<section id="HE0FA2D2F79D74204A9DB9A190B31FB5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blue Water Navy Vietnam Veterans Act of 2019</short-title></quote>.</text></section> <section id="HF205DA6AE5F24D5ABEBE03D0CA742185" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Clarification of presumptions of exposure for veterans who served in vicinity of Republic of Vietnam</header> <subsection id="H9A0DCE01AB904609BB71F0AA9B53CF2D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1116">section 1116</external-xref> the following new section:</text>

<section id="H58517B8C91E042C8958DE4A7A01FEC76"><enum>1116A.</enum><header>Presumptions of service connection for veterans who served offshore of the Republic of Vietnam</header>
<subsection id="H5872DE2F838D4F0890CFC79611861A06"><enum>(a)</enum><header>Service connection</header><text display-inline="yes-display-inline">For the purposes of section 1110 of this title, and subject to section 1113 of this title, a disease covered by section 1116 of this title becoming manifest as specified in that section in a veteran who, during active military, naval, or air service, served offshore of the Republic of Vietnam during the period beginning on January 9, 1962, and ending on May 7, 1975, shall be considered to have been incurred in or aggravated by such service, notwithstanding that there is no record of evidence of such disease during the period of such service.</text></subsection> <subsection id="H85FE42102E3A4BB882E09F0B3FA064EC"><enum>(b)</enum><header>Exposure</header><text display-inline="yes-display-inline">A veteran who, during active military, naval, or air service, served offshore of the Republic of Vietnam during the period beginning on January 9, 1962, and ending on May 7, 1975, shall be presumed to have been exposed during such service to an herbicide agent unless there is affirmative evidence to establish that the veteran was not exposed to any such agent during that service.</text></subsection>
<subsection id="H6155450803CC4123B1543FC24630FEF9" commented="no"><enum>(c)</enum><header>Effective date of award</header>
<paragraph id="H0A6EFBD2A8034731B5F4A53D4FA40D8A" commented="no" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided by paragraph (2), the effective date of an award under this section shall be determined in accordance with section 5110 of this title.</text></paragraph> <paragraph id="H53E87045E4A144A28A33727359D4B7A5" indent="up1" commented="no"><enum>(2)</enum> <subparagraph id="H9E8E49A435EC4F6C8A9165388083773F" commented="no" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (g) of section 5110 of this title, the Secretary shall determine the effective date of an award based on a claim under this section for an individual described in subparagraph (B) by treating the date on which the individual filed the prior claim specified in clause (i) of such subparagraph as the date on which the individual filed the claim so awarded under this section.</text></subparagraph>
<subparagraph id="HCF91EC34D9A547C0B5ACC84166B73955" indent="up1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">An individual described in this subparagraph is a veteran, or a survivor of a veteran, who meets the following criteria:</text> <clause id="H0DEE0D2D58EF41068CD602C49BEF0572" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">The veteran or survivor submitted a claim for disability compensation on or after September 25, 1985, and before January 1, 2020, for a disease covered by this section, and the claim was denied by reason of the claim not establishing that the disease was incurred or aggravated by the service of the veteran.</text></clause>
<clause id="HC987B072D9BE4B4C99FFC485D2B47FA3" commented="no"><enum>(ii)</enum><text>The veteran or survivor submits a claim for disability compensation on or after January 1, 2020, for the same condition covered by the prior claim under clause (i), and the claim is approved pursuant to this section.</text></clause></subparagraph></paragraph></subsection> <subsection id="H82DB31C1AFCF4BB2A21D703DB04B803E" commented="no"><enum>(d)</enum><header>Determination of offshore</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, for purposes of this section, the Secretary shall treat a location as being offshore of Vietnam if the location is not more than 12 nautical miles seaward of a line commencing on the southwestern demarcation line of the waters of Vietnam and Cambodia and intersecting the following points:</text>

