 <subsection id="HA118875B6F1E450A9FDC4ECBC65F7269"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Export-Import Bank of the United States is hereby redesignated as the United States Export Finance Agency.</text>
 </subsection><subsection id="H5D90902654D64C8FB678A74388D2671F"><enum>(b)</enum><header>References</header><text display-inline="yes-display-inline">Any reference to the Export-Import Bank of the United States in any law, rule, regulation, certificate, directive, instruction, or other official paper in force on the date of the enactment of this Act is deemed a reference to the United States Export Finance Agency.</text>
 </subsection></section><section display-inline="no-display-inline" id="H08F8184368A24191A0312A1E74E1FD4F" section-type="subsequent-section"><enum>4.</enum><header>Authorization period</header><text display-inline="no-display-inline">Section 7 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635f">12 U.S.C. 635f</external-xref>) is amended by striking <quote>2019</quote> and inserting <quote>2029</quote>.</text> </section><section id="H196DA249E7C0427D8F4B958E638A96B9"><enum>5.</enum><header>Aggregate loan, guarantee, and insurance authority</header><text display-inline="no-display-inline">Section 6(a)(2) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635e">12 U.S.C. 635e(a)(2)</external-xref>) is amended to read as follows:</text>

 <paragraph id="H98910738C8DA4F87AEA017448527ED41"><enum>(2)</enum><header>Applicable amount defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>applicable amount</term> means—</text> <subparagraph id="HC2C400E1A4314FE98E120C17A7501930"><enum>(A)</enum><text>$145,000,000,000 for fiscal year 2020;</text>
 </subparagraph><subparagraph id="H1868CCB8B50F42B1AF42351A1047D240"><enum>(B)</enum><text>$150,000,000,000 for fiscal year 2021;</text> </subparagraph><subparagraph id="HC5F327B9C5984D64AEF85F054A156B65"><enum>(C)</enum><text>$155,000,000,000 for fiscal year 2022;</text>
 </subparagraph><subparagraph id="H939AC6779A014A68A30DAA04DE8B6946"><enum>(D)</enum><text>$160,000,000,000 for fiscal year 2023;</text> </subparagraph><subparagraph id="H846673A11484402AB11E2224D522298C"><enum>(E)</enum><text>$165,000,000,000 for fiscal year 2024;</text>
 </subparagraph><subparagraph id="HDD1369F529EB4FDAB45875D8FF64C1C2"><enum>(F)</enum><text>$170,000,000,000 for fiscal year 2025; and</text> </subparagraph><subparagraph id="H3CF2D5452D2743D291A75FADD93C53E7"><enum>(G)</enum><text>$175,000,000,000 for each of fiscal years 2026 through 2029.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H62ED0755BDAC41829E795655D5557B05"><enum>6.</enum><header>Office of Minority and Women Inclusion</header>
 <subsection id="H6BF8D24FC57F46CFAC3C999C1F8E47C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3(i) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(i)</external-xref>) is amended to read as follows:</text>

					<subsection id="H0D75884DE5FA4747BF1DF25C57AED04F"><enum>(i)</enum><header>Office of minority and women inclusion</header>
 <paragraph id="HBE713B0470C541F6911CBF171F8B1193"><enum>(1)</enum><header>Establishment</header><text>The Agency shall establish an Office of Minority and Women Inclusion which shall be responsible for carrying out this subsection and all matters relating to diversity in management, employment, and business activities in accordance with such standards and requirements as the Director of the Office shall establish.</text>
 </paragraph><paragraph id="H5DEDB0BF9BF14BC19917EB3A2A23020E"><enum>(2)</enum><header>Transfer of responsibilities</header><text>The Agency shall ensure that, to the extent that the responsibilities described in paragraph (1) (or comparable responsibilities) were, as of the date of the enactment of this subsection, performed by another office of the Agency, the responsibilities shall be transferred to the Office.</text>
 </paragraph><paragraph id="HB4D2B31D3E01466C888C2E9FA58F6DF4"><enum>(3)</enum><header>Duties with respect to civil rights laws</header><text>The responsibilities described in paragraph (1) shall not include enforcement of statutes, regulations, or executive orders pertaining to civil rights, except that the Director of the Office shall coordinate with the President of the Agency, or the designee of the President of the Agency, regarding the design and implementation of any remedies resulting from violations of the statutes, regulations, or executive orders.</text>
 </paragraph><paragraph id="H9365A6AD85D64B10A396CF418801D1E3"><enum>(4)</enum><header>Training</header><text display-inline="yes-display-inline">The Agency shall make available to its employees appropriate inclusion and diversity training, not less frequently than every 2 years, to ensure employees have an understanding of the specific challenges facing minority- and women-owned businesses.</text>
						</paragraph><paragraph id="H68D4C79E7A7E43AEBF6B24EA3BD9AB10"><enum>(5)</enum><header>Director</header>
 <subparagraph id="H1CE51933FC764FDA8B542F8F0A836BBB"><enum>(A)</enum><header>In general</header><text>The Director of the Office shall be appointed by, and shall report directly to, the President of the Agency. The position of Director of the Office shall be a career reserved position in the Senior Executive Service, as that position is defined in section 3132 of title 5, United States Code, or an equivalent designation.</text>
 </subparagraph><subparagraph id="HC5A21FB599DD4AA38DE65266A600712B"><enum>(B)</enum><header>Duties</header><text>The Director shall—</text> <clause id="HDDAE67AAFEE6448C8FDF2CB0E423FAED"><enum>(i)</enum><text>develop standards for equal employment opportunity and diversity in race, ethnicity, gender, sexual orientation, and gender identity of the workforce and senior management of the Agency;</text>
 </clause><clause id="HDE12BA25E3F74A0EA98D645C96EA7B0F"><enum>(ii)</enum><text>develop standards for increased participation of minority-owned and women-owned businesses in the programs and contracts of the Agency, including standards for coordinating technical assistance to the businesses; and</text>
 </clause><clause id="HE9AAD66BF16E496AAE7913777EDA6D32"><enum>(iii)</enum><text>enhance the outreach activities of the Agency with respect to, and increase the total amount of loans, guarantees, and insurance provided by the Agency to support exports by socially and economically disadvantaged small business concerns (as defined in section 8(a)(4) of the Small Business Act) and small business concerns owned by women.</text>
 </clause></subparagraph><subparagraph id="H740E02B5E4294329B67479042CF49729"><enum>(C)</enum><header>Other duties</header><text>The Director shall advise the President of the Agency on the impact of the policies of the Agency on minority-owned and women-owned businesses.</text>
							</subparagraph></paragraph><paragraph id="H61BE8874FDA24F3C9923464E9C079828"><enum>(6)</enum><header>Inclusion in all levels of business activities</header>
 <subparagraph id="HA5F1D5ACEB6F4DC784D5C2985BDA272D"><enum>(A)</enum><header>Contracts</header><text>The Director of the Office shall develop and implement standards and procedures to ensure, to the maximum extent possible, the inclusion and utilization of minorities (as defined in section 1204(c) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811</external-xref> note), which definition is deemed, for purposes of this subparagraph, to include American Indians, Native Hawaiians (as defined in section 103 of the Native American Languages Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2902">25 U.S.C. 2902</external-xref>)), and Alaska Natives (defined as a member of any Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) that is based in the State of Alaska)) and women, and minority- and women-owned businesses (as such terms are defined in section 21A(r)(4) of the Federal Home Loan Bank Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1441a">12 U.S.C. 1441a(r)(4)</external-xref>) in all business and activities of the Agency at all levels, including in procurement, insurance, and all types of contracts. The processes established by the Agency for review and evaluation for contract proposals and to hire service providers shall include a component that gives consideration to the diversity of the applicant.</text>
