 <section id="H6B879504A5C342E482A04A914D87E25D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Labor Personnel on Farms Act</short-title></quote> or the <quote><short-title>HELP Farms Act</short-title></quote>.</text> </section><section id="H1B7E3F16830D49C8A4EDE251EC2A0C12"><enum>2.</enum><header>Temporary resident status and employment authorization for certain non-seasonal agricultural workers</header> <subsection id="HBFBD4C276857452485689DDBF29132AC"><enum>(a)</enum><header>In general</header> <paragraph id="HB00F8E0349C244A68FFA3C32AF8E1CC6"><enum>(1)</enum><header>Treatment of principal aliens</header><text>In the case of an alien described in subsection (b) who satisfies the requirements of subsection (c) and is not ineligible under subsection (e), the Secretary of Homeland Security, in consultation with the Secretary of Labor and the Secretary of State, shall—</text>
 <subparagraph id="H669658DACD3B47FCBF224930A05FB079"><enum>(A)</enum><text display-inline="yes-display-inline">adjust the status of the alien to that of an alien lawfully admitted for temporary residence for a two-year period not subject to renewal, and issue documentary evidence of such temporary resident status;</text>
 </subparagraph><subparagraph id="HB99D027D58574BC385368C9E48264DFD"><enum>(B)</enum><text display-inline="yes-display-inline">grant the alien authorization to engage in employment in the United States during such two-year period in an agricultural labor or services occupation not of a seasonal nature; and</text>
 </subparagraph><subparagraph id="HBC289667BBC74ADF9E891FDD68CA6B2F"><enum>(C)</enum><text>provide the alien an <quote>employment authorized</quote> endorsement or other appropriate work permit valid during such two-year period.</text> </subparagraph></paragraph><paragraph id="HEDD247C34FBB494DBB5D3C85D4313A1D"><enum>(2)</enum><header>Treatment of spouses and children</header><text>A spouse or unmarried child under 21 years of age of a principal alien who is included in an application under subsection (c)(1) and is not ineligible under subsection (e) shall be eligible for the same temporary resident status (and documentation of such status) as is granted to the principal alien.</text>
				</paragraph></subsection><subsection id="H79B087D0AE0149EB88080F6ADA3301DC"><enum>(b)</enum><header>Aliens described</header>
 <paragraph id="HE1963E3AF8BD4480B6E5CFDDD28BC66D"><enum>(1)</enum><header>In general</header><text>An alien is described in this subsection if the alien—</text> <subparagraph id="HEC6F812CA77B4A5D915FF94F8DFBD9A4"><enum>(A)</enum><text display-inline="yes-display-inline">during the preceding calendar year, was considered a United States resident for purposes of the Internal Revenue Code of 1986;</text>
 </subparagraph><subparagraph id="HDEF5FAD648304FF4A67B6EC5CF42F3C5"><enum>(B)</enum><text display-inline="yes-display-inline">does not qualify for status under section 101(a)(15)(H)(ii)(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(a)</external-xref>); and</text>
 </subparagraph><subparagraph id="H8835971435084F32BF20735B48AEA6A9"><enum>(C)</enum><text>is, and during the 2-year period preceding the date of the filing of the application under subsection (c) has been, employed by the sponsoring employer described in subsection(c)(2) in an agricultural labor or services occupation not of a seasonal nature.</text>
 </subparagraph></paragraph><paragraph id="H8573444FCD5344AEB8E4D89027162935"><enum>(2)</enum><header>Definition</header><text>For purposes of this section, the term <quote>agricultural labor or services</quote> includes—</text> <subparagraph id="HCBEC627B90994F74AC016EBC72A61843"><enum>(A)</enum><text display-inline="yes-display-inline">agricultural labor as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(g)</external-xref> of the Internal Revenue Code of 1986;</text>
 </subparagraph><subparagraph id="H61201A494C6143929A105B0A3526BECC"><enum>(B)</enum><text>agriculture as defined in section 3(f) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(f)</external-xref>);</text> </subparagraph><subparagraph id="H4DE3EF945171460BB598C93C207303F1"><enum>(C)</enum><text>all activities required for the preparation, processing or manufacturing of a product of agriculture (as such term is defined in such section 3(f)), or fish or shellfish, for further distribution;</text>
 </subparagraph><subparagraph id="H6FD43BD8C2A04C5CB4B5A79C7CA47BA8"><enum>(D)</enum><text>the handling, planting, drying, packing, packaging, processing, freezing, or grading prior to delivery for storage of any agricultural or horticultural commodity in its unmanufactured state;</text>
 </subparagraph><subparagraph id="H14387F75A05847C2BB27839D0C0EE335"><enum>(E)</enum><text>dairy cattle and milk production;</text> </subparagraph><subparagraph id="H7FC59AB9446F458483AF7A604C134A44"><enum>(F)</enum><text display-inline="yes-display-inline">range production of livestock;</text>
