			 demographic information for patent applications, and for other purposes.</official-title></form>
	<legis-body id="H9E6FBC1AB95242A0BC01291822D5A5A4" style="OLC">
 <section id="HBA04E4ECBDD94E11AC09F87C97AB1978" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inventor Diversity for Economic Advancement Act of 2019</short-title></quote> or the <quote><short-title>IDEA Act</short-title></quote>.</text> </section><section id="H3DD9354E812442918E2BE5FC126B4779" section-type="subsequent-section"><enum>2.</enum><header>Collection of demographic information for patent applications</header> <subsection id="HA6375A68A43E4131BAD81D9C6401418B"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">Chapter 11</external-xref> of title 35, United States Code, is amended by adding at the end the following new section:</text>

					<section id="H319AF9BF40E94E87A8624C39BDCC2608"><enum>124.</enum><header>Collection of demographic information for patent applications</header>
 <subsection id="HECDFEAEFE951499EBB5C799025E6DD7C"><enum>(a)</enum><header>Voluntary collection</header><text display-inline="yes-display-inline">The Director shall provide for the collection of demographic information, including gender, race, ethnicity, national origin, sexual orientation, age, military or veterans status, disability (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)), education level attained, and income level, related to each inventor listed with an application for patent, that may be submitted voluntarily by that inventor.</text>
 </subsection><subsection id="HFAD9A41379154B04AFB110DDB59949BF"><enum>(b)</enum><header>Access to information</header><text display-inline="yes-display-inline">Any information submitted under subsection (a) shall be kept confidential and separate from the application for patent. The Director shall establish appropriate procedures to ensure the confidentiality of any information submitted under subsection (a) and to ensure that demographic information is not included when the application for patent is examined.</text>
						</subsection><subsection id="HED14F3D67C4C495998D949B2A0027FAE"><enum>(c)</enum><header>Publication of demographic information</header>
 <paragraph id="HCED13351E2064536A7B4B43750A4F6D0"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Director shall publish a report that includes, except as provided in paragraph (2), the following:</text>
 <subparagraph id="HC3E73C1149164728909D38130F9CB58F"><enum>(A)</enum><text>The total number of patent applications filed during the previous year disaggregated by demographic information described in subsection (a) and by class number and title.</text>
 </subparagraph><subparagraph id="H78225887A94B470296CA20DFBDC24B21"><enum>(B)</enum><text display-inline="yes-display-inline">The total number of patents issued during the previous year disaggregated by demographic information described in subsection (a) and by class number and title.</text>
 </subparagraph></paragraph><paragraph id="HE147338D769949509814A489D64F4760"><enum>(2)</enum><header>Privacy</header><text>Personally identifying information may not be included in the report described in paragraph (1).</text> </paragraph><paragraph id="H246AF847BD644F5EAD71F42F18A74CAD"><enum>(3)</enum><header>Format</header><text>The report described in paragraph (1) shall be made available in a format that allows the demographic information to be cross-tabulated to review subgroups.</text>
 </paragraph><paragraph id="H76724B935F144CB5AF1BB7C507D48113"><enum>(4)</enum><header>Data availability</header><text display-inline="yes-display-inline">The Director shall make the data underlying the report described in paragraph (1) publicly available online in a format that is sortable by demographic information described in subsection (a), class number, and title.</text>
 </paragraph></subsection><subsection id="HE5ECE257B9D84A18B70DD9B0361A320A"><enum>(d)</enum><header>Biennial report</header><text display-inline="yes-display-inline">The Director shall submit to Congress a biennial report that evaluates the data collection process under this section, ease of access to the information by the public, and recommendations on how to improve data collection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H88F5104F00A0478588CA718F9F241762"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">chapter 11</external-xref> of title 35, United States Code, is amended by adding at the end the following new item:</text>

 </subsection><subsection id="HD793F9FA667142A68CDC5290C5F90B05"><enum>(c)</enum><header>Deadline for biennial report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, and every 2 years thereafter, the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office shall submit to Congress the biennial report required pursuant to section 124(d) of title 35, United States Code, as added by subsection (a).</text>