 </subparagraph><subparagraph id="H174B92F349174E66A9CCA2E4640A1B8F"><enum>(B)</enum><header>Applicability</header><text>This paragraph shall apply to all contracts for services of any kind, including all contracts for all business and activities of the Agency, at all levels.</text>
 </subparagraph><subparagraph id="HD0B9371658124CA4AE8FCF8AE4A989B8"><enum>(C)</enum><header>Outreach</header><text>The Agency shall establish a minority outreach program to ensure the inclusion (to the maximum extent practicable) of contracts entered into with the enterprises of minorities and women and businesses owned by minorities and women, including financial institutions, investment banking firms, underwriters, accountants, brokers, and providers of legal services.</text>
 </subparagraph></paragraph><paragraph id="HD586DFA9256C4D408A0861FE34D5FA8F"><enum>(7)</enum><header>Diversity in agency workforce</header><text>The Agency shall take affirmative steps to seek diversity in its workforce at all levels of the Agency consistent with the demographic diversity of the United States, in a manner consistent with applicable law, including—</text>
 <subparagraph id="H41E9C316DE194CF5A86090CC743F59E9"><enum>(A)</enum><text>to the extent the Agency engages in recruitment efforts to fill vacancies—</text> <clause id="HC77823CA4BAD417EB1549D45C6976572"><enum>(i)</enum><text>recruiting at historically Black colleges and universities, Hispanic-serving institutions, Asian American- and Native American Pacific Islander-serving institutions, Tribal colleges and universities, women’s colleges, community colleges, and colleges that typically serve majority minority populations; and</text>
 </clause><clause id="H762810DE33E646339D13ACAD0908779A"><enum>(ii)</enum><text>recruiting at job fairs in urban communities, and placing employment advertisements in print and digital media oriented toward women and people of color;</text>
 </clause></subparagraph><subparagraph id="H600114682CCC4D38A8EBBE7FFDF91368"><enum>(B)</enum><text>partnering with organizations that are focused on developing opportunities for minorities and women to place talented young minorities and women in industry internships (including paid internships), summer employment, and full-time positions; and</text>
 </subparagraph><subparagraph id="HCA8C79A4FC9E4BE3B6CC2A741CDD78E0"><enum>(C)</enum><text>by use of any other mass media communications that the Director of the Office determines necessary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HC80BCC64F0BC493797FFF2074872897A"><enum>(b)</enum><header>Inclusion in annual report</header><text display-inline="yes-display-inline">Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA2AD96E6670D4ABEAB9F625B95532470" style="OLC">
					<subsection id="HDFD75DE44134477CBDCED41E3F9544CD"><enum>(l)</enum><header>Office of Minority and Women Inclusion</header>
 <paragraph id="HB9C94132FD234A91A76A5C427183FFD6"><enum>(1)</enum><header>In general</header><text>The Agency shall include in its annual report to the Congress under subsection (a) a report from the Office of Minority and Women Inclusion regarding the actions taken by the Agency and the Office pursuant to section 3(i), which shall include—</text>
 <subparagraph id="H2F1B0FE7DA1645818C5F481B3E2D0336"><enum>(A)</enum><text>a statement of the total amounts paid by the Agency to contractors since the most recent report under this subsection;</text>
 </subparagraph><subparagraph id="H7A4F474DD47F446C8C565DF24603B7A7"><enum>(B)</enum><text>the percentage of the amounts described in subparagraph (A) that were paid to contractors as described in section 3(i)(5)(A);</text>
 </subparagraph><subparagraph id="H65EDD5374C9B478C8DFECB4235A30370"><enum>(C)</enum><text>the successes achieved and challenges faced by the Agency in operating minority and women outreach programs;</text>
 </subparagraph><subparagraph id="H7689D531E5464470B6D90D059A6349AE"><enum>(D)</enum><text display-inline="yes-display-inline">a description of the progress made by the Agency in supporting exports by minority-owned small business concerns and the progress made by the Agency in supporting small business concerns owned by women, including estimates of the amounts made available to finance exports directly by both categories of small business concerns, a comparison of these amounts with the amounts made available to all small business concerns, and a comparison of such amounts with the amounts so made available during the 2 preceding years;</text>
 </subparagraph><subparagraph id="HE7743E7CBF424CB5902F4A15574E1872"><enum>(E)</enum><text>the challenges the Agency may face in hiring qualified minority and women employees and contracting with qualified minority-owned and women-owned businesses; and</text>
 </subparagraph><subparagraph id="H5E6872847C0747958E6E503307C9C73B"><enum>(F)</enum><text>any other information, findings, conclusions, and recommendations for legislative or Agency action, as the Director of the Office deems appropriate.</text>
 </subparagraph></paragraph><paragraph id="HAE54BD2D61D441ABB0F19B3EEBD17E1D"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="HC30941BAFA934BCC94C4F427A882E15E"><enum>(A)</enum><header>Minority-owned small business concern</header><text>The term <quote>minority-owned small business concern</quote> has the meaning given the term <quote>socially and economically disadvantaged small business concern</quote> under section 8(a)(4) of the Small Business Act.</text>
 </subparagraph><subparagraph id="H49F1FBF6105B42DF8CCE923F23F92EA1"><enum>(B)</enum><header>Small business concern</header><text display-inline="yes-display-inline">The term <quote>small business concern</quote> has the meaning given that term under section 3(a) of the Small Business Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HC01AEECB447940259F10ECDAD79CEC00"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 8(f) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g(f)</external-xref>) is amended—</text>
 <paragraph id="HDFB3554CF3074A149BF446148E0685F5"><enum>(1)</enum><text>by striking paragraph (4); and</text> </paragraph><paragraph id="HB16E464E4CDF48CB96C8974BBE8BA89D"><enum>(2)</enum><text>by redesignating paragraphs (5) through (8) as paragraphs (4) through (7), respectively.</text>
 </paragraph></subsection><subsection id="HEE3375257C464DD080092BD7F8F01B8D"><enum>(d)</enum><header>Additional Advisory Committee members</header><text display-inline="yes-display-inline">Section 3(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(d)</external-xref>) is amended—</text> <paragraph id="HA661AA5836E1428E95C2FD7C2D093CDB"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="H30106998C2314021811D826F84FA14F0"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>17</quote> and inserting <quote>19</quote>; and</text> </subparagraph><subparagraph id="HDB7616EE0D924C118D6AA32DA103C30B"><enum>(B)</enum><text>in subparagraph (B), by inserting <quote>higher education,</quote> before <quote>State</quote>; and</text>
 </subparagraph></paragraph><paragraph id="HD677A2B5239147E48A236A420E34873E"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9C13BFC54F374F8EBC8B2096B1073E4E" style="OLC"> <subparagraph id="H22CAF3172D3A444AA001C5C6DD08FA8F" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">One member appointed to the Advisory Committee shall be representative of 4-year institutions of higher education.</text>
