 <section id="HEE825CAD678B4016B28DD70E90A236B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Valley Fever Now Act</short-title></quote>.</text> </section><section id="H24EF51BD47BF4E388CBF82B859D487D1" section-type="subsequent-section"><enum>2.</enum><header>Grants to develop programs to increase health care providers’ awareness of Valley fever</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g</external-xref> et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HB8B2EA61AE1F472B88E08BB56C986FBF" style="OLC">
				<section id="HFE451142A0FD4CBCA3BDEDD2E370B855"><enum>399V–7.</enum><header>Grants to develop programs to increase health care providers’ awareness of Valley fever</header>
 <subsection id="H558D4B419EFC4C04B7965B253CF83F0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration and in consultation with the Director of the Centers for Disease Control and Prevention, shall make awards of grants or cooperative agreements to eligible entities to establish and carry out programs—</text>
 <paragraph id="HAE3988895321414A8DE6DDBA364EA84B"><enum>(1)</enum><text>to increase health care providers’ awareness of Valley fever; and</text> </paragraph><paragraph id="HABEA194EDA1E464C9697598B8A511D79"><enum>(2)</enum><text>to educate and train health care providers on the diagnosis and treatment of Valley fever.</text>
 </paragraph></subsection><subsection id="H1BE6985E27494A55A061EEB86D311B89"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity selected to receive a grant or contract under this section shall use amounts awarded under such a grant or contract to provide innovative supportive activities (which may include activities that do not rely on the use of broadband services) to enhance education through distance learning, continuing educational activities, collaborative conferences, and electronic and telelearning activities.</text>
 </subsection><subsection id="HD189AF6294CF4AE4BC935883F5A5C212"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $1,000,000 for the period of fiscal years 2021 through 2023, to remain available until expended.</text>
 </subsection><subsection id="HE095BB8D4DA3490492CB3620951771D3"><enum>(d)</enum><header>Condition</header><text display-inline="yes-display-inline">A recipient of a grant under this section shall, as a condition on receipt of the grant, agree to develop curricula for the purposes specified in subsection (a) in coordination with local providers at hospitals and clinics.</text>
 </subsection><subsection id="H48E0F5F3C2614AA08A52B739D7497193"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H4B51AE424ACD4F9FB7272D9730CF0DE2"><enum>(1)</enum><text>The term <term>eligible entity</term> means—</text>
 <subparagraph id="HECD694672B464A4E9615F82E6F74E40B"><enum>(A)</enum><text>a State department of health (or similar State authority);</text> </subparagraph><subparagraph id="H7F3F4D9668734A4A9EAE96C924698072"><enum>(B)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), including a medical school or continuing medical education program at such institution;</text>
 </subparagraph><subparagraph id="H10DA92443275479A9797E3253528424E"><enum>(C)</enum><text display-inline="yes-display-inline">an entity operating a graduate medical residency training program under section 340E or under section 340H; or</text>
 </subparagraph><subparagraph id="H220F290229664082911006924AB19D0E"><enum>(D)</enum><text display-inline="yes-display-inline">a teaching hospital (as defined in section 415.152 of title 42, Code of Federal Regulations) that has physicians and other medical providers with specialized knowledge in diagnosing and treating Valley fever.</text>
 </subparagraph></paragraph><paragraph id="HCA2E5CFB23CA4C768CAB942E6253A767"><enum>(2)</enum><text>The term <term>Valley fever</term> means the condition caused by Coccidioidomycosis.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H0F94A553D80945DBA60C089F41923AA6" section-type="subsequent-section"><enum>3.</enum><header>Study comparing different case definitions used to identify valley fever</header> <subsection id="H7A6E2CE826D446208CF070D12EB9E92E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention shall conduct a study comparing different case definitions used to identify valley fever. Such study shall include the efficacy of the methods being used to establish such case definitions and the cost effectiveness of such methods, including using the case definition for valley fever established by the Council of State and Territorial Epidemiologist.</text>
