R. 6444</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200403">April 3, 2020</action-date><action-desc><sponsor name-id="G000589">Mr. Gooden</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Foreign Sovereign Immunities Act to establish an exception to jurisdictional immunity for a foreign state that discharges a biological weapon, and for other purposes.</official-title></form><legis-body id="HBFA2193222AC40C0A631BFF0890ECF14" style="OLC"><section id="H8CD9DE92352C421C87A4225C5C3EC2DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop China-Originated Viral Infectious Diseases Act of 2020</short-title></quote> or the <quote><short-title>Stop COVID Act of 2020</short-title></quote>. </text></section><section id="H16C53FC6FC7C4D7EB77D14C61600739B"><enum>2.</enum><header>Exception to jurisdictional immunity of a foreign state</header><subsection id="H1E99374C5383404ABA93455E1DF79E37"><enum>(a)</enum><header>Exception to jurisdictional immunity</header><text display-inline="yes-display-inline">Section 1605 of title 28, United States Code, is amended—</text><paragraph id="H461F3628063B4169B54F6A8069DF90D7"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively; and </text></paragraph><paragraph id="HEE07D52187A14743A2C6C14F7A103439"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" id="H2CCB643570E84A54B93F2124BDEAA78B" display-inline="no-display-inline"><subsection id="H7DCD25CF921941A1B75CF45E6F9D447D"><enum>(g)</enum><text display-inline="yes-display-inline">A foreign state shall not be immune from the jurisdiction of the courts of the United States in any case where such foreign state is found, whether intentionally or unintentionally, to have discharged a biological weapon, as defined in section 2280(d)(3) of title 18, United States Code, in the United States or such discharge results in the bodily injury of an United States citizen. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8AF505F9539E45D6A4B90FCE99D35F1C"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