 </subparagraph><subparagraph id="H7A8E745B9C704C68870B55D67A475366" indent="up2"><enum>(E)</enum><text display-inline="yes-display-inline">One member appointed to the Advisory Committee shall be representative of community colleges.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section display-inline="no-display-inline" id="H3AD74638F680488290A968AC1A4465A6" section-type="subsequent-section"><enum>7.</enum><header>Support for United States territories</header> <subsection id="H9C5711ABA56D46E1814BB4F938D55CB9"><enum>(a)</enum><header>Creation of the Office of Territorial Exporting</header><text>Section 3 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="HF840D7E0808A4AD5B5E817045884E0F8" style="OLC">
					<subsection id="HD51A7D6AFBD744F0B326FD54DDC96D86"><enum>(n)</enum><header>Office of territorial exporting</header>
 <paragraph id="H451CFD912AF747618337238595619065"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President of the Agency shall establish an Office of Territorial Exporting, the functions of which shall be to—</text>
 <subparagraph id="HF4580A5523E44287A8F5506DD1E16AE6"><enum>(A)</enum><text>promote the export of goods and services from the territories;</text> </subparagraph><subparagraph id="H7A27F0EC5F6F41BFBC0C41D10A48DB4E"><enum>(B)</enum><text>conduct outreach, education, and disseminate information concerning export opportunities and the availability of Agency support for such activities; and</text>
 </subparagraph><subparagraph id="HADB6EAAFBE734804AF637E4BAC21BDAB"><enum>(C)</enum><text>increase the total amount of loans, guarantees, and insurance provided by the Agency benefitting the territories.</text>
 </subparagraph></paragraph><paragraph id="H48F6D4D97776465E97DC77540F15B8BB"><enum>(2)</enum><header>Staff</header><text>The President of the Agency shall hire such staff as may be necessary to perform the functions of the Office, including—</text>

 <subsection id="H5E7D0853EDE14350BB899DA3D2FA1C0C"><enum>(m)</enum><header>Report on activities in the territories</header><text>The Agency shall include in its annual report to Congress under subsection (a) a report on the steps taken by the Agency in the period covered by the report to increase—</text>
 <paragraph id="H100F910A198C4947897CBF3354A73198"><enum>(1)</enum><text>awareness of the Agency and its services in the territories; and</text> </paragraph><paragraph id="HC9F66D6D7E2C4EB6B3F60FB16832E790"><enum>(2)</enum><text>the provision of Agency support to export businesses in the territories.</text>
 </paragraph></subsection><subsection id="H8873F26B522A4AC39F55404C29C4B4E5"><enum>(n)</enum><header>Report on consultations with potentially impacted communities</header><text display-inline="yes-display-inline">The Agency shall include in its annual report to Congress under subsection (a) of this section a report on the steps taken by the Agency to consult with affected communities, including affected workers, pursuant to section 11(a)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="HBEDFA5DA5CA34E91B93D9F71E11B87E9" section-type="subsequent-section"><enum>8.</enum><header>Alternative procedures during quorum lapse</header>
 <subsection id="H2CB199FF1DFC4A94BEAE2C604550CBB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3(c)(6) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(c)(6)</external-xref>) is amended—</text> <paragraph id="H0C4D5554BB2E463AB1FF000AFE2AAEFC"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>(6)</quote>; and</text>
 </paragraph><paragraph id="H4E0EBF126F9C43A1868FA87F54D17CD5"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD33F317E1D5947A7A7835B8CDB5E1388" style="OLC"> <subparagraph id="H6541F8F0EEBC4B15BC4A5DDCC908F4A8" indent="up2"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H954B7BCCED734A7EACA25F207B676574"><enum>(i)</enum><text display-inline="yes-display-inline">If there is an insufficient number of directors to constitute a quorum under subparagraph (A) for 90 consecutive days during the term of a President of the United States, a temporary Board, consisting of the following members, shall act in the stead of the Board of Directors:</text>

 </subclause><subclause id="HFF745EF7F04A4E4D951B8B6DCA5E26F8" indent="up1"><enum>(III)</enum><text>The Secretary of Commerce.</text> </subclause><subclause id="HC326F5884398459FBDA99E52DCD747C1" indent="up1"><enum>(IV)</enum><text>The members of the Board of Directors.</text>
 </subclause></clause><clause display-inline="no-display-inline" id="H54B79CEF6D9C4E95B56B06596542C360" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">If, at a meeting of the temporary Board—</text> <subclause id="H2A4C4F306094403A9188CC63FD57D7AD"><enum>(I)</enum><text>a member referred to in clause (i)(IV) is present, the meeting shall be chaired by such a member, consistent with Agency bylaws; or</text>
 </subclause><subclause id="H7C3C287B4C5D446988507E43681B0A56"><enum>(II)</enum><text display-inline="yes-display-inline">no such member is present, the meeting shall be chaired by the United States Trade Representative.</text> </subclause></clause><clause id="HB7A5895B1B614968BD8473937EA30D56" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">A member described in subclause (I), (II), or (III) of clause (i) may delegate the authority of the member to vote on whether to authorize a transaction, whose value does not exceed $100,000,000, to—</text>
 <subclause id="HB8F19662C8364567AF05E747C0A7EC70"><enum>(I)</enum><text>if the member is the United States Trade Representative, the Deputy United States Trade Representative; or</text>
 </subclause><subclause id="HD922DDF3CB284BE28DBC2FF3068D304C"><enum>(II)</enum><text>if the member is referred to in such subclause (II) or (III), the Deputy Secretary of the department referred to in the subclause.</text>
 </subclause></clause><clause id="H6839E94B1C7C466992963E773B28C341" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">If the temporary Board consists of members of only one political party, the President of the United States shall, to the extent practicable, appoint to the temporary Board a qualified member of a different political party who occupies a position requiring nomination by the President, by and with the consent of the Senate.</text>
 </clause><clause id="H056DDD3C090E4E50A037B8B5C5EC46DE" indent="up1"><enum>(v)</enum><text>The temporary board may not change or amend Agency policies, procedures, bylaws, or guidelines.</text> </clause><clause id="HCE3CE8A74F5F46E6A48ED803DE698D23" indent="up1"><enum>(vi)</enum><text display-inline="yes-display-inline">The temporary Board shall expire at the end of the term of the President of the United States in office at the time the temporary Board was constituted or upon restoration of a quorum of the Board of Directors as defined in subparagraph (A).</text>
 </clause><clause id="H69885B9426814BF0A9B35AAE8F027266" indent="up1"><enum>(vii)</enum><text display-inline="yes-display-inline">With respect to a transaction that equals or exceeds $100,000,000, the Chairperson of the temporary Board shall ensure that the Agency complies with section 2(b)(3).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H72BEBD75C5F74C939DEBFB79F57C9DE2"><enum>(b)</enum><header>Termination</header><text>The amendments made by subsection (a) shall have no force or effect after the 10-year period that begins with the date of the enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H5B4CBC331C134207BBDD5CE562BC6E16" section-type="subsequent-section"><enum>9.</enum><header>Strengthening support for United States small businesses</header>
 <subsection id="HA36B14EC3E104EE19BF102A197B11B11"><enum>(a)</enum><header>Small business policy</header><text display-inline="yes-display-inline">Section 2(b)(1) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)</external-xref>) is amended by striking subparagraph (E)(i)(I) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD3FA979172CC437BA537CF67DA1BB3C8" style="OLC">