 </subsection><subsection id="HC0EF2D04F79045BB941B80CE244919EB"><enum>(b)</enum><header>Valley fever defined</header><text display-inline="yes-display-inline">In this Act, the term <term>Valley fever</term> has the meaning given the term in section 399V–7 of the Public Health Service Act.</text> </subsection></section><section id="HE94431D0FB47423C9EB46438459D0B23"><enum>4.</enum><header>Allowing States to provide coverage under the Medicaid program for items and services furnished in connection with qualifying Valley fever clinical trials</header> <subsection id="HF98CF73D28AD4DF18C04D75807B1DDD8"><enum>(a)</enum><header>In general</header><text>Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text>
 <paragraph id="HBAD29F77D79D4EF095BA78B5875011CC"><enum>(1)</enum><text>in paragraph (29), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="H8154C9280EE9444EA9D0D13004297C7A"><enum>(2)</enum><text>by redesignating paragraph (30) as paragraph (31); and</text>
 </paragraph><paragraph id="HA94AC66F52094D138EA1794955A002D5"><enum>(3)</enum><text>by inserting after paragraph (29) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HB7B1DFD5494146DCBE983FA24AEEFCD9" style="OLC"> <paragraph id="H831BFB7F026244AD92F24C6F31F719F0"><enum>(30)</enum><text display-inline="yes-display-inline">items and services furnished in connection with participation in a qualifying Valley fever clinical trial (as defined in section 2709A(b)(4) of the Public Health Service Act), including travel and incidental expenses, regardless of whether such items and services are furnished by a participating provider under the Medicaid program (other than a provider excluded from participation in such program under section 1128) or whether such items and services are furnished in another State; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H9D34A28B37B243F3BF60C0AAF5EAF928"><enum>(b)</enum><header>Reduction in FMAP for States that do not provide coverage</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text> <paragraph id="HD570B8A8656942E697A7FA1814B709CA"><enum>(1)</enum><text>in subsection (b), by striking <quote>and (ff)</quote> and inserting <quote>(ff), and (gg)</quote>; and</text>
 </paragraph><paragraph id="HD61075D23C794C2DA04661578A1FAE5C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H0014DB8499754F7F9D90AB830FD817E0" style="OLC"> <subsection id="H0682346FC9D64484993C974C0BCEC564"><enum>(gg)</enum><header>Reduction in FMAP for States that do not provide coverage for certain items and services</header><text display-inline="yes-display-inline">With respect to a calendar quarter beginning on or after January 1, 2021, the Federal medical assistance percentage otherwise determined under subsection (b) for a State that does not provide coverage for items and services described in subsection (a)(30) that are furnished during such quarter shall be reduced by 5 percentage points.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="H79F6E90BBA604BB39AB7E659BF4AA019"><enum>(c)</enum><header>Ensuring access for Medicaid expansion population</header><text>Section 1937(b)(5) of such Act is amended by inserting before the period at the end the following: <quote>, and beginning January 1, 2021, coverage of items and services described in section 1905(a)(30)</quote>.</text> </subsection><subsection id="HA7EA7AA0D6CB4D1CB5D3F361522ECB04"><enum>(d)</enum><header>Prohibition on imposition of costsharing requirements</header><text display-inline="yes-display-inline">Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) is amended—</text>
 <paragraph id="HC5F0D3D072B6402CBC968837C9DAF185"><enum>(1)</enum><text>in section 1916(a)(2)—</text> <subparagraph id="H982E798A8E244E92852080901D864BB4"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end;</text>
 </subparagraph><subparagraph id="H838CE6F0484B44359733D5BED1B7F1AD"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>; and</quote> at the end and inserting <quote>, or</quote>; and</text> </subparagraph><subparagraph id="HF7DB3D9DB750414DB6E42D0971305828"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H7B6DD7327B734C8E80E8D1E20BF05474" style="OLC">
