			 individuals working in the White House or the Executive Office of the

 <section id="H988156C274F643BA8B27E8D3EA90D17C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commonsense Legislation Ensuring Accountability by Reporting Access of Non-Cleared Employees to Secrets Act</short-title></quote> or the <quote><short-title>CLEARANCES Act</short-title></quote>.</text>
		</section><section id="H69ADEA2DDAA54B619F29EC3FA39DCBBA"><enum>2.</enum><header>Report on security clearances for individuals working in the White House and Executive Office of
			 the President</header>
 <subsection id="H5E4B2E9B51C84003A4179540AEAD9FB9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart I of part III of title 5, United States Code, is amended by adding after section 10106 the following:</text>

					<chapter id="H0952AD680F524651A23EC4ADE23EA1A2"><enum>102</enum><header>Security Clearances</header>
						<toc container-level="chapter-container" idref="H0952AD680F524651A23EC4ADE23EA1A2" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
							<toc-entry idref="HF7297EA14FAB4537BC63E8351528B2E3" level="section">Sec.</toc-entry>
							<toc-entry idref="HF7297EA14FAB4537BC63E8351528B2E3" level="section">10201. Report on individuals working in the White House and Executive Office of the President.</toc-entry></toc>
						<section id="HF7297EA14FAB4537BC63E8351528B2E3"><enum>10201.</enum><header>Report on individuals working in the White House and Executive Office of the President</header>
 <subsection id="H03A21C203FF64F0BA861FC4D836224C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 months after the date of enactment of this section and every 3 months thereafter, the President shall submit a report to the appropriate congressional committees on security clearance information on any individual working in the White House or the Executive Office of the President, including—</text>
 <paragraph id="H386408090AB646DAB84CD1F49FF0BB68"><enum>(1)</enum><text>the President’s staff or any other individual in the White House or Office whose function is to advise or assist the President; and</text>
 </paragraph><paragraph id="H05BFAF99DE3040CDA14E98DD12F10962"><enum>(2)</enum><text>any individual who is detailed from the Government, a university, a think tank, or the private sector to the White House or the Office.</text>
 </paragraph></subsection><subsection id="HD3E651A765744E7FA6D933A4572691B7"><enum>(b)</enum><header>Report requirements</header><text>A report submitted under subsection (a) shall include the following:</text> <paragraph id="H2E5F62DCE7F240D09AD9CAFB62E64582"><enum>(1)</enum><text display-inline="yes-display-inline">The name and position of any individual working in the White House or the Office and who holds a security clearance.</text>
 </paragraph><paragraph id="H86D8AD731E4247F29EDD858B5C8EB1BA"><enum>(2)</enum><text>With respect to any detailee, the entity or agency from which the individual was detailed.</text> </paragraph><paragraph id="H126173031F8F4049A01EC66348B488B8"><enum>(3)</enum><text display-inline="yes-display-inline">With respect to any clearance listed pursuant to paragraph (1)—</text>
 <subparagraph id="H976BBFDDDED64E56B792462D925B9C58"><enum>(A)</enum><text>whether the clearance is temporary or permanent and level of the clearance;</text> </subparagraph><subparagraph id="H7B5BEA8387AF465B9661AF238B26F382"><enum>(B)</enum><text>the date the background investigation was initiated and the date of adjudication (if any); and</text>
 </subparagraph><subparagraph id="HD7C37B9508DB41E6B2F0008E9A7280E4"><enum>(C)</enum><text>the date of any interim reports or notifications from the investigating agency.</text> </subparagraph></paragraph><paragraph id="H4923EE1984544F909986BF51830129C1"><enum>(4)</enum><text>The name and position of any individual working in the White House or the Office who was granted a security clearance by the President or other authorizing personnel despite an unfavorable recommendation from the White House Security Office or an agency, and the date the decision was made to grant the clearance.</text>
 </paragraph><paragraph id="HECCEBCA46DA14B9489ECCD6030D29EC9"><enum>(5)</enum><text>The name and position of any individual not contained in any list above whom the President has provided access to classified information, the date the information was so provided, and the level of classification of the information.</text>
 </paragraph><paragraph id="H605D8DB48B534DF7900400F5FBD0E833"><enum>(6)</enum><text>The name and position of any individual working in the White House or Office—</text> <subparagraph id="HA1937D1E08BE4052B56BECA725BB3C2D"><enum>(A)</enum><text>whose security clearance has been revoked or suspended and the date of such revocation or suspension; or</text>
 </subparagraph><subparagraph id="H468AAD9D5D394BAB967227BBA3E797B4"><enum>(B)</enum><text>who held an interim security clearance for a period longer than one year, and a justification from the White House Counsel as to why it is in the national security interest of the United States to keep the employee in the position without a permanent security clearance.</text>
 </subparagraph></paragraph></subsection><subsection id="HE9BE0E22AC56498988465393D81CBF2E"><enum>(c)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="HAE85475476A94370958F2C8347A72715"><enum>(1)</enum><text>the term <quote>appropriate congressional committees</quote> means—</text>
 <subparagraph id="HF5833DA77A18447DB552F944C387AD75"><enum>(A)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on Intelligence and the Committees on Oversight and Reform and the Judiciary of the House of Representatives; and</text>
 </subparagraph><subparagraph id="H486160BB2FC14BC5BFBFD547D88CAC72"><enum>(B)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence and the Committees on Homeland Security and Governmental Affairs and the Judiciary of the Senate; and</text>
 </subparagraph></paragraph><paragraph id="H6C6A2A3ECD094976BB76498F493FE734"><enum>(2)</enum><text>the term <quote>Office</quote> means the Executive Office of the President.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" id="H8B3B78969CFE4C2FA162A56E888221B9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for such title is amended by adding after the item relating to chapter 101 the following:</text>
