			 and for other purposes.</official-title></form>
	<legis-body id="H1EC55C9D0DF6494F832D54F30686E52D" style="OLC">
 <section id="HBAAD7062E7AF47F1A9E33D0B0D9E0AEE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Tribal Advisory Committee Act of 2019</short-title></quote>.</text> </section><section id="H7A29CFAF6D7842269A1BA3A5CFED7E78" section-type="subsequent-section"><enum>2.</enum><header>Department of Veterans Affairs Advisory Committee on Tribal and Indian Affairs</header> <subsection id="H552B2CD003DD4BBC87091653497763DA"><enum>(a)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/5">chapter 5</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HA60F32170A8E4752862071F3D0D90AC1" style="USC">
					<section id="H01A7D0811C4C4DF39121E1AD04CC1671"><enum>547.</enum><header>Advisory Committee on Tribal and Indian Affairs</header>
						<subsection id="H97E925D6DB0640628D390BA2C2CE5982"><enum>(a)</enum><header>Establishment</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HB970CCC41F2D45B29ECD3F1A974F4651"><enum>(1)</enum><text>The Secretary shall establish an advisory committee to provide advice and guidance to the Secretary on matters relating to Indian tribes, tribal organizations, and Native American veterans.</text>
 </paragraph><paragraph id="H3DBD77D530004CDDA4BCFAD51F22C1F2" indent="up1"><enum>(2)</enum><text>The advisory committee established under paragraph (1) shall be known as the <quote>Advisory Committee on Tribal and Indian Affairs</quote> (in this section referred to as the <quote>Committee</quote>).</text> </paragraph><paragraph id="HA6BE56275A2C43C78E3728E60052226B" indent="up1"><enum>(3)</enum><text>The Committee shall facilitate, but not supplant, government-to-government consultation between the Department and Indian tribes or tribal organizations.</text>
 </paragraph><paragraph id="HF0DCD96615824235B288A6C41FB1E73E" indent="up1"><enum>(4)</enum><text>The Secretary shall consult with Indian tribes or tribal organizations in developing a charter for the Committee.</text>
							</paragraph></subsection><subsection id="HC07350C4FAF640CC93B191719E065F3B"><enum>(b)</enum><header>Membership</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H22B3288C01194E38A10EDE3E9C36B6FB"><enum>(1)</enum><text>The Committee shall be composed of 15 voting members selected by the Secretary from among individuals nominated by Indian tribes or tribal organizations for purposes of this section.</text>
 </paragraph><paragraph id="H339A7591F44548BFA5833D35DA2DDD7D" indent="up1"><enum>(2)</enum><text>In selecting members under paragraph (1), the Secretary shall ensure that—</text> <subparagraph id="H127838A866C54F87A7C3FFCF7ED5EE60"><enum>(A)</enum><text>each of the 12 service areas of the Indian Health Service is represented in the membership of the Committee; and</text>
 </subparagraph><subparagraph id="HECD6C0A02A054406B546C3F1520A9849"><enum>(B)</enum><text>not fewer than half of the members are veterans, unless the Secretary determines that an insufficient number of qualified veterans were nominated under paragraph (1).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73A8C4F89B7A4F54902910FB0FD997C0" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No member of the Committee may be an employee of the Federal Government.</text> </paragraph></subsection><subsection id="H3C59A4F23E094DF8B97A6A7717ED30EE"><enum>(c)</enum><header>Terms; vacancies</header> <paragraph commented="no" display-inline="yes-display-inline" id="H28CADC4B92264FA88ACAD0439755D593"><enum>(1)</enum><text>A member of the Committee shall be appointed for a term of two years.</text>
 </paragraph><paragraph id="H6654B931BD0A483996A805C2AF08FCF0" indent="up1"><enum>(2)</enum><text>The Secretary shall fill a vacancy in the Committee in the same manner as the original appointment within 180 days.</text>
							</paragraph></subsection><subsection id="H4901296273704E6BB0F47B15DEA633B4"><enum>(d)</enum><header>Meetings</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="H868F5384727A4F25B43626D304D73228"><enum>(1)</enum><text>The Committee shall meet in-person with the Secretary, or the Secretary's designee, not less frequently than twice each year and hold monthly conference calls as necessary.</text>
