><subsection id="H192452EC4FCF4E048E8AB78D45B482B5"><enum>(b)</enum><header>Eligible individual</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HEABC958E59FF40B2AD95772A64427D3D"><enum>(1)</enum><header>In general</header><text>The term <term>eligible individual</term> means any individual—</text><subparagraph id="HA1230B56B22245A5A606B3214BA49C7B"><enum>(A)</enum><text>who—</text><clause id="H268A9F5486304DB8A749AB80A187C055"><enum>(i)</enum><text>is a citizen or resident of the United States; or</text></clause><clause id="HD1117464711240D08627D1986AC5AC12"><enum>(ii)</enum><text>is described in paragraph (4);</text></clause></subparagraph><subparagraph id="HBC002519AE6B4AF6A636DE5C75F3BF68"><enum>(B)</enum><text>who, as of January 1, 2020, has attained the age of 16; and</text></subparagraph><subparagraph id="HBD6D183CDAEF4D4EB82393D7258FB5E4"><enum>(C)</enum><text>whose adjusted gross income either—</text><clause id="HCC88BA4D955747978FF3A5DE0BA45443"><enum>(i)</enum><text>does not exceed the threshold amount for the taxable year beginning in 2019; or</text></clause><clause id="H948DBFE876334B4E9151D7CFF2A6C0D2"><enum>(ii)</enum><text>would not exceed the threshold amount for the first taxable year beginning in 2020, determined on the basis of 2 consecutive months of such taxable year and annualized.</text></clause></subparagraph></paragraph><paragraph id="H4B2C2E08306542B3A90BA639CD7FDC95"><enum>(2)</enum><header>Special rule for married individuals</header><text display-inline="yes-display-inline">In the case of any individual who filed a joint return for the taxable year beginning in 2019, the individual and the spouse of the individual shall be treated as one person if either the individual or the spouse of the individual meets the requirements specified in subparagraphs (A) and (B) of paragraph (1).</text></paragraph><paragraph id="HB47CFE98D9F44FDEB3F4EF73740259B4"><enum>(3)</enum><header>Certain dependents</header><text display-inline="yes-display-inline">The term <term>eligible individual</term> does not include any dependent (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152</external-xref> of the Internal Revenue Code of 1986) who, as of December 31, 2019, has not attained the age of 16 and with respect to whom a deduction under section 151(c) of such Code is allowable to another individual for the taxable year beginning in 2019.</text></paragraph><paragraph id="HBD3F72B010134854BECCAFA9688BA653"><enum>(4)</enum><header>Special rule for individuals in the United States continuously since the declaration of national emergency</header><subparagraph id="H1903413A25D74DF4B65E8AB5822EAFFF"><enum>(A)</enum><header>In general</header><text>An individual is described in this paragraph if the individual—</text><clause id="HF9484ECD582043E9BC62B6EEC39FDFAE"><enum>(i)</enum><text>is not a citizen or resident of the United States; and</text></clause><clause id="HB80D69795FDD415C8712580B04140E93"><enum>(ii)</enum><text display-inline="yes-display-inline">has been physically present in the United States continuously since January 27, 2020 (the effective date of the public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) resulting from the COVID–19 pandemic), and continues to be physically present in the United States throughout the duration of the payment period.</text></clause></subparagraph><subparagraph id="H0DF16BB9625B4887A1222D44F4FE369E"><enum>(B)</enum><header>Break in presence</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(ii), an individual shall be considered to have failed to maintain continuous physical presence in the United States if the individual has departed from the United States for any period exceeding 90 days or for any periods, in the aggregate, exceeding 180 days.</text></subparagraph></paragraph><paragraph id="H3125F308BACA483C8EAFB3FED1C1AED7"><enum>(5)</enum><header>Consultation with other Federal and State agencies</header><text display-inline="yes-display-inline">For purposes of identifying and making payments under this section to all eligible individuals for whom the Secretary does not have sufficient tax return information to make such payments, the Secretary shall consult with—</text><subparagraph id="HAAFC40B3E9BB4AC7BF086DD1E2FB0435"><enum>(A)</enum><text>the Secretary of Veterans Affairs and the Commissioner of Social Security; and</text></subparagraph><subparagraph id="H533E0A2178FB47A6B711527730640FCA"><enum>(B)</enum><text display-inline="yes-display-inline">any