committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on May 14, 2019</action-instruction></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Attorney General to review, revise, and develop law enforcement and justice protocols appropriate to address missing and murdered Indians, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HJU00" reported-display-style="italic" id="H5CD5C3AFF79C4F36978B774E14EB3E53"><section commented="no" display-inline="no-display-inline" id="HC81D1CBD41204F5986DA5E8FAC3C8C9B" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Savanna’s Act</short-title></quote>.</text></section><section id="H358BA182524B4B18A56304604C3CF76A"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="H69AB1EBE87E34C738848604476BBB72F"><enum>(1)</enum><text>to clarify the responsibilities of Federal, State, Tribal, and local law enforcement agencies with respect to responding to cases of missing or murdered Indians;</text></paragraph><paragraph id="H7F4B44E4176141D6BDBF98B296755D1D"><enum>(2)</enum><text>to increase coordination and communication among Federal, State, Tribal, and local law enforcement agencies, including medical examiner and coroner offices;</text></paragraph><paragraph id="HE5862D894FA847E58B768A998CD4A7DA"><enum>(3)</enum><text>to empower Tribal governments with the resources and information necessary to effectively respond to cases of missing or murdered Indians; and</text></paragraph><paragraph id="H84F6FD82E597489BA091F1317B52D066"><enum>(4)</enum><text>to increase the collection of data related to missing or murdered Indian men, women, and children, regardless of where they reside, and the sharing of information among Federal, State, and Tribal officials responsible for responding to and investigating cases of missing or murdered Indians.</text></paragraph></section><section id="HA0DD4DE8AA5E4016824E2B0413E7E812"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HBA30FB81462F4885B8255AE8FB0ADBE0"><enum>(1)</enum><header>Confer</header><text>The term <quote>confer</quote> has the meaning given the term in section 514 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1660d">25 U.S.C. 1660d</external-xref>).</text></paragraph><paragraph id="H6B66C9C865B8408EAA89B195BAF09196"><enum>(2)</enum><header>Databases</header><text>The term <quote>databases</quote> means—</text><subparagraph id="HA37D0B28472E4F599E49508B72FAE68D"><enum>(A)</enum><text>the National Crime Information Center database;</text></subparagraph><subparagraph id="H07F99663719140B48055F21C93CE78A4"><enum>(B)</enum><text>the Combined DNA Index System;</text></subparagraph><subparagraph id="H68C7F4763DB741BE9C0EC840968583B5"><enum>(C)</enum><text>the Next Generation Identification System; and</text></subparagraph><subparagraph id="HE2BAAB81BBFC4C19A048899C8E106911"><enum>(D)</enum><text>any other database relevant to responding to cases of missing or murdered Indians, including that under the Violent Criminal Apprehension Program and the National Missing and Unidentified Persons System.</text></subparagraph></paragraph><paragraph id="H5AB79DB111BC4D24A7D1DEEE29E39148"><enum>(3)</enum><header>Indian</header><text>The term <quote>Indian</quote> means a member of an Indian Tribe.</text></paragraph><paragraph id="HF5F5E791D6B44BD6A4C06C82093BA750"><enum>(4)</enum><header>Indian country</header><text>The term <quote>Indian country</quote> has the meaning given the term in section 1151 of title 18, United States Code.</text></paragraph><paragraph id="H02F03833712D4580BC4E265E17B71A06"><enum>(5)</enum><header>Indian land</header><text>The term <quote>Indian land</quote> means Indian lands, as defined in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>).</text></paragraph><paragraph id="H6199739768B94049A0EDDC622DE01843"><enum>(6)</enum><header>Indian tribe</header><text>The term <quote>Indian Tribe</quote> has the meaning given the term <quote>Indian tribe</quote> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HC01A192ECC9742C2BD6072D2FE860F85"><enum>(7)</enum><header>Law enforcement agency</header><text>The term <quote>law enforcement agency</quote> means a Tribal, Federal, State, or local law enforcement agency.</text></paragraph></section><section id="H8D6FF885119A45E8A156745C63DC0A20"><enum>4.