<official-title display="yes">To encourage Federal agencies to expeditiously enter into or amend cooperative agreements with States for removal and remedial actions to address PFAS contamination in drinking, surface, and ground water and land surface and subsurface strata, and for other purposes.</official-title>

<section id="HBB7D19489C2348FD86A11EC5428C9671" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Accountability Act of 2019</short-title></quote>.</text> </section> <section id="HD59050019D8F47AAB539CCBCAD337F8F" section-type="subsequent-section"><enum>2.</enum><header>Cooperative agreements with States for removal and remedial actions to address drinking, surface, and ground water and soil contamination from PFAS</header> <subsection id="HD87D796B077D4E0C98F953F7EC663745"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HCBA2B8573407410AB4458D47BD27C636"><enum>(1)</enum><header>Federal facility</header> 
<subparagraph id="H6784BFD15D144D96A087710018A93FA3"><enum>(A)</enum><header>In general</header><text>The term <term>Federal facility</term> means a facility (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)) that is owned or operated by the Federal Government.</text> </subparagraph> <subparagraph id="H2266050F06904434AE3412685BAF6F7A"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Federal facility</term> includes—</text> 
<clause id="H124D49C1AB9549EAAEC32CB51A2F807B"><enum>(i)</enum><text>a facility or site—</text> <subclause id="HE6AB3D24EE8A4D1FBFF0CB70DC011C50"><enum>(I)</enum><text>owned by, leased to, or otherwise possessed by the United States; or</text> </subclause>
<subclause id="HDDB15B11A9E5473EB42D21DA34D0B667"><enum>(II)</enum><text>under the jurisdiction of the Secretary of Defense;</text> </subclause></clause> <clause id="H13B8862396D845C18FC4AA3D7C610CC8"><enum>(ii)</enum><text>a facility or site that, at the time of the actions leading to contamination or suspected contamination of drinking water, surface water, or groundwater or land surface or subsurface strata from a per­flu­or­i­nat­ed compound, was—</text> 
<subclause id="HC5CEFDFBB8C241AAB59FE9A1200FA368"><enum>(I)</enum><text>owned by, leased to, or otherwise possessed by the United States; or</text> </subclause> <subclause commented="no" display-inline="no-display-inline" id="HB9E7CD459FEF4993A0477B251A427240"><enum>(II)</enum><text>under the jurisdiction of the Secretary of Defense; and</text> </subclause></clause>
<clause id="H93A54D015E84483F99A2EA5CBB22D818"><enum>(iii)</enum><text>land owned and operated by a State when the land is used for training the National Guard pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">chapter 5</external-xref> of title 32, United States Code, with funds provided by the Secretary of Defense or the Secretary of a military department, even though that land is not under the jurisdiction of the Secretary of Defense.</text> </clause></subparagraph></paragraph> <paragraph id="H7D66EDC46FF64D4E8D1C51EE5F3F942A"><enum>(2)</enum><header>Fully fluorinated carbon atom</header><text>The term <term>fully fluorinated carbon atom</term> means a carbon atom on which all the hydrogen substituents have been replaced by fluorine.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H89C3DEA573904AE892F221F5953B31A6"><enum>(3)</enum><header display-inline="yes-display-inline">Perfluorinated compound</header><text display-inline="yes-display-inline">The term <term>perfluorinated compound</term> means a per­flu­or­o­al­kyl substance or a polyfluoroalkyl substance (or <quote>PFAS</quote>) that is manmade with at least 1 fully fluorinated carbon atom.</text> </paragraph> <paragraph id="H3B94BB387A0C45D7A3E1AE773EAE9855"><enum>(4)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text> </paragraph></subsection>
<subsection id="HFF6747E70294463396767A2B49B7A676"><enum>(b)</enum><header>Cooperative agreement</header> 
<paragraph id="HA5276ADBD7704B45AD95D4AB6EB8A3E8"><enum>(1)</enum><header>In general</header><text>On request by the Governor or chief executive of a State, a Federal department or agency shall work expeditiously to finalize a cooperative agreement for, or to amend an existing cooperative agreement to address, testing, monitoring, removal, and remedial actions to address contamination or suspected contamination of drinking water, surface water, or groundwater or land surface or subsurface strata from a perfluorinated compound originating from a Federal facility.</text> </paragraph> <paragraph id="H93033C45F2D24316B61EDF3DF502F961"><enum>(2)</enum><header>Minimum standards</header><text>A cooperative agreement finalized or amended under paragraph (1) shall require the area subject to the cooperative agreement to meet or exceed the most stringent of the following standards for perfluorinated compounds in any environmental media:</text> 