							</paragraph><paragraph id="H703EC12E41A241E2B579C07F6C262A10" indent="up1"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HF6B7321C50C948C890C9F7C4EB54D247"><enum>(A)</enum><text>Representatives of relevant Federal agencies may attend meetings of the Committee and provide information to the Committee.</text>
 </subparagraph><subparagraph id="H21272CCBCF624442A340239A402445DF" indent="up1"><enum>(B)</enum><text>One representative of the Office of Tribal Government Relations of the Department shall attend at each meeting of the Committee.</text>
 </subparagraph><subparagraph id="HE5B24CD68642466781F21081274FF66A" indent="up1"><enum>(C)</enum><text>Representatives attending meetings under this paragraph shall not be considered voting members of the Committee.</text>
								</subparagraph></paragraph></subsection><subsection id="HE5A6CD9A5A3A4D5790C38CC1A24BC39D"><enum>(e)</enum><header>Subcommittees</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HD641424312F14E2AACD2433F11D36634"><enum>(1)</enum><text>The Committee may establish subcommittees.</text> </paragraph><paragraph id="H31258C709F0D4F44BD402D538BD0E1D5" indent="up1"><enum>(2)</enum><text>The Secretary may, in consultation with the Committee, appoint a member to a subcommittee established under paragraph (1) who is not a member of the Committee.</text>
 </paragraph><paragraph id="H30342555D6864C2EBC194A44F6551044" indent="up1"><enum>(3)</enum><text>Such subcommittees may enhance the function of the Committee, but may not supersede the authority of the Committee or provide direct advice or work products to the Department.</text>
 </paragraph></subsection><subsection id="H65F26E3944CE4EE398C86369675638F6"><enum>(f)</enum><header>Duties</header><text>The duties of the Committee are as follows:</text> <paragraph id="HEE070F27E99440AABEF857A64FF46343"><enum>(1)</enum><text>To advise the Secretary on ways the Department can improve the programs and services of the Department to better serve Native American veterans.</text>
 </paragraph><paragraph id="HB5F0045855EE46349F68265AC9BA905B"><enum>(2)</enum><text>To identify for the Department evolving issues of relevance to Indian tribes, tribal organizations, and Native American veterans relating to programs and services of the Department.</text>
 </paragraph><paragraph id="H7F517839BE334FA5A065DA2A27EF68C1"><enum>(3)</enum><text>To propose clarifications, recommendations, and solutions to address issues raised at tribal, regional, and national levels, especially regarding the Annual Tribal Consultation Report.</text>
 </paragraph><paragraph id="H96E35FF640CB4DE79D4EAD6ECE7E0E81"><enum>(4)</enum><text>To provide a forum for Indian tribes, tribal organizations, and the Department to discuss issues and proposals for changes to Department regulations, policies, and procedures.</text>
 </paragraph><paragraph id="HE87C00CBDA3B4C109A712F68F32C6B6E"><enum>(5)</enum><text>To identify priorities and provide advice on appropriate strategies for tribal consultation on issues at the tribal, regional, or national levels.</text>
 </paragraph><paragraph id="H9582DD2536864E9BA79E7BF48DA9034C"><enum>(6)</enum><text>To ensure that pertinent issues are brought to the attention of Indian tribes and tribal organizations in a timely manner, so that tribal feedback can be obtained.</text>
 </paragraph><paragraph id="H8320CAEBC4A2415A8376408FE24F61C6"><enum>(7)</enum><text>To encourage the Secretary to work with other Federal agencies and Congress so that Native American veterans are not denied the full benefit of their status as both Native Americans and veterans.</text>
 </paragraph><paragraph id="HAC508A55627A4246A15F7E33B6C2D260"><enum>(8)</enum><text>To highlight contributions of Native American veterans in the Armed Forces.</text> </paragraph><paragraph id="HB11F0054E69942CA92617E86AFEE5CA3"><enum>(9)</enum><text>To update the consultation policy of the Department on tribal matters.</text>
							</paragraph></subsection><subsection id="HE0A9CFBEF3374F45A7ADD89EABF9E4F8"><enum>(g)</enum><header>Reports</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HFBB8988E18FF40D9BEC08ACC16FDE8A2"><enum>(1)</enum><text>Not less frequently than once each year, the Committee shall submit to the Secretary and the appropriate committees of Congress such recommendations as the Committee may have for legislative or administrative action for the upcoming year.</text>
