			 purposes.</official-title></form>
	<legis-body id="H137533C27826492D8EC6F3EBC96EADBC" style="OLC">
 <section id="H95F2BEE8A0B94879862CFA6D41B1F3ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Direct Enhancement of Snapper Conservation and the Economy through Novel Devices Act of 2019</short-title></quote> or the <quote><short-title>DESCEND Act of 2019</short-title></quote>.</text> </section><section id="H44474A75059B410D8294213C4BCA0FF0"><enum>2.</enum><header>Required use of descending devices</header> <subsection id="HD4FB6A3071EA4E3F855A867712DCD4A0"><enum>(a)</enum><header>Required gear in the Gulf reef fish fishery</header><text>Title III of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8444CEFB22204F798958163E12BFB86B" style="OLC">
					<section id="HE7152F6C385244E19C633EA2FE121A28"><enum>321.</enum><header>Required possession of descending devices</header>
 <subsection id="H28DB016E012C48F8BBFDDC759DDE95BD"><enum>(a)</enum><header>Require gear in the Gulf reef fish fishery</header><text display-inline="yes-display-inline">It shall be unlawful for a person on board a commercial or recreational vessel to fish for Gulf reef fish in the Gulf of Mexico Exclusive Economic Zone without possessing on board the vessel a venting tool or a descending device that is rigged and ready for use while fishing is occurring.</text>
 </subsection><subsection id="H2DC7966B59204920805838F4D6564C17"><enum>(b)</enum><header>Savings clause</header><text display-inline="yes-display-inline">No provision of this section shall be interpreted to affect any program or activity carried out by the Gulf Coast Ecosystem Restoration Council established by the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321</external-xref> note), or any project contained in an approved Restoration Plan developed by any Natural Resources Damage Assessment Trustee Implementation Group to reduce post-release mortality from barotrauma in Gulf of Mexico Reef Fish Recreational Fisheries.</text>
 </subsection><subsection id="HAF1EFB5FFA064C70A774D902F0126A75"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H3BE5B0D647584603BF094022421633D3"><enum>(1)</enum><header>Descending device</header><text>The term <quote>descending device</quote> means an instrument that—</text>
 <subparagraph id="H8E1E11D1CDE141B09FD746E3D85355A1"><enum>(A)</enum><text>will release fish at a depth sufficient for the fish to be able to recover from the effects of barotrauma;</text>
 </subparagraph><subparagraph id="H6B882917A1F34126A65D626B6EE2FDCD"><enum>(B)</enum><text>is a weighted hook, lip clamp, or box that will hold the fish while it is lowered to depth, or another device determined to be appropriate by the Secretary; and</text>
 </subparagraph><subparagraph id="H8FEF0AEB627040F6BDC18A96A9635C00"><enum>(C)</enum><text>is capable of—</text> <clause id="H5889A41FCCAD46F885F08B78A627D27C"><enum>(i)</enum><text>releasing the fish automatically;</text>
 </clause><clause id="H8A16622B8DDE4385910B73A7C8176009"><enum>(ii)</enum><text>releasing the fish by actions of the operator of the device; or</text> </clause><clause id="H343E85692FFF4472AC24543C8552218D"><enum>(iii)</enum><text>allowing the fish to escape on its own.</text>
 </clause></subparagraph></paragraph><paragraph id="H43A67258A6A147FCB21BE4D872FF7E59"><enum>(2)</enum><header>Venting tool</header><text>The term <quote>venting tool</quote> has the meaning given to it by the Gulf of Mexico Fishery Management Council.</text> </paragraph><paragraph id="H1512B4AE4B014EA39BB7D3E14BB046F4"><enum>(3)</enum><header>Gulf reef fish</header><text display-inline="yes-display-inline">The term <quote>Gulf reef fish</quote> means any fish chosen by the Gulf of Mexico Fishery Management Council that is in the reef Fishery Management Plan for the purposes of this Act.</text>
							</paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