agency making payments of pension or annuity to individuals for service performed in the employ of the United States or any State, political subdivision of a State, or any instrumentality thereof, which is not considered employment for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/21">chapter 21</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></subsection><subsection id="H8E2511F120DD4E3D89A1D65E7F39CD61"><enum>(c)</enum><header>Amount of payment</header><paragraph id="H32D2EDB428BA47B4946FBBE5C322A23C"><enum>(1)</enum><header>In general</header><text>The amount of each payment under subsection (a) shall be—</text><subparagraph id="H957E986FB8AE4259B7AD77795C8C4893"><enum>(A)</enum><text>except as provided in subparagraph (B), $2,000 in the case of an individual described in subsection (b)(1); and</text></subparagraph><subparagraph id="H41667BDA9E394F8AABDE1E4F2BDE8FC9"><enum>(B)</enum><text display-inline="yes-display-inline">$4,000, made jointly, in the case of two individuals filing a joint return for a taxable year beginning in 2019.</text></subparagraph></paragraph><paragraph id="HF383ABFEC3F4443698B65F681C9A40EB" commented="no"><enum>(2)</enum><header>Additional amount for dependents</header><subparagraph id="HE0DA5B63CCFE4469ADA6A28CF8602186" commented="no"><enum>(A)</enum><header>One child</header><text>If a deduction is allowed for one or more dependents on the return for the taxable year beginning in 2019, the amount in paragraph (1) shall be increased by $500 in the case of a return for which one deduction is allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/151">section 151(c)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><subparagraph id="HB68B7CE918084423B5B049EDD84519E5" commented="no"><enum>(B)</enum><header>Three or more children</header><text display-inline="yes-display-inline">In the case of deductions allowed for three or more dependents on the return for the taxable year beginning in 2019, subparagraph (A) shall be applied by substituting <quote>$1,500</quote> for <quote>$500</quote>.</text></subparagraph></paragraph><paragraph id="H076ED52886B847EE9B305331DE2C60FC"><enum>(3)</enum><header>Phaseout</header><subparagraph id="H3AF74890C7634CED8DA4E9A237A55346"><enum>(A)</enum><header>In general</header><text>The amount of a payment specified in paragraph (1) shall be reduced (but not below zero) by 5 percentage points for each $1,000 (or fraction thereof) by which the taxpayer’s adjusted gross income exceeds the threshold amount.</text></subparagraph><subparagraph id="H22EAB69E1C7747F8A8818A92EEA3383C"><enum>(B)</enum><header>Threshold amount</header><text>For purposes of subparagraph (A), the term <term>threshold amount</term> means—</text><clause id="H6DA6B240B51B4022AE32451C265EA371"><enum>(i)</enum><text display-inline="yes-display-inline">$130,000 in the case of an individual who filed a separate return for the taxable year beginning in 2019; and</text></clause><clause id="H1E912BABD94A49B1B1A7050FA6E8E97C"><enum>(ii)</enum><text display-inline="yes-display-inline">$260,000 in the case of the individuals treated as one person under subsection (c)(2) who filed a joint return for the taxable year beginning in 2019.</text></clause></subparagraph></paragraph></subsection><subsection id="H921B7BB2A62C46D5835749FF7EFAA9C8"><enum>(d)</enum><header>Special rules relating to available information</header><paragraph id="HB295A78237CD4B8B90D63E94311C9AAF"><enum>(1)</enum><header>Use of return information for 2018 returns</header><text display-inline="yes-display-inline">For purposes of making determinations under this section with respect to any individual, if return information of such individual is not available for the taxable year beginning in 2019, the Secretary shall use return information (if any) for the taxable year 2018 instead.