			 Act to agents representing foreign enterprises which are not under the
			 control or direction of foreign governments or foreign political parties,
			 to exclude agents who represent foreign governments which engage in a
			 pattern of gross violations of human rights from the exemption provided
			 under the Act for agents engaged in scholastic and certain other pursuits,
			 and for other purposes.</official-title></form>
	<legis-body id="HEDE437E4D5434D3E9F65D171EB9C4D2F" style="OLC">
 <section id="H7FFF9ADE9B8941578FC053BFA1806F44" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Influence Registration Modernization Act</short-title></quote> or the <quote><short-title>FIRM Act</short-title></quote>.</text> </section><section id="H0D2A866025BD46258227789C0AB52375"><enum>2.</enum><header>Waiving application of Foreign Agents Registration Act to agents representing foreign enterprises not under control or direction of foreign governments and foreign political parties</header> <text display-inline="no-display-inline">Section 1(b)(3) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)(3)</external-xref>) is amended—</text>
 <paragraph id="H661A679E7A83412E8E2CE1D000EFC747"><enum>(1)</enum><text>by striking <quote>a partnership</quote> and inserting <quote>an enterprise consisting of a partnership</quote>; and</text> </paragraph><paragraph id="H5452FD3F80BE4351A2806BFB04563176"><enum>(2)</enum><text>by striking the period at the end and inserting the following: <quote>, but only if the enterprise is under the control or direction of a government of a foreign country or a foreign political party.</quote>:</text>
			</paragraph></section><section id="H672AA57227DB46B29FA183FF41D3869D"><enum>3.</enum><header>Excluding agents representing governments which violate human rights from exemption for agents
			 engaged in religious, scholastic, academic, or scientific pursuits or fine
			 arts</header>
 <text display-inline="no-display-inline">Section 3(e) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/613">22 U.S.C. 613(e)</external-xref>) is amended by striking the semicolon at the end and inserting the following: <quote>, except that this subsection does not apply in the case of an agent who represents a foreign principal that is prohibited from receiving assistance under part I of the Foreign Assistance Act of 1961 by reason of the application of section 116 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n</external-xref>) or part II of such Act by reason of the application of section 502B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304</external-xref>).</quote>.</text>
		</section><section id="HCE642FBFDEC84E33BA54672950A9F32D"><enum>4.</enum><header>Requiring statements to be filed in digitized format</header>
 <subsection id="HEB5276C9A4104AC3B63044F6AC2D871C"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Section 2(g) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612(g)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>, in a manner which enables the statements and supplements to be filed in a digitized format and which incorporates the statements and supplements in a database which is fully searchable, sortable and downloadable.</quote>.</text>
 </subsection><subsection id="H927D889B74764EBEB70640E03806D0C2"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to statements and supplements filed after the expiration of the 1-year period which begins on the date of the enactment of this Act.</text>
 </subsection></section><section id="H478D82646E0E4DA2ADAB6E18EE4F4BE7"><enum>5.</enum><header>Availability of civil money penalty for violation</header><text display-inline="no-display-inline">Section 8 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/618">22 U.S.C. 618</external-xref>) is amended by inserting after subsection (c) the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H8036E833D8BC4E0E8F8F11B95BE38AE3" style="traditional">
 <subsection id="HA2C54C3D942E45A594F82A9575532C64"><enum>(d)</enum><text>Whoever knowingly violates any provision of this Act shall, upon proof of such knowing violation by a preponderance of the evidence, be subject to a civil money penalty of not more than $200,000, depending on the extent and severity of the violation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC61B54B55D354253A0320CD91A07ED0B"><enum>6.</enum><header>Transfer of responsibility for administration of Lobbying Disclosure Act of 1995 to Attorney
			 General</header>
			<subsection id="H966A6416AEE946B2A599FC55FD6B1908"><enum>(a)</enum><header>Requiring lobbyists To register with Attorney General</header>
