			 innovation and to enhance the industrial competitiveness of the United
			 States by developing technologies to reduce emissions of nonpower
			 industrial sectors, and for other purposes.</official-title></form>

 <section id="H777AA322920F40A0984460EBE2BADF20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Industrial Technology Act of 2019</short-title></quote> or the <quote><short-title>CIT Act of 2019</short-title></quote>.</text> </section><section id="H5D0DC0AD36F14FB08476A8EE4311FE78"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act and the amendments made by this Act is to encourage the development and evaluation of innovative technologies aimed at increasing—</text>
 <paragraph id="H7AF6B7ADEA844135A0B58E29BD9C901F"><enum>(1)</enum><text>the technological and economic competitiveness of industry and manufacturing in the United States; and</text>
 </paragraph><paragraph id="HC4F4F7BE9DDF438E8D0E03553B5F1CBC"><enum>(2)</enum><text display-inline="yes-display-inline">the emissions reduction of nonpower industrial sectors.</text> </paragraph></section><section id="H3BCC0FD8058E451C823A7D9FBC7F2631"><enum>3.</enum><header>Industrial emissions reduction technology development program</header> <subsection id="HF8F81637AFF14927ADE6DCB8C8310847"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Energy Independence and Security Act of 2007 is amended by inserting after section 453 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112</external-xref>) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA9AEF9CD76704B8FAB03024C1E8365D7" style="OLC">
					<section id="H5655316D0CB5487FA0810FD5CAA6B10B"><enum>454.</enum><header>Industrial emissions reduction technology development program</header>
 <subsection id="HD8AC1A85462B4EA4B272276D3D6064C3"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H5CA33AD38B864F979906A4ED43249FDB"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Science and Technology Policy.</text>
 </paragraph><paragraph commented="no" id="H7BFD5B2BBA104139B1FAD3A06E993328"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph commented="no" id="H5D080E1273A847888AD83EE3EE4B55A7"><enum>(A)</enum><text>a scientist or other individual with knowledge and expertise in emissions reduction;</text>
 </subparagraph><subparagraph commented="no" id="HADC2581CBD5743B781E18140A318AA85"><enum>(B)</enum><text>an institution of higher education;</text> </subparagraph><subparagraph commented="no" id="HC51B09453A674579B4325ED2C40BB5CD"><enum>(C)</enum><text>a nongovernmental organization;</text>
 </subparagraph><subparagraph commented="no" id="HE1DF0C92729C4D259E4D0DF3B23192AE"><enum>(D)</enum><text>a National Laboratory;</text> </subparagraph><subparagraph commented="no" id="H0884999354FE4B6FAA3652CAAC4909F8"><enum>(E)</enum><text>a private entity; and</text>
 </subparagraph><subparagraph commented="no" id="HBDEC0E2FEF7244099C9DF5275D69B762"><enum>(F)</enum><text>a partnership or consortium of 2 or more entities described in subparagraphs (B) through (E).</text> </subparagraph></paragraph><paragraph id="H4A34AF2D193B47C4B2BD518641B7017B"><enum>(3)</enum><header>Emissions reduction</header> <subparagraph id="HC6F34B651E59426CBC38B02F7EED8841"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>emissions reduction</term> means the reduction, to the maximum extent practicable, of net nonwater greenhouse gas emissions to the atmosphere by energy services and industrial processes.</text>
 </subparagraph><subparagraph id="H11540820C6584DE7900B5B55E1F861A4"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>emissions reduction</term> does not include the elimination of carbon embodied in the principal products of industrial manufacturing.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF55CF4A459F341A784FE45F8AF45ACD4"><enum>(4)</enum><header display-inline="yes-display-inline">Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5FC6A5BEDEF2469D8530B264F2CB90FF"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text>
							</paragraph></subsection><subsection id="H93632734F0F44ADD9927D22807EF3504"><enum>(b)</enum><header>Industrial emissions reduction technology development program</header>
 <paragraph id="H9C02EF302A2D47A7A042C79099BE444E"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>CIT Act of 2019</short-title>, the Secretary, in coordination with the Director and in consultation with the heads of relevant Federal agencies, National Laboratories, industry, and institutions of higher education, shall establish a crosscutting industrial emissions reduction technology development program of research, development, demonstration, and commercial application to further the development and commercialization of innovative technologies that—</text>
