			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide greater support for grandfamilies and older caretaker relatives.</official-title></form>
	<legis-body id="HB59BBC3C292C4C8796936657FE9DB0A8" style="OLC">
 <section id="H27C2887395DB4A74B6B19A4E3666E721" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Grandfamilies Act of 2019</short-title></quote>.</text> </section><section id="HBDBB240B0EC443C3ADCC99E66A802266"><enum>2.</enum><header>Increasing access to Social Security benefits for children who live with grandparents or other family members</header> <subsection id="HD5D95E75FB0A477CAD914769B20E0319"><enum>(a)</enum><header>In general</header><text>Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.) is amended—</text>
 <paragraph id="H08CED754C0844A25B9D3B17A13A6621D"><enum>(1)</enum><text>in section 202(d)—</text> <subparagraph id="H8AC4C27780B144F784BA8DCF9A777EC0"><enum>(A)</enum><text>in paragraph (1)(C), by inserting <quote>except as provided in paragraph (9),</quote> before <quote>was dependent</quote>; and</text>
 </subparagraph><subparagraph id="H1BF273DD3AAC4743B2E876DB104A8754"><enum>(B)</enum><text>by amending paragraph (9) to read as follows:</text> <quoted-block act-name="" id="H1BE5D85945A644BBB37882154D35550E" other-style="archaic" style="other"> <paragraph id="H534903F75F174BE79DF19714AC2D44C9" indent="up1"><enum>(9)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H0AF68CB684424B86B821A4CAEC1AC32E"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a child who is the child of an individual under clause (3) of the first sentence of section 216(e) and is not a child of such individual under clause (1) or (2) of such first sentence, the criteria specified in subparagraph (B) shall apply instead of the criteria specified in subparagraph (C) of paragraph (1).</text>
 </subparagraph><subparagraph id="H4CA3225049B247E4AAB70FAB75DB1839" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The criteria of this subparagraph are that—</text> <clause id="H844AE0F6906D46DDA3C9687569F0ECC9"><enum>(i)</enum><text>the child has been living with such individual in the United States for a period of not less than 12 months;</text>
 </clause><clause id="H9C24387C27394CED9763179271B268DC"><enum>(ii)</enum><text>the child has been receiving not less than ½ of the child's support from such individual for a period of not less than 12 months; and</text>
 </clause><clause id="H609BF3343B4A405FBBF8948BDAD80891"><enum>(iii)</enum><text>the period during which the child was living with such individual began before the child attained age 18.</text>
 </clause></subparagraph><subparagraph id="H780BC2C2F639412EA8CFEB4BFE5A8F11" indent="up1"><enum>(C)</enum><text>In the case of a child who is less than 12 months old, such child shall be deemed to meet the requirements of subparagraph (B) if, on the date the child attains 1 year of age, such child has lived with such individual in the United States and received at least ½ of the child's support from such individual for substantially all of the period which began on the date of such child's birth.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H1138D9643ADB4CE7B992A338642AC4CD"><enum>(2)</enum><text>in section 216(e), in the first sentence—</text> <subparagraph id="HCB45540279C94918B80B183DDDA976FC"><enum>(A)</enum><text>by striking <quote>grandchild or stepgrandchild of an individual or his spouse</quote> and inserting <quote>grandchild, stepgrandchild, or other first-degree, second-degree, third-degree, fourth-degree, or fifth-degree relative of an individual or the individual's spouse</quote>;</text>
 </subparagraph><subparagraph id="H9D1C64F372D94BF2B34F90FECD3CFA03"><enum>(B)</enum><text>by striking <quote>was no natural or adoptive parent</quote> and inserting <quote>is no living natural or adoptive parent</quote>;</text> </subparagraph><subparagraph id="H7E32FBC4397C4063A7FFE90D8141B9F9"><enum>(C)</enum><text>by striking <quote>was under a disability</quote> and inserting <quote>is under a disability</quote>;</text>
 </subparagraph><subparagraph id="H4178F432CFED4B6BADE4442BF2C484ED"><enum>(D)</enum><text>by striking <quote>living at the time</quote> and all that follows through <quote>, or (B)</quote> and inserting <quote>, (B)</quote>; and</text> </subparagraph><subparagraph id="H320031B1973C4B12A75E462B8A84D845"><enum>(E)</enum><text>by inserting <quote>, or (C) the person has been in the custody of such individual pursuant to a court order for a period of not less than 12 months</quote> before the first period.</text>
 </subparagraph></paragraph></subsection><subsection id="H88181D4DF6574EB792FAFC2AF30575FF"><enum>(b)</enum><header>Conforming amendments</header><text>Section 202(d)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)(1)</external-xref>) is amended—</text> <paragraph id="H6420DEEF6B224CF3A0E2EB1E33FE0711"><enum>(1)</enum><text>by striking <quote>subparagraphs (A), (B), and (C)</quote> and inserting <quote>subparagraphs (A) and (B) and subparagraph (C) or paragraph (9) (as applicable)</quote>; and</text>
 </paragraph><paragraph id="HA4C8EBDD8FD947B688CACE77F58A064B"><enum>(2)</enum><text>by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>subparagraph (B) and subparagraph (C) or paragraph (9) (as applicable)</quote>.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4D10F5765A2C489786365C5313F231D6"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of enactment of this Act.</text>
			</subsection></section><section id="HD67A2FCB52AF46CDB15C11105A727BCA"><enum>3.</enum><header>Eliminating barriers to TANF for children and older caretaker relatives</header>
 <subsection id="H8DA1B72F0F69491DAA946302D2226A6A"><enum>(a)</enum><header>Broadening good cause exception to requirement To provide information on noncustodial parents</header><text display-inline="yes-display-inline">Section 454(29)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654(29)(A)(i)</external-xref>) is amended by striking <quote>best interests of the child</quote> and inserting <quote>best interests of the child, including, if enforcement procedures against a non-custodial parent of the child are initiated, whether such procedures will impede the parent's ability to reunify with the child in the future</quote>.</text>
