 <section id="H6617537ECE9D4BFEB7512A88ECBD7607" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food and Fuel Consumer Protection Act of 2019</short-title></quote>.</text> </section><section id="HB5D433F8A04C4FA9B3CBDB96FB154538"><enum>2.</enum><header>Alleviating ethanol blend wall</header><text display-inline="no-display-inline">Section 211(o)(3)(B) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(3)(B)</external-xref>) is amended by inserting at the end the following:</text>

				<clause id="H5909DE81E71A4AE8B3E7258C9483225F"><enum>(iii)</enum><header>Limitation</header>
 <subclause id="H38C5AC60EDEB4CF2B388FCF51D8D7054"><enum>(I)</enum><header>In general</header><text>Notwithstanding the volumes specified in paragraph (2)(B), the Administrator shall not determine any renewable fuel obligation for a calendar year under this subsection that would result, directly or indirectly, in the introduction into commerce in the United States of a total volume of ethanol contained in transportation fuel that is greater than 9.70 percent of the total volume of gasoline projected to be sold or introduced into commerce in the United States for such calendar year.</text>
 </subclause><subclause id="HED2AD5BE073F4C6A8BC33A3B0B7E30D9"><enum>(II)</enum><header>Estimate</header><text>In implementing subclause (I), the Administrator shall request from the Administrator of the Energy Information Administration, and use without alteration, an estimate, with respect to the following calendar year, of the total volume of gasoline projected to be sold or introduced into commerce in the United States. The Administrator of the Energy Information Administration shall provide such estimate to the Administrator by October 31st each year.</text>
 </subclause><subclause id="HEA493A2B04A744B59176629F416A8478"><enum>(III)</enum><header>Applicability</header><text>The limitation established in subclause (I) shall apply without regard to the available supply of credits generated in a prior year pursuant to paragraph (5).</text>
 </subclause><subclause id="HCE9E5A4933C34FD1AB72D580A56391FE"><enum>(IV)</enum><header>Presumption</header><text display-inline="yes-display-inline">In implementing subclause (I) for a calendar year, the Administrator shall not exclude commercially available ethanol that is cellulosic biofuel or advanced biofuel.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HFA8D1335C7A44510A7E27E699CCA6EB4"><enum>3.</enum><header>Failure to meet deadlines</header><text display-inline="no-display-inline">Section 211(o)(3)(B) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(3)(B)</external-xref>), as amended by section 2, is further amended by adding at the end the following:</text>

 <clause id="HCF6CB456302A454294E95ED08666CAB3"><enum>(iv)</enum><header>Failure to meet deadlines</header><text display-inline="yes-display-inline">If the Administrator fails to determine and publish the renewable fuel obligation with respect to the following calendar year in accordance with clauses (i), (ii), and (iii), then the renewable fuel obligation for such year shall be—</text>
 <subclause id="HE65C4EA2CE2348C09FB996B1BC5B530A"><enum>(I)</enum><text>the renewable fuel obligation established for the most recent year for which such obligation was determined and published in the Federal Register in accordance with clause (iii); or</text>
 </subclause><subclause id="HAC52715F3B95477A8E7CF0C06CFA3E09"><enum>(II)</enum><text display-inline="yes-display-inline">if no such obligation has been determined and published in accordance with clause (iii), the renewable fuel obligation established for the most recent year which otherwise meets the 9.70 percent limitation in clause (iii).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