<toc-entry level="section">1116A. Presumptions of service connection for veterans who served offshore of the Republic of Vietnam.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HFE390CBB940645F2A76A9A74EFF05DA1"><enum>(c)</enum><header>Implementation</header>
<paragraph id="H1558785EAFDB4CCA895035B98B3E8104"><enum>(1)</enum><header>Guidance</header><text display-inline="yes-display-inline">Notwithstanding section 501 of such title, the Secretary of Veterans Affairs may issue guidance to implement section 1116A of title 38, United States Code, as added by subsection (a), before prescribing new regulations under such section.</text></paragraph> <paragraph id="H941886DD315C4CD189BEE2D0A961A5CE"><enum>(2)</enum><header>Updates</header> <subparagraph id="HDFA6125AACA84E4E9B0541F836796B31" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall submit a report to the Committees on Veterans’ Affairs of the House of Representatives and the Senate regarding the plans of the Secretary—</text>
<clause id="HE899FF01DD934F5DA1E14FA870A8667D" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">to conduct outreach under subsection (d); and</text></clause> <clause id="HEF832A8808AA41D3A14903F45666C193" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">to respond to inquiries from veterans regarding claims for disability compensation under section 1116A of title 38, United States Code, as added by subsection (a) of this section.</text></clause></subparagraph>
<subparagraph id="H0F64D5055C6F4534984DB991A07D646B" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">On a quarterly basis during the period beginning on the date of the enactment of this Act and ending on the date on which regulations are prescribed to carry out such section 1116A, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate updates on the status of such regulations.</text></subparagraph></paragraph> <paragraph id="H281D01FE56AF4B13A9591EC9772622EA"><enum>(3)</enum><header>Pending cases</header> <subparagraph id="H1BF197FF105F4764982C7B0EEFE9E5B8"><enum>(A)</enum><header>Authority to stay</header><text display-inline="yes-display-inline">The Secretary may stay a claim described in subparagraph (B) until the date on which the Secretary commences the implementation of such section 1116A.</text></subparagraph>
<subparagraph id="H52B1ADE7056240599271CDD065CFBF20"><enum>(B)</enum><header>Claims described</header><text>A claim described in this subparagraph is a claim for disability compensation—</text> <clause id="H20804D2651644C2497BB910632153313"><enum>(i)</enum><text display-inline="yes-display-inline">relating to the service and diseases covered by such section 1116A; and</text></clause>
<clause id="H35B561A3BEFB4B18BA391E5470923303" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">that is pending at the Veterans Benefits Administration or the Board of Veterans’ Appeals on or after the date of the enactment of this Act and before the date on which the Secretary commences the implementation of such section 1116A.</text></clause></subparagraph></paragraph></subsection> <subsection id="H7CCFFE86F4C146B5845C354138B23C6B" display-inline="no-display-inline"><enum>(d)</enum><header>Outreach</header> <paragraph id="HF3F7077BF4E14A8DA0522FE8BCD400AA"><enum>(1)</enum><header>Requirement</header><text>The Secretary of Veterans Affairs shall conduct outreach to inform veterans described in paragraph (2) of the ability to submit a claim for disability compensation under section 1116A of title 38, United States Code, as added by subsection (a). Such outreach shall include the following:</text>
<subparagraph id="H50F21C33B2F148DF90F5249FBB1C0DA0"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall publish on the website of the Department a notice that a veterans described in paragraph (2) may submit or resubmit a claim for disability compensation under such section 1116A.</text></subparagraph> <subparagraph id="H7E37265684D04BB4A0D348748579E220"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall notify in writing the veteran service organization community of the ability of veterans described in paragraph (2) to submit or resubmit claims for disability compensation under such section 1116A.</text></subparagraph></paragraph>