			</subsection><subsection id="H27376FE0F53C40E69388D1AF90EE6FCF"><enum>(b)</enum><header>Disregard of nonparent caretaker relative income, assets, and resources in child-Only cases</header>
 <paragraph id="H48766C94F3F04674ABA92A40653D7D9D"><enum>(1)</enum><header>In general</header><text>Section 408(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>
					<quoted-block act-name="" id="HF87EE6DE6B044909B094996FB941E28C" style="OLC">
						<paragraph id="H04F6F529F48741F4A4BFEBCC95321A49"><enum>(13)</enum><header>Disregard of income, assets, and resources for nonparent caretaker relatives in child-only cases</header>
 <subparagraph id="H2DD32D1B08774195926A54AC966CDF78"><enum>(A)</enum><header>In general</header><text>With respect to a minor child who does not reside in the same household as a parent of the child, a State to which a grant is made under section 403 shall not take into account the income, assets, or resources of such child's nonparent caretaker relative who is not seeking assistance under the State program funded under this part or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)) on their own behalf in determining whether the child is eligible for assistance under any such program, or in determining the amount or types of such assistance to be provided to the child.</text>
 </subparagraph><subparagraph id="HD43898B2BE79465D864DF3C675B1741D"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply in the case of a State program—</text> <clause id="H44EDCEA02933459AB18887800FC25692"><enum>(i)</enum><text>that is operated specifically for children living with nonparent caretaker relatives;</text>
 </clause><clause id="HF6A98BB4CFE7447C8611E95DCA453F0D"><enum>(ii)</enum><text>that provides monthly financial assistance to a child living with a nonparent caretaker relative in an amount that is greater than the amount of assistance that the child would receive on the child's own behalf under the State program funded under this part;</text>
 </clause><clause id="H6EEA3AE237AB48D68A52D78F77AB10A6"><enum>(iii)</enum><text>that is separate from the State program funded under this part; and</text> </clause><clause id="H67B02100B14D44CA841C4C3000EF6E98"><enum>(iv)</enum><text>that is described in the State plan submitted under section 402.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HF12D03F9C1084AE49044DFE7F5E55A95"><enum>(2)</enum><header>Penalty</header><text>Section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>
					<quoted-block act-name="" id="H68E14D5539844635B4410B18E76AAFE0" style="OLC">
						<paragraph id="H6BA687261AD24653B090E2216398A0C5"><enum>(17)</enum><header>Penalty for failure to disregard income, assets, and resources of nonparent caretaker relative in
 child-only cases</header><text>If the Secretary determines that a State to which a grant is made under section 403 in a fiscal year has violated section 408(a)(13) during the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to 3 percent of the State family assistance grant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H1A884EF93A274BA984E85A0C1BF190EF"><enum>(c)</enum><header>Eliminating 5-Year cap on assistance in child-Only cases</header>
 <paragraph id="H5313294B5AD746E6BC37618A60AE73E1"><enum>(1)</enum><header>In general</header><text>Section 408(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(7)</external-xref>) is amended by adding at the end the following new subparagraph:</text>
					<quoted-block act-name="" id="HF17CE23BB05443149A79B14F69FD7A9A" style="OLC">
 <subparagraph id="H0B9A04F8BA414CD9BD901BCA8278240F"><enum>(H)</enum><header>No limit for child-only cases</header><text>A State shall not limit the number of months of assistance under the State program funded under this part or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)) for a family in which all adults in the family—</text>
 <clause id="HF54948CA481C4F5FB54ECB7FB9929569"><enum>(i)</enum><text>are nonparent caretaker relatives of a child who does not reside in the same household of the parent of the child; and</text>
 </clause><clause id="H8201744E3D944F47B53E0701AD385654"><enum>(ii)</enum><text>do not receive assistance under the State program funded under this part or any other State program funded with qualified expenditures (as defined in section 409(a)(7)(B)(i)) on their own behalf.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HFBFB1D48BF444A1F86B3A13AE122BB44"><enum>(2)</enum><header>Penalty</header><text>Section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as previously amended by this section, is amended—</text>
 <subparagraph id="HE91A374B8BD843648598E86E551957DE"><enum>(A)</enum><text>in paragraph (9), by inserting <quote>(other than subparagraph (H))</quote> after <quote>section 408(a)(7)</quote>; and</text> </subparagraph><subparagraph id="H70FBFF04AC2E4B598D67A2377B1775C0"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text>
						<quoted-block act-name="" id="HD2C613FBFE7148D5A4B7F8EAC3355102" style="OLC">
 <paragraph id="H57E0BEB76952409B8CED7A4BAB2C5980"><enum>(18)</enum><header>Penalty for failure to comply with 5-year cap exemptions</header><text>If the Secretary determines that a State to which a grant is made under section 403 in a fiscal year has violated subparagraph (H) of section 408(a)(7) during the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to 3 percent of the State family assistance grant</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HD9C73B1B67E74ECC8EAC7DE076846701"><enum>(d)</enum><header>Exemption from work requirements for nonparent caretaker relatives in child-Only cases</header>