</enum><header>Improving tribal access to databases</header><subsection id="HF9592C4150B94B35A0420A551AC0E228"><enum>(a)</enum><header>Tribal enrollment information</header><text>The Attorney General shall provide training to law enforcement agencies regarding how to record the Tribal enrollment information or affiliation, as appropriate, of a victim in Federal databases.</text></subsection><subsection id="H7FB393C2FA9843449C4FDB2AD1CABD9B"><enum>(b)</enum><header>Consultation</header><paragraph id="H145FF613D21E45AE8DD5036D7425A0C9"><enum>(1)</enum><header>Consultation</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General, in cooperation with the Secretary of the Interior, shall complete a formal consultation with Indian Tribes on how to further improve Tribal data relevance and access to databases.</text></paragraph><paragraph id="H17CD04A32F5442FB8DAD1BCB5C7010C7"><enum>(2)</enum><header>Initial confer</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General, in coordination with the Secretary of the Interior, shall confer with Tribal organizations and urban Indian organizations on how to further improve American Indian and Alaska Native data relevance and access to databases.</text></paragraph><paragraph id="H4E2F0BD8026D40FD81088695FE2E3C65"><enum>(3)</enum><header>Annual consultation</header><text>Section 903(b) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20126">34 U.S.C. 20126(b)</external-xref>) is amended—</text><subparagraph id="H54654E1D348E4CEA86DF7AEBCA690A77"><enum>(A)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block id="H4FD57997A6DE4CE5963E6966847C0781" style="OLC" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="H6717F46B1A0146CF8F79B2ECAA824F6A"><enum>(2)</enum><text>enhancing the safety of Indian women from domestic violence, dating violence, sexual assault, homicide, stalking, and sex trafficking;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE00B689506B544878A208A9CBE418994"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H8C7932FB83A04D48807AA87DDAB0617F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H2C5799C6F6644436BD2974173EE93A81" style="OLC" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="H696A739168344A28AA526ADC0F3A5C29"><enum>(4)</enum><text>improving access to local, regional, State, and Federal crime information databases and criminal justice information systems.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HE44EBDB1B8B24E668E7D82C216556063"><enum>(c)</enum><header>Notification</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall—</text><paragraph id="H01CD9AEEDD18490581640C2AEE300CE8"><enum>(1)</enum><text>develop and implement a dissemination strategy to educate the public of the National Missing and Unidentified Persons System; and</text></paragraph><paragraph id="HEECC173D67BB49A7BDC8E85BF9F27B0D"><enum>(2)</enum><text>conduct specific outreach to Indian Tribes, Tribal organizations, and urban Indian organizations regarding the ability to publicly enter information, through the National Missing and Unidentified Persons System or other non-law enforcement sensitive portal, regarding missing persons, which may include family members and other known acquaintances.</text></paragraph></subsection></section><section id="H099548D03D07489096B24D680D43287F"><enum>5.</enum><header>Guidelines for responding to cases of missing or murdered indians</header><subsection id="HBAB100B5A8234CDAB54ED29ADCA853F8"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date on which the consultation described in section 4(b)(1) is completed, the Attorney General shall direct United States attorneys to develop regionally appropriate guidelines to respond to cases of missing or murdered Indians that shall include—</text><paragraph id="HBDBEB5B64D3C4B6990D017E40D827944"><enum>(1)</enum><text>guidelines on inter-jurisdictional cooperation among law enforcement agencies at the Tribal, Federal, State, and local levels, including inter-jurisdictional enforcement of protection orders and detailing specific responsibilities of each law enforcement agency;</text></paragraph><paragraph id="H0DC0245C1A8E4080AE33C18D2225BAF9"><enum>(2)</enum><text>best practices in conducting searches for missing persons on and off Indian land;</text></paragraph><paragraph id="H157E580909AB4519995CBC3D76FB7C0C"><enum>(3)</enum><text>standards on the collection, reporting, and analysis of data and information on missing persons and unidentified human remains, and information on culturally appropriate identification and handling of human remains identified as