			 data, and for other purposes.</official-title></form>

 <section id="HED854BFD84CD44AF9858ADBB44A1FC8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Map Improvement Act of 2019</short-title></quote>.</text> </section><section id="H2B985196A59641A5B818C411865AF6DD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph commented="no" id="H6F859E6695EF4A1382681B1697203F9B"><enum>(1)</enum><header>Assistant Secretary</header><text display-inline="yes-display-inline">The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text> </paragraph><paragraph commented="no" id="HB787774E7A15463AA3F473BE07AEAE68"><enum>(2)</enum><header>Broadband internet service</header><text>The term <term>broadband internet service</term>—</text>
 <subparagraph id="H7A505CD4F649431DAF7BA5E1A86C0354"><enum>(A)</enum><text>means mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service;</text>
 </subparagraph><subparagraph id="HBBB1D8D7A5664CA8B5C8E6C700827FB1"><enum>(B)</enum><text>includes any service that the Commission finds to be providing a functional equivalent of the service described in subparagraph (A) or that is used to evade the protections set forth in part 8 of title 47, Code of Federal Regulations, or any successor thereto; and</text>
 </subparagraph><subparagraph id="H066AA615373F4C5F99DEB7DC35E2215E"><enum>(C)</enum><text>does not include dial-up internet service.</text> </subparagraph></paragraph><paragraph id="H9045F74EF1084A46925F01984EA00CE4"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text>
 </paragraph><paragraph id="H7A8BDE1311284276BB4E52716DEB7110"><enum>(4)</enum><header>End user</header><text>The term <term>end user</term> means any individual or entity that uses a broadband internet service.</text> </paragraph><paragraph commented="no" id="H482228C069564290AFD8F59083110177"><enum>(5)</enum><header>Fixed broadband internet service</header><text>The term <term>fixed broadband internet service</term> means—</text>
 <subparagraph commented="no" id="HC35E34221F8D45459EA853F25034C6FF"><enum>(A)</enum><text>a broadband internet service that serves end users primarily at fixed endpoints using stationary equipment; and</text>
 </subparagraph><subparagraph commented="no" id="H6A697884283A44AC99F6850F114594B9"><enum>(B)</enum><text>includes fixed wireless services, including fixed unlicensed wireless services, and fixed satellite services.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H6FCD38A495C543E49BBF6DC9CC787B26"><enum>(6)</enum><header>GIS</header><text>The term <term>GIS</term> means geographic information systems.</text> </paragraph><paragraph commented="no" id="H2EE550053C654705BDA9A7CFA581BD2A"><enum>(7)</enum><header>Mobile broadband internet service</header><text display-inline="yes-display-inline">The term <term>mobile broadband internet service</term> shall have the meaning given such term by the Commission for purposes of this Act.</text>
 </paragraph><paragraph commented="no" id="HB96254A2FA5244A0B53621AE5BF76FFE"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text>
			</paragraph></section><section id="H48F8DC32C170478AA49AD6931BFF774E"><enum>3.</enum><header>Collection and mapping of fixed and mobile broadband internet service coverage</header>
			<subsection id="H6AC7EBEF4AC243E5B0265CA13686F370"><enum>(a)</enum><header>Standardized methodology rule</header>
 <paragraph id="H813B6DE3F5364F64BB02146A97A425E7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission, in coordination with the Assistant Secretary, shall promulgate a final rule to establish a standardized methodology for collecting and mapping accurate fixed broadband internet service and mobile broadband internet service coverage data in the United States, which shall—</text>
 <subparagraph id="H6CA12822418243D58FD44F663E6EF4A2"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that coverage data for fixed broadband internet service and mobile broadband internet service is collected in a standardized, consistent, and robust manner;</text>
 </subparagraph><subparagraph id="H7B216FC6AE7A4762A957075E654247E6"><enum>(B)</enum><text>improve the validity and reliability of coverage data;</text> </subparagraph><subparagraph id="HE5BBBC7F447645308FF581F17FE70BBA"><enum>(C)</enum><text>increase the efficiency of coverage data collection;</text>
 </subparagraph><subparagraph id="H6A7196D1B6094887987344F80145DA41"><enum>(D)</enum><text>contain standard definitions for different speed tiers, such as the 2G, 3G, 4G, and 4G LTE tiers and the equivalent for fixed broadband internet service;</text>