 <paragraph commented="no" id="HBE8E20BA01A047DFA6A0CA3FE0DDE53C"><enum>(1)</enum><header>In general</header><text>Section 408 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block act-name="" id="H076A18A2233C41C0992AE06184E457F8" style="OLC">
 <subsection commented="no" id="H7E3E047BC4194FA78918F02E697FDD49"><enum>(h)</enum><header>State required To exempt nonparent caretaker relatives from work participation in child-Only cases</header><text>A State shall not require an individual to engage in work if the individual—</text> <paragraph commented="no" id="HE59203CDE71A4159A3BA9A080E28BADA"><enum>(1)</enum><text>is the nonparent caretaker relative of a child who does not reside in the same household as a parent of the child; and</text>
 </paragraph><paragraph commented="no" id="H2F53C774AFC444DA9D3F7288D0E868CF"><enum>(2)</enum><text>resides in a household in which no adult receives assistance under the State program funded under this part or any other State program funded with qualified expenditures (as defined in section 409(a)(7)(B)(i)) on their own behalf.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H744853AA461244069A7C8E351B1E9AAC"><enum>(2)</enum><header>Penalty</header><text>Section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as previously amended by this section, is amended by adding at the end the following new paragraph:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="H668F58CDFD65473FA8489D9165E8107B" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="H8786157ECBF3489A81FF6023E1C1BFE4"><enum>(19)</enum><header>Penalty for failure to comply with work participation exemptions</header><text>If the Secretary determines that a State to which a grant is made under section 403 in a fiscal year has violated subsection (h) of section 408 during the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to 3 percent of the State family assistance grant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1DABB4C7708C406DB2B8702E6D657F81"><enum>(e)</enum><header>Eliminating 5-Year cap on assistance for older caretaker relatives</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H0A0BEA79C47644ABBDC7132152018032"><enum>(1)</enum><header>In general</header><text>Section 408(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(7)</external-xref>), as amended by subsection (c)(1), is amended by adding at the end the following new subparagraph:</text>
					<quoted-block act-name="" id="HE7CCE75CF1694FAA80224751BB8646FA" style="OLC">
						<subparagraph id="HA988A9CB456F475EB19EA4817656D18B"><enum>(I)</enum><header>Non-application of limit to older caretaker relatives</header>
 <clause id="H5FE7B86AD3DD46FCAB8CF6E597305393"><enum>(i)</enum><header>No limit for older caretaker relatives</header><text>Subparagraph (A) shall not apply and a State shall not limit the number of months of assistance under the State program funded under this part or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)) based on receipt of such assistance by an individual who is an older caretaker relative (as defined for purposes of paragraph (14)).</text>
 </clause><clause id="H0CB00624DF0640DD99F308083BDF010A"><enum>(ii)</enum><header>Disregard of months of assistance </header><text>In determining the number of months for which a family that includes an adult who has received assistance under the State program funded under this part or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)), the State shall disregard any month for which such assistance was provided with respect to the family during which such adult was an older caretaker relative (as defined for purposes of paragraph (14)).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2FC2CF1268EB464390B4B6ED39E11ED2"><enum>(2)</enum><header>Penalty</header><text>Section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as previously amended by this section, is amended—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H60270496EE82472DACC8B74786EA2878"><enum>(A)</enum><text>in paragraph (9), by inserting <quote>or (I)</quote> after <quote>subparagraph (H)</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H834A0CCB06034FF2A98C92475E52ACD1"><enum>(B)</enum><text>in paragraph (18), by inserting <quote>or (I)</quote> after <quote>subparagraph (H)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H5658EE70DC734273B2A259DCB38CD567"><enum>(f)</enum><header>Exemption from work requirements for older caretaker relatives</header>
 <paragraph id="HB7B1EAC3B29546E7990ACBB23E225326"><enum>(1)</enum><header>In general</header><text>Section 408 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608</external-xref>), by subsection (d)(1), is amended by adding at the end the following new subsection:</text>
					<quoted-block act-name="" id="H46BF40597BC847F6BD727733BD977375" style="traditional">
						<subsection id="H9B889EA63DEB4697A61E7E5866607AC9"><enum>(i)</enum><header>State required To exempt older caretaker relatives from work participation where caretaker receives
 assistance</header><text>A State shall not require an individual to engage in work, and, at the option of the State and on a case-by-case basis, may disregard such individual in determining the participation rates under section 407(a), if the individual—</text>
 <paragraph id="H712C6514271E4612BDF3465786086D13"><enum>(1)</enum><text>is an older caretaker relative (as defined for purposes of subsection (a)(14)); and</text> </paragraph><paragraph id="H934C97FD77F2424A9FEB83BFD8C01A30"><enum>(2)</enum><text>directly receives assistance on the individual’s own behalf under the State program funded under this part or any other State program funded with qualified expenditures (as defined in section 409(a)(7)(B)(i)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H0E8E4FA2E3954BF8A7C9247C5B5CD6E0"><enum>(2)</enum><header>Penalty</header><text>Paragraph (18) of section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as added by subsection (d)(2), is amended by inserting <quote>or (i)</quote> after <quote>subsection (h)</quote>.</text>
