	<legis-body id="HE81C8AB65F7B447A94055485837B46DC" style="OLC">
		<section id="HC4BEFB3F0DA3416A97C69A4662129AAA" section-type="section-one"><enum>1.</enum><header>Lead testing in Department of Defense Education Activity schools</header>
			<subsection id="H7787ECFB2D7C4954BAB82C151962FF53"><enum>(a)</enum><header>Lead-Based paint and lead in drinking water</header>
 <paragraph id="HA9D97B63CC8F435C86345A3E0FCF4CE2"><enum>(1)</enum><header>Testing required</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that all covered schools are tested for—</text> <subparagraph id="HD22B7B01481C4621B655CAB3BC4503D3"><enum>(A)</enum><text>the presence of lead-based paint; and</text>
 </subparagraph><subparagraph id="H6D83BD7FCDFE428FA074E70DD488CC93"><enum>(B)</enum><text>the presence of lead in drinking water.</text> </subparagraph></paragraph><paragraph id="H728B5316354B4DCA9B5C20A0D71351C9"><enum>(2)</enum><header>Standards</header><text>In carrying out paragraph (1), the Secretary shall ensure that tests are performed in accordance with the guidance document and testing protocol published by the Administrator of the Environmental Protection Agency under section 1464(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-24">42 U.S.C. 300j–24(b)</external-xref>).</text>
 </paragraph><paragraph id="HE9A8CB988C3E464AA3521629684F1652"><enum>(3)</enum><header>Notification</header><text>Not later than one day after a test is carried out pursuant to this subsection in a covered school, the Secretary shall notify of the results of the test—</text>
 <subparagraph id="H59DF168E055543A4850893FFC4AAE6AA"><enum>(A)</enum><text>the parents or legal guardians of students attending such covered school; and</text> </subparagraph><subparagraph id="H84C7651666A34C12B7D1CA03B4C6E157"><enum>(B)</enum><text>the employees of such covered school.</text>
					</subparagraph></paragraph></subsection><subsection id="H2B5349BC966E48CC9BFA1C267A17C8FB"><enum>(b)</enum><header>Lead mitigation</header>
 <paragraph id="HB6DA30D84B2A46009B849B48E82C70D5"><enum>(1)</enum><header>Activities required</header><text>The Secretary shall undertake activities necessary to mitigate the presence of lead in a covered school in which lead is detected as a result of a test performed pursuant to subsection (a).</text>
 </paragraph><paragraph id="H71117B6B5BB04283913BB26A0F019D91"><enum>(2)</enum><header>Standards</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall ensure mitigation is undertaken in accordance with the requirements of Department of Defense Education Activity Administrative Instruction 6055.01 (or successor instruction).</text>
 </paragraph></subsection><subsection id="HF29A958DEF124C35A470B6DF3CCC33EF"><enum>(c)</enum><header>Timing</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph id="H163F2EB321914CF29FE30727BB94DF23"><enum>(1)</enum><text>commence all actions required pursuant to subsection (a) not later than 30 days after the date of the enactment of this Act; and</text>
 </paragraph><paragraph id="H7BC131196A1A4B889DF77E9AEB60AF95"><enum>(2)</enum><text>complete all actions required pursuant to subsections (a) and (b) not later than two years after the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="H9F58DCA1B7E448A6B58EFC884DCADD37"><enum>(d)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall submit to the congressional defense committees a report containing information on activities carried out under this section, including—</text>
 <paragraph id="HFB89C555A23742F6B89460F23990DFF5"><enum>(1)</enum><text>the number of covered schools tested for lead-based paint;</text> </paragraph><paragraph id="HAB163C45ED574F66B03C5458987F3A07"><enum>(2)</enum><text>the number of covered schools tested for lead in drinking water;</text>
 </paragraph><paragraph id="H81F8FFCDD66D447FA40FEA0B92D66707"><enum>(3)</enum><text>for each covered school at which testing was performed, the results of the testing;</text> </paragraph><paragraph id="HA52CFD5E426D407EB750844A59697E49"><enum>(4)</enum><text>for each covered school at which testing was not performed, an explanation for the failure to perform the testing; and</text>
 </paragraph><paragraph id="H17D32352C0B141D095AE8A6FA17E7C32"><enum>(5)</enum><text>for each covered school in which lead was detected, the activities undertaken to mitigate the presence of lead.</text>
 </paragraph></subsection><subsection id="HF4D180EB6DA34ACA83EFFF0CB0F43ADC"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H5A664EBEC8BB4E3F83A6CA891F0EA1D7"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>congressional defense committees</term> has the meaning given that term in section 101(a) of title 10, United States Code.</text>
 </paragraph><paragraph id="HBAA3BFB934A1476FBF156BA5F3005CE5"><enum>(2)</enum><text>The term <term>covered school</term> means—</text> <subparagraph id="H285BAA09787A4285BC6F3555AD998809"><enum>(A)</enum><text>a school owned or operated by the Department of Defense Education Activity; or</text>
 </subparagraph><subparagraph commented="no" id="HD336D59F3B8F4B76AD5B71FF1A877D68"><enum>(B)</enum><text>a school with which the Secretary has entered into a contract or otherwise entered into an arrangement to provide educational programs under—</text>
 <clause commented="no" id="HC5EA431ECDAD4A49AFEF743ED3883A94"><enum>(i)</enum><text>section 2164 of title 10, United States Code; or</text> </clause><clause commented="no" id="H16154360E8474293AD92F30FFF336C8F"><enum>(ii)</enum><text>section 1402 of the Defense Dependents’ Education Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/20/921">20 U.S.C. 921</external-xref>).</text>
