R. 5901</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>October 1, 2020</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To establish a program to facilitate the adoption of modern technology by executive agencies, and for other purposes.</official-title></form><legis-body id="HECD07480EDE644E2BE66482DB6E28970" style="OLC"><section id="H5E7A2A1820B8496B874C7B89CF4A98A4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Information Technology Modernization Centers of Excellence Program Act</short-title></quote>.</text></section><section id="HCA23FEEE5C7F49A585FFCBC5DD434C2D"><enum>2.</enum><header>GSA modernization centers of excellence program</header><subsection id="H2CEA98E6C8DF40CC91D9307BA63F8AE0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H787EC49CAAAE439A8324D2243A75D093"><enum>(1)</enum><header>Cloud computing</header><text>The term <term>cloud computing</term> has the meaning given the term in section 1076 of the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note).</text></paragraph><paragraph id="H0DD3F1BAAAF7456A9BBC992810CD8CC7"><enum>(2)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code.</text></paragraph><paragraph id="H34F5F1ED4C844577A5DC150F2381F857"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the Information Technology Modernization Centers of Excellence Program established under subsection (b).</text></paragraph></subsection><subsection id="H508F94F7B6134A18BB25B07E04654067"><enum>(b)</enum><header>Establishment</header><text>The Administrator of General Services shall establish a program to be known as the Information Technology Modernization Centers of Excellence Program to facilitate the adoption of modern technology by executive agencies on a reimbursable basis.</text></subsection><subsection id="H81156C593AC84452BB2B80423054A79D"><enum>(c)</enum><header>Responsibilities</header><text>The Program shall have the following responsibilities:</text><paragraph id="H24A625795C69425596773D628E8DC02C"><enum>(1)</enum><text>To encourage the modernization of information technology used by an executive agency and how a customer interacts with an executive agency.</text></paragraph><paragraph id="H43B286FEF9FB40D882E6EE9CE87F0A20"><enum>(2)</enum><text>To improve cooperation between commercial and executive agency information technology sectors.</text></paragraph><paragraph id="H71A76525AB9B41BFB0DEC3EB21E526F7"><enum>(3)</enum><text>To the extent practicable, encourage the adoption of commercial items in accordance with section 3307 of title 41, United States Code.</text></paragraph><paragraph id="HEC33BE728AED4BE4AEEF68F990D76954"><enum>(4)</enum><text>Upon request by the executive agency, to assist executive agencies with planning and adoption of technology in focus areas designated by the Administrator, which may include the following:</text><subparagraph id="HDC0CA7EADC2E4F00A55F6C34C5CED099"><enum>(A)</enum><text>A commercial cloud computing system that includes—</text><clause id="H1DFD764050F041058CF1CAB67CBE6072"><enum>(i)</enum><text>end-to-end migration planning and an assessment of progress towards modernization; and</text></clause><clause id="H55F88075E1B847BE93299791F63B2B6D"><enum>(ii)</enum><text>a cybersecurity and governance framework that promotes industry and government risk management best practice approaches, prioritizing efforts based on risk, impact, and consequences.</text></clause></subparagraph><subparagraph id="H767B113E94A64582846BA0F8E24D004C"><enum>(B)</enum><text>Tools to help an individual receive support from and communicate with an executive agency.</text></subparagraph><subparagraph id="HA7927A03DD77486CB0CFEF33FFF05C6B"><enum>(C)</enum><text>Contact centers and other related customer supports.</text></subparagraph><subparagraph id="HDEA022CDEB22428AA234CD6FC1025A20"><enum>(D)</enum><text>Efficient use of data management, analysis, and reporting.</text></subparagraph><subparagraph id="H591F984A79EF4C518AD7DAD909D364EA"><enum>(E)</enum><text>The optimization of infrastructure, including for data centers, and the reduction of operating costs.</text></subparagraph><subparagraph id="H46BDE384AA88480AA673F7574E43704B"><enum>(F)</enum><text>Artificial intelligence.</text></subparagraph></paragraph><paragraph id="HE78DE4E17701478295297E2011E30A78"><enum>(5)</enum><text>To share best practices and expertise with executive agencies.</text></paragraph><paragraph id="H1CC91CD340634E2BBAC65D69E53028C1"><enum>(6)</enum><text>Other responsibilities the Administrator may identify.</text></paragraph></subsection><subsection id="H33E5E61111F24EF682AA2C418D029317"><enum>(d)</enum><header>Coordination</header><text>The Administrator shall coordinate with the Secretary of Homeland Security in establishing the Program to ensure that the technology, tools, and frameworks facilitated for executive agencies by the Program provide sufficient cybersecurity and maintain the integrity, confidentiality, and availability of Federal information. </text></subsection><subsection id="HA18FD07B585A44A08C8B2BEC3289F13B"><enum>(e)</enum><header>Program reporting</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report on the Program, which shall include the following:</text><paragraph id="H846DB5CC0F12435899D0E7E963A92D55"><enum>(1)</enum><text>A description of the reimbursable agreements, statements of work, and associated project schedules and deliverables for the Program.</text></paragraph><paragraph id="H6AC37C3AE7E74DDC883667AC445D7C27"><enum>(2)</enum><text>Details on the total amount of the reimbursable agreements.</text></paragraph><paragraph id="H881D3B14C53E42F4AF08A69CD923A0E5"><enum>(3)</enum><text>Any additional information the Administrator determines necessary.</text></paragraph></subsection><subsection id="H7503F40FE4AE4BD498F6D97FBB82B67A"><enum>(f)</enum><header>Sunset</header><text>This Act shall cease to have effect on the date that is 7 years after the date of enactment of this Act. </text></subsection><subsection id="HE856A5B13D114DEBBF8FFB1C4E8156D1"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to impair or otherwise affect the authority delegated by law to an executive agency or the head of an executive agency.</text></subsection></section><section id="HA1A7EE1E264F4B2BA81EEEBA31F5222C"><enum>3.</enum><header>Determination of Budgetary Effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body><attestation><attestation-group><attestation-date date="20200930" chamber="House">Passed the House of Representatives September 30, 2020.</attestation-date><attestor display="yes">Cheryl L.