 </subparagraph><subparagraph id="HDAE1E1E3A648405B83BBABDBD8930310"><enum>(E)</enum><text>ensure that the collection and validation process occurs on a regular basis; and</text> </subparagraph><subparagraph id="H5EF13CF70C3340EFB93F38CE0AD5C96A"><enum>(F)</enum><text display-inline="yes-display-inline">establish a standardized ongoing validation process and public feedback mechanism that will allow for consumers, State and local officials, and broadband internet service providers to submit data to the Commission to verify coverage data from broadband internet service providers and challenge any aspects of such data believed to be inaccurate.</text>
 </subparagraph></paragraph><paragraph id="HA3668431F7A548BB9D6483883A1230DA"><enum>(2)</enum><header>Considerations</header><text>In promulgating the rule required under paragraph (1), the Commission shall consider—</text> <subparagraph id="H50F40C4CBB8742C48B05315A361BB37D"><enum>(A)</enum><text display-inline="yes-display-inline">coordinating with the Postmaster General, the heads of other Federal agencies that operate delivery fleet vehicles, and the Director of the Bureau of the Census for assistance with data collection and the feasibility of using more granular address level data; and</text>
 </subparagraph><subparagraph id="HAAC49A6BE3334C9BBE05F08A5FF38A0E"><enum>(B)</enum><text display-inline="yes-display-inline">creating 1 centralized national map with multiple layers, including a layer each for fixed broadband internet service and mobile broadband internet service, which may be used in determining eligibility for all Federal broadband internet service grant, loan, and subsidy programs.</text>
 </subparagraph></paragraph><paragraph id="H25456A5150CD42099062C726DCF45632"><enum>(3)</enum><header>Establishment of Office</header><text display-inline="yes-display-inline">The Commission shall establish an Office of Broadband Data Collection and Mapping within the Commission to serve as the central point of collection, aggregation, and validation of data collected under the standardized methodology established under this subsection.</text>
				</paragraph></subsection><subsection id="H59B655721280447F8C47BB43EA8274FF"><enum>(b)</enum><header>Technical assistance program</header>
 <paragraph id="H36565524F104475FACBB0F77864EC95F"><enum>(1)</enum><header>In general</header><text>The Assistant Secretary shall establish a technical assistance program under which the Assistant Secretary shall provide grants to State and local entities, such as regional planning organizations, to—</text>
 <subparagraph id="H55615EEB616B4AFB8E3AB4FE61E4EA00"><enum>(A)</enum><text display-inline="yes-display-inline">assist such entities with mapping and the development of a GIS-based map of existing fixed broadband internet service and mobile broadband internet service; and</text>
 </subparagraph><subparagraph id="H2D0CB680F6E14212A4ABE203D5093E35"><enum>(B)</enum><text display-inline="yes-display-inline">assess current broadband internet service adoption rates and advertised broadband internet service pricing in the community.</text>
 </subparagraph></paragraph><paragraph id="H5CC4622C10774AAEBA0455E9AFA834C3"><enum>(2)</enum><header>Use of funds</header><text>Funds received under this subsection—</text> <subparagraph id="H12A359D8F5CF4EEB9D7D63A3E632B05E"><enum>(A)</enum><text>shall be used to—</text>
 <clause commented="no" id="HDA0C816F199C4DB79CDC317FF4B20211"><enum>(i)</enum><text display-inline="yes-display-inline">carry out the activities described in subparagraphs (A) and (B) of paragraph (1); and</text> </clause><clause id="H29E45790BFDB43C3B71F8EB6F1896A57"><enum>(ii)</enum><text>participate in the standardized ongoing validation process and public feedback mechanism described in subsection (a)(1)(F); and</text>
 </clause></subparagraph><subparagraph id="H83BC80C31B794C339A912C39E97DD436"><enum>(B)</enum><text>may be used to purchase GIS software and for technical assistance with that software.</text> </subparagraph></paragraph><paragraph id="HCAB63E6B71424BB088EA6AEE4C579253"><enum>(3)</enum><header>Other uses for GIS software</header><text display-inline="yes-display-inline">A grantee may use GIS software acquired using funds received under this subsection for other purposes in addition to broadband internet service mapping.</text>
				</paragraph></subsection></section></legis-body></bill>
