			 practices regarding how to combat unlawful robocalls made to hospitals and
			 how hospitals can protect themselves from such calls, and for other
			 purposes.</official-title></form>
	<legis-body id="H2D820C84F4F24FD3A922E818761C6B8D" style="OLC">
 <section id="H15DBD12AA27347F897CF5721FFB24F09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Patients and Doctors from Unlawful Robocalls Act of 2019</short-title></quote>.</text> </section><section id="H2BE0560F2F7A4A168F083ED19F95D17D"><enum>2.</enum><header>Hospital Robocall Protection Group</header> <subsection id="HE5E9FB1D6B7246249D98C6D6427D3C9C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commission shall establish an advisory committee to be known as the <quote>Hospital Robocall Protection Group</quote>.</text>
 </subsection><subsection id="H11FF47EBDE8E43DD8CDC9D8B169151E9"><enum>(b)</enum><header>Membership</header><text>The Group shall be composed only of the following members:</text> <paragraph id="HEE6F5199EE564D5F9B58F8A8B2016023"><enum>(1)</enum><text>An equal number of representatives from each of the following:</text>
 <subparagraph id="H6769A2325F2E43DD80A808E6084B031D"><enum>(A)</enum><text display-inline="yes-display-inline">Voice service providers that serve hospitals.</text> </subparagraph><subparagraph id="H5ED3E8FD17134ACB82DC606E280EA7CB"><enum>(B)</enum><text>Companies that focus on mitigating unlawful robocalls.</text>
 </subparagraph><subparagraph id="H809D1696145B469DA1A64BDE4EEBC749"><enum>(C)</enum><text>Consumer advocacy organizations.</text> </subparagraph><subparagraph id="HF3B1027A4B3048FBB283EAC674D2675D"><enum>(D)</enum><text>Providers of one-way voice over internet protocol services described in subsection (e)(4)(B)(ii).</text>
 </subparagraph><subparagraph id="HB941F3E4F1CA49F8A7EFF43EF0B9DEE9"><enum>(E)</enum><text>Hospitals.</text> </subparagraph><subparagraph id="H6993270EB20745F091D3BBEE47F4F5FC"><enum>(F)</enum><text>State government officials focused on combatting unlawful robocalls.</text>
 </subparagraph></paragraph><paragraph id="HCD91FFC7CD234191A80B1570076D0AEF"><enum>(2)</enum><text>One representative of the Commission.</text> </paragraph><paragraph id="H577ACE686C114B699843C477C4EB9F84"><enum>(3)</enum><text>One representative of the Federal Trade Commission.</text>
 </paragraph></subsection><subsection id="H9020C94E40E94C048B2E515F88C8917F"><enum>(c)</enum><header>Issuance of best practices</header><text>Not later than 180 days after the date on which the Group is established under subsection (a), the Group shall issue best practices regarding the following:</text>
 <paragraph id="H32946FF9454146809FF4F7DA10E8CDF2"><enum>(1)</enum><text display-inline="yes-display-inline">How voice service providers can better combat unlawful robocalls made to hospitals.</text> </paragraph><paragraph id="H8B1CDCF8675542F28CB15722A6814F57"><enum>(2)</enum><text>How hospitals can better protect themselves from such calls, including by using unlawful robocall mitigation techniques.</text>
 </paragraph><paragraph id="H5EE499F2753248DAACCA2CD6611E5107"><enum>(3)</enum><text>How the Federal Government and State governments can help combat such calls.</text> </paragraph></subsection><subsection id="H22F839628D294F5E8509F531B3DAC900"><enum>(d)</enum><header>Proceeding by FCC</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the best practices are issued by the Group under subsection (c), the Commission shall conclude a proceeding to assess the extent to which the voluntary adoption of such best practices can be facilitated to protect hospitals and other institutions.</text>
 </subsection><subsection id="H5E3E8530DE85459B8FD58998F89AB9EB"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF3979D3A81924E7AAC058527E3903294"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text>
 </paragraph><paragraph id="H41DBC3CE45694947BB6C1A4A4892AD1A"><enum>(2)</enum><header>Group</header><text>The term <quote>Group</quote> means the Hospital Robocall Protection Group established under subsection (a).</text> </paragraph><paragraph commented="no" id="H4673B37E51104CB0AB7E3CB59FE8309D"><enum>(3)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text>
 </paragraph><paragraph id="HF3083A0A33F444CDBD067EAD0D757A4D"><enum>(4)</enum><header>Voice service</header><text>The term <quote>voice service</quote>—</text> <subparagraph id="HE5EE849F898D44A2A2D91941103F7281"><enum>(A)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(1)</external-xref>); and</text>
 </subparagraph><subparagraph id="H8DFB8B6D7019438293B86B888B3E506A"><enum>(B)</enum><text>includes—</text> <clause id="H946C0C63E82A4F31A6664D8B28488B28"><enum>(i)</enum><text>transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine; and</text>
 </clause><clause id="HB19BB66B7B234F2AB45F137C5E2F1FF2"><enum>(ii)</enum><text>without limitation, any service that enables real-time, two-way voice communications, including any service that requires internet protocol-compatible customer premises equipment (commonly known as <quote>CPE</quote>) and permits out-bound calling, whether or not the service is one-way or two-way voice over internet protocol.</text>
