			 qualification for the Visa Waiver Program, and for other purposes.</official-title></form>
	<legis-body id="HDBF6C62C4A9D4944B1A7727705D2AE3C" style="OLC">
 <section id="HF370F550DE7B419FB48F0BF2EDD97AAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Allied Nations Travel Modernization Act of 2019</short-title></quote>.</text> </section><section id="HB2FA238D11414ABEBFBD676C32352B82"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
 <paragraph id="HF61E9749A312422EA970992D9ABD2641"><enum>(1)</enum><text>In 2016, 23 million people entered the United States under the Visa Waiver Program (VWP). Visitors through VWP constituted roughly <fraction>1/3</fraction> of all temporary visitors. According to the Department of Commerce, VWP travelers in fiscal year 2014 spent approximately $84 billion on goods and services.</text>
 </paragraph><paragraph id="H370E844378864FDC936FD01FB48112B6"><enum>(2)</enum><text>Due to the VWP, the U.S. Government saved from $1.9 billion to $3.2 billion for the cost of interviewing visitors in 2010.</text>
 </paragraph><paragraph id="HB805255EEF39468B9690BE0041D7F522"><enum>(3)</enum><text>All VWP countries are required to enter into information-sharing agreements with the United States on whether the citizens or nationals of that country traveling to the United States represent a security or criminal threat to the United States.</text>
 </paragraph><paragraph id="HEB403C04EBC742F28BB309B172515008"><enum>(4)</enum><text>VWP countries have provided the United States with information on more than 6,000 known or suspected terrorists as a result of VWP information sharing arrangements.</text>
 </paragraph><paragraph id="H1EDA56424E414DFB979BAA018460C0F9"><enum>(5)</enum><text>VWP countries have provided nearly 70 percent of the records in INTERPOL’s Stolen and Lost Travel Document Database, which DHS utilizes in its daily vetting of ESTA applications and Advance Passenger Information/Passenger Name Record data.</text>
 </paragraph><paragraph id="H33FB377CE69241C49218166E526D4CA3"><enum>(6)</enum><text>According to a Department of State FY 2018 annual report, the United States issued over 120,000 nonimmigrant visas to Polish nationals and over 50,000 nonimmigrant visas to Romanian nationals.</text>
 </paragraph><paragraph id="HA7CB7A416A0A46A7952AF1492266EDA4"><enum>(7)</enum><text>A Fiscal Year 2017 Report by the Department of Homeland Security found that the suspected in-country overstay rate was 1.17 percent for Poland and 1.19 percent for Romania.</text>
 </paragraph><paragraph id="H701A7B644D38439EABA94AB08512F1B8"><enum>(8)</enum><text>Poland has taken a serious stance against terrorism in recent years. This has included withdrawing from a refugee relocation plan by the EU after the 2015 Paris terror attacks.</text>
 </paragraph><paragraph id="H8BC9F1CCE05E4DB8BEC3060D6E74AC2D"><enum>(9)</enum><text>Romania deployed approximately 730 troops to Afghanistan and Iraq and has signed all twelve of the international protocols and conventions pertaining to terrorism.</text>
 </paragraph><paragraph id="H63A35B8A62584381978BE32C5D2AFAAE"><enum>(10)</enum><text>Congress should continue to promote the economy and provide government agencies with the necessary resources through the VWP. The inclusion of Poland and Romania in the VWP program would contribute to program goals.</text>
 </paragraph></section><section id="HA5F9E77C0B334334B7ADF9875556451D"><enum>3.</enum><header>Designation of program countries</header><text display-inline="no-display-inline">Section 217(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)</external-xref>) is amended—</text> <paragraph id="H3696C7447FB44BBC9BD74F08C090BE74"><enum>(1)</enum><text>in paragraph (2)(A)—</text>
 <subparagraph id="H389D0EEC74D04F4D87AD53F4F6E30B8D"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading for the subparagraph, by inserting after <quote><header-in-text level="subparagraph" style="OLC">Low nonimmigrant visa refusal rate</header-in-text></quote> the following: <quote><header-in-text level="subparagraph" style="OLC">; low visa overstay rate</header-in-text></quote>;</text> </subparagraph><subparagraph id="HB0DC302C5E3C4CBBA7645EE107D606F6"><enum>(B)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text>
 </subparagraph><subparagraph id="HFBF7FD826E67470E9CD399228D8464D2"><enum>(C)</enum><text>in clause (ii), by striking the period and inserting <quote>; or</quote>; and</text> </subparagraph><subparagraph id="HC2CAC643281E43169BCE2195BF036209"><enum>(D)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H20FC78CCF05C4A1D8A1C94B05BFCC619" style="OLC">
 <clause id="H2B23A57255124796A8828E19B545F16E"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of any other country—</text> <subclause id="H003F459905534A358AB124A27E9F0091"><enum>(I)</enum><text>the visa overstay rate (as such term is defined in paragraph (8)) for that country was not more than 2 percent during the previous 2 fiscal years;</text>
 </subclause><subclause id="HF50D4BD3FDB749128BA4773E09FBB607"><enum>(II)</enum><text display-inline="yes-display-inline">the country is a signatory to and has committed, during the previous two fiscal years, sufficient resources to support its obligations under the Wales Summit Declaration, issued at the meeting of the North Atlantic Council in Wales on September 5, 2014; and</text>