					<subparagraph id="H9194A7228EFC4C349A01373BADC1A65D" indent="up2"><enum>(E)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="HCF395185C79D4C2BB05B4BCF33B03E9F"><enum>(i)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H855D6900182545DAB1BF845A15D7C059"><enum>(I)</enum><text display-inline="yes-display-inline">It is further the policy of the United States to encourage the participation of small business (including women-owned businesses, minority-owned businesses, veteran-owned businesses, businesses owned by persons with disabilities, and businesses in rural areas) and start-up businesses in international commerce, and to educate such businesses about how to export goods using the United States Export Finance Agency.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H50D65562BCD44397A6492840EFF86E52"><enum>(b)</enum><header>Outreach</header>
 <paragraph id="H99A40E4C9B084EAF8AE0D6C27D63B56E"><enum>(1)</enum><header>Plan</header><text display-inline="yes-display-inline">Within 120 days after the date of the enactment of this Act, the United States Export Finance Agency shall prepare and submit to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a comprehensive outreach plan to ensure that small business owners are aware of the financing options available to them through the Agency. The plan shall include—</text>
 <subparagraph id="HE62D12614F7F40EABCD805B00676B63A"><enum>(A)</enum><text>input from the Small Business Administration and statewide small business coalitions with operations in rural, urban, and suburban regions;</text>
 </subparagraph><subparagraph id="HADAC00D57D1D47F7BDB13FCD04DF5A31"><enum>(B)</enum><text>an emphasis on outreach to businesses owned by women, minorities, veterans, persons with disabilities, and individuals self-identifying as lesbian, gay, bisexual, transgender, or queer;</text>
 </subparagraph><subparagraph id="HC74B0AABD6DD457496F60DEDCDF6929C"><enum>(C)</enum><text display-inline="yes-display-inline">an emphasis on outreach to businesses that export goods and services that are produced by Indian tribes and that are made, assembled, or otherwise derived on or from an Indian tribe’s Indian land (as defined in section 2601(2) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/2501">25 U.S.C. 2501(2)</external-xref>);</text>
 </subparagraph><subparagraph id="H389639E637CE4B118EEE0F4373023740"><enum>(D)</enum><text>a proposed budget for carrying out the plan during fiscal years 2020 through 2029, that provides for the spending of at least $1,000,000 annually for outreach to small businesses; and</text>
 </subparagraph><subparagraph id="H5E6CE3ABC3B243528142B778BB53B9D2"><enum>(E)</enum><text display-inline="yes-display-inline">an emphasis on outreach to small businesses in sectors impacted by retaliatory tariffs.</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HBD6A241019FB43B6823AC111D53D342E"><enum>(2)</enum><header>Report on activities in economically disadvantaged regions</header><text display-inline="yes-display-inline">Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g</external-xref>), as amended by sections 6(b) and 7(b) of this Act, is amended by adding at the end the following:</text>

						<subsection id="H75C9DBFD0084491FB9EA3CAB99F910D7"><enum>(n)</enum><header>Report on activities in economically disadvantaged regions</header>
 <paragraph id="HC2951177116B46018E87E1457875034D"><enum>(1)</enum><header>In general</header><text>The Agency shall include in its annual report to Congress under subsection (a) a report on the steps taken by the Agency in the period covered by the report to increase—</text>
 <subparagraph id="H12CBDC9014A8422597ADB528F796D85D"><enum>(A)</enum><text>awareness of the Agency and its services in economically disadvantaged regions; and</text> </subparagraph><subparagraph id="H15A39ECF220F4706937FCF30644E6452"><enum>(B)</enum><text>the provision of Agency support to export businesses in economically disadvantaged regions.</text>
 </subparagraph></paragraph><paragraph id="HB9A40D14E44C44CD86B8397E99215C6B"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In paragraph (1), the term <quote>economically disadvantaged region</quote> means a county or equivalent division of local government of a State in which, according to the most recently available data from the Bureau of the Census, 20 percent or more of the residents have an annual income that is at or below the poverty level.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H646046B26AA144E4ABC76DC9322BD53C"><enum>(3)</enum><header>Implementation</header><text>Section 2(b)(1)(E) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H12FB437C8F8A47DFBBF40736606D9557" style="OLC">
 <clause id="H5F0524A175294E58A7EB358B3EBE5D5A" indent="up3"><enum>(xi)</enum><text display-inline="yes-display-inline">After consultation with the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate, the Agency shall implement the outreach plan referred to in section 9(b)(1) of the United States Export Finance Agency Act of 2019.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HC3FFA85D183348DAB1AA3043956FB4AC"><enum>(c)</enum><header>Exclusion of unutilized insurance authority in calculating small business threshold</header><text display-inline="yes-display-inline">Section 2(b)(1)(E)(v) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)(v)</external-xref>) is amended by adding at the end the following: <quote>For the purpose of calculating the amounts of authority required under this clause, the Agency shall, with respect to insurance, exclude unutilized authorizations that terminated during the fiscal year.</quote>.</text>
			</subsection><subsection id="H78A1CD9E3CB841A7B7218AC1836EE7A6"><enum>(d)</enum><header>Increase in small business threshold</header>
 <paragraph id="HD25F1BB518284EC09D7939A1F3105531"><enum>(1)</enum><header>In general</header><text>Section 2(b)(1)(E)(v) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)(v)</external-xref>) is amended by striking <quote>25</quote> and inserting <quote>30</quote>.</text> </paragraph><paragraph id="H9AC168F6D6CB4B10847974FF822B788E"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on October 1, 2028.</text>
 </paragraph></subsection><subsection id="H637344E8B50C4C14AF285BC00040802F"><enum>(e)</enum><header>Report on activities supporting Indian tribes</header><text display-inline="yes-display-inline">Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g</external-xref>), as amended by the preceding provisions of this Act, is amended by adding at the end the following:</text>

 <paragraph id="HF4E44F1862774F509FBB64E04C9DBDEE"><enum>(1)</enum><text>awareness of the Agency and its services available to Indian tribes; and</text> </paragraph><paragraph id="H4BADE951D0B74DF0B72866E9FF742605"><enum>(2)</enum><text>the provision of Agency support to tribal export businesses.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H96869777B5BE49128A4BEE1C410D2096"><enum>10.</enum><header>Enhancing flexibility to respond to predatory export financing by China</header>
 <subsection id="HC22DE1D9A321488588A9795C70DF957D"><enum>(a)</enum><header>Deeming rule under tied aid credit program</header><text display-inline="yes-display-inline">Section 10(b)(5)(B)(i)(III) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-3">12 U.S.C. 635i–3(b)(5)(B)(i)(III)</external-xref>) is amended by adding at the end the following new sentence: <quote>The requirement that there be credible evidence of a history of a foreign export credit agency making offers not subject to the Arrangement is deemed met in the case of exports likely to be supported by official financing from the People’s Republic of China, unless the Secretary of the Treasury has reported to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate that China is in substantial compliance with the Arrangement.</quote>.</text>