Indian, including guidance stating that all appropriate information related to missing or murdered Indians be entered in a timely manner into applicable databases;</text></paragraph><paragraph id="HE038E037036147A98441186D1C795814"><enum>(4)</enum><text>guidance on which law enforcement agency is responsible for inputting information into appropriate databases under paragraph (3) if the Tribal law enforcement agency does not have access to those appropriate databases;</text></paragraph><paragraph id="H86610F200AF44813B8C75B26B96A87E0"><enum>(5)</enum><text>guidelines on improving law enforcement agency response rates and follow-up responses to cases of missing or murdered Indians; and</text></paragraph><paragraph id="H4E3D410041F149FE8B36EC30AF92D5CC"><enum>(6)</enum><text>guidelines on ensuring access to culturally appropriate victim services for victims and their families.</text></paragraph></subsection><subsection id="HEC298A553C34415A9CFC8A711F803FA9"><enum>(b)</enum><header>Consultation</header><text>United States attorneys shall develop the guidelines required under subsection (a) in consultation with Indian Tribes and other relevant partners, including—</text><paragraph id="H419F1F33E6DD4FE0B99464B6DC913558"><enum>(1)</enum><text>the Department of Justice;</text></paragraph><paragraph id="H34FFD1B7B6A54C2FB0C2A9FACED16467"><enum>(2)</enum><text>the Federal Bureau of Investigation;</text></paragraph><paragraph id="H35F7542F60BE4FE8AACD4926FEDC979F"><enum>(3)</enum><text>the Department of the Interior;</text></paragraph><paragraph id="HDCF9884555C44FFFA5802D0DDA1FCE0F"><enum>(4)</enum><text>the Bureau of Indian Affairs;</text></paragraph><paragraph id="HB5215C011608480FB7946F734F38C422"><enum>(5)</enum><text>Tribal, State, and local law enforcement agencies;</text></paragraph><paragraph id="HEA012147724A44D89F897C5F23157931"><enum>(6)</enum><text>medical examiners;</text></paragraph><paragraph id="HD780D0E0C917487894DBA096624C5642"><enum>(7)</enum><text>coroners;</text></paragraph><paragraph id="H21F5EFC12E124E74BD09FD7BCA051E0A"><enum>(8)</enum><text>Tribal, State, and local organizations that provide victim services; and</text></paragraph><paragraph id="HF311CFE8C7DB4BFCB7075C7CCC9428BF"><enum>(9)</enum><text>national, regional, or urban Indian organizations with relevant expertise.</text></paragraph></subsection><subsection id="H36697759C73647369C01653CC26A6DE8"><enum>(c)</enum><header>Compliance</header><paragraph id="HA41B5E83C66847949FABA8493617677B"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the United States attorneys shall implement, by incorporating into office policies and procedures, the guidelines developed under subsection (a).</text></paragraph><paragraph id="H19C8376D9ADC4FD999E842C68E61EFC8"><enum>(2)</enum><header>Modification</header><text>Each Federal law enforcement agency shall modify the guidelines, policies, and protocols of the agency to incorporate the guidelines developed under subsection (a).</text></paragraph><paragraph id="HB96A452AC1C6473D9EF06E1A773C3658"><enum>(3)</enum><header>Determination</header><text>Not later than the end of each fiscal year beginning after the date the guidelines are established under this section and incorporated under this subsection, upon the request of a Tribal, State, or local law enforcement agency, the Attorney General shall determine whether the Tribal, State, or local law enforcement agency seeking recognition of compliance has incorporated guidelines into their respective guidelines, policies, and protocols.</text></paragraph></subsection><subsection id="HB190AFE4E6384E60A3E10D56468F53AC"><enum>(d)</enum><header>Accountability</header><text>Not later than 30 days after compliance determinations are made each fiscal year in accordance with subsection (c)(3), the Attorney General shall—</text><paragraph id="H621D538AC6F2481A8A2D2A81F3CA47F9"><enum>(1)</enum><text>disclose and publish, including on the website of the Department of Justice, the name of each Tribal, State, or local law enforcement agency that the Attorney General has determined has incorporated guidelines in accordance with subsection (c)(3);</text></paragraph><paragraph id="H6F8FBB5855CC4BDE999BE3DD9ADCA25B"><enum>(2)</enum><text>disclose and publish, including on the website of the Department of Justice, the name of each Tribal, State, or local law enforcement agency that has requested a determination in accordance with subsection (c)(3) that is pending;</text></paragraph><paragraph id="HCDEE3BC9FDF3406D9E406E7E9BF7CA76"><enum>(3)</enum><text>collect the guidelines into a resource of examples and best practices that can be used by other law enforcement agencies seeking to create and implement such guidelines.