 <subparagraph id="HC4C7CC1C0AE842B19885F09418FC34A5"><enum>(F)</enum><text display-inline="yes-display-inline">items and services described in section 1905(a)(30); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H3D7C251B274F43CAA090E7AA86957391"><enum>(2)</enum><text>in section 1916A(b)(3)(B), by adding at the end the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="H5A57C095F4B444EFA06040901A497E47" style="OLC">
 <clause id="H3F78A80BA1254BDDB33F7887DE78DCAC"><enum>(xi)</enum><text display-inline="yes-display-inline">Items and services described in section 1905(a)(30).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H13315946327B42A1AD7E1BDFD5F19CC6"><enum>(e)</enum><header>Continuous coverage for individuals who lose Medicaid eligibility based on income</header><text>Section 1902(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)</external-xref>) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HC3E985C110D74A4DB55EEC7E36CA4502" style="OLC">
					<paragraph id="H898CF600B408435CBAEAB7D6B294EAB4"><enum>(16)</enum><header>Continuous coverage for items and services furnished in connection with qualifying Valley fever
 clinical trials</header><text display-inline="yes-display-inline">In the case of an individual who is eligible for medical assistance under the State plan (or a waiver of such plan) based on the application of modified adjusted gross income under paragraph (14)(A), who while so eligible is furnished items and services described in section 1905(a)(30) in connection with participation in a qualifying Valley fever clinical trial (as defined in section 2709A(b)(4) of the Public Health Service Act), and who while so furnished such items and services loses eligibility for such medical assistance due to a change in income of the family of which such individual is a member, such individual shall be deemed to continue to be an individual eligible for such medical assistance, without regard to such change in income, only with respect to such items and services through the end of the month in which such qualifying Valley fever clinical trial ends.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H27AB2E9FFAF5482798D8B4B043F28792"><enum>(f)</enum><header>Effective date</header>
 <paragraph id="H1C8A1859D613412EA87451AFE0CC8220"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to items and services furnished, and eligibility determinations made, on or after January 1, 2021.</text>
 </paragraph><paragraph commented="no" id="H23A74A507CF64BCB889CECFBA195CB7E"><enum>(2)</enum><header>Exception for State legislation</header><text display-inline="yes-display-inline">In the case of a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) that the Secretary of Health and Human Services determines requires State legislation in order for the respective plan to meet any requirement imposed by amendments made by this section, the respective plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet such an additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session shall be considered to be a separate regular session of the State legislature.</text>
				</paragraph></subsection></section><section id="HBB1911E4B8724475AE0DFD85B48E2DA3"><enum>5.</enum><header>Requirement for group health plans and health insurance issuers to provide coverage for items and
			 services furnished in connection with qualifying Valley fever clinical
			 trials</header>
 <subsection id="H46AFDECA663D4728AC27474A7A0C919A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart I of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg</external-xref> et seq.) is amended—</text>
 <paragraph id="H8BB0A47713B7420396EB742E9BF37EAE"><enum>(1)</enum><text>by redesignating the second section 2709 as section 2710; and</text> </paragraph><paragraph id="H76D262AAFFFC4ECD8E5CE973B32A3E6D"><enum>(2)</enum><text>by inserting after the first section 2709 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H64AAA3496CB24AEBA5FAA82845811962" style="OLC">
						<section id="H480007B8366043A18134B9C16812300D"><enum>2709A.</enum><header>Coverage for individuals participating in qualifying Valley fever clinical trials</header>