 <subparagraph id="HEB0D8729396D4CF4A13FBCEA4D0D3C12"><enum>(A)</enum><text>increase the technological and economic competitiveness of industry and manufacturing in the United States; and</text>
 </subparagraph><subparagraph id="HE56035CD50B74260AF17E6AA0550605B"><enum>(B)</enum><text>achieve emissions reduction in nonpower industrial sectors.</text> </subparagraph></paragraph><paragraph id="H840F47F462654B2492EE7EFCC741F988"><enum>(2)</enum><header>Coordination</header><text>In carrying out the program, the Secretary shall—</text>
 <subparagraph id="HE46760ECBDFF45C4ACF68199A23415C2"><enum>(A)</enum><text>coordinate with each relevant office in the Department and any other Federal agency;</text> </subparagraph><subparagraph id="H6077674B653E49028421845E1FB27356"><enum>(B)</enum><text>coordinate and collaborate with the Industrial Technology Innovation Advisory Committee established under section 455; and</text>
 </subparagraph><subparagraph id="HF67B17DC6C0D4E12A4956CADBD4F64C8"><enum>(C)</enum><text>coordinate with the energy-intensive industries program established under section 452.</text> </subparagraph></paragraph><paragraph id="H17843F9CD8F14FC092042F13D5E1A114"><enum>(3)</enum><header>Leverage of existing resources</header><text>In carrying out the program, the Secretary shall leverage, to the maximum extent practicable—</text>
 <subparagraph id="H2169A4164CDE4C9E8C574503D07D4E73"><enum>(A)</enum><text>existing resources and programs of the Department and other relevant Federal agencies; and</text> </subparagraph><subparagraph id="H1DD05E5930D2422E9D5347D16EED3321"><enum>(B)</enum><text>public-private partnerships.</text>
 </subparagraph></paragraph></subsection><subsection id="H6CC531127564497292878BE0A1811038"><enum>(c)</enum><header>Focus areas</header><text>The program shall focus on—</text> <paragraph id="HEDF58BA3E7C241AE8843050AC8F1566F"><enum>(1)</enum><text>industrial production processes, including technologies and processes that—</text>
 <subparagraph id="H29E28A29FDBE4DE986985402D88BE615"><enum>(A)</enum><text>achieve emissions reduction in high-emissions industrial materials production processes, including production processes for iron, steel, steel mill products, aluminum, cement, glass, pulp, paper, and industrial ceramics;</text>
 </subparagraph><subparagraph id="HD057F9F1B2B14C65A335F93FFDEFCAF4"><enum>(B)</enum><text>achieve emissions reduction in medium- and high-temperature heat generation, including—</text> <clause id="H1174B9A1DB2C4E83870B00B984B1B416"><enum>(i)</enum><text>through electrification of heating processes;</text>
 </clause><clause id="H9AA0C7B4746F40329B904AA1A1716864"><enum>(ii)</enum><text>through renewable heat generation technology;</text> </clause><clause id="HD3197E4F009E4AD09EF79F276E9756D3"><enum>(iii)</enum><text>through combined heat and power; and</text>
 </clause><clause id="H84BB4F703FC6478A8688E69F4A5683C4"><enum>(iv)</enum><text>by switching to alternative fuels, including hydrogen;</text> </clause></subparagraph><subparagraph id="H0FFC1E92386C461C967FDB9E8EB04833"><enum>(C)</enum><text>achieve emissions reduction in chemical production processes;</text>
 </subparagraph><subparagraph id="H4039D3CED3A7450EA0CA709310AA367A"><enum>(D)</enum><text>leverage smart manufacturing technologies and principles, digital manufacturing technologies, and advanced data analytics to develop advanced technologies and practices in information, automation, monitoring, computation, sensing, modeling, and networking that—</text>
 <clause id="HA5D0BFC23BD341FD89A9B9FCDACF5D59"><enum>(i)</enum><text>simulate manufacturing production lines;</text> </clause><clause id="H25EE261B3C4843269D2E2EF0FB0354EA"><enum>(ii)</enum><text>monitor and communicate production line status;</text>
 </clause><clause id="H9197440912774D518D874EA147DC0F92"><enum>(iii)</enum><text>manage and optimize energy productivity and cost throughout production; and</text> </clause><clause id="HC473697158DA44D18491BF6A23F59F38"><enum>(iv)</enum><text>model, simulate, and optimize the energy efficiency of manufacturing processes;</text>
 </clause></subparagraph><subparagraph id="HCD44F83572E64D32B29BBC83F63D0E2A"><enum>(E)</enum><text>leverage the principles of sustainable manufacturing to minimize the negative environmental impacts of manufacturing while conserving energy and resources, including—</text>