 </paragraph><paragraph id="HE750E948B3B74CB7A6A270D0459F27CD" indent="up1"><enum>(2)</enum><text>Not later than 90 days after the date on which the Secretary receives a recommendation under paragraph (1), the Secretary shall submit to the appropriate committees of Congress a written response to the recommendation.</text>
 </paragraph><paragraph id="H1B5E68D9692B43D192036972AE19D14F" indent="up1"><enum>(3)</enum><text>Not less frequently than once every two years, the Committee shall submit to the Secretary and the appropriate committees of Congress a report describing the activities of the Committee during the previous two years.</text>
 </paragraph><paragraph id="H9541285C167D4B839CA6D89BE32A4B42" indent="up1"><enum>(4)</enum><text>The Secretary shall make publicly available on an Internet website of the Department—</text> <subparagraph id="HF03F22E5B26340FE8D17B52EFFC977B2"><enum>(A)</enum><text>each recommendation the Secretary receives under paragraph (1);</text>
 </subparagraph><subparagraph id="H0FD77A6D9D6B4F00A85732A48570FEF0"><enum>(B)</enum><text>each response the Secretary submits under paragraph (2); and</text> </subparagraph><subparagraph id="H6C0790704FF846848A82C6C214B4BAC5"><enum>(C)</enum><text>each report the Secretary receives under paragraph (3).</text>
 </subparagraph></paragraph></subsection><subsection id="HF7AC555F5F3344948DFA7FDF367DB1D8"><enum>(h)</enum><header>Committee personnel matters</header><text>Each member of the Committee shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5 for each day (including travel time) during which such member is engaged in the performance of duties of the Committee.</text>
 </subsection><subsection id="H005AED3DB8394DA79DAAD55EA5009B56"><enum>(i)</enum><header>Federal Advisory Committee Act exemption</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Committee.</text> </subsection><subsection id="H4B8F017AF6B5429BB96586BC91FCECCF"><enum>(j)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="H2BB320CBD8BA4811AB32BFA23B44E8B6"><enum>(1)</enum><text>The term <term>appropriate committees of Congress</term> means—</text> <subparagraph id="H8FC2912DAE39481A917EBF54BBFBA32B"><enum>(A)</enum><text>the Committee on Veterans' Affairs and the Committee on Indian Affairs of the Senate; and</text>
 </subparagraph><subparagraph id="H288B323C42BC4F3EAF325D4290E0BAFF"><enum>(B)</enum><text>the Committee on Veterans' Affairs of the House of Representatives.</text> </subparagraph></paragraph><paragraph id="H7720FB82F7C94842A43B30CA14F73C2E"><enum>(2)</enum><text>The term <term>Indian tribe</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph id="H7C7A2B2E01AE4FAB9A8BA4E0DD581B68"><enum>(3)</enum><text>The term <term>Native American veteran</term> has the meaning given such term in section 3765 of this title.</text> </paragraph><paragraph id="H703A2A73537641B6A40CCA088EFFE64F"><enum>(4)</enum><text>The term <term>tribal organization</term> has the meaning given such term in section 3765 of this title and includes an Urban Indian organization (as defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE08B72AA0B664F0E933270F66D924B47"><enum>(b)</enum><header>Deadline for establishment</header><text>The Secretary of Veterans Affairs shall establish the advisory committee required by section 547 of title 38, United States Code, as added by subsection (a), not later than 180 days after the date of the enactment of this Act.</text>
 </subsection><subsection id="HDED6E25033D44BCB9AF0923F0FA3C8AD"><enum>(c)</enum><header>Deadline for initial appointments</header><text>Not later than 90 days after the date on which the Secretary establishes the advisory committee required by such section, the Secretary of Veterans Affairs shall appoint members under subsection (b)(1) of such section.</text>
 </subsection><subsection id="H4E7C30465D9F460FABDFA5A27B13F5BA"><enum>(d)</enum><header>Initial meeting</header><text>Not later than 90 days after the date on which the Secretary establishes the advisory committee required by such section, such advisory committee shall hold its first meeting.</text>
 </subsection><subsection id="H7123254B251B443FB745DD22967C54AE"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 5 of such title is amended by inserting after the item relating to section 546 the following new item:</text>
