<official-title display="yes">To authorize the Secretary of State to make direct loans under section 23 of the Arms Export Control Act, and for other purposes.</official-title>

<section id="HA1120038B7274061BDAAFC46C7AD015E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eastern European Security Act</short-title></quote>.</text></section> <section id="HF8434D33F3B444C0A2929D2B659EF04D"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that it is in the national security interest of the United States to—</text> 
<paragraph id="H4090436819B04DCE9625E79B84749A20"><enum>(1)</enum><text>deter aggression against North Atlantic Treaty Organization (NATO) allies by Russia or any other adversary;</text></paragraph> <paragraph id="HB849B540973049B8B5B9B4715C7C8B78"><enum>(2)</enum><text>assist NATO allies in acquiring and deploying modern, NATO interoperable military equipment and reducing their dependence on Russian or former Soviet-era defense articles;</text></paragraph> 
<paragraph id="H99653650D76B48F8B8F127F6E9F8DEB4"><enum>(3)</enum><text>ensure that NATO allies meet alliance defense commitments, including through adequate investments in national defense;</text></paragraph> <paragraph id="HD14FACBFEC354936B67DA466A919EDEF"><enum>(4)</enum><text>supplement existing grant assistance to key allies through foreign military financing loans, at rates competitive with those already available on commercial markets, to purchase NATO-interoperable military equipment; and</text></paragraph> 
<paragraph id="HE0576BDAC0F048068DA387D18866466F"><enum>(5)</enum><text>work to maintain and strengthen the democratic institutions and practices of all NATO allies, in accordance with the goals of Article 2 of the North Atlantic Treaty.</text></paragraph></section> <section id="H2AD01995C7A24203B2A431C6A1D50945"><enum>3.</enum><header>Foreign military loan authority</header> <subsection id="H26C2E029A09E4AFFBD54009F6DF08C3E"><enum>(a)</enum><header>In general</header><text>Beginning in fiscal year 2021, subject to the notification requirements under subsection (b) and to the availability of appropriations, the President, acting through the Secretary of State, is authorized—</text> 
<paragraph id="HD2F2CBCBF780437BA8BE6AFA14E58412"><enum>(1)</enum><text>to make direct loans under section 23 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2763">22 U.S.C. 2763</external-xref>) to NATO member countries that joined the alliance after March 1, 1999, notwithstanding the minimum interest rate required by subsection (c)(1) of such section; and</text></paragraph> <paragraph id="H50A6BC6178814664872A564E1010A287"><enum>(2)</enum><text>to charge fees for such loans under paragraph (1), which shall be collected from borrowers in accordance with section 502(7) of the Congressional Budget Act of 1974, and which may be used to cover the costs of such loans as defined in section 502 of the Congressional Budget Act of 1974.</text></paragraph></subsection> 
<subsection id="HCEEB5301B97141EF93883BB2C481E13B"><enum>(b)</enum><header>Notification</header><text>A loan may not be made under the authority provided by subsection (a) unless the Secretary of State submits to the appropriate congressional committees a certification, not fewer than fifteen days before entering into an agreement to make such loan, that—</text> <paragraph id="H7DA6142C564848B3BA64BC16A29181E8"><enum>(1)</enum><text>the recipient country is making demonstrable progress toward meeting its defense spending commitments in accordance with the 2014 NATO Wales Summit Declaration; and</text></paragraph> 
<paragraph id="HC4A1E4F4822F4DAB96025C5564400F93"><enum>(2)</enum><text>the government of such recipient country is respecting that country’s constitution and upholds democratic values such as freedom of religion, freedom of speech, freedom of the press, the rule of law, and the rights of religious minorities.</text></paragraph></subsection> <subsection id="H06F15223968C469687CD53BBA4D35390"><enum>(c)</enum><header>Repayment</header><text>A loan made under the authority provided by subsection (a) shall be repaid in not more than 12 years, but may include a grace period of up to 1 year on the repayment of the principal.</text></subsection> 
<subsection id="HDF4FF292D6B541929A04D9CFBF21FFA8"><enum>(d)</enum><header>Appropriate congressional committees defined</header><text>In this Act, the term <quote>appropriate congressional committees</quote> means—</text> <paragraph id="H5EF7D343AD9F4775A548B0D6010C6D42"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives; and</text></paragraph>