 </paragraph><paragraph id="H930C9772745644DE9DCD43752FFA9EE6"><enum>(3)</enum><header>Conforming amendments</header><text>402(a)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)(1)(A)</external-xref>) is amended—</text> <subparagraph id="H85C02C420AE44104953003F5A42321CA"><enum>(A)</enum><text>in clause (ii), by inserting <quote>and subject to subsection (h) and (i) of section 408</quote> before the period; and</text>
 </subparagraph><subparagraph id="HFF633CB1D56E4E9BA10A1A3DF00FC50C"><enum>(B)</enum><text>in clause (iii), by inserting <quote>and subject to subsection (h) and (i) of section 408</quote> before the period.</text> </subparagraph></paragraph></subsection><subsection id="HDFDE7E2FBC3A4FAEA94026B7391217AB"><enum>(g)</enum><header>Disregard of income, assets, and resources for older caretaker relatives</header> <paragraph id="HEAC13867A0F0485282D9AFB36A833AD2"><enum>(1)</enum><header>In general</header><text>Section 408(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as previously amended by this section, is amended by adding at the end the following new paragraph:</text>
					<quoted-block act-name="" id="H2F542E0C12E547F78F49A5AC32715244" style="OLC">
						<paragraph id="H3421DA08BA1F4133BF8D1FFDFBF99FBE"><enum>(14)</enum><header>Disregard of income, assets, and resources for older caretaker relatives</header>
 <subparagraph id="H3372FCEAAA97402580F78D4FBF2D7642"><enum>(A)</enum><header>In general</header><text>In determining the eligibility for, and amount of, assistance under the State program funded under this part or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)) for a family that includes an individual who is an older caretaker relative (as defined in subparagraph (B)), a State to which a grant is made under section 403 shall not take into account the income, assets, or resources of that individual.</text>
							</subparagraph><subparagraph id="HF8FC5F1C3C444E24BFDA8D543A4A8B62"><enum>(B)</enum><header>Definition</header>
 <clause id="H7C0A9E90E26944B3A0709079A3D7E5C5"><enum>(i)</enum><header>In general</header><text>For purposes of this paragraph, the term <term>older caretaker relative</term> means an individual who—</text> <subclause id="HC8C2FDD945F84F06AFD486E2DE20782C"><enum>(I)</enum><text>subject to clause (ii), has attained age 55; and</text>
 </subclause><subclause id="HD323CF69CF4840DDB30F9A629775D9A9"><enum>(II)</enum><text>is the primary caretaker for a minor child who—</text> <item id="H428963E0FFA44717B4CE81B89F341BB5"><enum>(aa)</enum><text>is living with the individual;</text>
 </item><item id="H23271CA6FE544ADFA2FE0F5642E3778F"><enum>(bb)</enum><text>does not have a parent living in the home; and</text> </item><item id="HD5247276B6D543E38C3879FE6D1DDA87"><enum>(cc)</enum><text>is a relative of the individual.</text>
 </item></subclause></clause><clause id="HBAA9C83816EC4ED9BA61021CD6CCBEF2"><enum>(ii)</enum><header>State option to modify age criterion</header><text>At the option of a State, such term shall include an individual who has not attained age 55.</text> </clause><clause id="H74C9BAD853FE4378995920A095DAFA8D"><enum>(iii)</enum><header>Determination to be made by State</header><text>The determination of whether an individual meets the criteria described in clause (i)(II) shall be made by the State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H291624B0D66247B0A3CA74D1D80E112A"><enum>(2)</enum><header>Penalty</header><text>Section 409(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>), as previously amended by this section, is amended by adding at the end the following new paragraph:</text>

 <paragraph commented="no" display-inline="no-display-inline" id="HB7BB977F32BE4C6FA744E9AEEE53FF08"><enum>(20)</enum><header>Penalty for failure to disregard income, assets, and resources for older caretaker relatives</header><text>If the Secretary determines that a State to which a grant is made under section 403 in a fiscal year has violated section 408(a)(14) during the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to 3 percent of the State family assistance grant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6F1312F42A7C49A581A728780C7FEA48"><enum>(h)</enum><header>Ensuring equitable treatment for older caretaker relatives under TANF</header>
				<paragraph id="H83C6ECCCF448439CBE1E298E18C3D0A4"><enum>(1)</enum><header>State notifications to older caretaker relatives of child TANF recipients</header>
 <subparagraph id="HB85CC190BD054B829819E4A2401124E8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 408(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), as previously amended by this section, is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H6E55C1D741624520974ABA3254CF92D0" style="OLC">
 <paragraph id="HCE12A2C5E1DF40CEAE9BAD1016E2D618"><enum>(15)</enum><header>State requirements regarding notice to relative caretakers</header><text display-inline="yes-display-inline">A State to which a grant is made under section 403 shall—</text> <subparagraph id="HBE7B31088A2B45E19F8003B92626020D"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that the State agency responsible for administering the State program funded under this part employs a resource employee who is trained to provide guidance to an older caretaker relative of a minor child if the child is a recipient of assistance under the program (or under a State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i))), on legal options regarding custody and guardianship of the child, including explaining to the relative caretaker how each legal option corresponds to the availability of benefits and services, and who serves as a liaison with other agencies and community organizations that provide resources and assistance to relative caretakers; and</text>
