			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Foreign Intelligence Surveillance Act of 1978 to require reviews by amici curiae of
			 applications made to the Foreign Intelligence Surveillance Court, and for
			 other purposes.</official-title></form>
	<legis-body id="H603DCA45D5CB4F338CBDBCBA7813FD43" style="OLC">
 <section id="H5FF8699AB220408280C78953E1926298" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FISA Improvements Act of 2019</short-title></quote>.</text> </section><section id="HE4F7358F1E1647BDA02DA92AA78F6F7C" section-type="subsequent-section"><enum>2.</enum><header>Enhanced fidelity of FISA applications and processes associated with the Foreign Intelligence Surveillance Court</header> <subsection id="H32D7852D7A5F48A39A25FB90EF57E1CE"><enum>(a)</enum><header>Mandatory review by amicus curiae</header><text display-inline="yes-display-inline">Section 103(i) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)(2)</external-xref>) is amended—</text>
 <paragraph id="H6C2002A45DAD48E6810BD63613465E0F"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph id="H42C89B473E3B42929C3ED9A028839FC2"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </subparagraph><subparagraph id="HB1BB3BD215BE49BAB47E2D4E6EBFC6F5"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="H6D9D385013644310AF1226D095B94B3B"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H47FA1646666B461AB916FB1E05AF28CA" style="OLC">
 <subparagraph id="H9FD46BF5E1434197A7A74C19DF4C1924"><enum>(C)</enum><text display-inline="yes-display-inline">shall appoint an individual who has been designated under paragraph (1) to serve as amicus curiae to assist such court in the consideration of any initial application for an order that seeks to target an identifiable United States person pursuant to sections 104, 303, 703, or 704.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HE99AEFB72359489DA757FF1696268C77"><enum>(2)</enum><text>in paragraph (4)—</text> <subparagraph id="HAFB61733B929450593F6363FAF8C80F2"><enum>(A)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively;</text>
 </subparagraph><subparagraph id="HF5B6458D852F4F0185E303E91016BC38"><enum>(B)</enum><text>by striking <quote>If a court</quote> and inserting <quote>(A) <header-in-text level="subparagraph" style="OLC">Novel or significant interpretations of law—</header-in-text>If a court</quote>, and adjusting the margins accordingly; and</text> </subparagraph><subparagraph id="H3674D3B982B84DD5ACCEC1B2E987BAD4"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HEEE394601E73446BB8317343D6D812CA" style="OLC">
 <subparagraph id="H54B3217E843A43F883893EFF2832E689"><enum>(B)</enum><header>Initial applications</header><text display-inline="yes-display-inline">If a court established under subsection (a) appoints an amicus curiae under paragraph (2)(C), the amicus curiae shall review the submitted application for which the individual has been appointed to assess the sufficiency of evidence supporting the probable cause determination required to issue an order pursuant to the application and provide to the court a written recommendation regarding such sufficiency.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="HE8309150EAAE4F6D9F457C6178268D1E"><enum>(b)</enum><header>Disclosure of unverified information</header><text>Section 104(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1804">50 U.S.C. 1804(a)</external-xref>) is amended—</text> <paragraph id="H69BEF2DAC0DA4E4AB9D7BB6D7B5FF18B"><enum>(1)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a semicolon;</text>
 </paragraph><paragraph id="H7CDF68F597DD42008AC8A8ECCF8A29E6"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="H61149E96DC0B45FABC9164E177D5E09D"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HA97A9E56E46F43C6913778451AF5AB3E" style="OLC">
 <paragraph commented="no" id="H8F6C0A19331D435F9CFF7F1DB03C8F32"><enum>(10)</enum><text display-inline="yes-display-inline">a statement fully disclosing the use of any information in the application that the Government cannot substantiate based on any supporting intelligence or open-source information available to the Government at the time of the application, including, at a minimum—</text>
 <subparagraph id="HDC44AC4053F34EE59EC569F86CCDC823"><enum>(A)</enum><text display-inline="yes-display-inline">the origin of such information;</text> </subparagraph><subparagraph id="HF762047D9D554325AD7DDBD99B64977A"><enum>(B)</enum><text>the means by which the Government obtained such information;</text>
 </subparagraph><subparagraph id="H2822B33FBEB14B248C35892E171BC242"><enum>(C)</enum><text>a summary of each step the Government took to verify the information prior to using the information in the application;</text>
 </subparagraph><subparagraph id="HCAAD908B5C34478FB72CB0CAAE588134"><enum>(D)</enum><text>whether the Government has used such information in any other judicial proceeding; and</text> </subparagraph><subparagraph id="H166707628DCB4B0C8242E66BE547D31B"><enum>(E)</enum><text>the necessity of using such information to support the probable cause determination required by section 105.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HC73AC3E8A4C843909BBE05B0EC2BBFC5"><enum>(c)</enum><header>Transcripts of proceedings</header><text display-inline="yes-display-inline">Subsection (c) of section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended—</text> <paragraph id="HB204E180DE92465294B6F26ADF3DA6E2"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, and shall be transcribed</quote> before the first period; and</text>
 </paragraph><paragraph id="H430A0A3F2F93420E8A0452D935766C62"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>, transcriptions,</quote> after <quote>applications made</quote>.</text> </paragraph></subsection><subsection id="HCDFB71EEB515491CA208D5D010A0F939"><enum>(d)</enum><header>Written record of interactions with court</header><text>Such section is further amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H56A7CB158EC34197B6DE42A1884CAD9B" style="OLC">
 <subsection id="H19A24B5A61554F7ABBE386424EFEBBAC"><enum>(l)</enum><header>Written record of interactions</header><text display-inline="yes-display-inline">The Attorney General shall maintain all written communications with the court established under subsection (a), including the identity of the employees of the court to or from whom the communications were made, regarding an application or order made under this title in a file associated with the application or order. The Attorney General shall document a summary of any oral communications with the court, including the identity of the employees of the court to or from whom the communications were made, relating to such an application or order and keep such documentation in a file associated with the application or order.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA0DB2F325CC348F6AD9A3254D9F9FE80"><enum>(e)</enum><header>Extensions</header><text>Section 105(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1805">50 U.S.C. 1805(d)(2)</external-xref>) is amended by adding at the end the following new sentence: <quote>To the extent practicable, an extension of an order issued under this title shall be granted or denied by the same judge who issued the original order.</quote>.</text>
