 <section changed="deleted" committee-id="SSGA00" id="H6C377DE87D6B4DB6B4521F40C3441E2F" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Overseas Personnel Enhancement Act of 2019</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSGA00" id="HA689A459C47A414592E24AAEB85F301E" reported-display-style="strikethrough"><enum>2.</enum><header>Overseas personnel briefing</header> <subsection id="H2AD545FB5F33457AA99050E5CE60C459"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after submission of the comprehensive 3-year strategy required under section 1910 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>) and every 180 days thereafter, the Secretary of Homeland Security shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate regarding Department of Homeland Security personnel with primary duties that take place outside of the United States.</text>
 </subsection><subsection id="HC102A61094E24C0E95EF88CB8484736B"><enum>(b)</enum><header>Requirements</header><text>The briefings required under subsection (a) shall include the following:</text> <paragraph id="H4E9D5C5C6FAA48C79C0EA4620CE5FA42"><enum>(1)</enum><text display-inline="yes-display-inline">A detailed summary of, and deployment schedule for, each type of personnel position with primary duties that take place outside of the United States and how each such position contributes to the Department of Homeland Security’s counterterrorism mission.</text>
 </paragraph><paragraph id="H086FCFF568ED4A86834507C0CAED7D45"><enum>(2)</enum><text>Information related to how the geographic and regional placement of such positions contributes to the Department’s counterterrorism mission.</text>
 </paragraph><paragraph id="H57D5ABF65D894160B3E09B93E9E397B7"><enum>(3)</enum><text display-inline="yes-display-inline">Information related to any risk mitigation plans for each geographic and regional placement, including to address counter-intelligence risks.</text>
 </paragraph><paragraph id="H11A67585C8964C54ABAA3ECC939A2021"><enum>(4)</enum><text>Information regarding the costs of deploying or maintaining personnel at each geographic and regional placement, including information on any cost-sharing agreement with foreign partners to cover a portion or all the costs relating to such deployment or maintenance.</text>
 </paragraph><paragraph id="HEEA069B1210B4620984D4E50AA3389B3"><enum>(5)</enum><text>Maintain and enhance practices to guard against counter-espionage and counter-intelligence threats, including cyber threats, associated with Department personnel.</text>
 </paragraph><paragraph id="H88EEEBFBD4FF41FE8BC373E3D16C8DD2"><enum>(6)</enum><text>Information regarding trends in foreign efforts to influence such personnel while deployed overseas to contribute to the Department’s counterterrorism mission.</text>
 </paragraph><paragraph id="H6A413B6EC09A4B70A81D95EF33E9E569"><enum>(7)</enum><text>Information related to the position-specific training received by such personnel before and during placement at a foreign location.</text>
 </paragraph><paragraph id="H8051B97E71DA4D4D9CC829604DADE5F7"><enum>(8)</enum><text>Challenges that may impede the communication of counterterrorism information between Department personnel at foreign locations and Department entities in the United States, including technical, resource, and administrative challenges.</text>
 </paragraph><paragraph id="HDA25698E760D424CAAC45DDB89B954C8"><enum>(9)</enum><text display-inline="yes-display-inline">The status of efforts to implement the strategy referred to in subsection (a).</text> </paragraph><paragraph id="H84E64C976BCC41728C56E6347E06E7A8"><enum>(10)</enum><text display-inline="yes-display-inline">The status of efforts (beginning with the second briefing required under this section) to implement the enhancement plan under section 3.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSGA00" id="H321B491C2EDA48CA99DEEA0889EAFBFC" reported-display-style="strikethrough"><enum>3.</enum><header>Overseas personnel enhancement plan</header>
 <subsection id="H09DF581DB83C451E95E59B23FF5E84CD"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the first briefing required under section 2, the Secretary shall submit to the Committee on Homeland Security of the House and the Committee on Homeland Security and Governmental Affairs of the Senate a plan to enhance the effectiveness of Department of Homeland Security personnel at foreign locations.</text>
 </subsection><subsection id="H93D635E9B9C74C06B76244636A57F4BB"><enum>(b)</enum><header>Plan requirements</header><text>The plan required under subsection (a) shall include proposals to—</text> <paragraph id="HCDDA2208953449748D307B6DFE26D2DF"><enum>(1)</enum><text>improve efforts of Department of Homeland Security personnel at foreign locations, as necessary, for purposes of providing foreign partner capacity development and furthering the Department’s counterterrorism mission;</text>
 </paragraph><paragraph id="HC3FA3FA7F1E44180B61DFBEFFBAF7A67"><enum>(2)</enum><text>as appropriate, redeploy Department personnel to respond to changing threats to the United States;</text> </paragraph><paragraph id="H4C887C81250947528E7E232FD66E0D48"><enum>(3)</enum><text>enhance collaboration among Department personnel at foreign locations, other Federal personnel at foreign locations, and foreign partners;</text>
 </paragraph><paragraph id="H1783D1AD256A4ED0B4F61896493AF79B"><enum>(4)</enum><text display-inline="yes-display-inline">improve the communication of counterterrorism information between Department personnel at foreign locations and Department entities in the United States, including to address technical, resource, and administrative challenges; and</text>
 </paragraph><paragraph id="H674A2A2FAF04478CAEBDF7AE01923601"><enum>(5)</enum><text display-inline="yes-display-inline">maintain practices to guard against counter-espionage threats associated with Department personnel.</text> </paragraph></subsection></section><section changed="deleted" committee-id="SSGA00" id="H5C8C5A14F5144E669747101065F489DA" reported-display-style="strikethrough"><enum>4.</enum><header>Termination</header><text display-inline="no-display-inline">The briefing requirement under section 2 shall terminate on the date that is 4 years after the submission of the strategy referred to in such section.</text></section></legis-body>