<paragraph id="HBECCF652D2404459988A8E6794908463" commented="no"><enum>(2)</enum><header>Veteran described</header><text display-inline="yes-display-inline">A veteran described in this paragraph is a veteran who, during active military, naval, or air service, served offshore of the Republic of Vietnam during the period beginning on January 9, 1962, and ending on May 7, 1975.</text></paragraph></subsection> <subsection commented="no" id="H46596FE8F36742FC932A44A63A47EF8F" display-inline="no-display-inline"><enum>(e)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than January 1, 2021, and annually thereafter for two years, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report regarding claims for disability compensation under section 1116A of title 38, United States Code, as added by subsection (a). Each report shall include, with respect to the calendar year preceding the report, disaggregated by the regional offices of the Department of Veterans Affairs, the following:</text>
<paragraph commented="no" id="H3B7C3D2190AD41658D617847E7DBB63F"><enum>(1)</enum><text>The number of claims filed under such section.</text></paragraph> <paragraph commented="no" id="H3A42BE015DB64D45B7F91762CC6C7B56"><enum>(2)</enum><text>The number of such claims granted.</text></paragraph>
<paragraph commented="no" id="H67C8C819FA23485BB04FF21B5F6E24A8"><enum>(3)</enum><text>The number of such claims denied.</text></paragraph></subsection> <subsection id="H24F4BCC757F04A4E87290ABF4F2FB52C" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Health care</header><text>Section 1710(e)(4) of title 38, United States Code, is amended by inserting <quote>(including offshore of such Republic as described in section 1116A(d) of this title)</quote> after <quote>served on active duty in the Republic of Vietnam</quote>.</text></subsection>
<subsection id="H326B9D9D2DD04BA6B38F95A08C6EE33B" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on January 1, 2020.</text></subsection></section> <section id="HA281B145DEBC49828210D6D5530D84CB" section-type="subsequent-section"><enum>3.</enum><header>Presumption of herbicide exposure for certain veterans who served in Korea</header> <subsection id="H6D4D7A8E07F74BE18686011F4371DD8A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">Chapter 11</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1116A">section 1116A,</external-xref> as added by section 2, the following new section:</text>

<section id="H75100F3A04364DA6B62853EC2958EC8A"><enum>1116B.</enum><header>Presumption of herbicide exposure for certain veterans who served in Korea</header>
<subsection id="H3F61574D3C6C4E20BB5894DCEB8D472D"><enum>(a)</enum><header>Presumption of service-Connection</header>
<paragraph commented="no" display-inline="yes-display-inline" id="HA74AA6D266134E4C9586C0B3DA3110DB"><enum>(1)</enum><text>For the purposes of section 1110 of this title, and subject to section 1113 of this title, a disease specified in subsection (b) that becomes manifest as specified in that subsection in a veteran described in paragraph (2) shall be considered to have been incurred or aggravated in the line of duty in the active military, naval, or air service, notwithstanding that there is no record of evidence of such disease during the period of such service.</text></paragraph> <paragraph id="H164CC28778C2409B928FC35C7D7BC440" indent="up1"><enum>(2)</enum><text>A veteran described in this paragraph is a veteran who, during active military, naval, or air service, served in or near the Korean Demilitarized Zone (DMZ), during the period beginning on September 1, 1967, and ending on August 31, 1971.</text></paragraph></subsection>
<subsection id="HBCF284D4A80D49F8BA224FF8FD2DC500"><enum>(b)</enum><header>Diseases</header><text>A disease specified in this subsection is—</text> <paragraph id="H7FF7112A02EF464CA41327B68940ED9A"><enum>(1)</enum><text>a disease specified in paragraph (2) of subsection (a) of section 1116 of this title that becomes manifest as specified in that paragraph; or</text></paragraph>