<subparagraph id="H1503ADCC9C104D2A86A39E918A8C60C1"><enum>(A)</enum><text>An enforceable State standard, in effect in that State, for drinking water, surface water, or groundwater or land surface or subsurface strata, as required under section 121(d) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9621">42 U.S.C. 9621(d)</external-xref>).</text> </subparagraph> <subparagraph id="HEA37AC579AC8467881F41B6E1B932843"><enum>(B)</enum><text>A health advisory under section 1412(b)(1)(F) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)(1)(F)</external-xref>).</text> </subparagraph>
<subparagraph id="HDBFFBB3582324DBA8512DF457549E76A"><enum>(C)</enum><text>Any Federal standard, requirement, criterion, or limit, including a standard, requirement, criterion, or limit issued under—</text> <clause id="H0B8228FB7CC24724804CFCCD626C89EC"><enum>(i)</enum><text>the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601</external-xref> et seq.);</text> </clause>
<clause id="H598A9C05D1CC4CAEBA3EE79BE2F08B99"><enum>(ii)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.);</text> </clause> <clause id="HBE3925CA7092452EA3CDE45D12250082"><enum>(iii)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.);</text> </clause>
<clause id="H88129CCA9550448680B1935CAC55511D"><enum>(iv)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.);</text> </clause> <clause id="H86AE7B43F1D1428DAB1F567EC1E06D6B"><enum>(v)</enum><text>the Marine Protection, Research, and Sanctuaries Act of 1972 (commonly known as the <quote>Ocean Dumping Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/33/1401">33 U.S.C. 1401</external-xref> et seq.); or</text> </clause>
<clause id="HA4510D197C044796887611D77106CE71"><enum>(vi)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901</external-xref> et seq.).</text> </clause></subparagraph></paragraph> <paragraph id="HAFEB29BB136E4291931729EB72930B4A"><enum>(3)</enum><header>Other authority</header><text>In addition to the requirements for a cooperative agreement under paragraph (1), when otherwise authorized to expend funds for the purpose of addressing ground or surface water contaminated by a perfluorinated compound, the head of a Federal department or agency may, to expend those funds, enter into a grant agreement, cooperative agreement, or contract with—</text> 
<subparagraph id="HC65C88D928F24DE99EB8B82FD415DA6B"><enum>(A)</enum><text>the local water authority with jurisdiction over the contamination site, including—</text> <clause id="H2D85AC0E04A149DD81F401BFDE58193E"><enum>(i)</enum><text>a public water system (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)); and</text> </clause>
<clause id="HE2826ADD158848658FFF3250A5832055"><enum>(ii)</enum><text>a publicly owned treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)); or</text> </clause></subparagraph> <subparagraph id="HDA913F169A054E03BC4DB4D5AF704516"><enum>(B)</enum><text>a State, local, or Tribal government.</text> </subparagraph></paragraph></subsection>
<subsection id="HE213F7886BC24012AC431B06BD58A175"><enum>(c)</enum><header>Notification requirement</header> 
<paragraph id="H3F7347E93B094265A86624953B1D52B3"><enum>(1)</enum><header>Definition of appropriate congressional committees</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text> <subparagraph id="H6B01185328F94A7EB52F2004740C1709"><enum>(A)</enum><text>the Committee on Environment and Public Works of the Senate;</text> </subparagraph>
<subparagraph id="H7AF96EFB7B314656AC29ACF672552557"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H551F605E71A64FBAA3EA6BE5B7461F07"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H76DD31F8C22D44B88BFAE4445DD82D4B"><enum>(D)</enum><text>the Committee on Oversight and Reform of the House of Representatives.</text> </subparagraph></paragraph> <paragraph id="H86E70E9B611245F4AD4C072C15656732"><enum>(2)</enum><header>Report</header> <subparagraph id="HA72B151D655847C5A64749FD591F20F3"><enum>(A)</enum><header>In general</header><text>If a cooperative agreement is not finalized or amended under subsection (b) by the date that is 1 year after the date on which a request by the Governor or chief executive of a State was made, the President shall submit a report described in subparagraph (B) to—</text> 
<clause id="HA30AA99C43AA4830946BA07CCEB982A9"><enum>(i)</enum><text>the appropriate congressional committees;</text> </clause> <clause id="HEE15A311FF0A4456B645879C8205532B"><enum>(ii)</enum><text>each Senator from the State affected by the perfluorinated compound contamination; and</text> </clause>
<clause id="HBCA422C1A6F54213B963C3575072C686"><enum>(iii)</enum><text>each member of Congress that represents a district affected by the per­fluo­ri­nat­ed compound contamination.</text> </clause></subparagraph> <subparagraph id="H3E2FF37547F041439FB4058236EAF942"><enum>(B)</enum><header>Report described</header><text>The report referred to in subparagraph (A) shall include—</text> 
<clause id="H786B2230A20E4914AB2F54B49F287186"><enum>(i)</enum><text>a detailed explanation of why a cooperative agreement has not been finalized or amended, as applicable; and</text> </clause> <clause id="H4D7922AC66B84C8E9C1A996BE8D37481"><enum>(ii)</enum><text>a projected timeline for finalizing or amending a cooperative agreement, as applicable.</text> </clause></subparagraph></paragraph></subsection></section>
