			 executive, administrative, and professional employees exempt from Federal
			 overtime compensation requirements, and automatically update such
			 threshold every 3 years.</official-title></form>
	<legis-body id="HE201FEBAD8EE4A8393D857E5B473D98F" style="OLC">
 <section id="HFC381AE2C4604319966DC0FCEC33F810" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Overtime Pay Act of 2019</short-title></quote>.</text> </section><section id="HD962F40CA5C94932BB34CC57BCA4BBA4"><enum>2.</enum><header>Minimum salary threshold for bona fide executive, administrative, and professional employees exempt from Federal overtime compensation requirements</header> <subsection id="H4B70C09843AD4AAE8413737C8CBE66C5"><enum>(a)</enum><header>In general</header><text>Section 13 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213</external-xref>) is amended—</text>
 <paragraph id="H165ADFEBD46A4752BCC3F8BDCC4E93C4"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="HEE08C48071CD45E0AEF96C9F658D3103"><enum>(A)</enum><text>by inserting <quote>subsection (k) and</quote> after <quote>subject to</quote>; and</text>
 </subparagraph><subparagraph id="H90FD753690BA4F1C80B47FFD80D4ABC0"><enum>(B)</enum><text>by inserting <quote>(except as provided under subsection (k)(2)(C))</quote> after <quote>Administrative Procedure Act</quote>; and</text> </subparagraph></paragraph><paragraph id="H7B0079F675C24C67BEE397F0FF3B52E0"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H597D093796DF4ADC9435C4D40DCE097B" style="OLC">
						<subsection id="HFF265D611A7142E7AB32F42EA897F2B7"><enum>(k)</enum><header>Minimum salary threshold</header>
 <paragraph id="H4D50AA8384FC414AB603C904E86CE781"><enum>(1)</enum><header>In general</header><text>Beginning on the effective date of the Restoring Overtime Pay Act of 2019, the Secretary shall require that an employee described in subsection (a)(1), as a requirement for exemption under such subsection, be compensated on a salary basis, or equivalent fee basis, within the meaning of such terms in subpart G of part 541 of title 29, Code of Federal Regulations (or any successor regulation), at a rate per week that is not less than the salary threshold under paragraph (2).</text>
							</paragraph><paragraph id="H2591739092454D948BFD49DF9A9D9A82"><enum>(2)</enum><header>Salary threshold</header>
 <subparagraph id="HE15D87BB29504D2DB1AAAB958B9CBBFC"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), the salary threshold shall be an amount that is equal to the 40th percentile of earnings of full-time salaried workers in the lowest-wage census region, as determined by the Bureau of Labor Statistics based on data from the second quarter of the calendar year preceding the calendar year in which such amount takes effect.</text>
 </subparagraph><subparagraph id="H4E87E20A9D614AAFBFC8E69AF45BC330"><enum>(B)</enum><header>Increased threshold</header><text>The Secretary may establish, through notice and comment rulemaking under section 553 of title 5, United States Code, a salary threshold that is an amount that—</text>
 <clause id="H3E576B85DE7144B0B33FD3EFB2D78EDD"><enum>(i)</enum><text>is greater than the 40th percentile of earnings of the full-time salaried workers described in subparagraph (A); and</text>
 </clause><clause id="HA8D835A34B5A44B9999CB2FF17593B3B"><enum>(ii)</enum><text>is calculated based on a data set and methodology established by the Secretary that are capable of being updated in accordance with subparagraph (C).</text>
									</clause></subparagraph><subparagraph id="H9DF64FD9AF2B4BD0BB0682104950655B"><enum>(C)</enum><header>Automatic updates</header>
 <clause id="H0C8F48CF250F4D59BD4E9FE37528860F"><enum>(i)</enum><header>In general</header><text>Not later than 3 years after the salary threshold first takes effect under subparagraph (A), and every 3 years thereafter, or, in the case in which the Secretary establishes an increased salary threshold under subparagraph (B), every 3 years after establishing such increased salary threshold, the Secretary shall update the amount of the salary threshold in effect under subparagraph (A) or (B), as applicable, so that such amount is equal to—</text>
 <subclause id="H6BFBADED34DC4FD5914BC4080DC1CBC9"><enum>(I)</enum><text>in the case in which the Secretary does not establish an increased salary threshold under subparagraph (B), the 40th percentile of earnings of full-time salaried workers in the lowest-wage census region, as determined by the Bureau of Labor Statistics based on data from the second quarter of the calendar year preceding the calendar year in which such updated amount is to take effect; and</text>
 </subclause><subclause id="H9030B244B42648AEA58CE5FD6F55550C"><enum>(II)</enum><text>in the case in which the Secretary establishes an increased salary threshold under subparagraph (B), the greater of—</text>
 <item id="H74762C8CEB5341FCB4A01327F66E9265"><enum>(aa)</enum><text>the 40th percentile described in subclause (I); and</text> </item><item id="HA507288F76274F659587797AFFCE2FED"><enum>(bb)</enum><text>the increased salary threshold established under subparagraph (B), as updated in accordance with the data set and methodology established by the Secretary under subparagraph (B)(ii).</text>
 </item></subclause></clause><clause id="H3D64A67B6DD34CF6B453B6C0F5E4D108"><enum>(ii)</enum><header>Nonapplicability of rulemaking</header><text>Any update described in this subparagraph shall not be subject to the requirements of notice and comment rulemaking under section 553 of title 5, United States Code.</text>
 </clause></subparagraph><subparagraph id="H8178CC1FDA2B4AFFB2E364C57C04919F"><enum>(D)</enum><header>Notice requirement</header><text>Not later than 60 days before a revised salary threshold under this paragraph takes effect, the Secretary shall publish a notice announcing the amount in the Federal Register and on the internet website of the Department of Labor.</text>
 </subparagraph></paragraph><paragraph id="H09C6F23C07D148F6BD25EA6FE00F3BA4"><enum>(3)</enum><header>Duties test</header><text>The Secretary shall, in addition to the requirement under paragraph (1), continue to require employees to satisfy a duties test, as prescribed by the Secretary, in defining and delimiting the terms described in subsection (a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H5F7C7F785D8C47B3B8E5941356476777"><enum>(b)</enum><header>Publication of earnings</header><text>Not later than 21 days after the end of each calendar quarter, the Bureau of Labor Statistics shall publish on its public website, for each week of such quarter, data on the weekly earnings of nonhourly, full-time salaried workers by census region (as designated by the Bureau of the Census).</text>
 </subsection><subsection id="H4E7021FAEACF40FA88336A9F2B2A1786"><enum>(c)</enum><header>Effective date</header><text>This Act, and the amendments made by this Act, shall take effect on the first day of the third month that begins after the date of enactment of this Act.</text>