 </subparagraph><subparagraph id="HA3874E87495D4C7494BA99CD3E302E20"><enum>(G)</enum><text>sheep herding or goat herding;</text> </subparagraph><subparagraph id="HA5D6838D17FD4EF3907751DCEEDE85D9"><enum>(H)</enum><text display-inline="yes-display-inline">commercial beekeeping and pollination;</text>
 </subparagraph><subparagraph id="HB3529A7C0A44419D9F815B04CDF20889"><enum>(I)</enum><text>animal shearing;</text> </subparagraph><subparagraph id="H33F03F01AFDF4C528A502C9812384346"><enum>(J)</enum><text display-inline="yes-display-inline">the killing of animals for meat or poultry processing and the breakdown of their carcasses; and</text>
 </subparagraph><subparagraph id="HDA855B02C4DA42D3AA6CB53583C9F61B"><enum>(K)</enum><text display-inline="yes-display-inline">activities related to the management and training of equines.</text> </subparagraph></paragraph></subsection><subsection id="H94639A216131480FABF402FAF5123D85"><enum>(c)</enum><header>Application requirements</header> <paragraph id="HC4877AB616364C1DB220661F79B7FBFB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An alien shall apply for adjustment of status and work authorization under this section during the 6-month period beginning on the date of the enactment of this Act. The application shall collect such information as the Secretary of Homeland Security determines necessary and appropriate. The Secretary shall establish a process through which an alien may submit a single application under this section on behalf of the alien and the alien’s eligible spouse and children.</text>
				</paragraph><paragraph id="H35489C8BB5F94B52A5BB3F7AA87B11C9"><enum>(2)</enum><header>Sponsoring employer</header>
 <subparagraph id="HCA07357C3A994D99965D5822EF1F92C5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An application under paragraph (1) shall be accompanied by an attestation from the alien’s employer that the alien continuously has been employed by the employer in an agricultural labor or services occupation not of a seasonal nature during the 2-year period preceding the date of the filing of the application.</text>
					</subparagraph><subparagraph id="HB402DFFECBAE483FAEF68F0D2E3AE1EB"><enum>(B)</enum><header>Employer protections</header>
 <clause id="HB43D31CB0E8146D094EDE107B46DDEB8"><enum>(i)</enum><header>Use of employment records</header><text>Copies of employment records or other evidence of employment provided by an alien or by an alien’s employer in support of an alien’s application under paragraph (1) may not be used in a civil or criminal prosecution or investigation of that employer under section 274A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref>) or under the Internal Revenue Code of 1986 for the prior unlawful employment of that alien regardless of the adjudication of such application or reconsideration by the Secretary of Homeland Security of such alien's prima facie eligibility determination. Employers that provide unauthorized aliens with copies of employment records or other evidence of employment pursuant to an application under paragraph (1) shall not be subject to civil and criminal liability pursuant to such section 274A for employing such unauthorized aliens.</text>
 </clause><clause id="H9DE2FE13B2BF40B3B639F1CCF9E91977"><enum>(ii)</enum><header>Limit on applicability</header><text>The protections for employers and aliens under clause (i) shall not apply if the aliens or employers submit employment records that are determined to be fraudulent.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H31A0105E4C43485DB077C672DD1BD07B"><enum>(d)</enum><header>Special rules for applicants</header>
 <paragraph id="H0610EC30BB2F4A57BA3E2D14C5199323"><enum>(1)</enum><header>Documentation</header><text>Upon the filing of an application under subsection (c)(1), the Secretary of Homeland Security shall furnish the applicant or applicants with documentation of status as an applicant under this section.</text>
 </paragraph><paragraph id="H78BC73F25D7F44B7B72344E5D3492AF5"><enum>(2)</enum><header>Aliens apprehended before or during the application period</header><text display-inline="yes-display-inline">If an alien who is apprehended during the period beginning on the date of the enactment of this Act and ending on the last day of the application period described in subsection (c)(1) appears prima facie eligible for temporary resident status under this section, the Secretary of Homeland Security—</text>
 <subparagraph id="HB967AD44468745A3BE7E866321FF28D2"><enum>(A)</enum><text>shall provide the alien with a reasonable opportunity to submit an application for such status under this section during such period; and</text>
 </subparagraph><subparagraph id="HF6F5AF9AC7914D4D9277832CD87BFA18"><enum>(B)</enum><text>if such an application is submitted, may not remove the individual until a final administrative determination is made on such application.</text>