 <clause id="H5E884C33280E4BD59D65B8A6CF5756CB"><enum>(i)</enum><text>by designing products that enable reuse, refurbishment, remanufacturing, and recycling;</text> </clause><clause id="H913549A402F445F0B78E5CB85D53EA35"><enum>(ii)</enum><text>by minimizing waste from industrial processes; and</text>
 </clause><clause id="HC1695629208047229A7C85169917C890"><enum>(iii)</enum><text>by reducing resource intensity; and</text> </clause></subparagraph><subparagraph id="HADC9C37A6EAC4A2E94477D7E96093ABF"><enum>(F)</enum><text>increase the energy efficiency of industrial processes;</text>
 </subparagraph></paragraph><paragraph id="H0A8546B6749C447FB2C86A36E6DF0F04"><enum>(2)</enum><text>alternative materials that produce fewer emissions during production and result in fewer emissions during use, including—</text>
 <subparagraph id="H32667C2C276D4A4FA9D4DFF363135B35"><enum>(A)</enum><text>innovative building materials;</text> </subparagraph><subparagraph id="H04927137A06E4125860BA4E691744B83"><enum>(B)</enum><text>high-performance lightweight materials; and</text>
 </subparagraph><subparagraph id="H9CFDB25722DF431399BDFCAE4EF4FF10"><enum>(C)</enum><text>substitutions for critical materials and minerals;</text> </subparagraph></paragraph><paragraph id="H750C711245B04967AF58311FBD4BC347"><enum>(3)</enum><text>development of net-zero emissions liquid and gaseous fuels;</text>
 </paragraph><paragraph id="HBA9CBBB8B2624A9EB4AC531E1D5F8C2A"><enum>(4)</enum><text>emissions reduction in shipping, aviation, and long-distance transportation, including through the use of alternative fuels;</text>
 </paragraph><paragraph id="H5033D178864149268898A64A60D20ED9"><enum>(5)</enum><text>carbon capture technologies for industrial processes;</text> </paragraph><paragraph id="H15A68173C81F47C9ADD536501FC847BA"><enum>(6)</enum><text>high-performance computing to develop advanced materials and manufacturing processes contributing to the focus areas described in paragraphs (1) through (5), including—</text>
 <subparagraph id="HA405E329C93042DB8E5E399388A7C7B0"><enum>(A)</enum><text>modeling, simulation, and optimization of the design of energy efficient and sustainable products; and</text>
 </subparagraph><subparagraph id="H4E2D6B8A366E480398E6A736C56FB94F"><enum>(B)</enum><text>the use of digital prototyping and additive manufacturing to enhance product design; and</text> </subparagraph></paragraph><paragraph id="HC68CF2AF7CF44CB2AF2B7DB58F7870AB"><enum>(7)</enum><text display-inline="yes-display-inline">other technologies that achieve net-zero emissions in nonpower industrial sectors as determined by Secretary in coordination with the Director.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA3073AD0CFCC46699AD12239C97B828A"><enum>(d)</enum><header>Grants, contracts, cooperative agreements, and demonstration projects</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H2CA21F4CF8B8451692864812E0040191"><enum>(1)</enum><header>Grants</header><text>In carrying out the program, the Secretary shall award grants on a competitive basis to eligible entities for projects that the Secretary determines would best achieve the goals of the program.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41DE6B16BAE34739BD2640339F381A70"><enum>(2)</enum><header>Contracts and cooperative agreements</header><text>In carrying out the program, the Secretary may enter into contracts and cooperative agreements with eligible entities and Federal agencies for projects that the Secretary determines would further the purposes of the program.</text>
 </paragraph><paragraph id="H80A377AD15584F638432B0671CBC5C9C"><enum>(3)</enum><header>Demonstration projects</header><text>In supporting technologies developed under this section, the Secretary shall fund demonstration projects that test and validate technologies described in subsection (c).</text>
 </paragraph><paragraph id="H24E3B8C9213A4BEB93B6359C7267635C"><enum>(4)</enum><header>Application</header><text>An entity seeking funding or a contract or agreement under this subsection shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text>