</text></paragraph></subsection><subsection id="HB9A6FAB2F1CD40149E98CDBAF3045ABA"><enum>(e)</enum><header>Training and technical assistance</header><text>The Attorney General shall use the National Indian Country Training Initiative to provide training and technical assistance to Indian Tribes and law enforcement agencies on—</text><paragraph id="H754B3C0824A34C35903DA1D4520F2FFA"><enum>(1)</enum><text>implementing the guidelines developed under subsection (a) or developing and implementing locally specific guidelines or protocols for responding to cases of missing or murdered Indians; and</text></paragraph><paragraph id="HB5287640D76B49D0B5AD7BC701D36B7E"><enum>(2)</enum><text>using the National Missing and Unidentified Persons System and accessing program services that will assist Indian Tribes with responding to cases of missing or murdered Indians.</text></paragraph></subsection><subsection id="H0EAFD085F20A428098A431BA8768EFB0"><enum>(f)</enum><header>Guidelines from indian tribes</header><paragraph id="HBD692F2FF8704E94ABACDF387BF26BE5"><enum>(1)</enum><header>In general</header><text>Indian Tribes may submit their own guidelines to respond to cases of missing or murdered Indians to the Attorney General.</text></paragraph><paragraph id="HB330336813C64312B446627FE2145CAA"><enum>(2)</enum><header>Publication</header><text>Upon receipt of any guidelines from an Indian Tribe, the Attorney General shall publish the guidelines on the website of the Department of Justice in 1 centralized location to make the guidelines available as a resource to any Federal agency, State, or Tribal government.</text></paragraph></subsection></section><section id="HA719891C5F2C42859CCF126B47EAD6BA"><enum>6.</enum><header>Annual reporting requirements</header><subsection id="HF5D8EAA866C446208FBF92EF16259F03"><enum>(a)</enum><header>Annual reporting</header><text>Beginning in the first fiscal year after the date of enactment of this Act, the Attorney General shall include in its annual Indian Country Investigations and Prosecutions report to Congress information that—</text><paragraph id="HEB4ADDD710CB4D6DA3877A76EDEF0D54"><enum>(1)</enum><text>includes known statistics on missing Indians in the United States, available to the Department of Justice, including—</text><subparagraph id="HA73B3B0E15E540E4B1976EB6C4C776DE"><enum>(A)</enum><text>age;</text></subparagraph><subparagraph id="H869F0488E36B44EBAAD28F09FC6A5DB9"><enum>(B)</enum><text>gender;</text></subparagraph><subparagraph id="H08313D1BF0504A89BC35AABC10DF7465"><enum>(C)</enum><text>Tribal enrollment information or affiliation, if available;</text></subparagraph><subparagraph id="H3445C80975E64FB48436A343B98F05EE"><enum>(D)</enum><text>the current number of open cases per State;</text></subparagraph><subparagraph id="HE9DCE8CFD7D8428795C74BC8D8ED47A9"><enum>(E)</enum><text>the total number of closed cases per State each calendar year, from the most recent 10 calendar years; and</text></subparagraph><subparagraph id="H7A1B498A78BB41D48BF5A1B2D9AE8519"><enum>(F)</enum><text>other relevant information the Attorney General determines is appropriate;</text></subparagraph></paragraph><paragraph id="H78F8232DEC824485959AD98A0FD55D2F"><enum>(2)</enum><text>includes known statistics on murdered Indians in the United States, available to the Department of Justice, including—</text><subparagraph id="HBBD66B8E9C7A4C529111360EAED3EFAF"><enum>(A)</enum><text>age;</text></subparagraph><subparagraph id="HE3B17DDAC9A74B2B82D10ADEA403AAEA"><enum>(B)</enum><text>gender;</text></subparagraph><subparagraph id="H92AEFF36778B4042BA7F921E6DD79AF2"><enum>(C)</enum><text>Tribal enrollment information or affiliation, if available;</text></subparagraph><subparagraph id="H7FF358B7A9A54309B09E709D5B3559EF"><enum>(D)</enum><text>the current number of open cases per State;</text></subparagraph><subparagraph id="HDF72A28B6B77445290E3034C39735117"><enum>(E)</enum><text>the total number of closed cases per State each calendar year, from the most recent 10 calendar years; and</text></subparagraph><subparagraph id="HA40FF838A1474C90A7D72A32D7D689E3"><enum>(F)</enum><text>other