 </subparagraph><subparagraph id="HEE849922895D43C6909746F8EC8B08A1"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that the State agency provides to any older caretaker relative of a minor child if the child is a recipient of assistance under the State program funded under this part (or under a State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i))), written notice that—</text>
 <clause id="HD19559AEE9FB4FC4BF1701E1700FCCB0"><enum>(i)</enum><text>explains the options of the older caretaker relative under Federal, State, and local law to participate in the care and placement of the child, including the financial ramifications of the options and any options that may be lost by choosing certain benefits;</text>
 </clause><clause id="H733562D2A1A84891B984E10586A79747"><enum>(ii)</enum><text>describes the requirements under section 471(a)(10) to become a foster family home and the additional services and supports that are available for a child placed in such a home;</text>
 </clause><clause id="H11CEA57BFD454716A002818841DB1045"><enum>(iii)</enum><text>if the State has elected the option to make guardianship assistance payments under section 471(a)(28), describes how the relative caretaker may enter into an agreement with the State to receive the payments;</text>
 </clause><clause id="HCFFB97D9F07C46BBBC42328173A1243B"><enum>(iv)</enum><text>describes policies under the State program funded under this part that are designed to help older caretaker relatives, including income, asset, and resource exemptions in determining program eligibility, <quote>good cause</quote> exemptions to child support enforcement policies, and work requirement exemptions;</text>
 </clause><clause id="HB3D7A9BD9C4F4B80829FF4178A22034D"><enum>(v)</enum><text>provides direct contact information for other agencies and community organizations that provide resources and assistance, such as housing, supplemental nutrition assistance, health care, and child care; and</text>
 </clause><clause id="HC944DEF50CA9491F9FD8CCFB5428F81A"><enum>(vi)</enum><text display-inline="yes-display-inline">provides direct contact information for the resource employee described in subparagraph (A).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H767965B0EE49484DB5123F926D54FF19"><enum>(B)</enum><header>Inclusion in State plan</header><text display-inline="yes-display-inline">Section 402(a)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)(1)(B)</external-xref>) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H8E251B28A5CC45CCAD22D01C58E1825B" style="OLC">
 <clause id="H1EF729302F8749C1A40EE8BE5BE21754"><enum>(vi)</enum><text display-inline="yes-display-inline">The document shall provide a detailed explanation of how the State intends to comply with section 408(a)(15).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HFBD785979A3347B5A8D4A8AF470F2EED"><enum>(C)</enum><header>Penalty</header><text>Section 409(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HAA947AC1AA6D46BC83E7E9B40E82AB74" style="OLC"> <paragraph id="H948F001651224F30AA499F87CFA55158"><enum>(21)</enum><header>Failure to notify relative caretakers</header><text display-inline="yes-display-inline">If the Secretary determines that a State to which a grant is made under section 403 for a fiscal year has violated section 408(a)(15) during the fiscal year, the Secretary shall reduce the grant payable to the State under section 403(a)(1) for the immediately succeeding fiscal year by an amount equal to 4 percent of the grant.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H424CF4CDCDDE4FC6A0C3A853EBE03BF3"><enum>(2)</enum><header>State treatment of relative caretakers of child TANF recipients</header><text display-inline="yes-display-inline">Section 402(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)</external-xref>), as amended by paragraph (2)(B), is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H283FC417D60E41B5A7C1BEE9F384D89D" style="OLC">
 <clause id="H3BEB83F0760A414789F6BA58B97C5707"><enum>(vii)</enum><text display-inline="yes-display-inline">The document shall provide a detailed explanation of the State’s treatment of older caretaker relatives of minor children, in cases in which the child is a recipient of assistance under the State program funded under this part (or under a State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i))), including—</text>
 <subclause id="HD8F25B581D404AC2BAC55FCDA10F15F4"><enum>(I)</enum><text>information regarding how the State defines terms such as <quote>relative</quote>, <quote>fictive kin</quote>, and <quote>caretaker</quote>;</text> </subclause><subclause id="H4CFC1D0AE21E43B29C210F59620A9D3F"><enum>(II)</enum><text display-inline="yes-display-inline">a description of the training received by caseworkers of the State agency responsible for administering the program in relation to older caretaker relatives of minor children, in cases in which the child is such a recipient;</text>
 </subclause><subclause id="H72CEF4DA3B5B486B947D8C12C8ED89EA"><enum>(III)</enum><text>an explanation of the ways in which assistance available under the program to an older relative caretaker of a minor child is affected by the temporary presence in the home of a biological parent of the child; and</text>
 </subclause><subclause id="HECB3C0A38791426785671F727A5230D0"><enum>(IV)</enum><text>an explanation of how benefits are adjusted for older caretaker relatives including income, asset, and resource exemptions in determining program eligibility, <quote>good cause</quote> exemptions to child support enforcement policies, and work requirement exemptions.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HE23148F010BF4749B024D900DDED2C24"><enum>(3)</enum><header>Enhanced data reporting</header><text display-inline="yes-display-inline">Section 411(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611(a)(7)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="yes-display-inline" id="HAC4F54658F4B4543985E1B1FC5D81E09" style="OLC">
