<legis-type>AN ACT</legis-type> 
<official-title display="yes">To provide for certain extensions with respect to the Medicaid program under title XIX of the Social Security Act, and for other purposes.</official-title>

<section id="H1DD7F57D7AA440F6B199A9DF1A1307C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustaining Excellence in Medicaid Act of 2019</short-title></quote>.</text></section> <section id="HBB8AF3DCC18F40DCBB4E13C6E6221D22"><enum>2.</enum><header>Extension of the Community Mental Health Services Demonstration Program</header><text display-inline="no-display-inline">Section 223(d)(3) of the Protecting Access to Medicare Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note), as amended by <external-xref legal-doc="public-law" parsable-cite="pl/116/29">Public Law 116–29</external-xref>, is amended by striking <quote>July 14, 2019</quote> and inserting <quote>September 13, 2019</quote>.</text></section> 
<section id="HDD43CF1A12D84444AB009E197AFF391E"><enum>3.</enum><header>Extension of protection for Medicaid recipients of home and community-based services against spousal impoverishment</header> 
<subsection id="HECB69790CE8240AA984718DDFBA2457F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2404 of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref> note) is amended by striking <quote>September 30, 2019</quote> and inserting <quote>December 31, 2019</quote>.</text></subsection> <subsection commented="no" id="HC489069860A74E01ADE0287AD1CF267C"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in section 2404 of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-5">42 U.S.C. 1396r–5</external-xref> note) or section 1902(a)(17) or 1924 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(17)</external-xref>, 1396r–5) shall be construed as prohibiting a State from applying an income or resource disregard under a methodology authorized under section 1902(r)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(r)(2)</external-xref>)—</text> 
<paragraph commented="no" id="H3BF88AF8AFB2403899C7BF32E7637342"><enum>(1)</enum><text display-inline="yes-display-inline">to the income or resources of an individual described in section 1902(a)(10)(A)(ii)(VI) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(ii)(VI)</external-xref>) (including a disregard of the income or resources of such individual’s spouse); or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF4C5CA38EFB3444EB6550DF5B0136161"><enum>(2)</enum><text display-inline="yes-display-inline">on the basis of an individual’s need for home and community-based services authorized under subsection (c), (d), (i), or (k) of section 1915 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n</external-xref>) or under section 1115 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>).</text></paragraph></subsection></section> 
<section id="H7788B05C59B64EEE9ABD649B1424BAA0"><enum>4.</enum><header>Extension of Money Follows the Person Rebalancing Demonstration</header><text display-inline="no-display-inline">Section 6071(h)(1)(F) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended by striking <quote>$132,000,000</quote> and inserting <quote>$254,500,000</quote>.</text></section> <section commented="no" id="H15C08C842BAB483796F9FAEBFAF077D5" section-type="subsequent-section"><enum>5.</enum><header>Extension for family-to-family health information centers</header><text display-inline="no-display-inline">Section 501(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/701">42 U.S.C. 701(c)</external-xref>) is amended—</text> 
<paragraph commented="no" id="H43459AB667D545CFB9D32510E139CB6D"><enum>(1)</enum><text>in paragraph (1)(A)(vii), by striking <quote>and 2019</quote> and inserting <quote>through 2024</quote>; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H15D4457154E2432EB3B5B0CE6F1F1BCA"><enum>(2)</enum><text>in paragraph (3)(C), by striking <quote>fiscal years 2018 and 2019</quote> and inserting <quote>fiscal year 2018 and each fiscal year thereafter</quote>.</text></paragraph></section> 
<section id="HCB31A1D9853949F4990592BE120D81FB"><enum>6.</enum><header>Reduced wholesale acquisition cost (WAC)-based payments for new drugs and biologicals</header><text display-inline="no-display-inline">Section 1847A(c)(4) of the Social Security Act (42 U.S.C. 1395w–3a(c)(4)) is amended by striking <quote>payable under this section for the drug or biological based on—</quote> and all that follows through the period at the end and inserting the following: “payable under this section—</text> <quoted-block display-inline="no-display-inline" id="H295A98323B964D96B7BB3443399F6290" style="OLC"> <subparagraph id="H6025ECC84E6446A1BA2FA4D35BE8FBE7"><enum>(A)</enum><text>in the case of a drug or biological furnished prior to January 1, 2019, based on—</text> 
<clause id="H5A037491C0224F048D6CC242F08391A2"><enum>(i)</enum><text>the wholesale acquisition cost; or</text></clause> <clause id="H7DB1C7557E21489999E716D6F196FB0E"><enum>(ii)</enum><text>the methodologies in effect under this part on November 1, 2003, to determine payment amounts for drugs or biologicals; and</text></clause></subparagraph> 
<subparagraph id="H98700979DE374F73B9CEF41098D64111"><enum>(B)</enum><text>in the case of a drug or biological furnished on or after January 1, 2019—</text> <clause id="HEB473B9A5E87493FA2EF159A1E6D9B0D"><enum>(i)</enum><text>at an amount not to exceed 103 percent of the wholesale acquisition cost; or</text></clause>
