<official-title display="yes">To modify the prohibition on United States assistance and financing for certain exports to Cuba under the Trade Sanctions Reform and Export Enhancement Act of 2000, and for other purposes.</official-title>

<section id="H6E79473F39414369BFDCC1DB0DA678D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cuba Agricultural Exports Act</short-title></quote>.</text></section> <section id="H0172D58CDF09456B99C31ED93324A1F6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H14F79D146CC34ABE88FBD53D57C11780"><enum>(1)</enum><text display-inline="yes-display-inline">The United States has a long history of providing safe and reliable exports. Close proximity to Cuba lends itself to low transportation costs for United States goods exported to Cuba. The United States is geographically poised to be a significant trading partner in agricultural commodities.</text></paragraph> <paragraph id="HA2AD68182F894382A3A2B093B0A52ACE"><enum>(2)</enum><text>Cuba imports approximately 80 percent of its food, with global agricultural exports to Cuba doubling over the past decade to $1,900,000,000.</text></paragraph> 
<paragraph id="H8285A47B4A5D4B89A39594562DD363B3"><enum>(3)</enum><text display-inline="yes-display-inline">In 2015, the Obama administration reversed a prior rule of the Department of the Treasury that defined <quote>cash in advance</quote> to require that cash payments must be made before United States products leave United States ports. The new rule defines <quote>cash in advance</quote> as <quote>cash before transfer of title</quote>, facilitating more efficient trade with Cuba.</text></paragraph> <paragraph id="HEF7E93C898984AACA72F0052FA1E3400"><enum>(4)</enum><text display-inline="yes-display-inline">The Trump administration has retained this definition and stated in its National Security Presidential Memorandum on Cuba that forthcoming regulatory changes shall not prohibit transactions that support the sale of agricultural commodities consistent with the Trade Sanctions Reform and Export Enhancement Act of 2000.</text></paragraph> 
<paragraph id="HE60BBA0A45CE4D4BA116BC60D7381BDD"><enum>(5)</enum><text display-inline="yes-display-inline">United States agricultural exporters are still not permitted to extend credit to Cuban buyers, including ALIMPORT, a State-owned and State-controlled entity that makes all decisions regarding United States exports to the Cuban market. As a result, United States agricultural exports to Cuba have declined and United States exporters face a key disadvantage relative to other exporting countries. Notably, rice exports fell from a value of $64,000,000 in 2004 to essentially $0 in 2009 and subsequent years.</text></paragraph> <paragraph id="H16A80FBA01864EC38EFF59E160AC0837"><enum>(6)</enum><text display-inline="yes-display-inline">Despite these restrictions, the United States has been the largest exporter of agricultural goods to Cuba over the last decade. However, the United States slipped to being the second leading exporter of agricultural goods to Cuba in 2013 and the third leading exporter of agricultural goods to Cuba in 2014. For many of Cuba’s top agricultural imports, such as wheat, rice, and dairy, there have been no transactions with the United States in well over a decade.</text></paragraph> 
<paragraph id="H5F0300B3ED954E72A982279033467C31"><enum>(7)</enum><text>While trade opportunities exist, Cuba remains an undemocratic autocracy that oppresses its own people and restricts freedom.</text></paragraph> <paragraph id="HB89DD587D3ED47F5B5BF32E5B228C386"><enum>(8)</enum><text display-inline="yes-display-inline">With these cautionary factors in mind, it is important to provide United States farmers and ranchers additional opportunities to benefit from trade with Cuba.</text></paragraph></section> 
<section id="HCBA1B23BA03A44C1BB13BEE33EE477AA"><enum>3.</enum><header>Modification of prohibition on United States assistance and financing for certain exports to Cuba under the Trade Sanctions Reform and Export Enhancement Act of 2000</header> 
<subsection id="HDF24AB65CDBF49F18D6ACB05B2BCC2A0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 908 of the Trade Sanctions Reform and Export Enhancement Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7207">22 U.S.C. 7207</external-xref>) is amended as follows:</text> <paragraph id="H4A393D3653A74D2F9DCC3D2A34F36E5C"><enum>(1)</enum><text>In the section heading, by striking <quote><header-in-text level="section" style="OLC">and financing</header-in-text></quote>.</text></paragraph> 
<paragraph id="H21A64EDB2245489F9BAB646EAF75F5E2"><enum>(2)</enum><text>In subsection (a), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H1441B9AFD9C440AEBAC3FF3D8C234838" style="OLC"> <paragraph id="HF8E7BEA176EE4BE8B4E3D9A06DDFADDC"><enum>(4)</enum><header>Exception for certain programs</header> <subparagraph id="H959DCAD31F944C2D970F583494CF80BA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), paragraph (1) shall not apply with respect to—</text> 
<clause id="H32ECF9F917AE4281B6A5A2BEC0A361A7"><enum>(i)</enum><text>exports to Cuba under section 202 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5622">7 U.S.C. 5622</external-xref>), section 203 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623</external-xref>), or section 702 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5722">7 U.S.C. 5722</external-xref>); or</text></clause> <clause id="HF93DDC6A8EC54261BF21D9DB1A53320F"><enum>(ii)</enum><text>any obligation or expenditure of funds to promote trade with Cuba by Federal commodity promotion programs established in accordance with a commodity promotion law, as defined by section 501(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7401">7 U.S.C. 7401(a)</external-xref>).</text></clause></subparagraph> 
