			 natural gas pipelines, to provide for greater public input opportunities,

 <section id="HB84E7DD054094D6AADAEBEF5567F1C8D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pipeline Fairness and Transparency Act</short-title></quote>.</text> </section><section id="H4C4070A580E042D5B0159DC38646FD84"><enum>2.</enum><header>Eminent domain</header> <subsection id="HC57E710D32AD4B93BC89356BC931D8ED"><enum>(a)</enum><header>Statement of policy</header><text>It is the policy of the United States to protect the rights of citizens of the United States to their private property, including by limiting the taking of private property by the Federal Government to situations in which the taking is for public use, with just compensation, and to benefit the general public, and not merely to advance the economic interests of private parties that would be given ownership or use of the property taken.</text>
 </subsection><subsection id="H7189B37A82264BE89B7D884E8E019E4F"><enum>(b)</enum><header>Just compensation</header><text>Section 7(h) of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717f">15 U.S.C. 717f(h)</external-xref>) is amended—</text> <paragraph id="H46ED8E6D9FF64B27A8DA247E64D440F7"><enum>(1)</enum><text>by striking <quote>(h) When any holder</quote> and inserting the following:</text>

 <paragraph id="HA5A16E221A3742669037EEBE6DD53CA0"><enum>(1)</enum><header>In general</header><text>When any holder</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block> </paragraph><paragraph id="HC6A5113B81A1476090C3CF313F8195C0"><enum>(2)</enum><text>in the second sentence—</text>