 <paragraph id="H2B19CEDADA6D4E4FA6CA20C11DED29C6"><enum>(1)</enum><header>Registration</header><text display-inline="yes-display-inline">Section 4(a)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(a)(1)</external-xref>) is amended by striking <quote>the Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text> </paragraph><paragraph id="H5ABF8D6F998149C79061CD36BB5AEBF0"><enum>(2)</enum><header>Notice of termination of registration</header><text display-inline="yes-display-inline">Section 4(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(d)</external-xref>) is amended by striking <quote>the Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text>
				</paragraph></subsection><subsection id="HEA1FEC0FC12A4E579BDBAD84D308136A"><enum>(b)</enum><header>Requiring lobbyists To file reports with Attorney General</header>
 <paragraph id="HF9AB3B5951D1498DAB42B650EB99A30C"><enum>(1)</enum><header>Quarterly reports by lobbyists</header><text>Section 5(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(a)</external-xref>) is amended by striking <quote>the Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text> </paragraph><paragraph id="HB8D357E6D6C2477DAEE3B24938D590ED"><enum>(2)</enum><header>Semiannual reports on certain contributions</header><text>Section 5(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(d)(1)</external-xref>) is amended by striking <quote>the Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text>
 </paragraph><paragraph id="H5AF16EAD2FAA428CBDC804AA54993F58"><enum>(3)</enum><header>Electronic filing</header><text display-inline="yes-display-inline">Section 5(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(e)</external-xref>) is amended—</text> <subparagraph id="H5A82554ACAF745F29571A506E0A6F379"><enum>(A)</enum><text>by striking <quote>the Secretary of the Senate or the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>; and</text>
 </subparagraph><subparagraph id="H4458D64469F94C92BD132C698E6DA59B"><enum>(B)</enum><text>by striking the second sentence.</text> </subparagraph></paragraph></subsection><subsection id="HF247BCC204D04D7788DD08BE1CB8E08F"><enum>(c)</enum><header>Disclosure and enforcement</header><text display-inline="yes-display-inline">Section 6(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605(a)</external-xref>) is amended in the matter preceding paragraph (1) by striking <quote>The Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>The Attorney General</quote>.</text>
 </subsection><subsection id="HBC6DBECB792C41DC8F172FB9459AD01A"><enum>(d)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 7(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1606">2 U.S.C. 1606(a)(1)</external-xref>) is amended by striking <quote>the Secretary of the Senate or the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text> </subsection><subsection id="HCDD651D6F9C642DD92805411EADCD5FC"><enum>(e)</enum><header>Conforming amendment relating to lack of general audit or investigative authority of Secretary and Clerk</header><text>Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1607">2 U.S.C. 1607</external-xref>) is amended by striking subsection (c).</text>
 </subsection><subsection id="H87CF4B6F547743968E07190740DF5FF3"><enum>(f)</enum><header>Permitting use of good faith estimates based on tax return information</header><text display-inline="yes-display-inline">Section 15(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1610">2 U.S.C. 1610(c)(1)</external-xref>) is amended by striking <quote>the Secretary of the Senate and the Clerk of the House of Representatives</quote> and inserting <quote>the Attorney General</quote>.</text> </subsection><subsection id="H7E411B2083DE4C879AD5DE6FE55C2760"><enum>(g)</enum><header>Effective date; transition</header> <paragraph id="H02E2AED74C914779893E08DCFC80C3B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to statements and reports filed after the expiration of the 1-year period which begins on the date of the enactment of this Act.</text>
 </paragraph><paragraph id="H2D95C08FF10F4C83B4A8AD38611D067E"><enum>(2)</enum><header>Transition</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of the Senate and the Clerk of the House of Representatives shall transfer to the Attorney General information on the statements and reports filed prior to the effective date described in paragraph (1) with the Secretary and the Clerk under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601</external-xref> et seq.).</text>
