 <section id="HC2AFF3F1734C49CE9276C31C63729AB5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Hearing Act of 2019</short-title></quote>.</text> </section><section display-inline="no-display-inline" id="H34C7B7FFF44C4CDBA8972A4DD9CD3076" section-type="subsequent-section"><enum>2.</enum><header>Providing coverage for hearing care under the Medicare program</header> <subsection id="HC595198AD1A043EDBBDBACEA325342A3"><enum>(a)</enum><header>Provision of aural rehabilitation and treatment services by qualified audiologists</header><text display-inline="yes-display-inline">Section 1861(ll)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ll)(3)</external-xref>) is amended by inserting <quote>(and, beginning January 1, 2022, such aural rehabilitation and treatment services)</quote> after <quote>assessment services</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H0AA1E60DFB4C4C86940FEE93654C5BCD"><enum>(b)</enum><header>Coverage of hearing aids</header>
 <paragraph id="HCC3BAB334CE9456FB99DB5DA75FE9D84"><enum>(1)</enum><header>Inclusion of hearing aids as prosthetic devices</header><text>Section 1861(s)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended by inserting <quote>, and including hearing aids furnished on or after January 1, 2022, to individuals diagnosed with profound or severe hearing loss</quote> before the semicolon at the end.</text>
 </paragraph><paragraph id="H4A081ED519A74E788A096B8A665553CA"><enum>(2)</enum><header>Payment limitations for hearing aids</header><text>Section 1834(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 <paragraph id="H027791BED8104965B0F12FC8B675C636"><enum>(6)</enum><header>Limitations for hearing aids</header><text display-inline="yes-display-inline">Payment may be made under this part with respect to an individual, with respect to hearing aids furnished on or after January 1, 2022—</text>
 <subparagraph id="H9F90280C321D48788EB9E4F9050C9557"><enum>(A)</enum><text>not more than once during any 5-year period;</text> </subparagraph><subparagraph id="HADEFE022EDD24F99BDEBE6A78AFD5DFC"><enum>(B)</enum><text>only for types of such hearing aids that are not over-the-counter hearing aids (as defined in section 520(q)(1) of the Federal Food, Drug, and Cosmetic Act) and that are determined appropriate by the Secretary; and</text>
 </subparagraph><subparagraph id="H09BB4529077545B0AFB6A167535E69E6"><enum>(C)</enum><text display-inline="yes-display-inline">only if furnished pursuant to a written order of a physician or qualified audiologist (as defined in section 1861(ll)(4)(B)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="HCEE6B258581E4F0BBD7B23A64733F6A4"><enum>(3)</enum><header>Application of competitive acquisition</header>
 <subparagraph id="H26663A6CC47B43EDA08744570C82FDEB"><enum>(A)</enum><header>In general</header><text>Section 1834(h)(1)(H) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(1)(H)</external-xref>) is amended—</text> <clause id="H68A33138605C4F6B8336CB3562100B79"><enum>(i)</enum><text>in the header, by inserting <quote><header-in-text level="subparagraph" style="OLC">and hearing aids</header-in-text></quote> before the semicolon;</text>
 </clause><clause id="HA12EB843C207401CA79E961A05949926"><enum>(ii)</enum><text>by inserting <quote>and of hearing aids described in paragraph (2)(D) of such section,</quote> after <quote>2009,</quote>; and</text> </clause><clause id="H792B8198BD1545889E01D0F615CB7716"><enum>(iii)</enum><text>in clause (i), by inserting <quote>or such hearing aids</quote> after <quote>such orthotics</quote>.</text>
						</clause></subparagraph><subparagraph id="HE5D707D35D1D4DEAB1BBFA1690E39708"><enum>(B)</enum><header>Conforming amendment</header>
 <clause id="HDD517CA9F52B4325BF4B467A96B8FE18"><enum>(i)</enum><header>In general</header><text>Section 1847(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

 <subparagraph id="H3AEA6B8DB74F4648A45AC9C7F2F1CA76"><enum>(D)</enum><header>Hearing aids</header><text display-inline="yes-display-inline">Hearing aids for which payment would otherwise be made under section 1834(h).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </clause><clause id="H582075523E144798B923CDBAF033445D"><enum>(ii)</enum><header>Exemption of certain items from competitive acquisition</header><text>Section 1847(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(7)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

 <subparagraph id="H64849C39F55744FFA2705BD39F98738E"><enum>(C)</enum><header>Certain hearing aids</header><text display-inline="yes-display-inline">Those items and services described in paragraph (2)(D) if furnished by a physician or other practitioner (as defined by the Secretary) to the physician’s or practitioner’s own patients as part of the physician’s or practitioner’s professional service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="H8CE7D2155BF6449299D93AD71D9948D7"><enum>(4)</enum><header>Inclusion of audiologists as certain practitioners to receive payment on an assignment-related
 basis</header><text display-inline="yes-display-inline">Section 1842(b)(18)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)(C)</external-xref>) is amended by adding at the end the following new clause:</text>

 <clause id="H20BE27FCFCB142BCB68FBC378D44D114"><enum>(vii)</enum><text display-inline="yes-display-inline">With respect to 2022 and each subsequent year, a qualified audiologist (as defined in section 1861(ll)(4)(B)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H84FC623FD0844427B0155E64DB985BE7"><enum>(c)</enum><header>Exclusion modification</header><text>Section 1862(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(7)</external-xref>) is amended by inserting <quote>(except such hearing aids or examinations as described in and otherwise allowed under section 1861(s)(8))</quote> after <quote>hearing aids or examinations therefor</quote>.</text>
 </subsection></section><section display-inline="no-display-inline" id="HD6CA428A6DB04582BF2385C549DD05AD" section-type="subsequent-section"><enum>3.</enum><header>Implementation funding</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall provide for the transfer from the Federal Supplementary Medical Insurance Trust Fund under section 1841 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395t">42 U.S.C. 1395t</external-xref>) to the Centers for Medicare &amp; Medicaid Services Program Management Account for the period of 2020 through 2024 of such sums as may be necessary for purposes of implementing the amendments made by section 2.</text>
		</section><section id="H891511D43A4142CB9AF05350C082E2A1"><enum>4.</enum><header>Report</header>
 <subsection id="H101101CCBEFA4534B0D21D1A8F876D9E"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the date that is 2 years after the date of the enactment of the <short-title>Medicare Hearing Act of 2019</short-title>, the Inspector General of the Department of Health and Human Services shall—</text> <paragraph id="H4E559010235248A9AD6C7D929E977DD2"><enum>(1)</enum><text display-inline="yes-display-inline">determine the feasibility of qualified audiologists (as defined in paragraph (4)(B) of 1861(ll) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ll)</external-xref>)) furnishing audiology services (as defined in paragraph (3) of such section) to individuals entitled to benefits under part A of title XVIII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref> et seq.) and enrolled for benefits under part B of such title (42 U.S.C.1395j et seq.) without such individuals being referred by a physician (as defined in section 1861(r) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)</external-xref>)) or practitioner (as described in section 1842(b)(18)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)(C)</external-xref>)) to qualified audiologists; and</text>
 </paragraph><paragraph id="H04E2A633D4E245E6BF668A1910B17905"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Secretary of Health and Human Services a report on the feasibility of the referral described in paragraph (1) and any program integrity or overutilization concerns with respect to such referral.</text>
 </paragraph></subsection><subsection id="HE25F6EB4E41D49EA91E481F420779A0B"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services may promulgate regulations to allow qualified audiologists to furnish audiology services without a referral from a physician or practitioner, consistent with the findings submitted to the Secretary pursuant to subsection (a)(2).</text>