<paragraph id="HF0282F31289449F3BD63F920A907B5C0"><enum>(2)</enum><text>any additional disease that—</text> <subparagraph id="HC84B721D0D8D4071804C7329AA7F68DF"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines in regulations warrants a presumption of service-connection by reason of having positive association with exposure to an herbicide agent; and</text></subparagraph>
<subparagraph id="H407B49A51DDE411DBC4F31F743B36ED2"><enum>(B)</enum><text display-inline="yes-display-inline">becomes manifest within any period prescribed in such regulations.</text></subparagraph></paragraph></subsection> <subsection id="H16B387868D164D35B51CF89452A0AE55"><enum>(c)</enum><header>Herbicide agent</header><text>For purposes of this section, the term <term>herbicide agent</term> has the meaning given such term in section 1821(d) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H9FC754DFFB354BD792FC1A4BF266BD21"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1116A, as added by section 2, the following new item:</text> <quoted-block display-inline="no-display-inline" id="HDBE055DBB78543248A57CC1FAAF88003" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">1116B. <paragraph id="HF66389256F23492A956E2E38AA21231A" display-inline="no-display-inline"><enum>(2)</enum><header>Updates</header>
<subparagraph id="H51019EED078742E3A0FC2B7A1720B94A" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary shall submit a report to the Committees on Veterans’ Affairs of the House of Representatives and the Senate regarding the plans of the Secretary to respond to inquiries from veterans regarding claims for disability compensation under section 1116B of title 38, United States Code, as added by subsection (a) of this section.</text></subparagraph> <subparagraph id="HF2FD43C6D76A41CCBAE1EB4B7249FCB2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">On a quarterly basis during the period beginning on the date of the enactment of this Act and ending on the date on which regulations are prescribed to carry out such section 1116B, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate updates on the status of such regulations.</text></subparagraph></paragraph>
<paragraph id="HFA675FFE81194C34BE7718F71E7ADA33"><enum>(3)</enum><header>Pending cases</header>
<subparagraph id="H672CFAFB07AA4AE1A130B64DAD0CB196"><enum>(A)</enum><header>Authority to stay</header><text display-inline="yes-display-inline">The Secretary may stay a claim described in subparagraph (B) until the date on which the Secretary commences the implementation of section 1116B of title 38, United States Code, as added by subsection (a).</text></subparagraph> <subparagraph id="H4F00F9F158CA405AA5A6951FE6AE9535"><enum>(B)</enum><header>Claims described</header><text>A claim described in this subparagraph is a claim for disability compensation—</text>
<clause id="HA9A868FC3BBC4402A9FDC4E87DDBD162"><enum>(i)</enum><text display-inline="yes-display-inline">relating to the service and diseases covered by such section 1116B; and</text></clause> <clause id="HC6F9AB97FABE4C9D823057F1E8825C7A"><enum>(ii)</enum><text display-inline="yes-display-inline">that is pending at the Veterans Benefits Administration or the Board of Veterans’ Appeals on or after the date of the enactment of this Act and before the date on which the Secretary commences the implementation of such section 1116B.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H2E5A221136474769BE44641B77D51B8D"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2020.</text></subsection></section> <section id="H4417E29F690C4460875600D9224AD7BD"><enum>4.</enum><header>Benefits for children of certain Thailand service veterans born with spina bifida</header> <subsection id="H14E9C7233A6F4E5FAE32C1E4AF191665"><enum>(a)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/18">chapter 18</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="H579BD13FD9D54D2DBD3FE0AC65D17E5F"><enum>1822.</enum><header>Benefits for children of certain Thailand service veterans born with spina bifida</header>
