 <section id="H1D4F1B892AFC497DACCE90F17726EF2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Terrorism Penalties Act of 2019</short-title></quote>.</text> </section><section id="H8C337FD821D944DFAA6CA35F905A29E0"><enum>2.</enum><header>Domestic terrorism</header> <subsection id="H3FC738F3F78C4F258CF5C2B34AE4C0D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4763215EBD9844A0B1C132AD62A4562E" style="USC">
					<section id="H5585E803871C490198685A72C1E39C24"><enum>2339E.</enum><header>Domestic terrorism</header>
 <subsection id="H91EFF9C368114ABBBB4E89F60CE17056"><enum>(a)</enum><header>Offenses and penalties</header><text display-inline="yes-display-inline">Whoever, with respect to a circumstance described in subsection (b), and with the intent to intimidate or coerce a civilian population or influence, affect, or retaliate against the policy or conduct of a government—</text>
 <paragraph id="H68EC4A031F2F4509935213DD300247CC"><enum>(1)</enum><text display-inline="yes-display-inline">kills any person, shall be sentenced to death or imprisonment of not more than a term of life imprisonment, fined under this title, or both;</text>
 </paragraph><paragraph id="H6470ABFB1070456799554BE81F565C16"><enum>(2)</enum><text>kidnaps any person, shall be imprisoned not more than a term of life imprisonment, fined under this title, or both;</text>
 </paragraph><paragraph id="HFFC64FAB1D67429DA4D831BC670F1A54"><enum>(3)</enum><text display-inline="yes-display-inline">assaults any person with a deadly weapon, shall be imprisoned not more than 30 years, fined under this title, or both;</text>
 </paragraph><paragraph id="H8BFA456196BB4305ACF502088D7CCA81"><enum>(4)</enum><text display-inline="yes-display-inline">assaults any person, and serious bodily injury results therefrom, shall be imprisoned not more than 30 years, fined under this title, or both;</text>
 </paragraph><paragraph id="H60F28B41477E4238ACC225D6F45E2703"><enum>(5)</enum><text display-inline="yes-display-inline">destroys or damages any structure, conveyance, or other real or personal property, shall be imprisoned not more than 25 years, fined under this title, or both; or</text>
 </paragraph><paragraph id="H347C5592309B4C64BBEAD9599AA89C83"><enum>(6)</enum><text>attempts or conspires to commit an offense described under paragraph (1), (2), (3), (4), or (5) of this subsection, shall be punished in the same manner as a completed act of such offense.</text>
 </paragraph></subsection><subsection id="H11F9127217C94E9FAABB794ED7E609B3"><enum>(b)</enum><header>Circumstance described</header><text>A circumstance described in this subsection is, with respect to an offense under subsection (a), that the offense is committed—</text>
 <paragraph id="HF3B7B1134E764095B337D4C563802A8E"><enum>(1)</enum><text>against any person or property within the United States, and—</text> <subparagraph id="HCEB14BEBEBFA40BC8089F87318F935AF"><enum>(A)</enum><text>the mail or any facility of interstate or foreign commerce is used in furtherance of the offense;</text>
 </subparagraph><subparagraph id="HC0EA2AB7AF344A19B0C8EF5DB375EB81"><enum>(B)</enum><text>such property is used in interstate or foreign commerce or in an activity that affects interstate or foreign commerce;</text>
 </subparagraph><subparagraph id="HB4D2D26499674644A88C6B28BFC5120B"><enum>(C)</enum><text>any perpetrator travels in or causes another to travel in interstate or foreign commerce in furtherance of the offense; or</text>
 </subparagraph><subparagraph id="HC17D01A5E4174A0BA77EA287276DE72D"><enum>(D)</enum><text>the offense, or the results of the offense, affect interstate or foreign commerce, or, in the case of a threat, attempt, or conspiracy, would have affected interstate or foreign commerce;</text>
 </subparagraph></paragraph><paragraph id="H63DAFDEFAF724AFD8F2694F95E183DBB"><enum>(2)</enum><text>against any property that is owned, leased, or used by the United States or by any department or agency of the United States, whether the property is within or outside of the United States; or</text>
 </paragraph><paragraph id="H8125EA39D4E3490BBC7F9DC95903E9C1"><enum>(3)</enum><text>against any property within the United States that is owned, leased, or used by a foreign government.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H1EDD97B09F95477DA26ABE2051559077"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections for such chapter is amended by adding after the item relating to section 2339D the following:</text>