 <subsection id="HC0B02149EDD5420AB560A20CDA13D21A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 2709, a group health plan or health insurance issuer offering group or individual health insurance coverage shall, with respect to an enrollee of such plan or coverage, respectively, provide coverage for any item or service furnished to such enrollee in connection with such enrollee’s participation in a qualifying Valley fever clinical trial, including travel and incidental expenses—</text>
 <paragraph id="H88370951F71D43C197B95379C80B775D"><enum>(1)</enum><text>without regard to whether such item or service is furnished by a participating provider or participating facility with respect to such item or service; and</text>
 </paragraph><paragraph id="H2DA3B1215C8544CFA3375A561C9F59AF"><enum>(2)</enum><text display-inline="yes-display-inline">in a manner so that, if such item or service is furnished to such enrollee by a nonparticipating provider or nonparticipating facility, the cost-sharing requirement (expressed as a copayment amount or coinsurance rate) is not greater than the requirement that would apply if such item or service were furnished by a participating provider or participating facility.</text>
 </paragraph></subsection><subsection id="H87BF21E0E4D84231BA6405971C05D4CA"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H1FF52E6964254771B9724F5CF8B75961"><enum>(1)</enum><header>Nonparticipating facility; participating facility</header> <subparagraph id="H2A73C3AD5130435FA75F4F7EBA64FBF1"><enum>(A)</enum><header>Nonparticipating facility</header><text display-inline="yes-display-inline">The term <term>nonparticipating facility</term> means, with respect to an item or service and a group health plan or group or individual health insurance coverage, a health care facility that does not have a contractual relationship with the sponsor of such plan or issuer of such coverage for furnishing such item or service under the plan or coverage.</text>
 </subparagraph><subparagraph id="HE89921CD231E46EB94B0B315233A6AAF"><enum>(B)</enum><header>Participating facility</header><text display-inline="yes-display-inline">The term <term>participating facility</term> means, with respect to an item or service and a group health plan or group or individual health insurance coverage, a health care facility that has a contractual relationship with the sponsor of such plan or issuer of such coverage for furnishing such item or service under the plan or coverage.</text>
									</subparagraph></paragraph><paragraph id="H693A8D81CB64427293E955BBB217BAA8"><enum>(2)</enum><header>Nonparticipating provider; participating provider</header>
 <subparagraph id="HFD05F1B3C73542609A82A818A1C6F9E6"><enum>(A)</enum><header>Nonparticipating provider</header><text display-inline="yes-display-inline">The term <term>nonparticipating provider</term> means, with respect to an item or service and a group health plan or group or individual health insurance coverage, a physician or other health care provider who is acting within the scope of practice of that provider’s license or certification under applicable State law and who does not have a contractual relationship with the sponsor of such plan or issuer of such coverage for furnishing such item or service under the plan or coverage.</text>
 </subparagraph><subparagraph id="H5C88B58052ED44BCB3F62031717EFE4F"><enum>(B)</enum><header>Participating provider</header><text display-inline="yes-display-inline">The term <term>participating provider</term> means, with respect to an item or service and a group health plan or group or individual health insurance coverage, a physician or other health care provider who is acting within the scope of practice of that provider’s license or certification under applicable State law and who has a contractual relationship with the sponsor of such plan or issuer of such coverage for furnishing such item or service under the plan or coverage.</text>
									</subparagraph></paragraph><paragraph id="H8C9AB3BC910F45188A3DEB0D405A48F8"><enum>(3)</enum><header>Qualifying Valley fever clinical trial</header>
 <subparagraph id="HBE1A0C3746F940EF840035D042B6EC4C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualifying Valley fever clinical trial</term> means a phase I, phase II, phase III, or phase IV clinical trial that is conducted in relation to the prevention, detection, or treatment of Valley fever (as defined in section 399V–7) and is described in any of the following clauses:</text>