 <text>The Secretary shall also prescribe regulations to improve the reporting of data on the economic well-being and circumstances of families with older relative caretakers of minor children, including, to the extent practicable, information relating to—</text><subparagraph id="HE84F414639624725B44129B55EA54207"><enum>(A)</enum><text display-inline="yes-display-inline">all adults in the family, including whether or not such adults are recipients of assistance under the State program funded under this part (or under a State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)));</text>
 </subparagraph><subparagraph id="H1F1C8BE9178248D784F559A079A454EB"><enum>(B)</enum><text display-inline="yes-display-inline">all minor children in the family, including whether any such minor child—</text> <clause id="HB5C7EB799E5F48F4A429367ECD89264F"><enum>(i)</enum><text>is required to be included in the foster care reporting population for purposes of the Adoption and Foster Care Analysis Reporting System (AFCARS) established pursuant to section 479; or</text>
 </clause><clause id="HFFADDF2E305B4BB2928F87CFF10C9FD6"><enum>(ii)</enum><text display-inline="yes-display-inline">is not required to be so included in such foster care reporting population, but—</text> <subclause id="HD23814FE4C8B4CE6BFFE703016DC4732"><enum>(I)</enum><text display-inline="yes-display-inline">is receiving services in the home of the relative caretaker that are supervised or administered by the State agency responsible for administering the State plan approved under part B;</text>
 </subclause><subclause id="H918DA0B0E0E449B4B8E0DF068DFF84B2"><enum>(II)</enum><text display-inline="yes-display-inline">was placed with the relative caretaker to prevent the need for foster care as a result of an intervention on behalf of the child which was carried out or supervised by the State agency administering the State plans under parts B and E; or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="HE541A9F012194BD2B90A4A831F99DC47"><enum>(III)</enum><text display-inline="yes-display-inline">was placed with the relative caretaker upon formal discharge from the care and placement responsibility of the State agency administering the plans under part B or E;</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="H761BB27B33954EF3ACE3F2F75E70317F"><enum>(iii)</enum><text display-inline="yes-display-inline">all families who applied for a good-cause exemption to the State's child enforcement cooperation policies; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H35F0CA692454407C92A8BE0801156958"><enum>(iv)</enum><text display-inline="yes-display-inline">all families who received a good-cause exemption to the State's child enforcement cooperation policies.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0F4ED7B0AD3D4175B63C4018171A938D"><enum>(i)</enum><header>Effective date</header>
 <paragraph id="HF9E5ADA7F8DE4F18A0337FEF3563D7DA"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB18F14EB3C2E4193BEE14E64077435E6"><enum>(2)</enum><header>Delay permitted</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="H84C968942BDF485F9899C4B9173568D1"><enum>(A)</enum><header>In general</header><text>Before the date described in subparagraph (B), a State plan under title IV of the Social Security Act shall not be regarded as failing to comply with an additional requirement imposed on the plan by this section if the Secretary of Health and Human Services determines that such additional requirement—</text>
 <clause commented="no" display-inline="no-display-inline" id="HDF71D4D5910C4347BE8A0A35A3B0631B"><enum>(i)</enum><text>requires State legislation (other than legislation appropriating funds) in order for the plan to meet such additional requirement; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H2DCD40D4D956408FAD27A318F2CE13D6"><enum>(ii)</enum><text>could not practicably be met by the plan before such date.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H998B8F77645A42B0BA210B315E9B6A4F"><enum>(B)</enum><header>Date described</header><text>For purposes of subparagraph (A), the date described in this subparagraph is, with respect to a State, the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of enactment of this section. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text>
					</subparagraph></paragraph></subsection></section><section id="HF7B037F16E4F4A59BA4DD36F6F97CD11"><enum>4.</enum><header>Improving the collection of child support for families receiving TANF assistance</header>
 <subsection id="HEC937B95A87548C0ABFB3AAECF7D8BE8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 454 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654</external-xref>) is amended—</text> <paragraph id="H9E34BD4577254A18ABC72210984555A2"><enum>(1)</enum><text>by redesignating paragraphs (30) through (34) as paragraphs (31) through (35), respectively; and</text>
 </paragraph><paragraph id="H4CFD3229C27040AAA57029FAAE4B8465"><enum>(2)</enum><text>by inserting after paragraph (29) the following:</text> <quoted-block display-inline="no-display-inline" id="H607D6C11006F414AA9B7E3E954A29373" style="OLC"> <paragraph id="H95B88624DC444FD2890505D5B9C3039E"><enum>(30)</enum><text display-inline="yes-display-inline">include a description of—</text>
 <subparagraph id="H8952A64C71784ABAB26296680D496C90"><enum>(A)</enum><text display-inline="yes-display-inline">the methods used by the State to determine whether an individual who has applied for or is receiving assistance under the State program funded under part A, the State program under part E, the State program under title XIX, or the supplemental nutrition assistance program, as defined under section 3(h) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(h)</external-xref>), is cooperating in good faith with the State in establishing paternity or in establishing, modifying, or enforcing a support order, as provided in paragraph (29);</text>
 </subparagraph><subparagraph id="HFB4A010437954B43887820E8A89E577C"><enum>(B)</enum><text>the State’s process for determining in a timely manner whether such an individual satisfies the cooperation requirement described in subparagraph (A) due to the individual’s participation in another State or Federal assistance program;</text>