 </subsection><subsection id="HCE386D2DF0C647469D8F3C9DD6BA7740"><enum>(b)</enum><header>Collaboration with USDA on export financing programs</header><text display-inline="yes-display-inline">Section 13(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-7">12 U.S.C. 635i–7(1)(A)</external-xref>) is amended by inserting <quote>, the Department of Agriculture,</quote> before <quote>and other Federal agencies</quote>.</text> </subsection></section><section display-inline="no-display-inline" id="HAC58E37857A04CE983D5B256A2886693" section-type="subsequent-section"><enum>11.</enum><header>Restriction on financing for certain entities</header><text display-inline="no-display-inline">Section 2 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref>) is amended by adding at the end the following:</text>

 </paragraph><paragraph id="HA2363B9041904E14B59F0DFDA3C51B44"><enum>(2)</enum><header>Prohibited end user, obligor, or lender</header><text>An end user, obligor, or lender is described in this paragraph if the end user, obligor, or lender is known to the Agency to be:</text>
 <subparagraph id="H6043842240E840309E2758E6F469BAC3"><enum>(A)</enum><text display-inline="yes-display-inline">The People’s Liberation Army of the People’s Republic of China.</text> </subparagraph><subparagraph id="H411E4F00CF804C06AF855660983A5174"><enum>(B)</enum><text display-inline="yes-display-inline">The Ministry of State Security of the People’s Republic of China.</text>
 </subparagraph><subparagraph id="HFB180A902B024A27BE4B008AF832DC8B"><enum>(C)</enum><text display-inline="yes-display-inline">Included on the Denied Persons List or the Entity List maintained by the Bureau of Industry and Security of the Department of Commerce.</text>
 </subparagraph><subparagraph id="HE5F0AA4A18774D089F6B2F761484700C"><enum>(D)</enum><text display-inline="yes-display-inline">Included on the Arms Export Control Act debarred list maintained by the Directorate of Defense Trade Controls of the Department of State.</text>
 </subparagraph><subparagraph id="HB07E443ECEC847D29CE85AD8B86CB462"><enum>(E)</enum><text display-inline="yes-display-inline">Any person who has paid a criminal fine or penalty pursuant to a conviction or resolution or settlement agreement with the Department of Justice for a violation of the Foreign Corrupt Practices Act in the preceding 3 years.</text>
 </subparagraph><subparagraph id="H4B1C6F47C91F4DECB8927E3065FAFAD2"><enum>(F)</enum><text display-inline="yes-display-inline">A person who, in the preceding 3 years, appeared on the Annual Intellectual Property Report to Congress by the Intellectual Property Enforcement Coordinator in the Executive Office of the President, if the person was convicted in any court.</text>
 </subparagraph></paragraph><paragraph id="HB22BE14379874B6C9AF7B30D1E06A4A4"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H2F50EF88A82E4BB08223B9D8AD99B9F5"><enum>(A)</enum><header>Person</header><text>The term <quote>person</quote> means an individual or entity.</text>
 </subparagraph><subparagraph id="HC957ECBF9A344F75ABDCD13282538241"><enum>(B)</enum><header>Entity</header><text display-inline="yes-display-inline">The term <quote>entity</quote> means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section display-inline="no-display-inline" id="H022E94B2DFE04A2DBD4FE252C4291B42"><enum>12.</enum><header>Prohibitions on financing for certain persons involved in sanctionable activities</header><text display-inline="no-display-inline">Section 2 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref>), as amended by section 11 of this Act, is amended by adding at the end the following:</text>

				<subsection id="HEB315C147AC3493F97F024C35780DA06"><enum>(m)</enum><header>Prohibitions on financing for certain persons involved in sanctionable activities</header>
 <paragraph id="HCC867BFCF5514CA1962F5BA0339E1728"><enum>(1)</enum><header>In general</header><text>Beginning on the date that is 180 days after the date of the enactment of this subsection, the Board of Directors of the Agency may not approve any transaction that is subject to approval by the Board with respect to the provision by the Agency of any guarantee, insurance, or extension of credit, or the participation by the Agency in any extension of credit, to a person in connection with the exportation of any good or service unless the person provides the certification described in paragraph (2).</text>
 </paragraph><paragraph id="HE0831BC58E2E4930A9B1E8D9371CBA94"><enum>(2)</enum><header>Certification described</header><text display-inline="yes-display-inline">The certification described in this paragraph is a certification by a person who is an end user, obligor, or lender that neither the person nor any other person owned or controlled by the person engages in any activity in contravention of any United States law, regulation, or order applicable to the person concerning—</text>
 <subparagraph id="HD11AA6A0B4514D45813B9B19D1503D0F"><enum>(A)</enum><text>trade and economic sanctions, including an embargo;</text> </subparagraph><subparagraph id="HEF5B8A9F120743E7A2F18FC652705C2C"><enum>(B)</enum><text>the freezing or blocking of assets of designated persons;</text>
 </subparagraph><subparagraph id="H8EE5E5584842402DA35D2F4B2F4E10C9"><enum>(C)</enum><text display-inline="yes-display-inline">sanctions relating to serious violations of human rights or free speech, including any sanctions—</text> <clause id="H2828B20416DD4369985A6D5DD91F02BD"><enum>(i)</enum><text>imposed under the Global Magnitsky Human Rights Accountability Act;</text>
 </clause><clause id="HE829DC972276469EA3930D4425DE77BE"><enum>(ii)</enum><text display-inline="yes-display-inline">related to the efforts to the Chinese government to limit or punish demonstrations in Hong Kong;</text> </clause><clause id="H1BE57B0D4DF240218A4003BC67141DE2"><enum>(iii)</enum><text>related to the political repression or detention of religious and ethnic minorities in China or Burma; or</text>
 </clause><clause id="H6708B4A450D24AAAAF45469875E77928"><enum>(iv)</enum><text>related to the gross violation of internationally recognized human rights (as defined in section 502B of the Foreign Assistance Act of 1961) in China;</text>
 </clause></subparagraph><subparagraph id="H182DDD47F15345448C5B96A236AF3013"><enum>(D)</enum><text display-inline="yes-display-inline">sanctions relating to the illegal trafficking of synthetic opioids, including any sanctions imposed pursuant to the Foreign Narcotics Kingpin Designation Act;</text>
 </subparagraph><subparagraph id="H130E738A47D64D849D4A00D050E9D418"><enum>(E)</enum><text display-inline="yes-display-inline">sanctions relating to human rights abuses, including engaging in human trafficking, including sex trafficking, and any sanctions imposed under Executive Order No. 13581 (Blocking Property of Transnational Criminal Organizations); or</text>
 </subparagraph><subparagraph id="H307F8CE67EF145FCB60523818F9A5F38"><enum>(F)</enum><text>other restrictions on exports, imports, investment, payments, or other transactions targeted at particular persons or countries.</text>
 </subparagraph></paragraph><paragraph id="H8864A5E834B946A6A256EF98BAC561F9"><enum>(3)</enum><header>Certification requirements</header><text display-inline="yes-display-inline">The certification described in paragraph (2) shall be made after reasonable due diligence and based on best knowledge and belief.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7F09F579CB7E40709AE151D34413869E"><enum>13.</enum><header>Promoting renewable energy exports, environmental and social standards, and accountability</header>