 <section changed="added" committee-id="SSGA00" id="id85246713ab014881b30e6494a1076634" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Overseas Personnel Enhancement Act of 2019</short-title></quote>.</text> </section><section changed="added" committee-id="SSGA00" id="idb78d7b3c370a4378901573feb5142d72" reported-display-style="italic"><enum>2.</enum><header>Overseas personnel briefing</header> <subsection id="id4259d6de5d4141dabb4d87044f5a0fee"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after submission of the comprehensive 3-year strategy required under section 1910 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>) and annually thereafter, the Secretary shall brief the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate regarding Department personnel with primary duties that take place outside of the United States.</text>
 </subsection><subsection id="id45f3b05f239a4a8e910d0510285c67d0"><enum>(b)</enum><header>Requirements</header><text>The briefings required under subsection (a) shall include the following:</text> <paragraph id="id1209c2314f15493f82b2ae473ddc6e3a"><enum>(1)</enum><text>A detailed summary of, and deployment schedule for, each type of personnel position with primary duties that take place outside of the United States and how each such position contributes to the Department's mission.</text>
 </paragraph><paragraph id="id9171755ff74b468fb9f7f9bb52860120"><enum>(2)</enum><text>Information related to how the geographic and regional placement of such positions contributes to the Department's mission.</text>
 </paragraph><paragraph id="id2d9c41f71e614c418d2a2e296244af8e"><enum>(3)</enum><text>Information related to any risk mitigation plans for each geographic and regional placement, including to address counter-intelligence risks.</text>
 </paragraph><paragraph id="idd812aab9b0f34e83b0335e53f2cddf91"><enum>(4)</enum><text>Information regarding the costs of deploying or maintaining personnel at each geographic and regional placement, including information on any cost-sharing agreement with foreign partners to cover a portion or all the costs relating to such deployment or maintenance.</text>
 </paragraph><paragraph id="id0cccbdf38f6f48a48ac011bfadb3216b"><enum>(5)</enum><text>Information on guidance and practices to guard against counter-espionage and counter-intelligence threats, including cyber threats, associated with Department personnel.</text>
 </paragraph><paragraph id="idbceea04c4ed4469f806939c6881cba46"><enum>(6)</enum><text>Information regarding trends in foreign efforts to influence such personnel while deployed overseas to contribute to the Department's mission.</text>
 </paragraph><paragraph id="idd29c7f6b93a942deaabac7ab2602d4c3"><enum>(7)</enum><text>Information related to the position-specific training received by such personnel before and during placement at a foreign location.</text>
 </paragraph><paragraph id="id0eef6e2ba8574898addca2fff3ace475"><enum>(8)</enum><text>Challenges that may impede the communication of counterterrorism information between Department personnel at foreign locations and Department entities in the United States, including technical, resource, and administrative challenges.</text>
 </paragraph><paragraph id="id2e59f0eb34db41a7a4128260802a0c5c"><enum>(9)</enum><text>The status of efforts to implement the strategy referred to in subsection (a).</text> </paragraph><paragraph id="id3095e1d085754abbb744ba7d4b60e9e6"><enum>(10)</enum><text>The status of efforts (beginning with the second briefing required under this section) to implement the enhancement plan under section 3.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSGA00" id="id52439abe06c84cbeb15da295b40a0b34" reported-display-style="italic"><enum>3.</enum><header>Overseas personnel enhancement plan</header>
 <subsection id="idda7f232530db402086fa3edf774c53e8"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the first briefing required under section 2, the Secretary shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a plan to enhance the effectiveness of Department personnel at foreign locations.</text>
 </subsection><subsection id="id35adee721765473aa2f16d3c401a3eca"><enum>(b)</enum><header>Plan requirements</header><text>The plan required under subsection (a) shall include proposals to—</text> <paragraph id="idf63d2227d7fc463aaf400ed21b8083dc"><enum>(1)</enum><text>improve efforts of Department personnel at foreign locations, as necessary, for purposes of providing foreign partner capacity development and furthering the Department's mission;</text>
 </paragraph><paragraph id="id7d379d6dbb1c4522b2dffa4bb361ed45"><enum>(2)</enum><text>as appropriate, redeploy Department personnel to respond to changing threats to the United States, consistent with the limits on the resources of the Department;</text>
 </paragraph><paragraph id="id2ba74005e2264ce2b4a244cf67d29f7d"><enum>(3)</enum><text>enhance collaboration among Department personnel at foreign locations, other Federal personnel at foreign locations, and foreign partners;</text>
 </paragraph><paragraph id="id2aa9205030a64f76ac96dde67cbdc19c"><enum>(4)</enum><text>improve the communication of information between Department personnel at foreign locations and Department entities in the United States, including to address technical, resource, and administrative challenges; and</text>
 </paragraph><paragraph id="ide8f94e93580a474ab42f9e750cb36ea4"><enum>(5)</enum><text>maintain practices to guard against counter-espionage threats associated with Department personnel.</text> </paragraph></subsection></section><section changed="added" committee-id="SSGA00" id="id2e5dc12f558f477198101f0ac242d438" reported-display-style="italic"><enum>4.</enum><header>Termination</header><text display-inline="no-display-inline">The briefing requirement under section 2 shall terminate on the date that is 4 years after the submission of the strategy referred to in subsection (a) of such section.</text>
 </section><section changed="added" committee-id="SSGA00" id="idA873A91C4253498FA07F8C722F1B5296" reported-display-style="italic"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text> <paragraph id="id9BE8CDE94C5B41E2986594895EF5D112"><enum>(1)</enum><text>the term <term>Department</term> means the Department of Homeland Security; and</text>