 </subclause><subclause id="H624C2583AB764276B90A5507EF0426B4"><enum>(III)</enum><text display-inline="yes-display-inline">the Department of State has not, in the previous fiscal year, issued a travel advisory other than <quote>exercise normal precautions</quote> for travel to the country.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H472B42C08D8E4C31B036DC1B49613E94"><enum>(2)</enum><text>in paragraph (3), to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1E7FD090FC424D269B32D62047CD90D0" style="OLC">
 <paragraph id="H032FF7254678419E8BDD804AD79F1162"><enum>(3)</enum><header>Continuing and subsequent qualifications</header><text display-inline="yes-display-inline">For each fiscal year after the initial period—</text> <subparagraph id="H7BCABAC78AE2459186547B17EB4EC44D"><enum>(A)</enum><header>Continuing qualification</header><text>In the case of a country which was a program country in the previous fiscal year, a country may not be designated as a program country unless—</text>
 <clause id="H8270BE75E5964C7887A72D14D6167C92"><enum>(i)</enum><text>the sum of—</text> <subclause id="H9CF5D7A4F6764F5FABD409C105BDF0F0"><enum>(I)</enum><text>the total of the number of nationals of that country who were denied admission at the time of arrival or withdrew their application for admission during such previous fiscal year as a nonimmigrant visitor, and</text>
 </subclause><subclause id="H1190361B51E844E7A96758C5291518CF"><enum>(II)</enum><text>the total number of nationals of that country who were admitted as nonimmigrant visitors during such previous fiscal year and who violated the terms of such admission,</text>
								</subclause><continuation-text continuation-text-level="clause">was less than 2 percent of the total number of nationals of that country who applied for admission
 as nonimmigrant visitors during such previous fiscal year; or</continuation-text></clause><clause id="HFDF55203213445ED9F2F75EDC7910DE0"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of that country—</text> <subclause id="H624B568D0E3F482982DE815A2664D5F6"><enum>(I)</enum><text>the visa overstay rate (as such term is defined in paragraph (8)) for that country was not more than 2 percent during the previous 2 fiscal years;</text>
 </subclause><subclause id="H9E53E511C2C5417D8AD897B06AAB23EC"><enum>(II)</enum><text display-inline="yes-display-inline">the country is a signatory to and has committed, during the previous two fiscal years, sufficient resources to support its obligations under the Wales Summit Declaration, issued at the meeting of the North Atlantic Council in Wales on September 5, 2014; and</text>
 </subclause><subclause id="H0E6E98595AB540AABCB13EF57B8D8A04"><enum>(III)</enum><text display-inline="yes-display-inline">the Department of State has not, in the previous fiscal year, issued a travel advisory other than <quote>exercise normal precautions</quote> for travel to the country.</text> </subclause></clause></subparagraph><subparagraph id="H675FC1E47A9343028C6C8E6E827B3F37"><enum>(B)</enum><header>New countries</header><text>In the case of another country, the country may not be designated as a program country unless one of the following requirements under clause (i) or (ii) is met:</text>
 <clause id="H745A8ABC4B954AED8E97E23D59E42C4C"><enum>(i)</enum><header>Low nonimmigrant visa refusal rate</header><text display-inline="yes-display-inline">The average number of refusals of nonimmigrant visitor visas for nationals of that country—</text> <subclause id="H42D0AA512D9A4F29AD0AA0FAEBE23DA4"><enum>(I)</enum><text>during the two previous full fiscal years was less than 2 percent of the total number of nonimmigrant visitor visas for nationals of that country which were granted or refused during those years; and</text>
 </subclause><subclause id="HC16DFB1A4BBC4EBC98677E1D2AD8E441"><enum>(II)</enum><text>during either of such two previous full fiscal years was less than 2.5 percent of the total number of nonimmigrant visitor visas for nationals of that country which were granted or refused during that year.</text>
 </subclause></clause><clause id="H3D84ED51200D4B2EB774665186479776"><enum>(ii)</enum><header>Low visa overstay rate</header><text display-inline="yes-display-inline">In the case of that country—</text> <subclause id="HA34B9F59120D4E9CA267452CE11B234B"><enum>(I)</enum><text>the visa overstay rate (as such term is defined in paragraph (8)) for that country was not more than 2 percent during the previous 2 fiscal years;</text>
 </subclause><subclause id="H097D07919DAC46929D3168ACED102047"><enum>(II)</enum><text display-inline="yes-display-inline">the country is a signatory to and has committed, during the previous two fiscal years, sufficient resources to support its obligations under the Wales Summit Declaration, issued at the meeting of the North Atlantic Council in Wales on September 5, 2014; and</text>
 </subclause><subclause id="HB171FA60FFDB4CE4A19AB73F357DD31A"><enum>(III)</enum><text display-inline="yes-display-inline">the Department of State has not, in the previous fiscal year, issued a travel advisory other than <quote>exercise normal precautions</quote> for travel to the country.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" id="H7759D1735D5C42CDA02A285445D5CD91"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act may be construed to require or direct the termination of the designation of a country as a program country under section 217 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187</external-xref>).</text>