 <subsection id="HFE0B59208BEA448D8A4318D69BC41AAA"><enum>(a)</enum><header>Office of financing for renewable energy, energy efficiency and energy storage exports</header><text>Section 2(b)(1)(C) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(C)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="HFAD2B30DADE24FD1B053F8339F2E52AF" style="OLC">
 <subparagraph id="HA82C09F54C14418CB77ADFF0B5345C84" indent="up2"><enum>(C)</enum><header>Office of financing for renewable energy, energy efficiency and energy storage</header><text>The President of the Agency shall establish an office whose functions shall be to promote the export of goods and services to be used in the development, production, and distribution of renewable energy resources, and energy efficiency (including battery electric vehicles, batteries for electric vehicles, and electric vehicle charging infrastructure) and energy storage technologies, and disseminate information concerning export opportunities and the availability of Agency support for such activities, to increase the total amount of loans, guarantees, and insurance provided by the Agency to support exports related to renewable energy, energy efficiency (including battery electric vehicles, batteries for electric vehicles, and electric vehicle charging infrastructure), and energy storage.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection display-inline="no-display-inline" id="H68831737AF3144E997A1737E9C9CEAD9"><enum>(b)</enum><header>Environmental policy and procedures</header><text display-inline="yes-display-inline">Section 11(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-5">12 U.S.C. 635i–5(a)</external-xref>) is amended—</text> <paragraph id="HA113BB03B41A48809D27D4841C89EBCD"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="H732A873D7F4942CF97C49EAE8995C16A"><enum>(A)</enum><text>in the second sentence, by inserting <quote>, including to potentially impacted communities in the country in which the activity will be carried out, at least 60 days before the date of the vote,</quote> before <quote>and supplemental</quote>;</text>
 </subparagraph><subparagraph id="HC8A48D4037E64815B77572CBF55BB14F"><enum>(B)</enum><text>by inserting after the second sentence the following: <quote>The procedures shall include a requirement for an analysis of the environmental and social impacts, including worker impacts and anticipated health impacts and costs, of the proposed activity and of alternatives to the proposed activity, including mitigation measures, where appropriate.</quote>; and</text>
 </subparagraph><subparagraph id="HAE119FD0827E4F8A894B76B6C0C55134"><enum>(C)</enum><text>in the third sentence, by striking <quote>The preceding sentence</quote> and inserting <quote>This paragraph</quote>;</text> </subparagraph></paragraph><paragraph id="H42979970411B449692D7C986C6856AB6"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (7) and inserting after paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA9FD619CBF6F4244BEBFBC6C8AC76708" style="OLC">
 <paragraph id="HEEE6BD9F45674C4493C80C3C133CD4E2"><enum>(2)</enum><header>Consultations with potentially impacted communities</header><text display-inline="yes-display-inline">In any credit or common terms agreements to which the Agency is a party relating to a transaction described in paragraph (1), the Agency shall include a provision to ensure that robust consultations with potentially impacted communities, including affected workers, in the country in which the activity will be carried out have been and will continue to be carried out throughout the project cycle.</text>
 </paragraph><paragraph id="H0F4D72C09AF2476BBD81B668EBE8C5AF"><enum>(3)</enum><header>Environmental and social due diligence procedures and guidelines review</header><text display-inline="yes-display-inline">By the end of 2020 and once at the end of each subsequent 3-year period, the Board of Directors of the Agency shall complete a review of the Environmental and Social Due Diligence Procedures and Guidelines ensuring that the procedures and guidelines incorporate requirements for project consideration that are consistent to limit greenhouse gas emissions and, to the maximum extent possible, to affirm that the Board operates consistently with the multilateral environmental agreements to which the United States is a party that are directly related to transactions in which the Agency is involved.</text>
 </paragraph><paragraph id="H4CFC6D7E0D824596B0A22AFBAC4539D6"><enum>(4)</enum><text display-inline="yes-display-inline">The Agency shall operate consistently with Annex VI of the Arrangement on Officially Supported Export Credits, as adopted by the Organisation for Economic Co-operation and Development as of January 2019.</text>
 </paragraph><paragraph id="HA143CEB692DE44C882B47130055D1F8A"><enum>(5)</enum><text>The Agency shall make publicly available the estimated amounts of CO<subscript>2</subscript> emissions expected to be produced from pending projects that the Agency has designated as Category A and B projects and work with other export credit agencies to encourage them to do the same.</text>
 <subparagraph id="H34357ACF476C4ABFB53A36C1ED6E6F54"><enum>(A)</enum><text>The Agency shall report CO<subscript>2</subscript> emissions associated with projects that the Agency has designated as Category A and B fossil fuel projects in its annual report by product categories.</text>
 </subparagraph><subparagraph id="H14E8367179ED4903802FCE113E175D6D"><enum>(B)</enum><text>The Agency shall advocate within the OECD and other multilateral fora for the full reporting of CO<subscript>2</subscript> emissions associated with appropriate energy and non-energy projects including manufacturing and agriculture.</text>
 </subparagraph><subparagraph id="HF77BE592C0084EC6BEF9583EAEFF8442"><enum>(C)</enum><text>The Agency shall undertake periodic reviews with stakeholders to ensure that the Agency employs the most appropriate methodology of estimating and tracking the CO<subscript>2</subscript> emissions from Category A and B projects the Agency supports.</text>
 </subparagraph></paragraph><paragraph id="H82768486AE4F4879B88C0CE8FACBF457"><enum>(6)</enum><text display-inline="yes-display-inline">The Agency shall develop and maintain measures to provide increased financing support for evolving technologies that reduce CO<subscript>2</subscript> emissions.</text>
 <subparagraph id="H57A7909813FB488CA213012D2B332903"><enum>(A)</enum><text display-inline="yes-display-inline">The Agency shall develop and maintain measures to encourage foreign buyers to seek available, commercially viable technology to reduce the CO<subscript>2</subscript> footprint of projects.</text>
 </subparagraph><subparagraph id="HF86E3C0C34094C36837F423874D7DBF7"><enum>(B)</enum><text display-inline="yes-display-inline">The Agency shall develop and maintain initiatives to finance aspects of project development that reduce or mitigate CO<subscript>2</subscript> emissions, such as effective carbon capture and sequestration technology, while maintaining the competitiveness of United States exporters.</text>
 </subparagraph><subparagraph id="HFBFC997BA43E4D65AC22543053F5389F"><enum>(C)</enum><text display-inline="yes-display-inline">In coordination with the Department of the Treasury, the Agency shall advocate in international fora for the availability of financing incentives for low to net zero CO<subscript>2</subscript>-emitting projects, a common methodology for evaluating and taking into account the social cost of carbon.</text>