 </paragraph><paragraph id="H0EBF60742B144FAEBF73D8FB3FDC7E81"><enum>(5)</enum><header>Cost sharing</header><text>In awarding funds under this section, the Secretary shall require cost sharing in accordance with section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4CFDA3A724E34B5B833EF3723CD9547F"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H36FBA8CC9AF14CE6A60AE8D3976F7895"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section for each fiscal year during which the program is in effect.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47E50544B19B41E0A6A392FAA7D8B45A"><enum>(2)</enum><header>Demonstration projects</header><text display-inline="yes-display-inline">Of the amount appropriated under paragraph (1), not more than $650,000,000 shall be used to carry out demonstration projects under subsection (d)(3).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA78050F14E4742F4AB30B8287B0681A1"><enum>(b)</enum><header>Technical amendment</header><text>The table of contents of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; 121 Stat. 1494) is amended by inserting after the item relating to section 453 the following:</text>

			</subsection></section><section id="H81F4BB15761F49BAB828090FEA4BAEC9"><enum>4.</enum><header>Industrial Technology Innovation Advisory Committee</header>
 <subsection id="HA126DBBD038840019AA77DABEACD9FEC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Energy Independence and Security Act of 2007 is amended by inserting after section 454 (as added by section 3(a)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5D1086925DFB4B40B29E8EE7AA167072" style="OLC">
					<section id="H974D8AE719C443FBBCD799908976A847"><enum>455.</enum><header>Industrial Technology Innovation Advisory Committee</header>
 <subsection id="HB78179F9CEED4E339F1D557E471B33D7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HFB79C04A218942EBA8A3F811772562F6"><enum>(1)</enum><header>Committee</header><text>The term <term>Committee</term> means the Industrial Technology Innovation Advisory Committee established under subsection (b).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08CADDCF0C0B40268269E65BADFF5AB8"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Science and Technology Policy.</text> </paragraph><paragraph id="HE06B03E5DD2D47E1A414E86F59605B31"><enum>(3)</enum><header>Emissions reduction</header><text display-inline="yes-display-inline">The term <term>emissions reduction</term> has the meaning given the term in section 454(a).</text>
 </paragraph><paragraph id="HCA1CD5026F53462B8196D62D862D6087"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the industrial emissions reduction technology development program established under section 454(b)(1).</text>
 </paragraph></subsection><subsection id="H9064EAE3764C4BF595EC251EEC94516A"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>CIT Act of 2019</short-title>, the Secretary, in coordination with the Director, shall establish an advisory committee, to be known as the <quote>Industrial Technology Innovation Advisory Committee</quote>.</text>
						</subsection><subsection id="H3009AF6F1D37482B9F02D1E7E468589A"><enum>(c)</enum><header>Membership</header>
 <paragraph id="HEC54C5D7377E486ABE40342B1AE3FF3E"><enum>(1)</enum><header>Appointment</header><text>The Committee shall be comprised of not fewer than 14 members, who shall be appointed by the Secretary, in coordination with the Director.</text>
 </paragraph><paragraph id="HD35D3DA654CD4B838163F4426125FF51"><enum>(2)</enum><header>Representation</header><text>Members appointed pursuant to paragraph (1) shall include—</text> <subparagraph id="HE0E6C29209DE4C67AD97F3F924942509"><enum>(A)</enum><text>not less than 1 representative of each relevant Federal agency, as determined by the Secretary;</text>
 </subparagraph><subparagraph id="H6D727AD3A2344B01BA93A11D20155BBC"><enum>(B)</enum><text>not less than 2 representatives of labor groups;</text> </subparagraph><subparagraph id="H459BD7C8D85A42399FC212506351F8B4"><enum>(C)</enum><text>not less than 3 representatives of the research community, which shall include academia and National Laboratories;</text>
 </subparagraph><subparagraph id="HF0FEBF17A5FF46ED8F3F3A0F5A588481"><enum>(D)</enum><text>not less than 2 representatives of nongovernmental organizations;</text> </subparagraph><subparagraph id="HF8640BE66D4A4266B6A9AEA5682E5BC8"><enum>(E)</enum><text>not less than 6 representatives of industry, the collective expertise of which shall cover every focus area described in section 454(c); and</text>
 </subparagraph><subparagraph id="H085EFA9505A843A786F0CB4B2C78113B"><enum>(F)</enum><text>any other individual whom the Secretary, in coordination with the Director, determines to be necessary to ensure that the Committee is comprised of a diverse group of representatives of industry, academia, independent researchers, and public and private entities.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H5622E69264F84789BB05740E386C6D16"><enum>(3)</enum><header>Chair</header><text>The Secretary shall designate a member of the Committee to serve as Chair.</text> </paragraph></subsection><subsection id="H09999A5F62074936936664E920969EAE"><enum>(d)</enum><header>Duties</header> <paragraph id="H77552685CA4746F18B4F8B3BF07CAA2A"><enum>(1)</enum><header>In general</header><text>The Committee shall—</text>
