			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To decriminalize marijuana, and for other purposes.</official-title></form>

 <section id="HA9F000EF8B6746BFA37CE3E18732D398" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marijuana Freedom and Opportunity Act</short-title></quote>.</text> </section><section id="HEB43DCFA2BC5488CBC84D1C52C4001FB"><enum>2.</enum><header>Decriminalization of marijuana</header> <subsection id="H61F72871D649481EAB25F82EA3E98104"><enum>(a)</enum><header>Marihuana removed from schedule of controlled substances</header><text>Subsection (c) of schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>) is amended—</text>
 <paragraph id="H76ABE8C5D3F6426C99B2967751EBCC75"><enum>(1)</enum><text>by striking <quote>marihuana</quote>; and</text> </paragraph><paragraph id="H1F4A3877687843768C504F0BC01B3A5D"><enum>(2)</enum><text>by striking <quote>tetrahydrocannabinols</quote>.</text>
 </paragraph></subsection><subsection id="HB125921EB8934A9196163B793039999D"><enum>(b)</enum><header>Removal of prohibition on import and export</header><text>Section 1010(b) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text> <paragraph id="H427C89EF3A4D405D804C321391C565E4"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="H714DD8030AFB4700886B9A0F929A1869"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>or</quote> after the semicolon;</text> </subparagraph><subparagraph id="H4565A772A98042268EE910056317E68A"><enum>(B)</enum><text>by striking subparagraph (G); and</text>
 </subparagraph><subparagraph id="HDECB8C7B77974512B72666886B95D1BA"><enum>(C)</enum><text>by redesignating subparagraph (H) as subparagraph (G);</text> </subparagraph></paragraph><paragraph id="H57045D440C6E419EB5885D5E74CFDCC4"><enum>(2)</enum><text>in paragraph (2)—</text>

 </paragraph></subsection><subsection id="H7C20D415FF6C4F72A8BBA0B9AE521EC8"><enum>(c)</enum><header>Conforming amendments to controlled substances act</header><text>The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended—</text> <paragraph id="HF47EE5E1B2064D7BB3061A6FF85729DE"><enum>(1)</enum><text>in section 102(44) (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>), by striking <quote>marihuana,</quote>;</text>
 </paragraph><paragraph id="H13D364A200B747AC8C20E60DE3556BF1"><enum>(2)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>)—</text> <subparagraph id="HAB07721A60A04DB08F24B2A8A919CAF5"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H31BC1C18E90F4493A6CF6F68E103165A"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="H947CA643755B4E9CBAB4C50C48B90C0A"><enum>(I)</enum><text>in clause (vi), by inserting <quote>or</quote> after the semicolon;</text>

 </paragraph><paragraph id="HAC11222BE0CC4E6C99E901DBCDC19017"><enum>(6)</enum><text>in section 419(a) (<external-xref legal-doc="usc" parsable-cite="usc/21/860">21 U.S.C. 860(a)</external-xref>), by striking the last sentence;</text> </paragraph><paragraph id="HEA22D8C4E67A47138E897430732BA387"><enum>(7)</enum><text>in section 422(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863(d)</external-xref>)—</text>
 <subparagraph id="H7A286A1349A44AEE8635503831991EC5"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>marijuana,</quote>; and</text> </subparagraph><subparagraph id="H925E473FF5654EDFB384D88D4E5FDF8E"><enum>(B)</enum><text>in paragraph (5), by striking <quote>, such as a marihuana cigarette,</quote>; and</text>
 </subparagraph></paragraph><paragraph id="HB9A6304D66B644D4BE32DAF91CDF33C5"><enum>(8)</enum><text>in section 516(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/886">21 U.S.C. 886(d)</external-xref>), by striking <quote>section 401(b)(6)</quote> each place the term appears and inserting <quote>section 401(b)(5)</quote>.</text> </paragraph></subsection><subsection id="H3C97ED4CF493419583040A1ECD609EB3"><enum>(d)</enum><header>Other conforming amendments</header> <paragraph id="H9FC93A5C2796468D885CFA5BF918E68F"><enum>(1)</enum><header>National forest system drug control act of 1986</header><text>The National Forest System Drug Control Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b</external-xref> et seq.) is amended—</text>
