			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To cancel the registration of all uses of the pesticide chlorpyrifos, and for other purposes.</official-title></form>

 <section id="HFFC0EEFA1A2442598E56AC76335C0C5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ban Toxic Pesticides Act of 2019</short-title></quote>.</text> </section><section id="H1A431AF66F574EE6B80C2920B99CEC8F"><enum>2.</enum><header>Cancellation of registration of Chlorpyrifos</header> <subsection id="HCCAC5669BB934FC2ABEEA8A90694E862"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Pursuant to section 6(b) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136d">7 U.S.C. 136d(b)</external-xref>), effective on the date of the enactment of this Act—</text>
 <paragraph id="H0DD5C14D89694C829F7E6CDFE365B0A2"><enum>(1)</enum><text display-inline="yes-display-inline">chlorpyrifos shall be deemed to generally cause unreasonable adverse effects on the environment due in part to dietary risks to humans posed by residues of that pesticide chemical on food;</text>
 </paragraph><paragraph id="H6167212543864F2081A499D98864B075"><enum>(2)</enum><text>the Administrator of the Environmental Protection Agency shall cancel the registration of all uses of chlorpyrifos; and</text>
 </paragraph><paragraph id="H32EE8AE77C374B70A2E4BCCCE418CA78"><enum>(3)</enum><text display-inline="yes-display-inline">following such cancellation, the Administrator shall, in accordance with section 408(l)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/346a">21 U.S.C. 346a(l)(2)</external-xref>), revoke any tolerance or exemption that allows the presence of chlorpyrifos or any pesticide chemical residue that results from its use, in or on food.</text>
 </paragraph></subsection><subsection id="H3333BBBA1B424FF9AA6E16C0AF97BAC7"><enum>(b)</enum><header>Use of existing stocks</header><text display-inline="yes-display-inline">Notwithstanding section 6(a) of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136d">7 U.S.C. 136d(a)</external-xref>), effective on the date of the enactment of this Act, the continued sale and use of existing stocks of chlorpyrifos is prohibited.</text>
 </subsection><subsection id="H9D08336E011E49C08C523B0080D0190C"><enum>(c)</enum><header>Reregistration</header><text display-inline="yes-display-inline">Effective on the date of the enactment of this Act, the Administrator of the Environmental Protection Agency may not reregister chlorpyrifos under section 4 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136a-1">7 U.S.C. 136a–1</external-xref>).</text>