 </subparagraph><subparagraph id="H743A678E2D61426B898777ACE4E98DDA"><enum>(D)</enum><text display-inline="yes-display-inline">The Agency shall encourage export credit agencies and other relevant lending institutions to adopt similar CO<subscript>2</subscript> policies, including encouraging transparency and the involvement of stakeholders.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HF4F34D095067485EAB1241243A2608C7"><enum>(3)</enum><text>in paragraph (7) (as so redesignated by paragraph (2) of this subsection), by striking <quote>paragraph (1)</quote> and inserting <quote>this subsection</quote>.</text> </paragraph></subsection><subsection display-inline="no-display-inline" id="H7F270596BA244C10B142C1732FF2E10A"><enum>(c)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Section 11(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-5">12 U.S.C. 635i–5(c)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3E9D00EAAE8D4CE3816C5F1C6DAE7D50" style="OLC">
 <subsection id="H50EC77A9294244E9965D216DF15442A9"><enum>(c)</enum><header>Inclusion in annual report to Congress</header><text display-inline="yes-display-inline">The Agency shall include in its annual report to Congress under section 8 a summary of its activities under subsections (a) and (b). The Board of Directors shall submit to the Congress a report, which shall be made publicly available on the Internet at the time of delivery—</text>
 <paragraph id="HE442BB9444614625B01E66CD7AB5359F"><enum>(1)</enum><text>that provides a detailed accounting of the methodology used to make greenhouse gas emissions project determinations;</text>
 </paragraph><paragraph id="H0DE89F123BDB4FCE8BF8A274C6D900D6"><enum>(2)</enum><text display-inline="yes-display-inline">details the steps taken to ensure that the Environmental and Social Due Diligence Procedures and Guidelines of the Agency are consistent with—</text>
 <subparagraph id="H5BF02B2FB3BE450696C2FC08D4592459"><enum>(A)</enum><text>reducing greenhouse gas emissions; and</text> </subparagraph><subparagraph id="H0BCDD4763D254AD69AC13CB06275E5A1"><enum>(B)</enum><text>operating consistently with the multilateral environmental agreements to which the United States is a party that are directly related to transactions in which the Agency is involved; and</text>
 </subparagraph></paragraph><paragraph id="H87B1F4084F0C4AC1B43B53D3A02A7B76"><enum>(3)</enum><text display-inline="yes-display-inline">details the effects of exports and projects financed by the Agency on the number of jobs created or retained in the energy and related technologies industries of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection display-inline="no-display-inline" id="HAAAA8F0FFBF14002A5378CA59B3EE8D6"><enum>(d)</enum><header>Financing for renewable energy, energy efficiency, and energy storage technologies</header><text display-inline="yes-display-inline">Section 2(b)(1)(K) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(K)</external-xref>) is amended by inserting <quote>, energy efficiency (including battery electric vehicles, batteries for electric vehicles, and electric vehicle charging infrastructure), and energy storage. It shall be a goal of the Bank to ensure that not less than 5 percent of the applicable amount (as defined in section 6(a)(2)) is made available each fiscal year for the financing of renewable energy, energy efficiency (including battery electric vehicles, batteries for electric vehicles, and electric vehicle charging infrastructure), and energy storage technology exports</quote> before the period.</text>
 </subsection><subsection id="H3D72B1E537B549718FA4085D10052B40"><enum>(e)</enum><header>Sense of the Congress regarding Agency accountability</header><text>It is the sense of the Congress that—</text> <paragraph id="HACA1CA6C54D045CEA448AE7CA1F9464B"><enum>(1)</enum><text display-inline="yes-display-inline">the Board of Directors of the United States Export Finance Agency (in this section referred to as the <quote>Agency</quote>) should, after a public consultation process, establish a formal, transparent, and independent accountability mechanism to review, investigate, offer independent dispute resolution to resolve, and publicly report on allegations by affected parties of any failure of the Agency to follow its own policies and procedures with regard to the environmental and social impacts of projects, including impacts on workers, and on situations where the Agency is alleged to have failed in ensuring the borrower is fulfilling its obligations in financing agreements with respect to the policies and procedures;</text>
 </paragraph><paragraph id="HB4C0172DEA734B02A7770A9119173A82"><enum>(2)</enum><text>the accountability mechanism should be able to provide advice to management on policies, procedures, guidelines, resources, and systems established to ensure adequate review and monitoring of the environmental and social impacts of projects;</text>
 </paragraph><paragraph id="H72F1A1D5C2B949CA8DF33252246EBB09"><enum>(3)</enum><text>in carrying out its mandate, the confidentiality of sensitive business information should be respected, as appropriate, and, in consultation with potentially impacted communities, project sponsors, Agency management, and other relevant parties, a flexible process should be followed aimed primarily at correcting project failures and achieving better results on the ground;</text>
 </paragraph><paragraph id="H9F67CC4F05554B03923C4261AD278E40"><enum>(4)</enum><text>the accountability mechanism should be independent of the line operations of management, and report its findings and recommendations directly to the Board of Directors of the Agency and annually to the Congress;</text>
 </paragraph><paragraph id="H1809285020FE45E9A61C285735D3E674"><enum>(5)</enum><text>the annual report of the Agency should include a detailed accounting of the activities of the accountability mechanism for the year covered by the report and the remedial actions taken by the Agency in response to the findings of the accountability mechanism;</text>
 </paragraph><paragraph id="H3995F0DD66574813927111C4467F46A7"><enum>(6)</enum><text>in coordination with the accountability mechanism, the Agency and relevant parties should engage in proactive outreach to communities impacted or potentially impacted by Agency financing and activities to provide information on the existence and availability of the accountability mechanism;</text>
 </paragraph><paragraph id="H7232647FCA65499E82D4B7841F40E46A"><enum>(7)</enum><text>the President of the Agency should, subject to the approval of the Board of Directors of the Agency, and consistent with applicable law, through an open and competitive process, including solicitation of input from relevant stakeholders, appoint a director of the accountability mechanism, who would be responsible for the day-to-day operations of the mechanism, and a panel of not less than three experts, including the director, who would also serve as chair of the panel; and</text>
 </paragraph><paragraph id="H5B43EDC1E48C4818AC1161E2E445E62F"><enum>(8)</enum><text display-inline="yes-display-inline">the accountability mechanism director and members of the panel should not have been employed by the Agency within the 5 years preceding their appointment, and should be ineligible from future employment at the Agency.</text>
 </paragraph></subsection></section><section display-inline="no-display-inline" id="H34515906ACA648908B760F08D0CBD84B" section-type="subsequent-section"><enum>14.</enum><header>Reinsurance program</header><text display-inline="no-display-inline">Section 51008 of the Fixing America’s Surface Transportation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref> note) is amended—</text> <paragraph id="HE61AB520E8DB445A80F782CBDC03869C"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Pilot</header-in-text></quote>;</text>
 </paragraph><paragraph id="HDA88B1AB5BE2424EBBE168E83C03BB83"><enum>(2)</enum><text>in subsection (a), by striking <quote>pilot</quote>;</text> </paragraph><paragraph display-inline="no-display-inline" id="H6445989A6F5F48D381F9C82DD16F5F53"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking <quote>$1,000,000,000</quote> and inserting <quote>$2,000,000,000</quote>; and</text>
