Horn of Oklahoma</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for an exception to certain small business
			 contracting requirements applicable to the Department of Veterans Affairs
			 procurement of certain goods and services covered under the Ability One
			 program, and for other purposes.</official-title></form>
	<legis-body id="H831EE52CCA354D8592108A325A72B47A" style="OLC">
 <section id="HE11B6F17102F447FB1CEBBFFD1091385" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Contracting Preference Consistency Act</short-title></quote>.</text> </section><section id="HC11A39E79F5648048EC094B0A93F222B"><enum>2.</enum><header>Exception to Department of Veterans Affairs small business contracting requirement for certain goods and services covered under Ability One program</header> <subsection id="H3CDA5A65E63F4B78ADDB594A8CC70D2B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (d) of section 8127 of title 38, United States Code, is amended—</text>
 <paragraph id="H31E74108975C482394CF650EBF41E786"><enum>(1)</enum><text>by striking <quote>Except</quote> and inserting <quote>(1) Except</quote>;</text> </paragraph><paragraph id="H6347CB63338F401FAEA589DB001363D2"><enum>(2)</enum><text>by inserting <quote>in paragraph (2) and</quote> before <quote>in subsections (b) and (c)</quote>; and</text>
 </paragraph><paragraph id="HD68D1A3A8FFB44598424DD0F1D5E4BF4"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HFDD2A6F3DCEE4332AE8B365E193823DD" style="USC"> <paragraph display-inline="no-display-inline" id="H874E454439A34CFF854E3BC2330AE96D" indent="up1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HB821218881DB44688BCF5F5BD18847C7"><enum>(A)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (1), with respect to the procurement of a covered product or service, a contracting officer of the Department shall procure such product or service from a source designated under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/85">chapter 85</external-xref> of title 41, and in accordance with the regulations prescribed under such chapter.</text>
 </subparagraph><subparagraph id="HB11DB3F0029C46BF98784FFF01BD1CA6" indent="up1"><enum>(B)</enum><text>In this paragraph, the term <quote>covered product or service</quote> means—</text> <clause id="H1FFBBEB3A4424AD09D8B8468AEF13711"><enum>(i)</enum><text display-inline="yes-display-inline">a product or service that—</text>
 <subclause id="H20C1CC195B1C46AEBB776214C2178A06"><enum>(I)</enum><text>is included on the procurement list under section 8503(a) of title 41; and</text> </subclause><subclause id="H44DC9C85E490401CB20304E66406F307"><enum>(II)</enum><text>was included on such procurement list on or before December 22, 2006; or</text>
 </subclause></clause><clause display-inline="no-display-inline" id="H9F88B780C8674B75ABE34D16BDBBB409"><enum>(ii)</enum><text display-inline="yes-display-inline">a product or service that—</text> <subclause id="HF462C3C3D67F4BCCADA24B9763E8BB15"><enum>(I)</enum><text>is a replacement for a product or service described under clause (i);</text>
 </subclause><subclause id="HE2C886CC190041F9B76B96E3180567FC"><enum>(II)</enum><text>is essentially the same and meeting the same requirement as the product or service being replaced; and</text>
 </subclause><subclause id="H02F20A5FE9D84EB9834445B306ABF95C"><enum>(III)</enum><text>a contracting officer determines meets the quality standards and delivery schedule of the Department.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H94E95C1DD59740B8B21F19CE97693FCD"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Such section is further amended in each of subsections (b) and (c), by striking <quote>For</quote> and inserting <quote>Except as provided in subsection (d)(2), for</quote>.</text> </subsection><subsection id="H5A85EFDC45DA4053B2426BEC2C8F4177"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to a contract entered into on or after the date of the enactment of this Act.</text>