 <subparagraph id="HBCCC73FAE7434F328C11529762C36676"><enum>(A)</enum><text>in consultation with the Secretary and the Director, develop the missions and goals of the program, which shall be consistent with the purposes of the program described in section 454(b)(1); and</text>
 </subparagraph><subparagraph id="HB56C83D02B184DB198B413C08EE19172"><enum>(B)</enum><text>advise the Secretary and the Director with respect to the program—</text> <clause id="H6463D59B3CEA4EB1A43F5C4DF38E72C4"><enum>(i)</enum><text>by identifying and evaluating any technologies being developed by the private sector relating to the focus areas described in section 454(c);</text>
 </clause><clause id="H75A0D0D941BA42B1BFDA24D77AA0ECB0"><enum>(ii)</enum><text>by identifying technology gaps in the private sector in those focus areas, and making recommendations to address those gaps;</text>
 </clause><clause id="H0658AE11954A4B1791D2037AF9F35119"><enum>(iii)</enum><text>by surveying and analyzing factors that prevent the adoption of emissions reduction technologies by the private sector; and</text>
 </clause><clause id="H66F1DA6D368145C8B59D5A364ED62482"><enum>(iv)</enum><text>by recommending technology screening criteria for technology developed under the program to encourage adoption of the technology by the private sector; and</text>
 </clause></subparagraph><subparagraph id="HA1D214E4A1A34810826D1CC7A9219BDC"><enum>(C)</enum><text>develop the roadmap described in paragraph (2).</text> </subparagraph></paragraph><paragraph commented="no" id="H039E64202F7C49E6AF2B8ABA3CF004F7"><enum>(2)</enum><header>Emissions reduction roadmap</header> <subparagraph commented="no" id="H1F5C30D13536472281E8A94496CFA897"><enum>(A)</enum><header>Purpose</header><text>The purpose of the roadmap developed under paragraph (1)(C) is to achieve the goals of the program in the focus areas described in section 454(c).</text>
 </subparagraph><subparagraph commented="no" id="HF015F9352A664F41B151A13C7EFC5F67"><enum>(B)</enum><header>Contents</header><text>The roadmap developed under paragraph (1)(C) shall—</text> <clause commented="no" id="HA866A11FBE8547ADA915AD565D38555A"><enum>(i)</enum><text>specify near-term and long-term qualitative and quantitative objectives relating to each focus area described in section 454(c), including research, development, demonstration, and commercial application objectives;</text>
 </clause><clause commented="no" id="H3E43E725554F4AC48C189B0EEDFB74E1"><enum>(ii)</enum><text>specify the anticipated timeframe for achieving the objectives specified under clause (i);</text> </clause><clause commented="no" id="H7E76F04918C743628BD2D42C3732EE31"><enum>(iii)</enum><text>include plans for developing emissions reduction technologies that are globally cost-competitive; and</text>
 </clause><clause commented="no" id="HE08D97E084634F0FA35CB1E7C9890C52"><enum>(iv)</enum><text>identify the appropriate role for investment by the Federal Government, in coordination with the private sector, to achieve the objectives specified under clause (i).</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H0E74AC8C71194C249564B6FCEA694430"><enum>(e)</enum><header>Meetings</header>
 <paragraph commented="no" id="HE6BF76A1B64A4A2CBF4423FAE1EDC277"><enum>(1)</enum><header>Frequency</header><text>The Committee shall meet not less frequently than 2 times per year, at the call of the Chair.</text> </paragraph><paragraph commented="no" id="H0E07D8F9062546B08C6EF671894331A9"><enum>(2)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which the members are appointed under subsection (b), the Committee shall hold its first meeting.</text>
							</paragraph></subsection><subsection id="H1D9CD8DF95A54AAA8D7704B5C726A8AA"><enum>(f)</enum><header>Committee report</header>
 <paragraph id="H5F541EC4D97A483FBD289C17198BCD91"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of the <short-title>CIT Act of 2019</short-title>, and not less frequently than once every 3 years thereafter, the Committee shall submit to the Secretary a report on the progress of achieving the purposes of the program.</text>
