 <section id="HFD9F75BE2BB240B4AF4F8F7DB09849F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Student Protection Act</short-title></quote>.</text> </section><section id="H7966C9B27472406C890639BD64E21044"><enum>2.</enum><header>Institutional expenditures</header> <subsection id="H5F9CAE1348AD4BF089496B5C4662A4F9"><enum>(a)</enum><header>Consumer information</header><text display-inline="yes-display-inline">Section 132(i)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015a">20 U.S.C. 1015a(i)(1)</external-xref>) is amended by adding at the end:</text>

 <subparagraph id="H5E9098A6AB9D498DA20D6E5F79E737DD"><enum>(AA)</enum><text display-inline="yes-display-inline">The institution’s expenditures on instruction, student services, marketing, recruitment, advertising, and lobbying.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HDEC1E7A8ACD842CD85B01FDEFD436D87"><enum>(b)</enum><header>Restrictions on certain expenditures</header><text display-inline="yes-display-inline">Part G of title IV of the Higher Education Act of 1965 is amended by adding at the end the following:</text>

					<section id="H230EDD83CE314BCD9511B4F5426CEA08"><enum>498E.</enum><header>Restrictions on certain expenditures</header>
						<subsection id="H1CD6F9CB557A485EB365B2C3D856CD81"><enum>(a)</enum><header>Establishing definitions</header>
 <paragraph id="H0975FD5C769141369A80F575224E29D7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of each survey conducted under the Integrated Postsecondary Education Data System after the date of enactment of the Higher Education Student Protection Act and this Act, the Secretary shall define the following terms:</text>
 <subparagraph id="HE210D7D9D9EC4F6BBCC20342ECD3FBEB"><enum>(A)</enum><text>Marketing.</text> </subparagraph><subparagraph id="H26634B611DBE4A78B3F2A86B9958ED31"><enum>(B)</enum><text>Recruitment.</text>
 </subparagraph><subparagraph id="H2412CDD5F94A48F68CD2302E24CB61EB"><enum>(C)</enum><text>Advertising.</text> </subparagraph><subparagraph id="H7443D1219A5F4DFEAC61B2439670B2FA"><enum>(D)</enum><text>Lobbying.</text>
 </subparagraph><subparagraph id="H6B4333AFAEF147769E9CCB97877F1885"><enum>(E)</enum><text>Student services.</text> </subparagraph></paragraph><paragraph id="HC4BEFBBA6FCD4675BE0B8D8049DE4341"><enum>(2)</enum><header>Exclusion of certain activities</header><text display-inline="yes-display-inline">In defining the term <term>student services</term> under paragraph (1)(E), the Secretary shall ensure that such term does not include marketing, recruitment, advertising, or lobbying.</text>
 </paragraph></subsection><subsection commented="no" id="H0CF2568C757B4F23AB44548AE98B0BFD"><enum>(b)</enum><header>Limitation on expenditures</header><text display-inline="yes-display-inline">In a case in which the Secretary determines with respect to an institution of higher education participating in any program under this title that, for any of the 3 most recent institutional fiscal years for which the institution submits to the Secretary disclosures on the expenditures of the institution on instruction, the amount expended by such institution on instruction for such fiscal year is less than an amount equal to 1/3 of institution’s revenues derived from tuition and fees—</text>
 <paragraph id="HE602B1811C014D039EEBC0ECCC1EB27B"><enum>(1)</enum><text display-inline="yes-display-inline">for any institutional fiscal year after such determination is made, the sum of the amount expended by the institution on marketing, recruitment, advertising, and lobbying may not exceed the amount of the institution’s revenues derived from sources other than Federal education assistance funds; and</text>
 </paragraph><paragraph id="H63EA8813E0794BE8A0CD28A048C2910F"><enum>(2)</enum><text display-inline="yes-display-inline">in a case in which the institution fails to meet the requirements of paragraph (1) for 2 consecutive institutional fiscal years, the institution shall be ineligible to participate in the programs authorized by this title for a period of not less than two institutional fiscal years.</text>
 </paragraph></subsection><subsection id="HE129CD704D34450AB9594AE3D622DE53"><enum>(c)</enum><header>Publication on website</header><text display-inline="yes-display-inline">The Secretary shall, on an annual basis, publicly disclose on the Department’s website, information with respect to any institution of higher education that is subject to the requirements of subsection (b)(1), including—</text>
 <paragraph id="H99EF65BC1311470E9AEE90F144335399"><enum>(1)</enum><text display-inline="yes-display-inline">the quotient of the amount that the institution expends on instruction for purposes of section 132(i)(1)(AA) divided by the institution’s revenues derived from tuition and fees, expressed as a percentage;</text>
 </paragraph><paragraph id="H7D9E58117C90481183F601F787555889"><enum>(2)</enum><text>the sum of such institution’s expenditures on advertising, recruiting, marketing, and lobbying;</text> </paragraph><paragraph id="HCA02998912BB4D1BBAB5F6EA8440F687"><enum>(3)</enum><text>the amount of such institution’s revenues received from sources outside of Federal education assistance funds; and</text>
 </paragraph><paragraph id="H41DB861E5DE846D1B3590FC839B2874A"><enum>(4)</enum><text>the difference between paragraphs (2) and (3).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section></legis-body></bill>