relevant information the Attorney General determines is appropriate;</text></subparagraph></paragraph><paragraph id="HA2EB1E437294480DAE8C93DDD76B5D3D"><enum>(3)</enum><text>maintains victim privacy to the greatest extent possible by excluding information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context; and</text></paragraph><paragraph id="H8A667151F25649E98C5F39B0418956E8"><enum>(4)</enum><text>includes—</text><subparagraph id="HB98909F805D844BD8170231427762071"><enum>(A)</enum><text>an explanation of why the statistics described in paragraph (1) may not be comprehensive; and</text></subparagraph><subparagraph id="HC616D101C6D44A4C95B708035CAD2E17"><enum>(B)</enum><text>recommendations on how data collection on missing or murdered Indians may be improved.</text></subparagraph></paragraph></subsection><subsection id="H57C70DD726CC4257AEFB7E46598A8AEA"><enum>(b)</enum><header>Compliance</header><paragraph id="H8ED17C6B3AEA408788D9BCFC2307B5D9"><enum>(1)</enum><header>In general</header><text>Beginning in the first fiscal year after the date of enactment of this Act, and annually thereafter, for the purpose of compiling accurate data for the annual report required under subsection (a), the Attorney General shall request all Tribal, State, and local law enforcement agencies to submit to the Department of Justice, to the fullest extent possible, all relevant information pertaining to missing or murdered Indians collected by the Tribal, State, and local law enforcement agency, and in a format provided by the Department of Justice that ensures the streamlining of data reporting.</text></paragraph><paragraph id="H7BC8954CC06A4DCE8C9EA3B26A1B8B54"><enum>(2)</enum><header>Disclosure</header><text>The Attorney General shall disclose and publish annually, including on the website of the Department of Justice, the name of each Tribal, State, or local law enforcement agency that the Attorney General has determined has submitted the information requested under paragraph (1) for the fiscal year in which the report was published.</text></paragraph></subsection><subsection id="H3BF24326F8464AD386DF3FAA4288556F"><enum>(c)</enum><header>Inclusion of gender in missing and unidentified persons statistics</header><text>Beginning in the first calendar year after the date of enactment of this Act, and annually thereafter, the Federal Bureau of Investigation shall include gender in its annual statistics on missing and unidentified persons published on its public website.</text></subsection></section><section id="H87BE6365BC864DC1A728A2B0F82F0531"><enum>7.</enum><header>Implementation and incentive</header><subsection id="H4F72BE655560459AA3BCB6290C74C8E7"><enum>(a)</enum><header>Grant authority</header><text>Section 2101(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10461">34 U.S.C. 10461(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HBE91FEFF9086409699957DC0E9B18A04" style="OLC" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="HBF312C863CD94B669299E4A9D49DCCDA"><enum>(23)</enum><text>To develop, strengthen, and implement policies, protocols, and training for law enforcement regarding cases of missing or murdered Indians, as described in section 5 of Savanna’s Act.</text></paragraph><paragraph id="H5C89CE32AE424A6AA08A4665A44B113A"><enum>(24)</enum><text>To compile and annually report data to the Attorney General related to missing or murdered Indians, as described in section 6 of Savanna’s Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB121D7BF737648039D1599A99DB5A271"><enum>(b)</enum><header>Grants to indian tribal governments</header><text>Section 2015(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10452">34 U.S.C. 10452(a)</external-xref>) is amended—</text><paragraph id="H2378681AF0754AE18D90A1ED0BDE5394"><enum>(1)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE5F7BC76B39A40A1AC357BD99B6A2E4F"><enum>(2)</enum><text>in paragraph (10), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H8E0D63E227BE4819A61126B401503DE1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H935B388146C74E4B9AB3F0B5E9410509" style="OLC" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="HB3BE71BD9F45418599BFF6A6FA325898"><enum>(11)</enum><text>develop, strengthen, and implement policies, protocols, and training for law enforcement regarding cases of missing or murdered Indians, as described in section 5 of Savanna’s Act;