 </subparagraph></paragraph><paragraph id="H8D43504E586E4954A45A9060C4902B4E"><enum>(3)</enum><header>Aliens in removal proceedings</header><text display-inline="yes-display-inline">Notwithstanding any other provision of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) if an alien is in removal, deportation, or exclusion proceedings during the period beginning on the date of the enactment of this Act and ending on the last day of the application period described in subsection (c)(1) and is prima facie eligible for temporary resident status under this section, upon motion by the Secretary of Homeland Security and with the consent of the alien or upon motion by the alien, the Executive Office for Immigration Review shall—</text>
 <subparagraph id="HEB82B121499B42D9844F7C7918FC80F0"><enum>(A)</enum><text>terminate such proceedings without prejudice to future proceedings; and</text> </subparagraph><subparagraph id="H493073CF2C8F4D20ABB9E5C7F1B87F5D"><enum>(B)</enum><text>permit the alien a reasonable opportunity to apply for such status.</text>
 </subparagraph></paragraph><paragraph id="H1895343A079642CFB86E0CEC8E64687E"><enum>(4)</enum><header>Period pending adjudication of application</header><text display-inline="yes-display-inline">During the period beginning on the date on which an alien applies for temporary resident status under this section and ending on the date on which the Secretary of Homeland Security makes a final decision regarding such application, the alien—</text>
 <subparagraph id="HD552EF3B174A4E3CB1C0E46852156A78"><enum>(A)</enum><text>is eligible to apply for advance parole;</text> </subparagraph><subparagraph id="HF7B6E46533E64BC7AFA2615AE307B08C"><enum>(B)</enum><text>may not be detained by the Secretary or Homeland Security or removed from the United States unless the Secretary makes a prima facie determination that such alien is, or has become, ineligible for temporary resident status;</text>
 </subparagraph><subparagraph id="H0E45839F6B54420E91431847065369D9"><enum>(C)</enum><text>shall not be considered unlawfully present under section 212(a)(9)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(B)</external-xref>); and</text>
 </subparagraph><subparagraph id="H9ADF69F182B54E56958456C9E516CE1B"><enum>(D)</enum><text>shall not be considered an unauthorized alien (as defined in section 274A(h)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)(3)</external-xref>)).</text>
					</subparagraph></paragraph></subsection><subsection id="H83FBDBB7F9CB41CFAB1920863233E792"><enum>(e)</enum><header>Ineligible aliens</header>
 <paragraph id="H757167656F854F029E199EF58DF661FB"><enum>(1)</enum><header>In general</header><text>An alien shall be ineligible for adjustment of status and work authorization under this section if the Secretary of Homeland Security determines that—</text>
					<subparagraph display-inline="no-display-inline" id="HC0B80B887FAC4129AE1F308CF4B300B0">
						<enum>(A)</enum>
 <text>the alien ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion;</text>
					</subparagraph><subparagraph id="H12A8CB45EDFC45E599CD49D613C63104">
						<enum>(B)</enum>
 <text>the alien has been convicted in the United States by a final judgment of a particularly serious crime (as defined in paragraph (2));</text>
					</subparagraph><subparagraph id="HE7DFEF01B251429C8B4400708641C4E4">
						<enum>(C)</enum>
 <text>there are serious reasons for believing that the alien has committed a serious nonpolitical crime outside the United States prior to the arrival of the alien in the United States;</text>
					</subparagraph><subparagraph id="HC098EEC77A974E8998708EB75FB97B4E">
						<enum>(D)</enum>
 <text>there are reasonable grounds for regarding the alien as a danger to the security of the United States;</text>
					</subparagraph><subparagraph id="H88D11AF18F82449A99EBE60A3BEFA4CD">
						<enum>(E)</enum>
 <text>the alien is described in subclause (I), (II), (III), (IV), or (VI) of section 212(a)(3)(B)(i) or section 237(a)(4)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) (relating to terrorist activity), unless, in the case only of an alien inadmissible under subclause (IV) of section 212(a)(3)(B)(i) of such Act, the Secretary of Homeland Security determines, in the Secretary's discretion, that there are not reasonable grounds for regarding the alien as a danger to the security of the United States; or</text>
 </subparagraph><subparagraph id="HF3A0C8661FD54EF6948FEFAC4980CACF"><enum>(F)</enum><text>the alien has not satisfied all Federal, State, and local tax liabilities.</text> </subparagraph></paragraph><paragraph id="H02521EFE2D6A4BC49A801BA59138B87C"><enum>(2)</enum><header>Definition</header><text>For purposes of paragraph (1)(B), an alien who has been convicted of the following shall be considered to have been convicted of a particularly serious crime:</text>