 <clause commented="no" id="HB8E2245936544129A4925746289E7C5F"><enum>(i)</enum><text>The study or investigation is approved or funded (which may include funding through in-kind contributions) by one or more of the following:</text>
 <subclause display-inline="no-display-inline" id="H1D8A775141C343D38C37817CC6FEEFE5"><enum>(I)</enum><text>The National Institutes of Health.</text> </subclause><subclause id="HFEED9B3AC2BB4EF8B86811128D0CB1C1"><enum>(II)</enum><text>The Centers for Disease Control and Prevention.</text>
 </subclause><subclause id="H4872FC644CF54A6E9437EBBE6DD69E1C"><enum>(III)</enum><text>The Agency for Healthcare Research and Quality.</text> </subclause><subclause id="H56DE5430321341B8BA2AE12CEBC5C312"><enum>(IV)</enum><text>The Centers for Medicare &amp; Medicaid Services.</text>
 </subclause><subclause id="H991FB7E44FB64CF5BE8803EA1D4714FA"><enum>(V)</enum><text>A cooperative group or center of any of the entities described in subclauses (I) through (IV) or the Department of Defense or the Department of Veterans Affairs.</text>
 </subclause><subclause id="HA34A0E4763B14CBCA7AE2F0C9ECF8757"><enum>(VI)</enum><text>A qualified non-governmental research entity identified in the guidelines issued by the National Institutes of Health for center support grants.</text>
 </subclause><subclause id="HED2C02C9E9D947329FDBD3E7B0639B06"><enum>(VII)</enum><text>Any of the following if the conditions described in subparagraph (B) are met:</text> <item id="HDA1A13D7B2544AB7BF5037FBAF2F5BFD"><enum>(aa)</enum><text>The Department of Veterans Affairs.</text>
 </item><item id="HE517F427C9EE4C35934303AED9F3270C"><enum>(bb)</enum><text>The Department of Defense.</text> </item><item id="HE2F4D42E34D341A6A3B4FD527DD69E85"><enum>(cc)</enum><text>The Department of Energy.</text>
 </item></subclause></clause><clause commented="no" id="H82ADF708C399485A808090AF822EFBB7"><enum>(ii)</enum><text display-inline="yes-display-inline">The clinical trial is conducted under an investigational new drug application reviewed by the Food and Drug Administration.</text>
 </clause><clause commented="no" id="H4D3FF1C4B5D1435FAD37D85D569D2733"><enum>(iii)</enum><text display-inline="yes-display-inline">The clinical trial is a drug trial that is exempt from having such an investigational new drug application.</text>
 </clause></subparagraph><subparagraph id="H820A0DEEBBB6444A82B5DA5D0F14AFE4"><enum>(B)</enum><header>Conditions</header><text>For purposes of subparagraph (A)(i)(VII), the conditions described in this subparagraph, with respect to a clinical trial approved or funded by an entity described in such subparagraph (A)(i)(VII), are that the clinical trial has been reviewed and approved through a system of peer review that the Secretary determines—</text>
 <clause id="HBB4E0902933B4BB49C2C0EB18CA7DB6A"><enum>(i)</enum><text>to be comparable to the system of peer review of studies and investigations used by the National Institutes of Health; and</text>

			</subsection></section><section commented="no" id="H3C8787BD5F7140CFBCC7457B1D3C1191"><enum>6.</enum><header>Medicare coverage of items and services furnished in connection with qualifying Valley fever
			 clinical trials</header>
 <subsection id="H698772AD05394916B75E18B85C492BE0"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> <paragraph id="H2478C5EB94264EC1997650148848FF29"><enum>(1)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="H73BD7F4B39D1440DAF4651F6570CAAC5"><enum>(2)</enum><text>in subparagraph (HH), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="H06916880F69C41B8BC02D4D9C9A74A1E"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

 </paragraph></subsection><subsection id="H9D62CE9B655A4FD6B07772535B87D86C"><enum>(b)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text> <paragraph id="HE55AF7216DA545E2AF4ECB796EB00E6C"><enum>(1)</enum><text>by striking <quote>and (CC)</quote> and inserting <quote>(CC)</quote>; and</text>
 </paragraph><paragraph id="HC95F526ABB044D539849B839527491DD"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (DD) with respect to items and services described in section 1861(s)(2)(II), the amount paid shall be 100 percent of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848</quote>.</text>