</text></paragraph><paragraph id="H24F8DBD1368B4CE1A8AD991EBFA93A19"><enum>(2)</enum><header>Individuals for whom information not available</header><text>In the case of any individual for whom return information is not available from the Internal Revenue Service and the Secretary determines that sufficient information is not available from the Social Security Administration or the Department of Veterans Affairs, the Secretary shall provide for an application process for individuals to receive payments under this section. Such application shall be in such form and filed in such manner as the Secretary may require. For purposes of carrying out this section, the Secretary of the Treasury shall work in cooperation with the Secretary of Veterans Affairs and the Commissioner of Social Security. </text></paragraph></subsection><subsection id="H3F09491B4C954691A4501716571982E6"><enum>(e)</enum><header>Other definitions</header><text>For purposes of this section—</text><paragraph id="H812D7C8D98C94D968E2CAC67741C81BA"><enum>(1)</enum><header>Citizen or resident</header><text display-inline="yes-display-inline">The term <term>citizen or resident of the United States</term> means a citizen or resident (as such terms are used in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(30)(A)</external-xref> of the Internal Revenue Code of 1986) of the United States.</text></paragraph><paragraph id="H1EA06D6AA6DE4709922C31F1F2E1C3CE"><enum>(2)</enum><header>United States defined</header><text display-inline="yes-display-inline">The term <term>United States</term> means the several States, the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the United States Virgin Islands.</text></paragraph><paragraph id="H86EC2F2D13EE463BB20037BD6748B1E0"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury or the Secretary’s delegate.</text></paragraph><paragraph id="H5D20FDCA4B8C45F4ABA5F32C24DAEC18"><enum>(4)</enum><header>Other terms</header><text>Except as otherwise provided in this section, any term used in this section which is used in the Internal Revenue Code of 1986 shall have the meaning as used in the Internal Revenue Code of 1986.</text></paragraph></subsection><subsection id="H141D10F465A44D3AACF90EC7E763816D"><enum>(f)</enum><header>Special rules</header><text>For purposes of this section—</text><paragraph id="HA48200FE603F4B249DEC013A0C138065"><enum>(1)</enum><header>Income exclusion</header><text>Payments under this section shall not be includible in gross income for purposes of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HE3F40A96AD5C49ED949E3F06B13F3F04"><enum>(2)</enum><header>Excluded from gross estate</header><text display-inline="yes-display-inline">Payments under this section shall not be includible in the gross estate of any individual for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/11">chapter 11</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HD31F8DAA5BFF4E30A399F8683C1449DB"><enum>(3)</enum><header>Toll-free hotline telephone number</header><text display-inline="yes-display-inline">The Secretary shall provide a 24 hour toll-free hotline telephone number for any individual to apply for payments, and make inquiries regarding the payment deliveries, under this section.</text></paragraph><paragraph id="HBBAC972ACCC7461981548D50EE10E61F"><enum>(4)</enum><header>Payments disregarded in the administration of Federal programs and federally assisted programs</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any payment made to any individual under this section shall not be taken into account as income or income maintenance, and shall not be taken into account as resources for a period of 12 months from receipt, for purposes of determining the eligibility of such individual (or any other individual) for benefits or assistance (or the amount or extent of benefits or assistance) under any Federal program or under any State or local program financed in whole or in part with Federal funds.</text></paragraph></subsection><subsection id="HA674D080BA1744FA9D34A7E22ACA4AAA" commented="no"><enum>(g)</enum><header>Regulations or other guidance</header><text>The Secretary shall issue such regulations or other guidance as may be necessary or appropriate to carry out this section, including regulations or guidance to—</text><paragraph id="H135687953FFA4C7EBC727DF1AFF1DE93" commented="no"><enum>(1)</enum><text>address changes in marital status, births, and deaths;</text></paragraph><paragraph id="H53150C7AA124412C8712C6431B5FDAB5" commented="no"><enum>(2)</enum><text>use the most current information available; and</text></paragraph><paragraph id="H32815CC51E064362A2E7FD79230D75D3" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">provide for proper adjustments in payments, and recapture of payments, to correct under and over payments.</text></paragraph></subsection><subsection id="H206FCFEF0F0F4ABB9C517A6A0AEE5B58"><enum>(h)</enum><header>Appropriations</header><text display-inline="yes-display-inline">There are hereby appropriated from money in the Treasury not otherwise appropriated such sums as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