 </paragraph><paragraph id="H06D006056704416DA17FE338AAAB0F9C"><enum>(2)</enum><header>Contents</header><text>The report under paragraph (1) shall include—</text> <subparagraph id="HD7AB8A3975084DB2B58F4DF7484EFC53"><enum>(A)</enum><text>a description of any technology innovation opportunities identified by the Committee;</text>
 </subparagraph><subparagraph id="HC001D141841249338EBE1DFF58F79E1D"><enum>(B)</enum><text>a description of any technology gaps identified by the Committee under subsection (d)(1)(B)(ii);</text> </subparagraph><subparagraph id="H5E10353662A04D04BEA5414AEB0F0AF2"><enum>(C)</enum><text>recommendations for improving technology screening criteria and management of the program;</text>
 </subparagraph><subparagraph id="H397DDA14BA72403D9F4227439E41F685"><enum>(D)</enum><text>an evaluation of the progress of the program and the research and development funded under the program;</text>
 </subparagraph><subparagraph id="H8896E2C586824F259AF4A0CCD9CEED12"><enum>(E)</enum><text>any recommended changes to the focus areas of the program described in section 454(c);</text> </subparagraph><subparagraph commented="no" id="HCC57F50A03F841888115649C89379468"><enum>(F)</enum><text>a description of the manner in which the Committee has carried out the duties described in subsection (d)(1) and any relevant findings as a result of carrying out those duties;</text>
 </subparagraph><subparagraph commented="no" id="HC207F078C25C4825837DD4E8CA232C39"><enum>(G)</enum><text>the roadmap developed by the Committee under subsection (d)(1)(C);</text> </subparagraph><subparagraph id="H482FE1DDCB154DBB920ACD263F77BBA1"><enum>(H)</enum><text>the progress made in achieving the goals set out in that roadmap;</text>
 </subparagraph><subparagraph commented="no" id="HAC4BBF19B14C400ABB3311076AA77D1A"><enum>(I)</enum><text>a review of the management, coordination, and industry utility of the program;</text> </subparagraph><subparagraph commented="no" id="H9499B326C663497583D238B84CEAE49F"><enum>(J)</enum><text>an assessment of the extent to which progress has been made under the program in developing commercial, cost-competitive technologies in each focus area described in section 454(c); and</text>
 </subparagraph><subparagraph commented="no" id="H22982179AF2A486C850F4016F3ED5AC2"><enum>(K)</enum><text>an assessment of the effectiveness of the program in coordinating efforts within the Department and with other Federal agencies to achieve the purposes of the program.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H2DE0B74A405F4F848295F2E9928C81C0"><enum>(g)</enum><header>Report to Congress</header><text>Not later than 60 days after receiving a report from the Committee under subsection (f), the Secretary shall submit a copy of that report to the Committee on Science, Space, and Technology of the House of Representatives, the Committee on Energy and Natural Resources of the Senate, and any other relevant Committee of Congress.</text>
 </subsection><subsection commented="no" id="HAF901CC895354563912B8E50131D98E9"><enum>(h)</enum><header>Applicability of Federal Advisory Committee Act</header><text>Except as otherwise provided in this section, the Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Committee.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HCBCAD9D9B2614B87A052D3965DF66D0C"><enum>(b)</enum><header>Technical amendment</header><text>The table of contents of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; 121 Stat. 1494) (as amended by section 3(b)) is amended by inserting after the item relating to section 454 the following:</text>

 <subsection id="H804494D1CE294EB683C187B8E47AD18D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Energy Independence and Security Act of 2007 is amended by inserting after section 455 (as added by section 4(a)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6C0DAF6272204C588FE2C8908ACDC02E" style="OLC">
					<section id="H0AB999BB42E3439D944B8905F889F601"><enum>456.</enum><header>Technical assistance program to implement industrial emissions reduction</header>
 <subsection id="HA1BC2486EA424942A24B1B8BD269B4AC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H6422A71277144BC78FFD24A3BF4F5688"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text>
 <subparagraph id="H09A2C24A82D84935B5D54891FB21F6E5"><enum>(A)</enum><text>a State;</text> </subparagraph><subparagraph id="HCED4C54C13A348FD9C2416E70CA28591"><enum>(B)</enum><text>a unit of local government;</text>
 </subparagraph><subparagraph id="H1996405CCA41448C99C39A1557B2F62A"><enum>(C)</enum><text>a territory or possession of the United States;</text> </subparagraph><subparagraph id="H3444A7EE469C4668A6310D4A47BE91C9"><enum>(D)</enum><text>a relevant State or local office, including an energy office;</text>