 </subparagraph><subparagraph id="HCFBFCB4FB43B446393C27BBC85F5023F"><enum>(C)</enum><text display-inline="yes-display-inline">the good cause or other exceptions to the cooperation requirement that the State recognizes, including an explanation of any special requirements or considerations for an older relative caretaker seeking to apply for such an exception; and</text>
 </subparagraph><subparagraph id="HDCE5E3646F5D49DC96FBB21F21F76AA3"><enum>(D)</enum><text display-inline="yes-display-inline">how the State makes clear to an individual who has applied for or is receiving assistance under a program referred to in subparagraph (A)—</text>
 <clause id="H084E507BD8F244C199B7CD9370A96712"><enum>(i)</enum><text>what, if anything, the individual needs to do in order to satisfy the cooperation requirement, including explaining to the individual how the individual might satisfy the requirement through participation in another State or Federal assistance program;</text>
 </clause><clause id="HBB821FC80BB041CE9C6D28F3AE21C27A"><enum>(ii)</enum><text display-inline="yes-display-inline">the effect on the individual’s eligibility to receive assistance under a program referred to in subparagraph (A), and under other State or Federal assistance programs, if the individual fails to satisfy the cooperation requirement; and</text>
 </clause><clause id="HDFE70932F114448AA16BA4A9C144AA55"><enum>(iii)</enum><text>the good cause or other exceptions to the cooperation requirement for which the individual may be eligible, including the standard of proof required to qualify for each exception and an explanation of any special requirements or considerations for older caretaker relatives;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H2BAA9A0BD35E46EDA9D4B08A1753654D"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.) is amended—</text> <paragraph id="H48177D9D19E1401EBC75A479DBB54A92"><enum>(1)</enum><text>in section 452(k)(1), by striking <quote>section 454(31)</quote> and inserting <quote>section 454(32)</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC60022BB689C4BFEB6DB5EC70DD63253"><enum>(2)</enum><text>in section 454, in the matter following paragraph (35) (as redesignated by subsection (a)) by striking <quote>paragraph (33)</quote> and inserting <quote>paragraph (34)</quote>.</text>
 </paragraph></subsection><subsection id="H075D87B53D6C4E989345948C3802816B"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of enactment of this Act.</text>
			</subsection></section><section id="HB32C61D8E4DA4338ACE77CE289352AC7"><enum>5.</enum><header>Encouraging States to adopt temporary guardianship laws</header>
 <subsection id="H465DFACE5EC14BC186844893A35F0B5D"><enum>(a)</enum><header>In general</header><text>Section 474(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/674">42 U.S.C. 674(a)(7)</external-xref>) is amended by inserting <quote>(or, in the case of a State that has in effect for the quarter a temporary guardianship law (as defined in section 475(14)), 75 percent)</quote> after <quote>50 percent</quote>.</text>
 </subsection><subsection id="H0EC132FA5B7148519EE2F9103EBD4B05"><enum>(b)</enum><header>Definition</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended by adding at the end the following new paragraph:</text>

					<paragraph id="HB029911C9BC847EE91A66EAA8AD9A0C4" indent="up1"><enum>(14)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H500FB79DBE2542F1801559BD3080896C"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>temporary guardianship law</term> means a State law that allows for the establishment, by operation of such law and through an easily navigable simple civil process of a relationship between a child and a nonparent caretaker who has taken responsibility for caring for the child in the absence of the child's parents in which some of the parental rights with respect to the child are transferred to the caretaker for a specified period of time which may be extended or renewed, except that the total period of time for which such rights are transferred to the caretaker (including any extensions or renewals) shall not exceed a maximum period of time (as established by the State).</text>
 </subparagraph><subparagraph id="HC00AA662EE0941EA9BB0E473D74756A3" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Under the process established under a law described in subparagraph (A)—</text> <clause id="H86CE176554EE4731AA296113929ADBFD"><enum>(i)</enum><text display-inline="yes-display-inline">court fees shall be waived or reduced; and</text>
 </clause><clause id="HC9D0BF5626E141F583D9A2AB5A527A9B"><enum>(ii)</enum><text display-inline="yes-display-inline">any court forms or filings related to the process are easy enough to understand that a nonparent caretaker who has taken responsibility for caring for the child in the absence of the child's parents could reasonably complete such forms or filings without legal assistance.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H0E8EF91D8DF743989C78EC8A7883AE51"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of enactment of this Act.</text>
			</subsection></section><section id="H8D3C91446D4D4F8D9C942E2F08C41B40"><enum>6.</enum><header>Guidance</header>
 <subsection id="HE4348BEBF0DF4DDF8227ED98C9F3EB7C"><enum>(a)</enum><header>Guidance to States on ensuring awareness of child welfare system among kinship caregivers</header><text display-inline="yes-display-inline">Not later than the first day of the first fiscal year that begins after the date of enactment of this Act, the Secretary of Health and Human Services shall issue guidance to States on ways to ensure that kinship caregivers who receive assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.) or any other State program funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)(7)(B)(i)</external-xref>)) are—</text>