<subsection id="H6D27EA6B65A745B2890E578938496A87"><enum>(a)</enum><header>Benefits authorized</header><text>The Secretary may provide to any child of a veteran of covered service in Thailand who is suffering from spina bifida the health care, vocational training and rehabilitation, and monetary allowance required to be paid to a child of a Vietnam veteran who is suffering from spina bifida under subchapter I of this chapter as if such child of a veteran of covered service in Thailand were a child of a Vietnam veteran who is suffering from spina bifida under such subchapter.</text></subsection> <subsection id="H9E0407D9A55F46878268E3D2BC395CA0"><enum>(b)</enum><header>Spina bifida conditions covered</header><text>This section applies with respect to all forms and manifestations of spina bifida, except spina bifida occulta.</text></subsection>
<subsection id="HFCAC8402E39D4DF5B4A91088EDA635EC"><enum>(c)</enum><header>Veteran of covered service in Thailand</header><text>For purposes of this section, a veteran of covered service in Thailand is any individual, without regard to the characterization of that individual's service, who—</text> <paragraph id="H54C6BE06B8C34BFB884882231770D342"><enum>(1)</enum><text>served in the active military, naval, or air service in Thailand, as determined by the Secretary in consultation with the Secretary of Defense, during the period beginning on January 9, 1962, and ending on May 7, 1975; and</text></paragraph>
<paragraph id="H7B3DBF1E8B4744E8BE904F60DBC3EE49"><enum>(2)</enum><text>is determined by the Secretary, in consultation with the Secretary of Defense, to have been exposed to a herbicide agent during such service in Thailand.</text></paragraph></subsection> <subsection id="H6DE42514FE0E4F768EBF98B4BE32A0D7"><enum>(d)</enum><header>Herbicide agent</header><text>For purposes of this section, the term <term>herbicide agent</term> means a chemical in a herbicide used in support of United States and allied military operations in Thailand, as determined by the Secretary in consultation with the Secretary of Defense, during the period beginning on January 9, 1962, and ending on May 7, 1975.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H512BAA01797F4F34B6F569D8F11ABBD6"><enum>(b)</enum><header>Conforming amendment to definition of <quote>child</quote></header><text>Section 1831(1) of such title is amended—</text> <paragraph id="H6000033BADAD4F369352E332E752AE51"><enum>(1)</enum><text>in subparagraph (B)—</text>

<subparagraph id="H6BA05CF6CDB54C609D6AC4EA4539D700"><enum>(B)</enum><header>Claims described</header><text>A claim described in this subparagraph is a claim for benefits—</text> <clause id="HF17E23827B7A40C187591EDC8FA9995E"><enum>(i)</enum><text display-inline="yes-display-inline">relating to the spina bifida and service covered by such section 1822; and</text></clause>
<clause id="HD50545D7EBC3439D81F20BC5E572995F"><enum>(ii)</enum><text display-inline="yes-display-inline">that is pending at the Veterans Benefits Administration or the Board of Veterans’ Appeals on or after the date of the enactment of this Act and before the date on which the Secretary commences the implementation of such section 1822.</text></clause></subparagraph></paragraph></subsection> <subsection id="HCB4FC440C1834B7A8E111DE8C098AE98"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report identifying—</text>
<paragraph id="HED10DFC3221E4FC2A4C51C9BE32B3215"><enum>(1)</enum><text display-inline="yes-display-inline">the military installations of the United States located in Thailand during the period beginning on January 9, 1962, and ending on May 7, 1975, at which an herbicide agent (as defined in section 1822 of title 38, United States Code, as added by subsection (a)) was actively used; and</text></paragraph> <paragraph id="H22CB2A2E6C2D48A29AFE190AC283F93F"><enum>(2)</enum><text>the period of such use.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H5DF9AF1606AC450BAD1858240F2FFC8D"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2020.</text></subsection></section> <section id="H662BFA9A3BAC430CBA26FD30D16232E4"><enum>5.</enum><header>Updated report on certain Gulf War Illness study</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an updated report on the findings, as of the date of the updated report, of the Follow-up Study of a National Cohort of Gulf War and Gulf Era Veterans under the epidemiology program of the Department of Veterans Affairs.</text></section>
<section id="HAB44CE9F7D984F96957CEE5BD35E68B0" section-type="subsequent-section" display-inline="no-display-inline"><enum>6.</enum><header>Loans guaranteed under home loan program of Department of Veterans Affairs</header>