 </subparagraph><subparagraph id="HD1B089386A204496A8E16C760A523A3C"><enum>(E)</enum><text>a tribal organization (as defined in section 3765 of title 38, United States Code);</text> </subparagraph><subparagraph id="H7A4633B0FC474AC4B75B6A5E27BCC45E"><enum>(F)</enum><text>an institution of higher education; and</text>
 </subparagraph><subparagraph id="H86F4E3CBEEC545E28916F19699D4C5C4"><enum>(G)</enum><text>a private entity.</text> </subparagraph></paragraph><paragraph id="H8C5710EFB62A4BF99C4184CABBF9CE07"><enum>(2)</enum><header>Emissions reduction</header><text display-inline="yes-display-inline">The term <term>emissions reduction</term> has the meaning given the term in section 454(a).</text>
 </paragraph><paragraph commented="no" id="H1C52048B52654F4998BC4FA03E5C86A5"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE29B5805F8BF4AD0813E8EF5AA82F7EA"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b).</text>
 </paragraph></subsection><subsection id="H9AE71C32DCEA45F7AAEDB3B46A3D0AC6"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the CIT Act of 2019, the Secretary shall establish a program to provide technical assistance to eligible entities to promote the commercial application of emission reduction technologies in nonpower industrial sectors.</text>
						</subsection><subsection id="H854D3D62B51146DBA20957579DB1DC7C"><enum>(c)</enum><header>Applications</header>
 <paragraph id="H04770D80B7F849FFA1F84DE1AA476F6E"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring technical assistance under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text>
 </paragraph><paragraph id="HBF9E40674EB04126BE41EAEBDC4645B7"><enum>(2)</enum><header>Application process</header><text>The Secretary shall seek applications for technical assistance under the program on a periodic basis, but not less frequently than once every 12 months.</text>
 </paragraph><paragraph id="HECEC13ACE7FB43739DC748701F7673D5"><enum>(3)</enum><header>Priorities</header><text>In selecting eligible entities for technical assistance under the program, the Secretary shall give priority to an eligible entity—</text>
 <subparagraph id="H91517D9EFE6B4688B8F87903C1389F25"><enum>(A)</enum><text display-inline="yes-display-inline">carrying out a commercial application of technology that has the greatest potential for emissions reduction in nonpower industrial sectors;</text>
 </subparagraph><subparagraph id="HEE771DC217D748D2AD09AC1DCD1AC4D1"><enum>(B)</enum><text>located in a State that has historically relied on industrial sectors for a substantial portion of the State economy, as determined by the Secretary, taking into account employment data, per capita income, and other indicators of economic output in the State; or</text>
 </subparagraph><subparagraph id="HE6087D3980974557A0702AA6C47B40FA"><enum>(C)</enum><text>located in a State that has experienced significant decline in the economic contribution of industry to the State.</text>
 </subparagraph></paragraph></subsection><subsection id="H3640D78C8A9C459583017CF9BFEE4C01"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section for each fiscal year during which the program is in effect.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H1B67792620C04B2B834553AC87D87C86"><enum>(b)</enum><header>Technical amendment</header><text>The table of contents of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; 121 Stat. 1494) (as amended by section 4(b)) is amended by inserting after the item relating to section 455 the following:</text>

 </subsection></section><section id="HA49E72A4E1B0457A8330302E45A89841"><enum>6.</enum><header>Coordination of research and development of energy efficient technologies for industry</header><text display-inline="no-display-inline">Section 6(a) of the American Energy Manufacturing Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6351">42 U.S.C. 6351(a)</external-xref>) is amended—</text>
 <paragraph id="H4797909C39424B50864E8D613503656B"><enum>(1)</enum><text>by striking <quote>Industrial Technologies Program</quote> each place it appears and inserting <quote>Advanced Manufacturing Office</quote>; and</text> </paragraph><paragraph id="HBD4278731EE04BD4B98717083E236D5D"><enum>(2)</enum><text>in the matter preceding paragraph (1), by striking <quote>Office of Energy</quote> and all that follows through <quote>Office of Science</quote> and inserting <quote>Department of Energy</quote>.</text>