 </paragraph><paragraph id="H98489348F97247E4A3E0DCA22FF8DBE9"><enum>(4)</enum><text>by striking subsections (c) through (e) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H27A32356CDF74948A8C545882D1D1DC9" style="OLC"> <subsection id="H41F09A00E0874D489EDC7A7D1274974A"><enum>(c)</enum><header>Factors for consideration in reinsurance pools</header><text display-inline="yes-display-inline">In implementing this section, the Agency shall, with respect to a reinsurance pool, pursue appropriate objectives to reduce risk and costs to the Agency, including by the following, to the extent practicable:</text>
 <paragraph id="HE52891D95C934978ACC8F413298DC91A"><enum>(1)</enum><text>Ensuring a reasonable diversification of risks.</text> </paragraph><paragraph id="H7B779D19F4A741BFB02ECD5F879C2249"><enum>(2)</enum><text>Including larger exposures where the possibility of default raises overall portfolio risk for the Agency.</text>
 </paragraph><paragraph id="H445843FFE8A94F939600C4EADE0686BE"><enum>(3)</enum><text>Excluding transactions from the pool that are covered by first-loss protection.</text> </paragraph><paragraph id="H219E15E9E8774541AC3D3C4C8FDD80B6"><enum>(4)</enum><text>Excluding transactions from the pool that are collateralized at a rate greater than standard market practice.</text>
 </paragraph><paragraph id="HCAB0FECB71E54587BD5848D41480CF44"><enum>(5)</enum><text>Diversifying reinsurance pools by industry and other appropriate factors.</text> </paragraph><paragraph id="H59A71A258734415DAFB6781C5B7518EB"><enum>(6)</enum><text>Exploring different time periods of coverage.</text>
 </paragraph><paragraph id="H537B51F0A1274D9490335BA21EDBA035"><enum>(7)</enum><text>Exploring both excess of loss structures on a per-borrower as well as an aggregate basis.</text> </paragraph></subsection><subsection id="H2C85CD9E7E0B4983887AFF4E54A6DF1D"><enum>(d)</enum><header>Biennial reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this subsection, and every 2 years thereafter through 2029, the Agency shall submit to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a written report that contains an assessment of the use of the program carried out under subsection (a) since the most recent report under this subsection.</text>
 </subsection><subsection id="H448E12D7A90B4A0C9ABFDFDD3A17E740"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit any authority of the Agency described in section 2(a)(1) of the Export-Import Bank Act of 1945.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section display-inline="no-display-inline" id="H7016DE5A2891482CBF0FC18975B85905" section-type="subsequent-section"><enum>15.</enum><header>Information technology systems</header><text display-inline="no-display-inline">Section 3(j) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(j)</external-xref>) is amended—</text> <paragraph id="H34898920F1AF440FA7A551E87352AA45"><enum>(1)</enum><text>in paragraph (1), by striking all that precedes subparagraph (A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBC4C38C0B0E5458D974E004F4D2CA1C2" style="OLC">
 <paragraph id="H5A8D1AC00B9D4FB89A67EE4ED7D57C3A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (3) and (4), the Agency may use an amount equal to 1.25 percent of the surplus of the Agency during fiscal years 2020 through 2029 to—</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HA907DD8E1B7C40339DFF3CD7A69CFE15"><enum>(2)</enum><text>by striking paragraph (3) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H47EDAD4BD0FB4637A7D818E00E16231D" style="OLC"> <paragraph id="HB18163F7B1B44406ACCB90EA26F50DF2"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">The aggregate of the amounts used in accordance with paragraph (1) for fiscal years 2020 through 2029 shall not exceed $40,000,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HCE7C140E58F54034B0C6AF9D739E0361"><enum>16.</enum><header>Administratively determined pay</header><text display-inline="no-display-inline">Section 3 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a</external-xref>), as amended by section 7(a) of this Act, is amended by adding at the end the following:</text>
			<quoted-block id="HE2A034DC013F43FE880D65511FF23043" style="OLC">
				<subsection id="HD04BCDB3E15B43DE8515A89DD7E69091"><enum>(o)</enum><header>Compensation of employees</header>
 <paragraph id="H7667CEE3302E4605B9FCA5063B6FE58B"><enum>(1)</enum><header>Rates of pay</header><text>Subject to paragraph (2), the Board of Directors of the Agency, consistent with standards established by the Director of the Office of Minority and Women Inclusion, may set and adjust rates of basic pay for employees and new hires of the Agency without regard to the provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, except that no employee of the Agency may receive a rate of basic pay that exceeds the rate for level III of the Executive Schedule under section 5313 of such title.</text>
 </paragraph><paragraph id="HB2646A1325204EC68523D70AF42AE866"><enum>(2)</enum><header>Limitations</header><text display-inline="yes-display-inline">The Board of Directors of the Agency may not apply paragraph (1) to more than 35 employees at any point in time. Nothing in paragraph (1) may be construed to apply to any position of a confidential or policy-determining character that is excepted from the competitive service under section 3302 of title 5, United States Code, (pursuant to schedule C of subpart C of part 213 of title 5 of the Code of Federal Regulations) or to any position that would otherwise be subject to section 5311 or 5376 of title 5, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HFF18E8F7095743A08F3245985D63824C" section-type="subsequent-section"><enum>17.</enum><header>Authority of the United States Export Finance Agency to use <enum-in-header>3</enum-in-header> percent of its profits for administrative expenses</header><text display-inline="no-display-inline">Section 3 of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a</external-xref>), as amended by the preceding provisions of this Act, is amended by adding at the end the following:</text>

 <subparagraph id="HA9DBB31E898A4B3D8E0CE575ADC01E0C"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (2), in addition to any other amounts that the Agency may use to cover administrative expenses of the Agency, the Agency may use not more than 3 percent of the surplus (as defined in subsection (j)(2), without regard to subparagraph (B)(ii) of such subsection) of the Agency, for each fiscal year in the 5-year period beginning with the date of the enactment of this paragraph, to cover administrative expenses of the Agency.</text>
 </subparagraph><subparagraph id="HEFC09A48D0AE4B4BA30F9150F2C2B679"><enum>(B)</enum><header>Use for regional offices</header><text display-inline="yes-display-inline">Of the amount of the surplus which may be used as provided in subparagraph (A), the Agency shall use at least one-third to expand or establish regional offices of the Agency.</text>
 </subparagraph></paragraph><paragraph id="H5DF5F9AABBE64E5BB11A4D919F59959D"><enum>(2)</enum><header>Subject to appropriations</header><text display-inline="yes-display-inline">The authority provided by paragraph (1) may be exercised only to such extent and in such amounts as are provided in advance in appropriations Acts.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HCCB386E80D004164A63F26612C2F0FAC"><enum>18.</enum><header>GAO report on the effect of Agency closure on businesses that use Agency services</header><text display-inline="no-display-inline">Within 1 year after the date of the enactment of this Act, the Comptroller General shall submit to the Congress a written report on the effect that closure of the United States Export Finance Agency would have on businesses that use services of the United States Export Finance Agency.</text>