 <subparagraph id="HD00DDF6CA00A4E5B99E90A1641E7A8D6"><enum>(A)</enum><text>in section 15002(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b(a)</external-xref>) by striking <quote>marijuana and other</quote>;</text> </subparagraph><subparagraph id="H81408BF8B2B34CEE829299BE80E60295"><enum>(B)</enum><text>in section 15003(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559c">16 U.S.C. 559c(2)</external-xref>) by striking <quote>marijuana and other</quote>; and</text>
 </subparagraph><subparagraph id="H18A755139FD4496C8D85E77CB66957D3"><enum>(C)</enum><text>in section 15004(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559d">16 U.S.C. 559d(2)</external-xref>) by striking <quote>marijuana and other</quote>.</text> </subparagraph></paragraph><paragraph id="H210F611D901E4A6BA5487BEB495207B9"><enum>(2)</enum><header>Interception of communications</header><text>Section 2516 of title 18, United States Code, is amended—</text>
 <subparagraph id="HDDA2AE0CA3D64A868AA0094D4999840A"><enum>(A)</enum><text>in subsection (1)(e), by striking <quote>marihuana,</quote>; and</text> </subparagraph><subparagraph id="H10CDCBF5A02E4A219655F9E90F52245A"><enum>(B)</enum><text>in subsection (2) by striking <quote>marihuana,</quote>.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="HE6B50F940F2C4A2A8ADD06E5CBE98A60"><enum>3.</enum><header>Level the economic playing field</header>
 <subsection commented="no" id="HB08F8A51F64F466CBB9C14D4801AB2D6"><enum>(a)</enum><header>Estimate</header><text display-inline="yes-display-inline">On an annual basis, the Secretary of the Treasury shall make a reasonable estimate of total tax revenue generated by the marijuana industry for the previous 12-month period.</text>
 </subsection><subsection commented="no" id="H38FDB53C90D8484DABE5C2722F985A1D"><enum>(b)</enum><header>Transfer</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall transfer from the general fund of the Treasury to the trust fund established under subsection (c) the greater of—</text>
 <paragraph commented="no" id="H2041FB7A8C544EA2A8E0C449849FFDEB"><enum>(1)</enum><text display-inline="yes-display-inline">an amount equal to 10 percent of the amount estimated under subsection (a); and</text> </paragraph><paragraph commented="no" id="H4202035C45C244A0B873EB439FF8A2E3"><enum>(2)</enum><text display-inline="yes-display-inline">$10,000,000.</text>
				</paragraph></subsection><subsection id="H4E87389F9FBC45B1A656A1842DDC832F"><enum>(c)</enum><header>Trust fund</header>
 <paragraph id="HF3584AACEB604821AB0C3EE14A12FAE9"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a trust fund to be known as the Marijuana Opportunity Trust Fund, which shall consist of amounts transferred under subsection (b).</text>
 </paragraph><paragraph id="HE5BC4B6F0862443F9F834A08677B7E0D"><enum>(2)</enum><header>Use of amounts</header><text>Amounts in the trust fund established under paragraph (1) shall be made available to the Administrator of the Small Business Administration to provide loans under section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>) to assist—</text>
 <subparagraph id="H7DA9B171871245B5963512E98038807B"><enum>(A)</enum><text>small business concerns owned and controlled by women, as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>), that operate in the marijuana industry; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H720E25658EB5401DBC197F596616BAB2"><enum>(B)</enum><text>small business concerns owned and controlled by socially and economically disadvantaged individuals, as defined in section 8(d)(3)(C) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(3)(C)</external-xref>), that operate in the marijuana industry.</text>
					</subparagraph></paragraph></subsection></section><section id="H4453531DE71E4078A2242D7CDF653424"><enum>4.</enum><header>Highway safety research</header>
 <subsection id="H4F331EC2B5E044C1970200089618CFB6"><enum>(a)</enum><header>Study; development</header><text>The Administrator of the National Highway Traffic Safety Administration (referred to in this section as the <quote>Administrator</quote>) shall—</text>
 <paragraph id="H06BF3BDA56FA47B3A8BB0013F15C0131"><enum>(1)</enum><text>carry out a study of the impact of driving under the influence of tetrahydrocannabinol on highway safety; and</text>