 <paragraph id="H8983C47CC13C49C2A7ED9816812D96DD"><enum>(3)</enum><header>Just compensation</header><text>In determining the just compensation for property acquired by the exercise of the right of eminent domain under paragraph (1), in the case of land subject to a conservation easement, the court with jurisdiction over the proceeding shall consider the lost conservation value of that land.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HE3C05294A7E348BEAC1C9F076456B7DC"><enum>3.</enum><header>Process coordination for environmental review</header><text display-inline="no-display-inline">Section 15 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717n">15 U.S.C. 717n</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HBD9EBA82BD7045369431CB9B629F8F6C" style="OLC"> <subsection id="H062C3C63FDEF421C9B716F5DC37F5CCD"><enum>(g)</enum><header>Environmental review for interstate natural gas pipelines</header> <paragraph id="H7F5D350EF98547CCBD699F68C5D48E77"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
						<subparagraph id="H067AACC95D5245C3AE07B157B80E58C8"><enum>(A)</enum><header>Federal authorization</header>
 <clause id="HA684DAD052C14010A3F2E752EE985B1B"><enum>(i)</enum><header>In general</header><text>The term <term>Federal authorization</term> means any authorization required under Federal law with respect to an application for a certificate of public convenience and necessity under section 7.</text>
 </clause><clause id="HBC378AD99A324914AC155DFBE1127DDB"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>Federal authorization</term> includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to an application for a certificate of public convenience and necessity under section 7.</text>
 </clause></subparagraph><subparagraph id="H171D72843DC147389FF94AC2EB95CC54"><enum>(B)</enum><header>Project</header><text>The term <term>project</term> means a project for the construction or extension of facilities for the transportation in interstate commerce of natural gas that requires Federal authorization.</text>
						</subparagraph></paragraph><paragraph id="H8D0BFF69339F4D89A9380EE92C6819B1"><enum>(2)</enum><header>Supplemental environmental impact statements</header>
 <subparagraph id="H5208E4AA01124B4FAD4F8CD3D2D63324"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to an application for Federal authorization, the Commission shall prepare a supplement to a draft environmental impact statement or a final environmental impact statement if—</text>
 <clause id="H131A520B6826491B8BC593936E6F9288"><enum>(i)</enum><text display-inline="yes-display-inline">the Commission makes a substantial change in the proposed action that is relevant to environmental concerns; or</text>
 </clause><clause id="H2BDDAD7A05A3410DB409D7C9C301706B"><enum>(ii)</enum><text>there are significant new circumstances or information relevant to environmental concerns and bearing on the proposed action or its impacts.</text>
 </clause></subparagraph><subparagraph id="H4B53DA75E59640F8A111091430AF8BAD"><enum>(B)</enum><header>Mitigation plans</header><text>If a draft environmental impact statement prepared with respect to an application for Federal authorization does not include information about mitigation plans for adverse impacts that cannot reasonably be avoided, a supplemental environmental impact statement shall be prepared that includes such information.</text>
 </subparagraph></paragraph><paragraph id="H456849D28BA949C7ACA269D78EEF2948"><enum>(3)</enum><header>Public meeting requirements</header><text>In complying with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) with respect to an application for Federal authorization, the Commission shall ensure that any public meeting shall be held—</text>
 <subparagraph id="H62B27C9BBE4144DBB04074F9F56E4B93"><enum>(A)</enum><text>in each county or equivalent subdivision in which the project will be located; and</text> </subparagraph><subparagraph id="HBD8BEC7AA1974229AD4884D5CA59BAF6"><enum>(B)</enum><text>during each period of public comment following, if applicable, publication of—</text>
 <clause id="H03AB615AD6D041048BCE36481BA55D4B"><enum>(i)</enum><text>a draft environmental impact statement;</text> </clause><clause id="H417515AF37CA437BAA61EA78EC90EEED"><enum>(ii)</enum><text>a final environmental impact statement; and</text>
 </clause><clause id="H00D107F738804AD095F2601E6280AB9B"><enum>(iii)</enum><text>any supplemental environmental impact statement.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="HC909094E18A84D5492E729287D85ADC2"><enum>4.</enum><header>Impacts on critical natural resources</header><text display-inline="no-display-inline">Subsection (g) of section 15 of the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717n">15 U.S.C. 717n</external-xref>) (as added by section 3) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H6F8330DB7D6F4ABDBB02004DD8FF5B1E" style="OLC">
				<paragraph id="HA28E298F1E404C788DEC0BD4857D8B8B"><enum>(4)</enum><header>National scenic trails</header>
 <subparagraph id="H476077CF847E48E785D163F7AADCA4F1"><enum>(A)</enum><header>In general</header><text>In preparing an environmental impact statement with respect to an application for Federal authorization for a project, any evaluation of the visual impacts of the project on a national scenic trail designated by the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241</external-xref> et seq.) in the environmental impact statement shall—</text>
 <clause id="H95F66CD13C664FFE911BD84E55CC23A0"><enum>(i)</enum><text>consider the cumulative visual impacts of any similar proposed project—</text> <subclause id="H24E9FB0BB35E4DA48A3CA1FFDB5707FE"><enum>(I)</enum><text>for which an application for Federal authorization is in the pre-filing or filing stage; and</text>
 </subclause><subclause id="HEF5B761DD1334B9D9BE850B91E4EDBE8"><enum>(II)</enum><text>that impacts the same national scenic trail within 100 miles of the first project; and</text> </subclause></clause><clause id="HE83F54E502C4406BA8AB6298ACB4C49E"><enum>(ii)</enum><text>include visual impact simulations depicting leaf-on and leaf-off views at each location where major visual impacts occur, as identified, authenticated, and justified during the period of public comment preceding the publication of a draft environmental impact statement by the head of the Federal agency or independent agency administering the land at the applicable location.</text>
 </clause></subparagraph><subparagraph id="H8DB46765D46549AAADA5B1DB67AFA710"><enum>(B)</enum><header>National forest management plans</header><text display-inline="yes-display-inline">No amendment to a National Forest management plan under the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600</external-xref> et seq.) shall be considered, pursuant to an application for Federal authorization, if the result of the amendment would substantially interfere with the nature and purposes of a national scenic trail designated by the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241</external-xref> et seq.).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