 <subparagraph id="H4574491BC95447BCA612C6089CE2D972"><enum>(A)</enum><text>A felony for which the alien was sentenced to a term of imprisonment of not less than 60 months.</text> </subparagraph><subparagraph id="HD6224C9F2C344AD78DC5411CE82E6BFC"><enum>(B)</enum><text>Murder, rape, kidnapping, or a felony offense described in chapter 77 (relating to peonage and slavery) or 113B (relating to terrorism) of title 18, United States Code.</text>
 </subparagraph><subparagraph id="H2E4D141625A14D09A1FF7F4157642D1B"><enum>(C)</enum><text>Three or more felonies of any kind.</text> </subparagraph></paragraph><paragraph id="HD707D415DB894853AE4C09A622EA1B7D"><enum>(3)</enum><header>Termination of benefits</header><text>Temporary resident status and work authorization granted under this section shall be terminated if the Secretary of Homeland Security determines that the alien—</text>
 <subparagraph id="HDC989FEEF3BE4B86A660E2E5DE94ED63"><enum>(A)</enum><text>meets a condition described in paragraph (1); or</text> </subparagraph><subparagraph id="H55CC4B4BA3114E9B8BFD2C0CB99B397C"><enum>(B)</enum><text display-inline="yes-display-inline">is not employed in an agricultural labor or services occupation not of a seasonal nature.</text>
 </subparagraph></paragraph></subsection><subsection id="H1EA285B4C27045E0ACBBF62C4FDD9B0D"><enum>(f)</enum><header>Documentation features</header><text display-inline="yes-display-inline">Documentary evidence of temporary resident status provided under this section shall—</text> <paragraph id="HFDE9DD6FC0134C16B0377391904F6D3F"><enum>(1)</enum><text>be machine-readable and tamper-resistant;</text>
 </paragraph><paragraph id="H606769615F8842C1BD3786853B812D78"><enum>(2)</enum><text>contain a digitized photograph;</text> </paragraph><paragraph id="H8D14611186014CF0BF38CF83540F0492"><enum>(3)</enum><text>during the alien’s authorized period of admission, serve as a valid travel and entry document for the purpose of applying for admission to the United States; and</text>
 </paragraph><paragraph id="H77B13ACCADB54F0CB9FA8C2D00755998"><enum>(4)</enum><text>include such other features and information as the Secretary of Homeland Security may prescribe.</text> </paragraph></subsection><subsection id="H8E5139611E494C0488E6CA79375908FC"><enum>(g)</enum><header>Confidentiality of information</header> <paragraph id="H5435EA3BABEC4A88968FF5F14D11EBBF"><enum>(1)</enum><header>In general</header><text>Except for purposes of carrying out paragraph (2), and consistent with subsection (c)(2)(B), the Secretary of Homeland Security, the Attorney General, or any other official or employee of the Department of Justice or the Department of Homeland Security shall not—</text>
 <subparagraph id="H6D6C0A0AFE424D98ACC3F194EB79917D"><enum>(A)</enum><text display-inline="yes-display-inline">use the information furnished by the applicant, or the sponsoring employer described in subsection (c)(2)(A), pursuant to an application filed under this section for any purpose other than to make a determination on the application;</text>
 </subparagraph><subparagraph id="H01C108FD35D24976B616ABFEB42749A9"><enum>(B)</enum><text>make any publication whereby the information furnished by any particular applicant or sponsoring employer can be identified; or</text>
 </subparagraph><subparagraph id="H3636B6529FF242B08C8E487E23127EDE"><enum>(C)</enum><text>permit anyone other than the sworn officers and employees of the Department of Homeland Security to examine individual applications.</text>
 </subparagraph></paragraph><paragraph id="HAE835F0E252949F6B7A834B2D7A50A58"><enum>(2)</enum><header>Penalties for false statements in applications</header><text display-inline="yes-display-inline">Whoever files an application under this section and knowingly and willfully falsifies, misrepresents, conceals, or covers up a material fact or makes any false, fictitious, or fraudulent statements or representations, or makes or uses any false writing or document knowing the same to contain any false, fictitious, or fraudulent statement or entry, shall be subject to section 1001 of title 18, United States Code.</text>
 </paragraph></subsection></section><section id="HAEF8E9E013C44112847594E8B745233A"><enum>3.</enum><header>Modification of H-2A regulations</header><text display-inline="no-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary of Labor shall modify the Secretary’s regulations governing the program under section 101(a)(15)(H)(ii)(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(a)</external-xref>) so as to ensure that aliens desiring to come temporarily to the United States to work in an agricultural labor or services occupation not of a seasonal nature are eligible to be granted authorization for employment in the United States on an annual, rather than a seasonal, basis under such program.</text>