<subparagraph id="H6A078D1BCB6043C0B8CBCBB2DE8BF953"><enum>(B)</enum><header>Restriction on certain recipients</header><text>The exceptions under subparagraph (A) shall not apply if the recipient of the United States assistance would be an entity controlled by the Government of Cuba, including the Revolutionary Armed Forces of Cuba, the Ministry of the Interior of Cuba, and any subdivision of either such governmental entity.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H17FABEFFA7454CC7B152C968A7F20A0C"><enum>(3)</enum><text display-inline="yes-display-inline">In subsection (b), to read as follows:</text>

<subsection id="H7E7E34BB144F4CF7A13848959A744463"><enum>(b)</enum><header>Financing of sales of agricultural commodities to Cuba</header> 
<paragraph id="H1237124F74094775B40E5844F649459F"><enum>(1)</enum><header>In general</header><text>A person subject to the jurisdiction of the United States may provide payment or financing for sales of agricultural commodities to Cuba or to an individual or entity in Cuba.</text></paragraph> <paragraph id="H06B8157073534FC4B0E447A70212E2A9"><enum>(2)</enum><header>Definitions</header><text>In this section:</text> 
<subparagraph id="HD1DF334993964FFE924348E9D90DB32C"><enum>(A)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> has the meaning given that term in section 102 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5602">7 U.S.C. 5602</external-xref>).</text></subparagraph> <subparagraph id="H5E42B0C54B6F4312AEC65394AC546EB3"><enum>(B)</enum><header>Financing</header><text>The term <term>financing</term> includes any loan or extension of credit.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H149F80D521CD4975847388366B45260D"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Subsection (f)(4) of section 203 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5623">7 U.S.C. 5623</external-xref>), as amended by section 3201 of title III of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>), is further amended by striking <quote>Notwithstanding</quote> and all that follows through <quote>funds made available</quote> and inserting <quote>Funds made available</quote>.</text></subsection></section> <section id="H2E4FFA128EA14F3F9F2ABCF3C144CFC9"><enum>4.</enum><header>Authority of persons subject to the jurisdiction of the United States to invest with respect to certain agricultural business in Cuba</header> <subsection commented="no" id="H2506487929934A569C09060F90CFF5CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a person subject to the jurisdiction of the United States may make an investment with respect to the development of an agricultural business in Cuba if the Secretary of State and Secretary of Agriculture jointly determine that—</text> 
<paragraph commented="no" id="H780124B6FE384062B62356FA4156524C"><enum>(1)</enum><text>the agricultural business is not controlled by the Government of Cuba, including the Revolutionary Armed Forces of Cuba, the Ministry of the Interior of Cuba, or any subdivision of either such governmental entity; and</text></paragraph> <paragraph commented="no" id="H1B0D8DF873484E54B0326EDFB42139F9"><enum>(2)</enum><text>the agricultural business does not traffic in the property of persons subject to the jurisdiction of the United States that was confiscated by the Cuban Government on or after January 1, 1959.</text></paragraph></subsection> 
<subsection id="H9C1A7B8A51C84BF3BBD451499F8D8EEC"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB131FABE2E7A4C898D4E7E316920F67B"><enum>(1)</enum><header>Agricultural business</header><text display-inline="yes-display-inline">The term <term>agricultural business</term> means any entity involved in the production, manufacture, or distribution of agricultural products (as such term is defined in section 207 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1626">7 U.S.C. 1626</external-xref>)).</text></paragraph> 
<paragraph id="H3A9A14D068BB47BBB6DD38C66E493EC2"><enum>(2)</enum><header>Confiscated, Cuban Government, property, and traffic</header><text>The terms <term>confiscated</term>, <term>Cuban Government</term>, <term>property</term>, and <term>traffic</term> have the meanings given such terms in section 4 of the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/22/6023">22 U.S.C. 6023</external-xref>).</text></paragraph> <paragraph commented="no" id="HB90BC3B8A5764189AD491A19A84A324B"><enum>(3)</enum><header>Investment</header><text display-inline="yes-display-inline">The term <term>investment</term>, with respect to the development of an agricultural business in Cuba, means—</text> 
<subparagraph commented="no" id="H475E4768C5D74C43828FC4DAB316D308"><enum>(A)</enum><text>entry into a contract involving the purchase of a share of ownership, including an equity interest, in the development of the agricultural business;</text></subparagraph> <subparagraph commented="no" id="HDED6546F2FFD409E8AF432B41486EB0C"><enum>(B)</enum><text>entry into a contract providing for participation in royalties, earnings, or profits in the development of the agricultural business; or</text></subparagraph> 
<subparagraph commented="no" id="H1D6AD9E618384D22AD43C86830835B32"><enum>(C)</enum><text>entry into, or performance or financing of, a contract to sell goods, services, or technology relating to the agricultural business.</text></subparagraph></paragraph></subsection></section> </legis-body> </bill>