 <paragraph id="H18C5E92D4C274B778D03540470CF412B"><enum>(1)</enum><text>provided with information about any appropriate assistance and services available to them through the child welfare system of the State, including eligibility for foster care licensure and pathways to guardianship assitance programs or adoption subsidies, and how to access such assistance and services; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B2262EE1A154226984060876ACAD6B3"><enum>(2)</enum><text>referred to any kinship navigator program operated by the State.</text> </paragraph></subsection><subsection id="H7DC0A95DCC1640A8B1F6DEBB9E802880"><enum>(b)</enum><header>Guidance on coordinating assistance for caregivers</header><text>Not later than the first day of the first fiscal year that begins after the date of enactment of this Act, the Secretary of Health and Human Services shall issue guidance for States identifying options for State programs, including programs funded under title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.), programs funded under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001</external-xref> et seq.), and other relevant programs that are jointly funded or administered by States and the Federal Government, to collaborate, coordinate, and streamline outreach to, and processing of applications of assistance, for grandparents and older relative caregivers or kinship caregivers caring for grandchildren and other relative children residing with them.</text>
			</subsection></section><section id="HF8490C2AB2CF49E98E8BBF4777B86EC8"><enum>7.</enum><header>State support plans for grandparents caring for grandchildren</header>
 <subsection id="HF9704CFA0F8843D2A51672644BC67D25"><enum>(a)</enum><header>In general</header><text>Not later than the first day of the first fiscal year that begins after the date of enactment of this Act, from amounts appropriated to carry out this section, the Secretary of Health and Human Services shall award grants to States for purposes of developing State support plans for grandparents caring for grandchildren and other relatives caring for relative children.</text>
 </subsection><subsection id="HCCCABE5474354DA5A3E0C289EB5ECC56"><enum>(b)</enum><header>Requirements</header><text>A State support plan for grandparents caring for grandchildren and other relatives caring for relative children that is funded by a grant under this section shall include the following:</text>
 <paragraph id="H540DFFAF90014804A41427773851381D"><enum>(1)</enum><text>An initial assessment of the state of grandparents caring for grandchildren and other relatives caring for relative children in the State.</text>
 </paragraph><paragraph id="H3A4EDBC8F2D64B05B67DB0D812FF66D6"><enum>(2)</enum><text>A plan for how appropriate State agencies can collaborate in their efforts to provide financial support, housing services, and other services and supports to grandparents caring for grandchildren and other relatives caring for relative children.</text>
 </paragraph><paragraph id="H51329519E8D041668BCDD028816582FB"><enum>(3)</enum><text>Steps that the State proposes to take over the next 5 years to ensure that grandparents caring for grandchildren and other relatives caring for relative children have necessary resources.</text>
 </paragraph><paragraph id="H312B2A6810BB49BA90B7A28F91A83F39"><enum>(4)</enum><text>A plan to simplify or combine application requirements for State public assistance programs to reduce administrative burdens on recipients, with a focus on families consisting of grandparents or other older caretaker relatives raising relative children.</text>
 </paragraph></subsection><subsection id="HB184212FD91F4F3F91E68B3E5AB9F185"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $10,000,000 to carry out this section.</text> </subsection></section><section id="H80FA93945A5644019F08E2A99CE39890"><enum>8.</enum><header>National Technical Assistance Center on Grandfamilies</header> <subsection id="HB69FDE545C0A4302BEE6226E19E0BDFA"><enum>(a)</enum><header>In general</header><text>Not later than the first day of the first fiscal year that begins after the date of enactment of this Act, the Administrator of the Administration for Community Living shall establish a National Technical Assistance Center on Grandfamilies (in this section referred to as the <term>Center</term>) to conduct the activities described in subsection (b).</text>
 </subsection><subsection id="H83B07C748B81417F93584D89CE98FDB0"><enum>(b)</enum><header>Activities of center</header><text>The Center—</text> <paragraph id="H486FDF88949549519DAC7B222383FAB1"><enum>(1)</enum><text>shall engage experienced experts to identify model practices or programs, related to health, nutrition, housing, and other related issues, to help serve children, parents, and caregivers in grandfamilies;</text>
 </paragraph><paragraph id="H74E2E2ACBE594A668EE841E8455BB0C2"><enum>(2)</enum><text>may develop guidelines for States to encourage best practices to support grandfamilies impacted by parental substance use, including ways to help caregivers meet children’s health, development, and wellbeing needs (including promotion of safe sleep practices), support birth parents’ access, engagement, and success in treatment, support birth parents' formation of a healthy attachment with their children, and promote positive parenting (including co-parenting support) skills for both relative caregivers and birthparents; and</text>
 </paragraph><paragraph id="H125B00C7267F46FB8CB15D92FF9060DB"><enum>(3)</enum><text>may facilitate learning across States and provide technical assistance and resources to individuals and entities that directly work with all 3 generations in grandfamilies.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1E057210E9664BA8A083D96DD2BE86E2"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $5,000,000 to carry out this section.</text> </subsection></section></legis-body></bill>