<subsection id="HAC6E7940DCF641EEB9F5B272478EA137"><enum>(a)</enum><header>Adjustment of loan limit</header>
<paragraph id="H02691562C6134BC09027C30C9EED0E97"><enum>(1)</enum><header>In general</header><text>Section 3703(a)(1) of title 38, United States Code, is amended—</text> <subparagraph id="H9776AB724164439D96AB958C3A20D661"><enum>(A)</enum><text>in subparagraph (A)—</text>
<clause id="HEA1E61E3390A4DA8B5B5BBF2D53A40E1"><enum>(i)</enum><text>in clause (i)(IV), by striking <quote>the lesser of the maximum guaranty amount (as defined in subparagraph (C)) or</quote>;</text></clause> <clause id="HB09103B3B9054FC4A84D39F21D305D90"><enum>(ii)</enum><text>in clause (ii), by striking <quote>subparagraph (B) of this paragraph</quote> and inserting <quote>subparagraph (B) or (C)</quote>;</text></clause></subparagraph>

<clause id="H8EFF05905FA547AABB223FC9130ABFC0" display-inline="yes-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">With respect to loans described in subclause (IV) of subparagraph (A)(i) made to a veteran not covered by clause (ii), the maximum amount of guaranty entitlement available to the veteran shall be 25 percent of the loan.</text></clause> <clause id="HC15BA30A4D3A410FBBCF20B990B9B1D9" display-inline="no-display-inline" commented="no" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">With respect to loans described in subclause (IV) of subparagraph (A)(i) made to a covered veteran, the maximum amount of guaranty entitlement available to the veteran shall be 25 percent of the Freddie Mac conforming loan limit, reduced by the amount of entitlement previously used by the veteran under this chapter and not restored as a result of the exclusion in section 3702(b) of this title.</text></clause>
<clause id="HD145B18449D24A92AC4EA070ABA774A1" indent="up1" commented="no"><enum>(iii)</enum><text>In this subparagraph:</text> <subclause id="H879AEAECEC204F14BA4DA7A5D22B5AB9" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">The term <term>covered veteran</term> means a veteran who has previously used entitlement under this chapter and for whom the full amount of entitlement so used has not been restored as a result of the exclusion in section 3702(b) of this title.</text></subclause>
<subclause id="HDBC694D9B88045089F91F2EFB367128D" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">The term <term>Freddie Mac conforming loan limit</term> means the limit determined under section 305(a)(2) of the Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454(a)(2)</external-xref>) for a single-family residence, as adjusted for the year involved.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H1B79EA8FF2C44A469FEB8F6C9A9A31EC" commented="no"><enum>(2)</enum><header>Loans to Native American veterans</header><text>Section 3762(c) of such title is amended—</text>

<subsection id="H6798757D1F68476B8D8A519B36A75CEF"><enum>(e)</enum><header>Guidance</header><text display-inline="yes-display-inline">Notwithstanding section 501 of title 38, United States Code, the Secretary of Veterans Affairs may issue guidance to implement this section before prescribing new regulations under sections 3703, 3729, and 3762 of such title, as amended by this section.</text></subsection></section> <section id="H374580EEE71546FF91CC732AB505D9D1" section-type="subsequent-section"><enum>7.</enum><header>Information gathering for Department of Veterans Affairs home loan appraisals</header> <subsection id="H2068FF4BBF474458A8085D57A6CF7B7C"><enum>(a)</enum><header>In general</header><text>Section 3731(b) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H86237963F8A8488AAEF5038499D83071" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall permit an appraiser on a list developed and maintained under subsection (a)(3) to make an appraisal for the purposes of this chapter based solely on information gathered by a person with whom the appraiser has entered into an agreement for such services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection display-inline="no-display-inline" id="HA8104BB6B1A2453390E332417B1E0F8D"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to an appraisal under section 3731 of such title, on or after January 1, 2020.</text></subsection>