 </subsection><subsection id="HED6C9A761DE24A34810AAAA458C9DA3A"><enum>(b)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">Section 308(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1858">16 U.S.C. 1858(a)</external-xref>) is amended by inserting <quote>or section 321</quote> after <quote>section 307</quote>.</text>
 </subsection><subsection id="H2D6340E52CEF4967A466E09F4D768C37"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect 1 year after the date of enactment of this Act.</text> </subsection><subsection id="HC012093628584302B56C7E62745EC13E"><enum>(d)</enum><header>Sunset</header><text display-inline="yes-display-inline">Five years after the date of enactment of this Act, the Magnuson-Stevens Fishery Conservation and Management Act is amended—</text>
 <paragraph id="HF6C62470219441D092DE16D7E60CEFFF"><enum>(1)</enum><text>in section 308(a), by striking <quote>or section 321</quote>; and</text> </paragraph><paragraph id="H70FBDEA74E2F49FBB41E4EC380B10FAD"><enum>(2)</enum><text>by striking title 321.</text>
				</paragraph></subsection></section><section id="H1BA6BB99BF0A4CB191310A0D447231E1"><enum>3.</enum><header>Improving discard mortality data</header>
 <subsection id="H5FDDE95CA9A442CA95BD9BB4252F6D4E"><enum>(a)</enum><header>Agreement</header><text>Within 60 days of the date of enactment of this Act, the Secretary shall enter into an agreement with the National Academy of Sciences to conduct a study and produce a report on discard mortality in the Gulf of Mexico reef fish fisheries. Such study shall include—</text>
 <paragraph id="H4E9D64FEFF134D0699E8F0873E21C329"><enum>(1)</enum><text>assessment of gaps and biases in reporting of discards and associated discard mortality;</text> </paragraph><paragraph id="H6697AEB50CC043488D2EB434F1DF3EB7"><enum>(2)</enum><text>assessment of uncertainty and likely impacts of such uncertainty in discard mortality;</text>
 </paragraph><paragraph id="HCA381128A1DD416D904A6C13EA9826D8"><enum>(3)</enum><text>assessment of the effectiveness and usage rates of barotrauma-reducing devices;</text> </paragraph><paragraph id="HD7DEF3A574A24FC3B9F4F548F92CDBDB"><enum>(4)</enum><text>recommendations for future research priorities; and</text>
 </paragraph><paragraph id="HD8B94C2D74B34A739F496794F74F159F"><enum>(5)</enum><text>recommendations for standardized reporting and quantification of discards for fisheries under the Gulf of Mexico Reef Fish Fishery Management Plan.</text>
 </paragraph></subsection><subsection id="H555B47AB5C92418389BCFB96F2731B96"><enum>(b)</enum><header>Deadline</header><text>The National Academy of Sciences shall complete the study described in subsection (a) and transmit the final report to the Secretary within 2 years of the date of enactment of this Act. The Secretary shall, within 3 months of receiving such study and report, submit such study and report in (a) to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.</text>
 </subsection><subsection id="HE8AD172014BC4B88B421486C31299408"><enum>(c)</enum><header>Plan</header><text>Within 1 year of receiving the study and report in described in subsection (a), the Gulf of Mexico Fishery Management Council and the Secretary shall—</text>
 <paragraph id="H78F4F9B4D6434C2E948005E19C360974"><enum>(1)</enum><text>develop guidance for minimum standards for quantifying and reporting discards and associated mortality in the Gulf of Mexico Reef Fish Fishery Management Plan; and</text>
 </paragraph><paragraph id="H08F2331FA7B04107A7AFFD84D572D861"><enum>(2)</enum><text>develop a plan to assess and monitor the effectiveness and usage of barotrauma-reducing devices and the impact on discard mortality rates in Gulf of Mexico reef fish fisheries.</text>
 </paragraph></subsection><subsection id="HB0C172D4635F4150B3BCF47D4C4033AC"><enum>(d)</enum><header>Follow-Up report</header><text>Within 3 years of developing minimum standards and developing the assessment and monitoring plan in subsection (c), the Secretary shall provide a detailed report on implementation to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.</text>