 </paragraph><paragraph id="H6C7008B35C864DB39F88C99E9FB2933B"><enum>(2)</enum><text>develop enhanced strategies and procedures to reliably determine the impairment of a driver under the influence of tetrahydrocannabinol.</text>
 </paragraph></subsection><subsection id="HF46938C61BF84F3B9BD67BC1ECDEF13A"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this section $50,000,000 for each of fiscal years 2020 through 2024.</text>
			</subsection></section><section id="HC128E037CBE04F7AB79454E15A4E9959"><enum>5.</enum><header>Public health research</header>
 <subsection id="H66116AF3FF92453DAEBCB1E0E2130607"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services, in consultation with the Director of the National Institutes of Health and the Commissioner of Food and Drugs, shall conduct research on the impacts of marijuana, including—</text>
 <paragraph id="H922781DD122142F1B071CC1E4CA2E103"><enum>(1)</enum><text>effects of tetrahydrocannabinol on the human brain;</text> </paragraph><paragraph id="HC1735D7544EF40F69C69ACD5213B06B6"><enum>(2)</enum><text>efficacy of medicinal marijuana as a treatment for specific diseases and conditions; and</text>
 </paragraph><paragraph id="HF7E62EAD5F4F4995A7F2601E0B3501CA"><enum>(3)</enum><text>identification of additional medical benefits and uses of cannabis.</text> </paragraph></subsection><subsection id="HA9E724FA2ADB41C3B4F3B3DE5616B570"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Health and Human Services, $100,000,000 for each of fiscal years 2020 through 2024, for purposes of carrying out the activities described in subsection (a).</text>
 </subsection></section><section id="H184925B85592432E9F6CF99F3CBA6C49"><enum>6.</enum><header>Protect kids</header><text display-inline="no-display-inline">The Alcohol and Tobacco Tax and Trade Bureau of the Department of the Treasury shall promulgate regulations that—</text>
 <paragraph id="H1DF1693B700B44CDB951BB8B1DC8739C"><enum>(1)</enum><text>require restrictions on the advertising and promotion of products related to marijuana, if the Secretary determines that such regulation would be appropriate for the protection of the public health, taking into account—</text>
 <subparagraph id="H21BF36C11BFC4C89AF228F1C4D95620C"><enum>(A)</enum><text>the risks and benefits to the population of individuals age 18 and under, including users and nonusers of marijuana products;</text>
 </subparagraph><subparagraph id="H70AEF7340E9142269E064B6BB53F399D"><enum>(B)</enum><text>the increased or decreased likelihood that existing users of marijuana products who are age 18 and under will stop using such products; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H53108C688A484EB1899C514D391AC2AA"><enum>(C)</enum><text>the increased or decreased likelihood that those age 18 and under who do not use marijuana products will start using such products; and</text>
 </subparagraph></paragraph><paragraph id="H66E566E4C4994250B0F71291021FC034"><enum>(2)</enum><text>impose restrictions on the advertising and promotion of products related to marijuana consistent with and to the full extent permitted by the First Amendment to the Constitution of the United States.</text>
 </paragraph></section><section id="HCA82115D87094D57B66B5D3F1000B987"><enum>7.</enum><header>Grants for expungement of marijuana convictions</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Attorney General to award grants to States and units of local government for the purpose of administering, expanding, or developing expungement or sealing programs for convictions of possession of marijuana $20,000,000 for each of fiscal years 2020 through 2024 with not less than 50 percent of those funds being directed to cover the cost of public defenders or legal aid providers.</text>
 </section><section id="HAC7FD344F86C43189F446B2C9BB5CFBA"><enum>8.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or an amendment made by this Act, may be construed to modify the authority of the Federal Government to prevent marijuana trafficking from States that have legalized marijuana to those that have not.</text>
